A Honda lemon law lawyer treats that offer as a real choice, because arbitration and a lawsuit award different things. California lemon law lets a new or leased Honda qualify for a buyback, meaning a refund of what you paid, or for a replacement, which is a substantially identical new Honda. It turns on whether the dealers could fix the car in a reasonable number of repair attempts, which means a fair set of tries. The statute sets no fixed count.
Civil Code section 1795.4 gives the lessee, the driver who leases, the rights a buyer would hold. Demonstrators and dealer-owned cars qualify when they carry Honda's new car warranty. A business Ridgeline qualifies too, if its gross vehicle weight is under 10,000 pounds and the company has at most five vehicles registered in California.
In Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, the California Supreme Court ruled that leftover factory coverage does not turn a used car into a new one. The exception is a sale where the manufacturer's new car warranty was issued with it. Rodriguez left certified pre-owned programs alone, so a certified Honda usually sits outside the new-vehicle remedy, though the question remains unsettled.
Lemon law and consumer warranty disputes are all Cline APC takes on, working from La Jolla and Poway. When a Civic, CR-V or Pilot returns to the dealer again and again for one fault, phone (888) 982-6915.
Which Honda Steering and Stalling Defects Bring Owners to a Lemon Law Lawyer?
Steering leads the complaints filed with the National Highway Traffic Safety Administration (NHTSA) on 2021 to 2026 Civics and CR-Vs. Electrical faults lead on the Pilot. One Honda steering gearbox recall reaches Civics and CR-Vs, and the Pilot drew separate recalls for stalling, steering and brake pedals.
| Model | Model years | What Honda's campaign describes | Claims |
|---|---|---|---|
| Civic | Certain 2022 to 2024 cars given a replacement rack in a service repair (23V704000), then certain 2022 to 2025 cars (24V744000) | A replacement rack that may have been assembled incorrectly, then a gearbox that may have been built incorrectly | Honda Civic lemon law claims |
| CR-V and CR-V Hybrid | Certain 2023 to 2025 (24V744000) | The same gearbox defect, with excess friction and hard steering | Honda CR-V lemon law claims built on steering assist defects |
| Pilot | Certain 2023 and 2024 (23V735000), then certain 2023 to 2025 (25V031000, 25V391000) | A possibly loose steering gearbox bearing, fuel injection software that may cause a stall, and an unsecured brake pedal pivot pin | Honda Pilot breakdown and tow records |
Say you lease a 2024 Civic in Chula Vista, and the steering has been in the shop three times in 14 months. A recall notice alone does not prove your car has a nonconformity. Under section 1793.22(e)(1) of the Civil Code, that term means a defect substantially impairing the car's use, value or safety. Still, all three visits count, since each gave Honda a dated chance to repair.
Heavy Steering That Outlasts Campaign 24V744000
A recall repair is still a repair visit. It lands on your record with a date and mileage. Under campaign 24V744000, dealers replace the worm gear spring and redistribute or add grease. Say a 2023 CR-V got that remedy, yet the steering still feels heavy on State Route 163. The visits after the recall show that the defect outlasted Honda's fix.
Repair Orders From Ball Honda and Pacific Honda in One Lemon Law File
Authorized Honda dealers do warranty work as Honda's representatives, so a visit at any of them counts against Honda. Say you bought a CR-V at Ball Honda on National City Boulevard, then switched to Pacific Honda on Convoy Street near your office. Both stores' orders belong in one file, could-not-duplicate visits included. A Honda lemon law attorney in Poway sorts papers from two dealers the same way.
Does a Honda Goodwill Repair Get You What a Lemon Law Attorney Can Recover?
No. Honda's booklet says Honda may cover some repairs outside its limited warranties, case by case. It also describes special adjustment programs that pay for certain repairs past the warranty terms. Both are repairs, and the 2025 booklet describes no repurchase program. The buyback duty in section 1793.2(d)(2) of the Civil Code sits with American Honda.
Restitution is the legal word for a buyback. A civil penalty is an award added to damages to punish certain violations, such as willful ones.
| Item | Song-Beverly repurchase in court | CDSP award | Honda goodwill repair |
|---|---|---|---|
| Remedy | Restitution or a substantially identical replacement, the buyer's choice | Repair, repurchase, replacement, repair reimbursement, or denial | Honda pays part or all of certain repairs |
| Civil penalty for a willful violation | Up to twice actual damages, Civil Code 1794(c) | Never required, 1793.22(d)(7) | None |
| Attorney fees and costs | Awarded under 1794(d) only when the buyer prevails | Never required, and the Department of Consumer Affairs (DCA) says fees may not be covered unless Honda lets the arbitrator include them | None |
| Consequential damages beyond towing, rental and repairs | Available as the statute allows | Optional for the program | None |
Consider a 2023 CR-V Hybrid bought at Pacific Honda that has had drive components replaced twice. If Honda ignored a written buyback request, a Honda lemon law lawyer may weigh willfulness ahead of arbitration's speed.
