A Hyundai Tucson lemon law lawyer builds this kind of claim on proof that the event happened. Often a short dated video is that proof.
Hyundai's amended recall report on the braking campaign says no warning appears when the system brakes too early. Repeated failures can lead to a buyback, meaning Hyundai takes the SUV back and refunds you, or to a substantially identical new Tucson as a replacement. In Hyundai lemon law claims, either remedy can follow a reasonable number of failed repair attempts, a count the law leaves to the facts.
Working from La Jolla and Poway, Cline APC accepts lemon law and warranty matters, nothing else.

Why Does a Tucson Lemon Law Lawyer Care When It Brakes Hard on an Empty Lane?
Forward collision avoidance leads Tucson complaints, and Hyundai's report lists no warning when the system brakes early. Hyundai's filings describe other Tucson faults too. A cluster can go black, lights can go out, steering assist can drop away and a shifter can leave Park without the brake.
NHTSA data pulled September 23, 2026, shows 1,409 complaints on 2021 through 2026 Tucson models, and 386 name forward collision avoidance. One complaint can name several components, and each is an owner report, not proof. So put your own words on each order.
- It slammed on the brakes with an open lane ahead.
- The car behind me had to swerve.
- The instrument cluster went black, then came back.
- The headlights or taillights quit at random on my 2022.
- The steering suddenly went heavy with a warning on my 2024.
- The shifter came out of Park without the brake pedal on my 2025.
Say you drive a 2025 Tucson Hybrid on Interstate 5 through Carlsbad, and it brakes hard twice in one week. The first time, no camera was running. The second time, a windshield camera caught the empty lane and the sudden stop.
A Cluster That Goes Black on a Dark Freeway
Campaign 26V047000 covers certain 2025 and 2026 Tucson Hybrid and Plug-In Hybrid models and 2026 Tucsons. Its summary says a software error may make the instrument panel display fail. A later campaign, 26V400000, gives the same description for certain 2025 and 2026 Tucson, Tucson Hybrid and Plug-In Hybrid models. Both updates can arrive over the air or at a dealer. If the cluster goes dark near Rancho Bernardo, film it with the date showing once you are safely stopped.
Which Tucson Recalls Does a Lawyer Check for Your Model Year and Powertrain?
The braking campaign reaches certain 2025 and 2026 Tucson, Tucson Hybrid and Plug-In Hybrid models, and the display campaigns cover 2025 and 2026 as well. A 12-vehicle lighting campaign touched 2022, and steering assist falls on 2024. The shifter campaign covers 2025, and the oil pump controller campaign covers 2023 and 2024.
| Model years | Versions named | Campaign | What to capture |
|---|---|---|---|
| 2022 | Tucson | 21V938000 | Lights going out at night (12 vehicles, all dealer-repaired) |
| 2023 and 2024 | Tucson | 23V526000 | A dated photo of your outdoor parking spot |
| 2024 | Tucson | 24V412000 | The steering warning, filmed only after stopping |
| 2025 | Tucson | 24V877000 | A written report the same day, never a reenactment |
| 2025 and 2026 | Tucson, Hybrid and Plug-In Hybrid | 26V316000 and 26V400000 | The empty lane, the stop and any dark cluster |
| 2025 and 2026 | Tucson with the 2.5-liter engine | 25V549000 | An engine knock recorded while parked |
Say you own a 2024 Tucson and park outside under the oil pump controller advisory. The days the Tucson spends at the dealer for that repair can still count as days out of service. Campaign 25V549000 also reaches the Santa Fe and shapes Hyundai Santa Fe lemon law claims.
What Does the Phantom Braking Recall Mean for a Hyundai Tucson Lemon Law Lawyer?
Campaign 26V316000, which NHTSA received in May 2026, says front camera software may make the system brake earlier than a driver expects. Hyundai counted 376 reports about the system between October 28, 2024, and April 27, 2026. A completed update does not end your rights if the braking continues.
Say the Tucson gets the camera update, and a month later it brakes hard again on State Route 163. That event, on video, goes into the next repair order. Then the recall visit and the new visit can sit in one history for one defect. NHTSA's recall lookup shows whether the update is still open on your VIN.
Campaign 26V316000 and a Camera That Reacts Too Early
Hyundai's amended Part 573 report covers certain 2025 and 2026 Tucson, Tucson Hybrid, Tucson Plug-In Hybrid and Santa Cruz models. It says the system may react too early to objects ahead and brake suddenly. That may raise the risk of a rear-end crash. The report lists no warning at all. Dealers update the front camera software under TSB 26-01-048H, and owner letters were expected July 17, 2026.
Lighting and Steering Assist Campaigns on the 2022 and 2024 Tucson
Campaign 21V938000 covered 12 certain 2022 Tucsons whose control unit software could leave the headlights or taillights inoperative. NHTSA says dealers repaired every affected vehicle, so no owner letters went out. Campaign 24V412000 reaches certain 2024 Tucsons with a power steering circuit board that may short and cut assist. Dealers replace the power pack. Losing assist at speed may be judged likely to cause death or serious bodily injury.
