Volvo Lemon Law Lawyers in San Diego
The warning you saw on your Volvo in April is back, and the SUV sits at the Kearny Mesa Road service drive again. A neighbor says to file for arbitration first. A Volvo lemon law lawyer would tell you that step does not exist for your car.

California lemon law still lets a new or leased Volvo qualify for a buyback, meaning Volvo repurchases it. What counts is whether Volvo had a reasonable number of repair attempts, a fair set of chances to fix the defect.
Volvo has no program on the Department of Consumer Affairs list of state-certified arbitration programs. That department, called DCA, also left Volvo off its roster of electing manufacturers as of September 29, 2026. Those are the carmakers that opted into newer court procedures. So you pick among four routes. Press for more repairs, ask the New Motor Vehicle Board to mediate, send Volvo Car USA a written demand, or file suit.
Cline APC takes on only lemon law and consumer warranty claims, from La Jolla and Poway.

Which XC60 and XC90 Electrical Complaints Does a Volvo Lemon Law Lawyer Count?
The National Highway Traffic Safety Administration, or NHTSA, logs 233 owner complaints about 2021 to 2026 XC60s, and 87 name the electrical system. XC90 owners filed 159 over the same years, 56 naming it. The firm pulled those figures on September 29, 2026. They are owner reports, not findings, yet they show which orders need the closest read.
| Model | Model years | What the record shows | Claims |
|---|---|---|---|
| XC60 | 2021 to 2026 | 233 complaints, 87 electrical, plus steering gear, battery module and engine start campaigns | Volvo XC60 electrical defect claims |
| XC90 | 2021 to 2026 | 159 complaints, 56 electrical, with plug-in and mild hybrid faults | Volvo XC90 plug-in and mild hybrid claims |
Say your 2022 XC90 plug-in hybrid gets a recall letter. The retailer tells you to stop charging until a battery module arrives, so you drive on gasoline for weeks. Whether that lost use supports a claim depends on how long it lasts and what the orders say. A Volvo lemon law lawyer also asks whether the problem came back.
Four Recall Problems the XC60 and XC90 Share
First, campaign 22V793000, received October 20, 2022, covers certain 2022 and 2023 plug-in hybrids. Its engine control module software may fail to start the combustion engine, and drive power can drop as the battery runs down. Next, 23V001000 covers certain 2019 to 2022 V60 Cross Country, XC60 and XC90 vehicles. Doubled screws in the steering gear may let one fall into the gearbox housing and lock the steering wheel. Campaign 25V179000 reaches certain 2020 to 2022 plug-in hybrids whose battery module may short when fully charged and parked. Finally, 25V908000 replaced camera campaign 25V282000, and vehicles repaired under 25V282 need the new remedy.
Workshop-Only Software Releases and the Visit Count
Visit counts matter because of the presumption in Civil Code section 1793.22, subdivision (b). That rule of proof treats Volvo as having had a reasonable number of repair attempts once its conditions are met. Those conditions must arise within 18 months or 18,000 miles, whichever comes first. The statute calls a defect that substantially impairs use, value or safety a nonconformity. Two repairs of a nonconformity likely to cause death or serious bodily injury qualify, and so do four repairs of the same nonconformity. Each of those two routes also requires at least one direct notice to Volvo itself, if the warranty materials clearly disclosed that duty. More than 30 cumulative days out of service for repair qualifies with no notice. Volvo can rebut the presumption, and a claim can still succeed on the full history under section 1793.2(d)(2).
Volvo's release notes mark some software releases workshop-only, meaning a retailer visit and a repair order. When one targets your complaint and the symptom returns, that visit counts. A release aimed at something unrelated adds nothing to the count for your defect.
What Does a Complete Volvo Repurchase Offer Contain, According to a Lemon Law Attorney?
It should track Civil Code section 1793.2, subdivision (d)(2)(B). That formula returns the price paid or payable, including factory options, the taxes and official fees, and incidental damages, the costs the defect forced on you, such as tows and rentals. It then subtracts a mileage offset for miles driven before the first repair visit for the defect.