American Honda Owes the Refund Even When a Dealer Did the Repairs
The booklet names the warrantor as the Honda Automobile Division of American Honda Motor Co., Inc., a California corporation in Torrance. That company owes the repurchase, not the dealership. Restitution under section 1793.2, subdivision (d)(2)(B), returns the price paid or payable, with transportation and factory options, plus tax, license and registration. It adds incidental damages, such as reasonable towing, rental and repair costs you actually paid. Non-Honda items a dealer added, such as outside tint, stay out.
Honda may subtract a mileage offset, a deduction for the miles you drove before first bringing the car in for that defect. Multiply the price by those miles, then divide by 120,000. So a $48,500 Pilot first taken in for stalling at 9,600 miles carries a $3,880 offset, as arithmetic only. The buyback calculator runs your figures, and you can send the firm Honda's offer before signing.
Fees and Penalties CDSP Never Has to Consider
DCA lists CDSP Auto Line as the certified program for Honda and Acura. Honda sponsors it, and the National Center for Dispute Settlement (NCDS) runs it. DCA says the program charges the consumer nothing, needs no attorney and usually decides within 40 days. Honda's booklet says generally 40 days, or 47 if you skipped Honda's customer service office.
Section 1793.22, subdivision (d)(7), lets a certified program skip multiple damages and attorney fees. Honda is bound only once you accept the decision, and it then has a reasonable time, no more than 30 days, to perform. Reject it, and the lawsuit stays open, along with the presumption, a shortcut that treats Honda as having had a reasonable number of repair attempts. The written findings still come into court without further foundation. In court, section 1794(d) awards reasonable attorney fees and costs, if a lawyer represents you, only when the buyer prevails. Cline APC explains its own lemon law fees at the first meeting.
Which Honda Warranty Terms Does a Lemon Law Attorney Check First?
Honda's 2025 warranty booklet gives basic coverage of 3 years or 36,000 miles, whichever comes first, 12-volt battery included. Powertrain coverage runs 5 years or 60,000 miles, as in the 2023 and 2024 booklets. Other parts run longer, and booklets vary by year.
Lemon law rights ride on the express warranty, the written promise in that booklet. The applicable warranty is whichever coverage reaches your defect. Say your Accord Hybrid in El Cajon keeps flashing a hybrid system warning while the dealer tests the battery. A Honda lemon law lawyer will want that written capacity finding, since it may decide whether the battery warranty applies.
Honda Hybrid Batteries and Emissions Parts Under Longer Terms
The booklet treats gradual high-voltage battery capacity loss as expected and not covered. Loss greater than normal degradation is covered for 8 years or 100,000 miles, as an authorized Honda dealer determines. Seat belts carry 15 years or 150,000 miles, and inside-out rust-through carries 5 years with no mileage limit. California emissions parts get at least 3 years or 50,000 miles, and specially listed parts get 7 years or 70,000. For each years-or-miles term, whichever comes first controls. Honda also cannot deny emissions coverage solely because receipts are missing.
CDSP Can Stand Between a Honda Owner and the Presumption
That presumption comes from subdivision (b) of Civil Code section 1793.22. When its conditions are met, it treats Honda as having had a reasonable number of repair attempts. The window is 18 months or 18,000 miles, whichever comes first. Two or more repairs of a nonconformity likely to cause death or serious bodily injury are enough. Four or more repair visits for the same nonconformity also count. Both routes need direct notice to Honda itself, given at least once, when the warranty or owner's manual discloses that duty clearly and conspicuously. On direct notice, the 2025 booklet only says some states require owners to notify the manufacturer, so whether that meets California's disclosure standard is a judgment call. Separately, a Honda kept out of service more than 30 cumulative days for repair of nonconformities qualifies with no notice.
Under subdivision (c), timely written notice describing CDSP means you use the program before relying on the presumption. A late notice that hurt your position does not count. Honda can try to rebut the presumption. A Honda that first fails at month 26 can still qualify, judged on every repair visit, under Civil Code section 1793.2(d)(2).
