California lemon law reaches a new or leased Audi with a substantial warranty defect the dealers cannot fix within a reasonable number of repair attempts, meaning a fair number of chances. Audi then owes a buyback, refunding what you paid, or a replacement, namely a substantially identical new Audi.

Civil Code section 1793.22 covers a new Audi bought or used mainly for personal, family or household purposes. The same goes for a demonstrator sold with Audi's new car warranty. A business Audi with a gross vehicle weight under 10,000 pounds counts as well, when no more than five vehicles are registered to the buyer in California. A lessee, meaning someone who leases, has a buyer's rights under Civil Code section 1795.4.

Under Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, leftover factory coverage does not make a used Audi a new motor vehicle unless the manufacturer's new car warranty was issued with that sale. On certified pre-owned programs the court did not rule, so a certified Audi usually sits outside the new-vehicle remedy, and the point stays unsettled.

Cline APC handles only California lemon law and warranty claims, meeting Audi owners by appointment in La Jolla and Poway. For a failure that keeps coming back, call (888) 982-6915.

What Goes Wrong on an Audi Q5 or Q4 e-tron That an Audi Lemon Law Lawyer Can Use?

On some Q5s, engine connecting rod bearings may become damaged, and some Q5 plug-in hybrid batteries may overheat. Two Q4 e-tron campaigns involve charging hardware and the on-board charger. A recall alone does not make an Audi a lemon. Every recall visit puts a dated repair on your record.

ModelModel yearsNHTSA campaign summaryClaims
Audi Q5Certain 2021 to 2023 Q5 and Q5 Sportback, and 2021 to 2024 plug-in hybridsBearings may become damaged, which can result in engine failure (22V753000). The high-voltage battery may overheat (25V080000)Audi Q5 engine and fault code claims
Audi Q4 e-tronCertain 2022 to 2024 (23V842000), and 2024 and 2025 (25V125000)Some home outlets may not handle the 220V or 240V plug at 100%, so an outlet or cable can overheat (23V842000). The on-board charger may stop charging the 12-volt battery, which can cut drive power (25V125000)Audi Q4 e-tron battery and charging claims

Say your Q4 e-tron loses range in its second summer, and a high-voltage warning appears twice. Whether those symptoms add up to one nonconformity depends on the repair orders. Section 1793.22(e)(1) uses that term for a defect that substantially impairs use, value or safety.

Campaigns the Q4 e-tron Shares With the Volkswagen ID.4

Campaigns 25V120000 and 25V125000 each reach both the Q4 e-tron and the ID.4. Q5 campaign 22V753000 also covers some 2022 and 2023 Volkswagen Atlas models. An Audi lemon law lawyer can use that overlap to help show a design issue rather than one bad car. The firm brings Volkswagen claims built on the same campaigns as well. Each brand's warranty and deadline get checked separately.

Will Audi Buy Back My Car If I Just Ask, or Do I Need a Lawyer?

Asking customer care is not the same as a California repurchase. The refund comes from Civil Code section 1793.2(d)(2). Audi takes part in BBB AUTO LINE, a state-certified arbitration program. Its certified pre-owned booklet says you usually need not use it first. Timely written notice of the program changes when a legal shortcut becomes available.

ItemCourt judgmentBBB AUTO LINE decision
Price paid or payable, plus taxes and official feesRefunded, Civil Code 1793.2(d)(2)(B)An ordered repurchase follows that rule, Civil Code 1793.22(d)(5)

Attorney fees and costsReasonable fees and costs if the buyer prevails, Civil Code 1794(d)The program need not award them, Civil Code 1793.22(d)(7)

Say you paid $62,000 for an A6 and first brought it in for the defect at 9,000 miles. Under the statute's formula, 9,000 miles is 7.5% of 120,000, so the offset on $62,000 may be $4,650. That is arithmetic only.

What an Audi Repurchase Refunds Beyond the Sticker Price

Restitution, the legal name for a buyback, returns the price paid or payable. That includes transportation charges and options Audi installed, but not items a dealer or buyer added. Collateral charges come back too, meaning sales or use tax, license fees and registration fees. Incidental damages, meaning costs such as reasonable repairs, towing and rentals the buyer actually incurred, are added. A replacement comes with new-vehicle warranties and its tax and fees paid, but you never have to accept one over a refund. The buyback calculator gives a rough figure, and your paperwork sets the real one.