Restitution is the statute's word for that refund, and replacement means a substantially identical new Volvo. Volvo did not elect, so the deductions in Code of Civil Procedure section 871.27 and the standard release in section 871.25 do not govern.
| Line item | Song-Beverly treatment | Source |
|---|---|---|
| Price paid or payable, with transportation charges and factory-installed options | Refunded | Civil Code 1793.2(d)(2)(B) |
| Sales or use tax, license and registration fees and other official fees | Refunded | Civil Code 1793.2(d)(2)(B) |
| Reasonable towing, rental car and repair costs actually incurred | Refunded as incidental damages | Civil Code 1793.2(d)(2)(B) |
| Equipment you or a dealer added | Left out | Civil Code 1793.2(d)(2)(B) |
| Miles driven before the first repair visit for the defect | Subtracted as the mileage offset | Civil Code 1793.2(d)(2)(C) |
| Outside service contracts, negative equity and rebates | Section 871.27 does not govern a Volvo | CCP 871.20(a) |
| Refund or replacement | Your choice, never Volvo's | Civil Code 1793.2(d)(2) |
Picture a $72,500 XC90 T8 first repaired for the eventual defect at 4,800 miles. The offset is $72,500 times 4,800, divided by 120,000, or $2,900. Your contract sets the real figures, and the buyback calculator runs a rough number.
Lender Payoffs Inside a Volvo Lemon Law Buyback
A repurchase usually splits into a payment to your lender or leasing company and a check to you. The payoff figure should include interest through the payoff date. Get the lender's payoff letter in writing, and then compare it with the balance your lender reports that same week. A lease buyback involves the leasing company too, so keep each monthly statement.
A $3,000 Keep-the-Car Offer on a Stalling XC90
Some answers offer cash or extended coverage while you keep the Volvo. Say Volvo offers $3,000 on an XC90 that has stalled twice near Mission Valley. Accepting it may trade away the repurchase claim even if the stalls continue. Section 871.25 does not apply, so the parties write their own release. A Volvo lemon law lawyer reads which claims it gives up beyond the car itself.
Once Volvo's 4-Year Basic Warranty Ends, What Does an Attorney Say Certified by Volvo Adds?
Volvo's Certified by Volvo page describes 12 months of unlimited-mileage coverage. It starts on the later of the certified purchase date or the day the original Basic Warranty expires. The same Volvo page gives that Basic Warranty as 4 years or 50,000 miles, whichever comes first. Even so, a certified Volvo is usually beyond the reach of the new-vehicle remedy.
The California Supreme Court's 2024 decision, Rodriguez v. FCA US, LLC, 17 Cal.5th 189, says a used car stays used even with factory months left. The one exception is a sale that came with the manufacturer's new car warranty, issued at that sale. Still, the court did not rule on certified pre-owned programs, so the point is unsettled. Say you bought a certified 2022 XC60 from a franchised retailer in 2025, and its screen keeps freezing on State Route 56. Civil Code section 1795.5 still gives a used-car seller who makes an express warranty, a written promise about the car, duties much like a manufacturer's.
Leased XC40s, XC60s, and XC90s Under Section 1795.4
A lessee is the person who leases the car. Under Civil Code section 1795.4, that person holds the same rights against Volvo that a buyer would. Leasing an XC40, XC60 or XC90 changes the paperwork but not those rights. If the lease is about to end while the defect continues, talk to a lawyer before you turn the car in.
The Mahwah Notice Address in the 2026 Electric-Model Manual
Volvo's 2026 warranty manual for its fully electric models says a consumer in certain states may be required to give written notice. It names the Customer Care Center of Volvo Car USA LLC at 1800 Volvo Place in Mahwah, New Jersey, 07430. Direct notice matters only for the presumption's two-repair and four-repair routes. Still, one certified letter to the address in your own booklet removes the argument.
Are Volvo Recall Visits Repair Visits Too, and Why Does a Lawyer Want the R-Numbers?
Yes. A recall is a safety campaign Volvo files with NHTSA, and it does not by itself prove your Volvo has a nonconformity. A recall visit still produces a repair order in your history. Volvo's own numbers, such as R10312 for the battery recall, pair with NHTSA numbers to show whether a remedy failed or a new defect appeared.
| Volvo record | Figure |
|---|---|
| NHTSA owner complaints, XC60, model years 2021 to 2026 | 233, with 87 naming the electrical system |
| NHTSA owner complaints, XC90, model years 2021 to 2026 | 159, with 56 naming the electrical system |
| NHTSA recall campaigns, XC60, model years 2021 to 2026 | 13 |
| NHTSA recall campaigns, XC90, model years 2021 to 2026 | 13 |
| Campaigns named here, with Volvo's numbers | 22V793000 (R10198), 23V001000 (R10213), 25V179000 (R10312), 25V282000 (R10320), 25V908000 (R10333) |
| State-certified arbitration program | None on the DCA list |
The firm pulled these figures on September 29, 2026, counting each campaign once. Say your camera recall visit closed as complete, and then the screen went black in reverse again. Under 25V908000, your SUV needs the new remedy, by dealer visit or over the air. A Volvo lemon law lawyer counts every visit.
