Dodge Charger Lemon Law Lawyer in San Diego

Basic coverage on your 2022 Charger ran out this year. The transmission still will not shift past third gear, and the service advisor now wants a credit card. A Dodge Charger lemon law lawyer treats that moment as a deadline question, not a dead end.

A Dodge lemon law claim asks whether FCA US LLC, Dodge's maker, had a reasonable number of repair attempts, meaning enough fair chances, to fix a nonconformity. That is the statute's word for a defect that substantially impairs the car's use, value or safety.

FCA US LLC has elected the newer court procedures in Code of Civil Procedure sections 871.20 and following, which makes it an electing manufacturer. The Department of Consumer Affairs roster lists its opt-in as April 25, 2025. Section 871.21 then governs a Charger sold in 2025 or earlier. It requires suit within one year after the applicable express warranty, the booklet coverage for the defect, ends, and never more than six years after delivery. Repair days and a pre-suit notice pause both limits. That notice is a demand required only before a suit seeking civil penalties, extra damages a court may award when a violation was willful.

Charger owners sit down with Cline APC at its La Jolla office or its Poway office. If a defect is still unfixed, call (888) 982-6915 with your in-service date and latest work order.

Can a Dodge Charger Lemon Law Lawyer Help When the Transmission Slips or Sticks in Third?

Yes, when the fault keeps returning. FCA's technical service bulletin (TSB) 21-009-25 REV. C, dated July 4, 2025, lists slipping on shifts, no reverse and no gear higher than third as comments customers may make about LD Chargers with the 850RE eight-speed. Put the symptom on each repair order in your own words.

  • The transmission slips when shifting.
  • The Charger will not move in reverse.
  • The car will not shift higher than third gear.
  • Drive engages late, with a thump.
  • An electric Charger drops into limp mode with a warning.
  • A cluster message reads Lamp Out while a turn signal stays dark.

The first three come from FCA's bulletin. NHTSA complaints describe the fourth on 2023 cars and the fifth on electric cars. FCA's STAR case S2308000081, a record of similar past repairs, describes the sixth. Complaints record what owners told NHTSA, not findings about your car.

Say your 2021 Charger SXT shudders into gear on Interstate 805, and two visits end with could not duplicate. A written complaint naming the gear and the warning lamp documents each visit as a dated repair attempt.

Which Charger Generation Do You Drive, and Can a Dodge Charger Lemon Law Attorney Date Its Coverage?

FCA's bulletins call the 2021 to 2023 car the LD Charger and the 2024 and later car the LB Charger. LD owners are usually near or past the end of coverage. LB owners, with Dodge's electric Daytona Scat Pack or a twin-turbo inline-six, are early in it. Coverage terms vary by booklet and model year, so read yours.

FCA's Mopar site lists current Dodge coverage as 3 years or 36,000 miles basic and 5 years or 60,000 miles powertrain, whichever comes first in each case. Say you bought a 2022 Charger R/T in March 2022 from Sunroad on Balboa Avenue and drive 15,000 miles a year on Interstate 805. The odometer passes 36,000 miles around August 2024 and 60,000 around March 2026. A basic-only defect's default one-year window closed around August 2025. A powertrain defect's default window runs to around March 2027, and the six-year limit lands in March 2028, before any pauses.

What Does TSB 21-009-25 Tell a Dodge Charger Lemon Law Lawyer About a Slipping 850RE?

TSB 21-009-25 REV. C replaces the D clutch in the 850RE on 2020 to 2023 LD Chargers. It applies with the malfunction lamp on, at least 7,000 miles on the car and gear ratio codes stored. Its policy line reads reimbursable within the provisions of the warranty, so the powertrain end date can separate a covered repair from a bill.

Say a Santee owner opens the curtain airbag letter for a 2021 Charger SXT after basic coverage ended. Dealers replace both curtain airbags under that recall, and the visit still goes on the timeline.

Curtain Airbag Inflators on 2021 Chargers

Campaign 24V198000 covers 2018 to 2021 Chargers and Chrysler 300s. FCA's updated Part 573 recall report of February 13, 2025 counts 217,802 Chargers built July 5, 2018 through May 20, 2021. It lists no warning before an inflator rupture. FCA first reported it March 14, 2024, and owner letters began February 20, 2025. Several 2021 owners told NHTSA in 2024 and early 2025 that the repair part was not available. Waiting for a part does not count as a repair attempt by itself, but the wait dates belong in your file. Cline APC also takes Chrysler 300 curtain airbag claims.

Coolant Residue, Lamp Out Messages and Other STAR Cases

Each STAR case says it does not authorize warranty repairs. Case S2607000002, released February 2026, covers Hemi models including the Charger. Dry residue at the water pump weep plug may be normal, while liquid coolant is unacceptable, and a pressurization test settles it. Case S2308000081, released July 2023, covers a Lamp Out message with a dead turn signal. It sends technicians to a corroded body control module connector and to water entry at the windshield, body seams or HVAC filter housing. Case S2308000120, a January 2026 revision, lists 2024 to 2026 LB Chargers whose failed rain sensor can disable automatic headlamps and wipers. Cline APC takes Dodge Durango lemon law claims built on case S2308000081 too.