How Many NHTSA Complaints Name Civic, CR-V and Pilot Faults, and Do They Help a Lawyer?
Owners filed 2,286 CR-V, 1,703 Civic and 1,061 Pilot complaints with NHTSA for 2021 to 2026 models. Steering leads on the CR-V and Civic, and the electrical system on the Pilot. Complaints are owner reports, not proof. A recall repair, though, is a dated visit.
| Honda by the numbers | Figure | Source |
|---|---|---|
| NHTSA complaints, 2021 to 2026 CR-V and CR-V Hybrid | 2,286, with 875 naming steering | NHTSA, pulled September 23, 2026, each complaint counted once across model names |
| NHTSA complaints, 2021 to 2026 Civic | 1,703, with 1,236 naming steering | Same pull |
| NHTSA complaints, 2021 to 2026 Pilot | 1,061, with 242 naming the electrical system | Same pull |
| NHTSA complaints, 2024 to 2026 models only | CR-V 901, Pilot 337, Civic 264 | NHTSA, pulled September 29, 2026, counted the same way |
Say your 2023 Pilot loses power twice on the Interstate 15 grade toward Rancho Bernardo. No complaint count proves that case, but a dated repair order for each failure can help prove it. Check the VIN on NHTSA's recall lookup, and a Honda lemon law lawyer can match each campaign to an order.
Do Honda Owners Get Four Years or Five, and When Does a Lawyer Start the Clock?
Four. Honda was not on the DCA election roster when checked September 23, 2026, or again on September 29. So a Honda sold in 2025 or earlier gets four years under Commercial Code section 2725. That clock generally runs from tender of delivery. Advice promising five years has the law wrong.
An electing manufacturer is a brand that opted in to the newer AB 1755 procedures, and the DCA list of electing manufacturers omits Honda. On that track, a pre-suit notice is a written demand that must reach the manufacturer at least 30 days before a suit for civil penalties. It does not apply to a Honda sold in 2025 or earlier.
Say you bought a 2024 Pilot at Poway Honda in March 2024. The default four-year line falls in March 2028, extended by any days at CDSP under section 1793.22(c). If a warranty explicitly covers future performance and the breach could only surface then, the clock starts when the breach is or should have been discovered. If your Honda was sold new in 2026 or a later year, Code of Civil Procedure section 871.29(d) requires the manufacturer to name the governing procedure. A Honda lemon law lawyer confirms the real date from your papers.
Does the AAA Clause in Recent Honda Booklets Reach a Lemon Law Claim?
The 2025 booklet includes an Agreement to Arbitrate that sends disputes to one American Arbitration Association (AAA) arbitrator. The 2024 booklet carries the same clause, while the 2023 booklet has none. Written notice to Honda's Office of the General Counsel comes first, and a formal claim can follow after 60 days unresolved. The clause allowed an opt-out letter within 30 days after delivery.
Honda pays every AAA fee except your initial filing fee, capped at $250. Whether the clause reaches a lemon law claim depends on your booklet year and papers. A CDSP decision binds Honda only on your acceptance, but the AAA clause binds both sides where it applies.
A Written Buyback Request Builds the Honda Lemon Law Willfulness Record
Section 1794, subdivision (c), allows a civil penalty for a willful violation, capped at twice actual damages. It does not apply in class actions or to claims resting only on the implied warranty. Subdivision (e) offers a penalty without willfulness. Under (e)(2), though, it falls away when the manufacturer keeps a qualified program in substantial compliance, and Honda sponsors CDSP. So a Honda buyer seeking a penalty generally must prove willfulness. A dated letter listing every visit, with proof of delivery, shows when Honda knew.
Because Honda's booklet does not require an NCDS claim before litigation, a federal Magnuson-Moss claim under 15 U.S.C. section 2310(d) need not wait on CDSP.
Should a Honda Lemon Law Lawyer Compare CDSP and Court Before You File?
Yes, ideally before any claim form goes out. Bring the sales or lease agreement, repair orders in date order, letters with Honda or NCDS, the booklet and tow receipts. Cline APC checks them against the presumption window and the four-year date. Book that free consultation at (888) 982-6915.
Say your six-month-old Civic has been in four times for one steering complaint, with a letter to Honda after the second visit. That file sits inside the presumption window, so CDSP, which DCA says usually decides within 40 days, may suit you. A claim built on willfulness or heavy incidental costs may fit court better.
A Honda lemon law lawyer at Cline APC compares your booklet year, repair orders and delivery date before any filing. Nobody can promise how either forum rules, and every next step is your call.
