Honda Pilot Lemon Law Lawyer in San Diego

Your Pilot lost power on Interstate 15 near Rancho Bernardo. The kids followed the tow truck in a rideshare. A week later, the dealer handed the SUV back with a software update. A Honda Pilot lemon law lawyer treats that day's tow invoice as evidence.

It shows the failure, the moment Honda's dealer took custody and a cost the law can add back in Honda lemon law claims.

Honda gets a reasonable number of repair attempts, which is the law's term for a fair share of chances to fix a defect. If it still falls short, California law lets you choose restitution, which refunds what you paid, or a substantially identical new Pilot in its place. First, check your VIN on the recall lookup run by the National Highway Traffic Safety Administration (NHTSA).

Cline APC limits its work to lemon law and consumer warranty matters, from offices in Poway and La Jolla.

If your Pilot has left you on the shoulder twice or more, call (888) 982-6915 and keep the tow invoices in hand.

What Should a Lawyer Know When a Honda Pilot Stalls on Interstate 15 With the Family Aboard?

Pilot owners report electrical faults, driver assist braking and engine trouble most often. A text search of their NHTSA complaints finds 72 describing a tow, 53 a stall and 44 a no-start or no-restart. Honda's recall filings add steering lock-up and a brake pedal that can shift out of position.

Owners filed 1,061 complaints with NHTSA about 2021 to 2026 Pilots, in a September 23, 2026 pull. Electrical complaints lead at 242, ahead of forward collision avoidance at 230 and the engine at 185. Those are owner reports, not findings. When they match what happened, your repair orders should carry words like these.

  • It lost power at freeway speed, and I coasted to the shoulder.
  • The engine shut off at a light and would not restart.
  • It stalled again after the recall update.
  • The steering locked while I was turning.
  • The brake pedal felt out of place under my foot.
  • It braked hard with nothing ahead of it.

Say your 2024 Pilot dies at the State Route 56 interchange, and a flatbed takes it to Poway Honda. The law calls a defect that substantially impairs the Pilot's use, value or safety a nonconformity.

Which 2023 to 2025 Honda Pilots Carry a Stall, Steering or Brake Pedal Recall a Lawyer Should Check?

The stall campaign 25V031000 and the brake pedal campaign 25V391000 reach certain 2023 to 2025 Pilots. Steering campaign 23V735000 reaches just 519 certain 2023 and 2024 Pilots. Complaint totals, by contrast, cover the 2021 to 2026 model years, so they reach older Pilots the recalls skip.

A recall creates no lemon law claim by itself, and a notice does not prove your SUV has the defect. Picture a 2023 Pilot bought at Honda of Escondido that stalls twice after its recall work. Both stalls, both tows and the recall visit may belong in one file. Finishing a campaign leaves the claim intact when the symptom returns.

How Does a Lawyer Use Honda's Fuel Injection Software Recall for a Pilot That Stalls?

Campaign 25V031000 says a software error in the fuel injection electronic control unit may cause an engine stall or loss of power. NHTSA's record says that can increase the risk of a crash or injury. Dealers then reprogram the software. That visit counts as a repair opportunity even though no part changes hands.

Say your Pilot stalls on Interstate 15 near the Carmel Mountain Road exit a month after the update. Note the nearest exit and the time, then match them to the tow driver's pickup record. That stall shows the defect outlasted Honda's fix. If the dealer ran the update during a stall visit, make sure the order names both.

A Loose Ball Bearing in the Steering Gearbox

Honda's filing for 23V735000 blames a manufacturing error that may leave a loose ball bearing in the gearbox. The remedy is a new electric power steering rack. A Pilot that cannot be steered cannot be driven to the dealer, so these failures often start with a tow. CR-V and Civic owners face a different gearbox recall, the subject of Honda CR-V steering claims and Civic steering claims.

Brake Pedal Pivot Pins That Shift Out of Position

Campaign 25V391000 says the brake pedal pivot pin was not secured properly. NHTSA's record adds that a shifted pedal can keep the driver from braking as intended, raising the risk of a crash or injury. Dealers then inspect the pedal assembly and replace it as necessary. A brake defect is a strong candidate for the two-repair route, which needs a defect likely to cause death or serious bodily injury.

Why Does a Honda Pilot Lemon Law Lawyer Trust the Tow Invoice Over the Repair Order?

A repair order often shows the day the work was written up. That can come a day or two after an after-hours tow. The tow invoice shows when the Pilot actually left your control. So ask the dealer to note a covered tow on the order, and keep any after-hours drop receipt.

Say a flatbed delivers your Pilot on a Friday night, and the service department writes it up Monday. Your Pilot left service Friday. So the tow invoice and a drop receipt support counting that weekend, which a Monday order would leave out.