Should a Dodge Charger Lemon Law Attorney Check the Dates Before You Pay for a Transmission Repair?

Yes. Ask the service department to print the warranty start date FCA shows for your VIN. Make sure every work order carries a drop-off date and a ready date, as Civil Code section 1795.6(d) requires. Keep any backorder notice too. Those dates can push a coverage end date past the one the booklet prints.

Say your 2021 Charger GT went in three times for a clunk into drive, and the visits added up to 26 days. Section 1795.6(a) pauses the warranty while the car is in for warranty repair. The end date then falls 26 days later than the booklet shows.

Put the Failed Repair in Writing Within 60 Days

Section 1795.6(b)(2) keeps the warranty from expiring when a repair did not fix the defect and you told FCA or the seller within 60 days after the repair was completed. Say a 2023 Charger's transmission was repaired at 59,000 miles and slipped again at 60,400. A written callback inside those 60 days can keep the powertrain warranty open for that defect. Under subdivision (c), the manufacturer includes its service facility, so a written note to the dealer counts.

Aftermarket Parts and a Dodge Charger Lemon Law Defense

The Federal Trade Commission says a warranty stays in effect when you use aftermarket parts. The manufacturer must prove the part caused the damage before it denies coverage. In a suit under FCA's newer procedures, filed with a lawyer on or after January 1, 2025, section 871.26 also requires a list of modifications made after purchase. Keep receipts that show what was installed and when.

Inside 18 Months, Can a Dodge Charger Lemon Law Lawyer Use the Presumption for an LB Charger?

Yes, some LB Chargers are still inside 18 months or 18,000 miles, whichever comes first. Civil Code section 1793.22(b) then treats FCA as having had a reasonable number of repair attempts once a route is met. LD cars past that window rely on the full repair record and the section 871.21 filing clock.

One route counts two or more repairs of the same nonconformity likely to cause death or serious bodily injury. The next route counts four or more repairs of the same nonconformity. Both need direct notice, your own letter to FCA, at least once if the warranty requires it. The third route is more than 30 cumulative days out of service for repair, with no letter. FCA may try to rebut the presumption. After the window closes, section 1793.2(d)(2) still lets a claim rest on the full repair history.

Say the display on your 2025 electric Charger fails again after the campaign 26V262000 update. FCA's filing counts 20,271 vehicles across the Charger and Jeep Wagoneer S and blames a software error. The second visit can count toward the same nonconformity.

One Year After Coverage Ends, With the Section 871.21(c) Pauses

A 2021 Charger delivered in spring 2021 reaches the six-year limit in spring 2027. That date can arrive before a late powertrain window closes, so it can control. The pauses in section 871.21(c) cover repair days, up to 60 days after a pre-suit notice, and tolling under Civil Code section 1793.22. FCA's receipt of the notice must come at least 30 days before filing, and its 30-day offer period runs from receipt. If FCA offers within 30 days and finishes within 60 days of receipt, civil penalties stay out, and missing either date leaves them available. FCA must name which procedure governs a Charger sold new in 2026 or later, at the sale, under section 871.29(d).

A $9,200 Offset on a Charger Now Showing 61,000 Miles

A buyback, also called restitution, is the refund FCA pays when it takes the car back. It covers the price with factory options, taxes and official fees, and incidental damages, the costs the defect caused. FCA may subtract a mileage offset, a charge for the miles driven before the first repair visit for the defect. The formula is the price times those miles, divided by 120,000. A $46,000 Charger first in for its transmission at 24,000 miles carries a $9,200 offset, even at 61,000 miles now. Try your own figures in the buyback calculator.

Secondhand LD Chargers After Rodriguez

The California Supreme Court held in Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 that remaining factory coverage does not make a used car new. That changes if FCA's new car warranty was issued with that sale. The court did not rule on certified pre-owned programs, so those cars are usually outside the remedy, though nobody can call that settled. Civil Code section 1795.5 can reach a dealer that gave its own express warranty on a used Charger.

Can a Dodge Charger Lemon Law Lawyer Count the Months Left on Your Clock?

Bring the purchase or lease contract, every work order, emails, recall letters and FCA case numbers. Call (888) 982-6915 to book a free consultation. Cline APC, a San Diego lemon law firm, then tells you which coverage applies, whether section 1795.6 moved its end date and how many months remain.

Say your 2023 Scat Pack's powertrain window closes in four months. A Dodge Charger lemon law lawyer can count the repair days and notice days now, while time remains.

Nobody can promise what FCA will offer, and every decision about your Charger stays yours.