Rollaway and Fire Risk Campaigns on 2023 to 2025 Tucsons
Campaign 24V877000 covers certain 2025 Tucsons whose console wiring may be routed improperly. The transmission may then shift out of Park without the brake pedal, so Hyundai advised using the parking brake until dealers reroute the wiring. Campaign 23V526000 covers certain 2023 and 2024 Tucsons whose Idle Stop and Go oil pump controller may overheat, which is a fire risk. Hyundai advised parking outside and away from structures until the repair.
How Does a Tucson Lemon Law Lawyer Get Dash Camera Video Into the Repair Record?
Play the clip for the advisor at write-up, and ask that the complaint line say you showed video of the event. If the advisor declines, email the clip to the dealership that day and keep the sent message. That way, the dealer's own paperwork ties your footage to a dated visit.
Say the advisor rides along, the system behaves, and the order reads could not duplicate. Under CACI 3202, the jury instruction California courts use, a dealer visit can count even when no repair was made. A Hyundai Tucson lemon law lawyer treats your job as giving Hyundai a fair chance to fix the defect, not diagnosing it.
Locking the Dash Camera File Before the Loop Erases It
California's Vehicle Code describes a video event recorder as one that records in a continuous loop but saves video only when triggered. So an ordinary drive can erase yesterday's braking event. Many cameras save a clip on their own after a hard stop, and many have a button that saves the last few seconds. Then copy the original file the same day, unedited, with a backup in cloud storage.
Dash Camera Mounts California Allows on a Hyundai Tucson
Vehicle Code section 26708 allows a video event recorder in a seven-inch square in the lower windshield corner farthest from the driver. It also allows a five-inch square in the corner nearest the driver, outside any airbag zone, or a five-inch square centered high on the glass. You must post a notice that passenger conversations may be recorded. The recording belongs to the registered owner or the person leasing the car, who may switch the device off. Penal Code section 632 also bars recording a confidential conversation without everyone's consent, so film the road, not the advisor.
Does Video Count as a Repair Visit for a Hyundai Tucson Lemon Law Attorney?
No, but video makes each visit harder to dismiss. Under Civil Code section 1793.22(b), inside 18 months or 18,000 miles, whichever comes first, owners get a presumption, which works as a legal shortcut. The shortcut treats Hyundai as having had a reasonable number of repair attempts if a route is met.
For the statute, a nonconformity must substantially impair use, value or safety. Two repairs qualify when one is likely to cause death or serious bodily injury. Lost steering assist may fit. Any other nonconformity needs four repairs of the same problem. Both visit routes also need one written notice to Hyundai itself, if the handbook disclosed that duty. A shop total beyond 30 cumulative days out of service for repair of nonconformities also works. The presumption is rebuttable. Even without it, section 1793.2(d)(2) can support a claim built on every repair visit.
Say you record a braking event at 2,000 miles but wait until 5,000 miles to book the visit. That delay changes the numbers.
A Video at 2,000 Miles Does Not Start the Tucson Lemon Law Offset
A buyback, called restitution in the statute, refunds the price paid or owed, plus tax, registration and incidental costs such as a tow or rental. You choose between that and a replacement. Hyundai may deduct a mileage offset for driving before the defect first reached the dealer. The formula multiplies the price by the odometer at that first visit and divides by 120,000. For a $36,000 Tucson, a first visit at 2,000 miles means $600, while waiting until 5,000 miles means $1,500. Both numbers are arithmetic only, and the buyback calculator offers a ballpark.
Arbitration Before the Presumption, and a Deadline That Pauses for Shop Time
BBB AUTO LINE holds state certification as Hyundai's arbitration program, according to the Department of Consumer Affairs. With timely written notice of the program from Hyundai, you must try it before invoking the presumption, under section 1793.22(c). Rejecting its decision leaves suit open, and time in the program extends the deadline. Hyundai's handbook says the program may ask for repair orders, so offer your video log too.
The department also lists April 28, 2025 as Hyundai Motor America's opt-in date for the AB 1755 lawsuit procedures, which section 871.30 extends to Tucsons sold in 2025 and earlier. Hyundai must disclose which procedure applies to any Tucson sold new from 2026 on, under section 871.29(d). For the older Tucsons, the section 871.21 deadline requires suit within one year after the applicable express warranty, the written coverage that fits your defect, ends. Nor can suit come more than six years after delivery. Each limit pauses during shop time for a nonconformity, and a pre-suit notice, the written demand in section 871.24, can pause them for up to 60 more days.
That notice matters only before a suit seeking civil penalties, an added award for a willful violation. Hyundai needs it in hand 30 days or more before filing. Hyundai keeps penalties out by offering a remedy by day 30 and completing it by day 60. Missing either date leaves them available.
Can a Hyundai Tucson Lemon Law Lawyer See What the Dealer Never Saw?
Yes, once the clips and the orders sit side by side. Copy the clips to one folder, then gather your contract, each repair order, the event log and emails to the dealership. Book a free consultation through Cline APC at (888) 982-6915, and the review pairs each clip with a visit.
Say your event log names each file by date, time, odometer and road. That log lets a Hyundai Tucson lemon law lawyer match each clip with the next order.
Civil Code section 1794(d) makes Hyundai pay reasonable attorney fees and costs only if a buyer prevails. Nobody can promise how a Tucson claim ends. Cline APC also meets Hyundai owners in Poway.
