An Audi lemon law lawyer in La Jolla starts with the business-vehicle sentence in Civil Code section 1793.22. It covers a new business Audi under 10,000 pounds gross vehicle weight if the buyer has five or fewer vehicles registered in California.

A new Audi bought or leased mainly for personal use qualifies too. Either way, Audi's dealers must have failed to fix a substantial defect within a reasonable number of repair attempts, meaning a fair number of chances. Audi then owes restitution, meaning a buyback that refunds the price, or a replacement, a substantially identical new Audi.

Cline APC sees Audi owners at 7855 Ivanhoe Avenue, Suite 400, La Jolla, CA 92037, or by phone. Have the registration card ready and call (888) 982-6915.

Can a La Jolla Audi Lawyer Use Repair Orders From Any Audi Dealer?

Yes. Every authorized Audi service department does warranty work for Audi. So visits at Audi San Diego, Audi Carlsbad and Audi Escondido build one repair history. A car several employees share needs one folder, so no visit drops from the count.

Cline APC's La Jolla lemon law lawyers gather orders from all three. Audi San Diego is at 9010 Miramar Road, Audi Carlsbad at 5425 Paseo Del Norte and Audi Escondido at 1556 Auto Park Way. Say one associate drops the car off in Carlsbad, another picks it up, and nobody keeps the order. Ask the dealer for a copy, because even a could-not-duplicate order proves Audi had the car for that defect.

One Service Folder for an Audi Several Employees Drive

The driver who notices the defect should write down the date, the road and what the car did. That driver then gives the advisor the same words. At pickup, ask for a printed order. Every order goes into one folder the office manager controls, and towing or rental receipts go in the same day. Matching wording ties the visits together.

Does an Audi Titled to Your Practice Qualify, and What Does a La Jolla Lawyer Count?

It can. The second sentence of Civil Code section 1793.22(e)(2) covers a new vehicle bought or used primarily for business, under 10,000 pounds gross vehicle weight. That buyer can be a person, partnership, LLC or corporation with no more than five motor vehicles registered in California.

The defect must be a nonconformity, meaning a warranty defect that substantially impairs use, value or safety. Section 1793.2(d)(2) then imposes a manufacturer obligation, a duty to replace the car or make restitution. Picture an orthodontist whose professional corporation has three cars registered. It buys a new Audi Q5 for the drive from Bird Rock to Genesee Avenue, making four. NHTSA campaign 22V753000 covers certain 2021 to 2023 Q5 models whose connecting rod bearings may become damaged, a recall Audi lemon law lawyers review.

Counting Registrations in the Buyer's Own Name

The statute counts vehicles registered to the buyer in this state, not employees or revenue. A sole proprietor's family minivan counts toward five, because the registration names her. A professional corporation or LLC that signs the contract is its own buyer with its own count. Section 1793.22 does not say when the count is taken. So keep a dated registration list from the month of purchase.

When a Company Audi Is Mostly the Family Car

The first sentence of subdivision (e)(2) asks how a car is bought or used. An LLC-titled Audi driven mostly for school runs can fit that personal-use test. The mileage log shows how it was really used. Company leases are harder, because section 1791 defines both a lease and a lessee in terms of an individual. For a company over five vehicles, a federal Magnuson-Moss Warranty Act claim may remain, since 16 CFR 700.1 treats automobiles as consumer products. That route lacks California's repurchase formula.

Which Deadline Governs a Company Audi Claim, and Where Does a La Jolla Attorney File It?

The Department of Consumer Affairs list of manufacturers opting into newer lemon law procedures omitted Audi when checked September 30, 2026. That leaves four years under Commercial Code section 2725, usually from tender of delivery. BBB AUTO LINE, the state-certified program Audi takes part in, is a separate route whose days extend that clock.

Neither section 871.21's deadline nor the section 871.24 pre-suit notice applies to a maker that has not elected. That notice is a demand needed only before suing an electing maker for civil penalties, meaning extra money a court can add. The four-year exception needs a warranty that explicitly extends to future performance, where discovery must await that performance. Time then counts from the date the breach is or should have been discovered. For a lease, Commercial Code section 10506 may apply, also four years. Form ADM-254 routes 92037, 92121, 92122 and 92126 to the Central Division downtown under Local Rule 1.2.2(E). Carlsbad and Escondido zip codes go to the North County Division in Vista, though venue also turns on where the contract was made.

BBB AUTO LINE's California rules copy the five-vehicle business test. They also generally require a California retail purchase or lease and exclude claims alleging fraud or other violations of law. A claim must arrive within six months after the applicable warranty expires. BBB Auto Line appears beside Volkswagen and Audi on the Department of Consumer Affairs program list. Only your acceptance makes a decision binding on Audi, which must then perform within a reasonable time, no more than 30 days after acceptance. Rejecting it keeps court open, and program days extend the deadline under section 1793.22(c).

When Business Miles Close the 18,000-Mile Window Early

Within 18 months or 18,000 miles, whichever comes first, a presumption can treat Audi as having had a reasonable number of repair attempts. The routes are two or more repairs of a nonconformity likely to cause death or serious bodily injury, or four or more repairs of one nonconformity. A third route counts more than 30 cumulative days out of service for repair. The first two need at least one direct notice, a complaint to Audi itself, when the warranty or owner's manual clearly discloses that duty. Audi may rebut it, though the whole repair record can still carry a claim afterward. After timely written notice from Audi, you must try BBB AUTO LINE before asserting the presumption, and a rejected decision leaves it available.

Say a biotech startup's Audi Q4 e-tron logs 25,000 miles a year between Torrey Pines Road and Carlsbad. It passes 18,000 miles in under a year. Section 1794.3 excludes defects caused by unreasonable use, but a failure at low miles answers most of that argument.

Who Receives the Refund When a La Jolla Audi Lawyer Settles for an LLC?

Restitution goes to whoever paid or still owes the price. When an LLC signed the contract and the loan, the LLC receives the refund after the lender's payoff. The entity, not the driver, signs any release, so its authority to settle should be clear before an offer arrives.

Say the LLC paid $66,000 for an Audi Q7, and the first visit for the problem came at 6,000 miles. The offset may be $3,300, as arithmetic only. Under section 1794(c), a willful violation can bring a civil penalty of up to twice actual damages. The penalty in section 1794(e) usually does not reach Audi, which participates in BBB AUTO LINE. If the LLC prevails, section 1794(d) lets it recover costs and reasonable attorney fees. Try the buyback calculator.

Can Partners Sharing One Company Audi Call an Audi Lemon Law Lawyer in La Jolla Together?

Yes. Cline APC reviews a company-owned Audi in a free consultation, either on Ivanhoe Avenue or by phone. The review sorts who bought the car, how many vehicles share the registration list and who drove it. Then it applies the presumption and the four-year clock to what is left.

Gather the contract, the registration list, every repair order, the mileage log and any BBB AUTO LINE notice. Two partners can join an Audi lemon law lawyer in La Jolla on one call. The review cannot predict a result.

Send the firm a short message online. You can call (888) 982-6915 and mention that a business owns the Audi.