BBB AUTO LINE Awards Versus an Audi Lemon Law Judgment

The DCA places Volkswagen and Audi under BBB Auto Line in its certified program list, and Audi takes part in it. DCA says filing has no cost to the consumer and no lawyer is needed. Decisions usually come within 40 days after the program gets the application. A decision binds Audi only once you accept it. The program must then give Audi a reasonable time to perform, no more than 30 days after your acceptance, under section 1793.22(d)(3).

Reject the decision, and you can still sue. The findings come into evidence, and you can assert the presumption, a rule that treats Audi as having had a reasonable number of repair attempts. Program days also extend your deadline under section 1793.22(c). Section 1794(e) drops its separate penalty for a maker whose qualified program substantially complies with section 1793.22, and Audi takes part in one. So an Audi buyer usually has to prove a willful violation under section 1794(c) to seek a penalty.

How Does an Audi Lemon Law Attorney Read the Warranty Booklet One Coverage Term at a Time?

Audi's certified pre-owned booklet gives the New Vehicle Limited Warranty as 4 years or 50,000 miles, whichever occurs first. The e-tron battery, emissions parts and rust-through run longer, and those terms can keep a claim alive after the basic warranty ends. Booklets differ by model and year.

The statute asks whether Audi fixed the car to match the applicable express warranties, meaning the written promises covering the failed part. Say you bought a new Q7 in March 2024. At 22 months and 31,000 miles, the transmission slams into gear, and three dealer repairs fail to stop it. No visit falls inside the presumption window. Even so, three failed attempts can support a claim, and an Audi lemon law lawyer weighs the orders and the downtime.

Audi's Basic Term Generally Covers Engine and Transmission

Audi's certified pre-owned booklet lists the express warranties Audi of America makes. Besides the certified coverage, it names the New Vehicle Limited Warranty, a corrosion perforation warranty and the federal emissions warranties. No separate powertrain term appears. So engine and transmission defects on a new Audi generally fall under the basic term, unless your own booklet says otherwise for that model year.

The Presumption Covers Only 18 of Audi's 48 Warranty Months

Section 1793.22(b) treats Audi as having had a reasonable number of repair attempts when one of three routes occurs within 18 months or 18,000 miles, whichever comes first. Two or more repairs of a nonconformity likely to cause death or serious bodily injury count, as do four or more repairs of the same nonconformity. Both need at least one direct notice, a report to Audi itself, when the booklet or manual clearly discloses that duty. The third route counts more than 30 cumulative days out of service for repair and needs no direct notice. Only conditions beyond Audi's control extend it.

Audi can rebut the presumption. After the window, the full repair history can still carry a claim under section 1793.2(d)(2). DCA's lemon law FAQ says the law applies throughout the original warranty period and requires at least two repair attempts. If Audi gave timely written notice of BBB AUTO LINE, section 1793.22(c) requires trying it before asserting the presumption.

Eight Years of e-tron Battery Coverage and Normal Capacity Loss

Audi USA's electric vehicle FAQ describes battery coverage of 8 years or 100,000 miles, whichever occurs first, for model year 2021 and newer e-tron vehicles. The FAQ says capacity decreases with time and use, and warranty work may not restore 100% net capacity. A sudden drop, a high-voltage warning or a refusal to charge points toward a defect instead. Each module or cell replacement is a repair attempt on the record.

Emissions and Rust-Through Terms That Outlast Audi's Basic Warranty

A California Air Resources Board fact sheet dated March 6, 2026, lists these terms. The federal basic term runs 2 years or 24,000 miles, whichever comes first. Catalytic converters, the electronic emissions control unit and the onboard diagnostic computer get 8 years or 80,000 miles, whichever comes first. California's defects warranty under title 13, section 2037, runs 3 years or 50,000 miles, whichever comes first. High-cost emissions parts listed in the owner's manual get 7 years or 70,000 miles, whichever comes first. The booklet also refers to a 12-year corrosion perforation warranty, regardless of mileage.