Towing Honda Covers to the Nearest Authorized Dealer

Honda's 2025 warranty booklet tells owners to call the nearest authorized Honda dealer when the vehicle cannot be driven. Towing to that dealer is also covered if the failure falls under a booklet warranty. An emergency repair at another shop is reimbursed only when three things are true. The repair is covered, every authorized dealer within 50 miles was closed or absent, and the Pilot was immobile or unsafe.

What to Tell the Roadside Dispatcher

Most breakdowns start with a phone call, so the dispatcher's notes echo what you say. Describe the failure plainly, such as engine shut off at speed or steering locked while turning. Also give the exact location and any dash warnings. A call record made before the dealer saw the SUV is independent proof if the order later says could not duplicate. Ask for a reference number that day.

Can a Lawyer Use the 30-Day Route or the Safety Route for a Honda Pilot Lemon Law Claim?

Within 18 months or 18,000 miles, whichever comes first, each route treats Honda as having had a reasonable number of repair attempts. Section 1793.22(b)(3) needs more than 30 cumulative days out of service for repair of nonconformities. Subdivision (b)(1) needs two repairs for a defect likely to cause death or serious bodily injury.

The third route is four or more repairs of the same nonconformity. Both repair-count routes need direct notice to Honda itself when the booklet requires it. Together, the three routes form the presumption, a legal shortcut in many Honda lemon law claims. Honda can rebut it, and a Pilot outside the window can still qualify on its full repair history.

Say your Pilot sat at Poway Honda for 12 days after a March tow and nine more after a June tow. That is 21 days so far toward the 30-day route, which needs no letter to Honda. A freeway stall or a shifting brake pedal may fit the two-repair route, though the facts decide.

Why a Roadside Call Does Not Count as Honda Pilot Lemon Law Notice

Direct notice means telling Honda itself. You need it at least once for the two-repair and four-repair routes when Honda's booklet or manual spelled out that duty clearly and conspicuously. A call to a roadside dispatcher is not a letter to the manufacturer. Write to Honda Automobile Customer Service in Torrance, Mail Stop CHI-5, with your VIN and each breakdown date, and keep a copy.

A Three-Row Rental in a Honda Pilot Lemon Law Refund

Under section 1793.2(d)(2)(B), incidental damages, meaning costs the breakdowns caused, include reasonable towing and rental charges you actually incurred. So a family that bought a Pilot for its third row may need a comparable rental, not a compact sedan. Whether a rental cost is reasonable depends on the facts, and Honda can dispute it. The booklet excludes incidental expenses from loss of use. Still, Civil Code section 1790.1 voids a buyer's waiver of the statute's protections unless the statute allows it. Costs Honda already paid, such as a covered tow, do not come back twice.

The First Tow's Odometer and the Four-Year Clock

Honda may deduct a mileage offset covering the miles you logged before the first delivery for the defect. For a $46,900 Pilot first towed in for a stall at 12,000 miles, price times miles over 120,000 gives $4,690 as arithmetic only. The buyback calculator runs your own numbers. A tow operator's odometer reading at pickup can help pin down that mileage, though a roadside call with no tow does not.

Honda never chose the newer AB 1755 lawsuit rules, an opt-in track some brands took. So Commercial Code section 2725 gives a Pilot sold in 2025 or earlier four years. That period usually runs from tender of delivery. When a warranty explicitly covers future performance and the problem could only surface then, it runs from when the breach is or should have been discovered. A July 2023 delivery sets a default date of July 2027. Honda must name the governing procedure for Pilots sold new in 2026 or later, under Code of Civil Procedure section 871.29, subdivision (d).

Which Receipts Does a Honda Pilot Lemon Law Lawyer Want to See First?

Start with the tow invoices, roadside records and rental agreements from each breakdown. Then add the sales or lease papers, every repair order and the recall letters. In a free consultation, Cline APC checks whether that history supports the presumption and which deadline applies. Call (888) 982-6915 to set it up.

Say your receipts sit in the glove box, a kitchen drawer and your phone. Gather them in date order, because a cost no repair order explains is an easy target. Honda's program is the California Dispute Settlement Program (CDSP Auto Line), which the Department of Consumer Affairs certifies. It must come first only if you want the presumption and Honda sent you timely written notice describing it, under Civil Code section 1793.22(c). Program days also extend the filing deadline.

A civil penalty, an extra award that punishes a violation, may be as much as twice actual damages under section 1794(c) when Honda acted willfully. Honda's certified program usually rules out the subdivision (e) penalty. Under section 1794(d), reasonable attorney fees and costs, if a lawyer represents you, join the judgment only for a buyer who prevails. A Honda Pilot lemon law lawyer can also point owners with records from two stores to a Poway Honda lemon law attorney. Nobody can promise an outcome.

When your papers are together, describe the tows in a message to the firm.