The NHTSA VIN Search and Volvo's Open Campaigns
NHTSA's recall lookup takes a 17-character VIN and lists any open campaign for that vehicle. Write the NHTSA number and Volvo's R-number on your copy of each recall order. Civil Code section 1793.1(a)(2) requires the shop to hand you a copy of the warranty work order, so ask for the full version with notes. When a later order describes the same symptom, the paired numbers show whether the remedy failed.
Display and Charging Faults Add Up to 32 Days in a Volvo Lemon Law Claim
Under the presumption's third route, repairs of nonconformities must keep your Volvo out of service for more than 30 cumulative days. Those days fall within 18 months or 18,000 miles, whichever comes first. They can span several defects. A signed extension form does not stretch this limit, since only conditions beyond Volvo's control do. For example, 11 days at Kearny Mesa for a display fault and 21 in Escondido for a charging fault reach 32.
Should a Volvo Lemon Law Lawyer Choose Mediation, a Direct Demand or a Lawsuit?
It depends on your records. With no election, Commercial Code section 2725 gives four years, generally from tender of delivery. Board mediation is informal and no-cost, but it lists Lemon Law outside its reach. A written demand after the presumption events is the notice section 1794(e)(3) requires before one civil penalty, extra money beyond damages, can apply.
Say you drive a 2024 XC60 B5 in Poway, and Customer Care told you twice to wait for a software fix that never came. Volvo keeps no certified program, so section 1793.22(c) never makes you arbitrate first. The presumption can go straight into a lawsuit.
Under Commercial Code section 2725, one exception has two parts, a warranty that explicitly extends to future performance and a breach whose discovery must await that performance. When both hold, the four years start once the breach is or should have been discovered. Tender of delivery is when the seller hands over the car, so an XC40 delivered on March 3, 2023, has a default date of March 3, 2027. Section 871.29(d) adds a duty for new Volvos sold in 2026 or later, since Volvo must give notice at the sale naming the procedure that governs.
Disputes the New Motor Vehicle Board Will and Will Not Mediate
DCA points owners of brands without a certified program to court or to Board mediation. The Board takes purchase or lease contract disputes and manufacturer warranty or repair disputes. It also takes used vehicles sold by a new vehicle dealer and used vehicles with original warranty left. Private party sales, third-party warranties, as-is sales, odometer fraud and Lemon Law sit outside its jurisdiction. However, participation is voluntary, and the Board says it cannot order a remedy. Section 1793.22(c) extends the deadline for time in a third-party dispute resolution process, but do not count on Board mediation pausing the four years.
The Second Civil Penalty Stays Open Against Volvo
Section 1794(c) permits a penalty of up to twice actual damages when a violation was willful, though not on a claim built solely on the implied warranty the law attaches to a sale. A second penalty under section 1794(e), also capped at twice damages, targets a failure to repurchase or replace. However, its (e)(2) exception protects only a manufacturer with a qualified program, and Volvo has none. That penalty needs a written notice under (e)(3), sent after the presumption events. Volvo avoids it by complying within 30 days after that notice is served. Subdivision (e)(5) bars collecting both penalties for one violation.
Central or North County Filing for a Volvo Case
Local Rule 1.2.2(E) of San Diego Superior Court sends East and South County civil filings to Central, at the Hall of Justice downtown. The North County Division in Vista still takes its own civil filings. On Form ADM-254, Volvo Cars San Diego at 5350 Kearny Mesa Road sits in Central's 92111. Volvo Cars Escondido at 1938 Auto Park Way and Volvo Cars Carlsbad at 6830 Avenida Encinas sit in North County. Venue also weighs where defendants do business, which the firm works out for Volvo owners who live in La Jolla too.
With No Volvo Arbitration Step, When Should You Call a Volvo Lemon Law Lawyer?
Call once a Volvo defect returns after a repair. Volvo owners skip the arbitration step many brands require, but they also get no preset schedule. In a free consultation, a lawyer at Cline APC checks your visits and days out of service against the presumption. The lawyer also dates your four-year period.
Say you lease an XC90 and hold a Customer Care case number from last month. Bring the lease, every repair order and that case number.
Section 1794(d) says a buyer who prevails recovers costs and reasonable attorney fees. A Volvo lemon law lawyer at the firm explains its own fee arrangement at the first meeting. Nobody can promise how Volvo will respond.
When your folder is ready, send Cline APC a message online or call (888) 982-6915 and name your Volvo's model and year.