Which Recalls Can an Audi Lemon Law Attorney Count Toward Your Claim?

A recall shows Audi found a risk across many vehicles, not that your car is a lemon. Every recall visit still lands on your record as a dated repair visit. When the recall repair does not end the symptom you reported, the claim stays open.

Model year searchedOwner complaints to NHTSARecall campaigns reaching Audi models
202413914
202516211
2026343
2024 to 202632723

These counts come from NHTSA's complaint and recall searches, pulled September 30, 2026, so complaint figures are approximate. Each complaint is an owner's account, not a finding. A campaign or complaint covering several model years counts once in the total row. Say your Q5 got the 22V753000 remedy, an engine inspection with a replacement engine if necessary. Then the symptom returns on Interstate 15. NHTSA's recall lookup covers safety recalls on your VIN, not service actions.

Recall Work on an Audi Does Not Close the Lemon Law Claim

An Audi lemon law lawyer reads each remedy before counting the visit. Campaign 23V842000 concerns the compact charging cable, and its remedy is a new cable with a temperature sensor. That recall alone does not show a battery defect. Campaign 25V080000, by contrast, names the Q5 plug-in hybrid's battery. Dealers install advanced diagnostic software, and owners whose cars lack online data are advised not to charge until the final remedy is available. Audi's battery statement refers to e-tron vehicles, so hybrid owners should check their own booklet.

Audi Service Actions and Warranty Extensions Outside the Recall List

Audi's bulletin AWA-24-04, dated May 16, 2024, extends automatic emergency braking coverage for listed models, including 2013 to 2023 Q5 and 2022 and 2023 Q4 e-tron models. It runs up to 12 months or 12,000 miles past the basic term. It covers 75% of an authorized dealer's diagnosed and confirmed repair of a failed emergency braking control unit, camera, LIDAR or sensor. If the basic term's time limit had passed by May 16, 2024, the extension ran to November 16, 2024. Service action 91FN updates battery software on certain 2022 and 2023 Q4 e-trons, and dealers evaluate the battery and replace affected cell modules.

How Long Does an Audi Owner Have to Sue, and Which Date Does a Lawyer Count From?

Audi was missing from the Department of Consumer Affairs roster of makers opting into the newer lemon law procedures on September 30, 2026. Makers can elect for later sales. So an Audi claim runs on the four-year period in Commercial Code section 2725. That clock usually starts at tender of delivery, the day the dealer hands over the car.

Section 871.24's pre-suit notice, a demand needed only before a suit seeking civil penalties, applies only to electing makers, which Audi was not. Say you bought a 2021 A4 new in El Cajon, and a catalytic converter fault returned after three repairs at 62,000 miles. Delivery was more than four years ago. Even so, the 8-year federal catalytic converter coverage may promise future performance. An Audi lemon law lawyer checks its wording and the date the fault surfaced.

Delivery Day as the Default Starting Point for an Audi Lemon Law Claim

Under Commercial Code section 2725, a breach of warranty occurs at tender of delivery, even before you know of the defect. On that default rule, an Audi delivered in June 2022 reached its default four-year date in June 2026. The exception needs two conditions. First, the warranty must explicitly extend to future performance. Second, discovery of the breach must await that performance. Then the clock runs from when the breach is or should have been discovered. Program days and other pauses can also extend it. A lease may follow Commercial Code section 10506, also four years. Under section 871.29(d), Audi must also name at the sale the procedure governing any car sold new in 2026 or later.

Asking Audi to Repurchase Without a Pre-Suit Notice

Direct notice is a separate idea from the pre-suit notice. It matters only for the two-repair and four-repair routes of the presumption, and it goes wherever the booklet and manual say. Say your A5 stalled twice at a light on Clairemont Mesa Boulevard. Before a third visit, check the booklet for a direct notice clause and follow it. For the certified pre-owned warranty, Audi's booklet requires BBB AUTO LINE before a federal Magnuson-Moss Warranty Act remedy under 15 U.S.C. section 2310(d).
