A Hyundai lemon law lawyer treats that stack of orders as evidence and starts by grading the defect. A new or leased Hyundai that its dealers still cannot fix after a reasonable number of repair attempts may be bought back or replaced under California lemon law. That phrase means the fair number of chances Hyundai gets.

A buyback means Hyundai repurchases the vehicle, and a replacement means a substantially identical new Hyundai. The Department of Consumer Affairs (DCA) also lists Hyundai Motor America among automakers that elected AB 1755's newer lawsuit procedures, with an April 28, 2025 date.

Civil Code section 1793.22(e)(2) takes in a Hyundai bought or used mainly for household, family or personal purposes. Dealer-owned cars and demonstrators qualify when sold with Hyundai's new car warranty. Business cars qualify at under 10,000 pounds gross vehicle weight, with no more than five vehicles registered to the business in California. Also, a lessee, the person who leases, gets the same rights as a buyer under Civil Code section 1795.4.

Consumer warranty and lemon law disputes are the only cases Cline APC takes, at its La Jolla and Poway offices. When one Hyundai failure keeps sending you back, call (888) 982-6915.

Which Hyundai Defects Does a Lemon Law Lawyer Treat as Dangerous, Stranding or Costly?

Hyundai's recall filings on recent models fall into three tiers. Steering, airbag and braking faults threaten safety. Charging unit, transmission and engine failures can strand the car. Finally, tow wiring faults cut into use or value. Each tier changes how many repair visits the law expects before Hyundai must act.

Civil Code section 1793.22(e)(1) says a defect counts as a nonconformity when it substantially impairs the vehicle's use, value or safety to the buyer or lessee. A steering failure meets that test, while a trim rattle may not.

ModelModel yearsWhat Hyundai's campaign describesClaims

Say the steering assist on your 2024 Tucson drops out twice on State Route 163, and the dealer works on it each time. Campaign 24V412000 covers that fault on certain 2024 Tucsons. So those two visits may count toward the fastest route to the presumption, a legal shortcut.

Safety-Tier Campaigns on the Tucson and Santa Fe

On certain 2024 Santa Fes, campaign 24V561000 covers floor wiring that may chafe, which Hyundai says can fire the airbags or keep them from deploying. Campaign 25V809000 covers side curtain airbags that may be installed improperly on certain 2025 Tucsons and 2025 and 2026 Santa Fes. Also, campaign 26V218000 covers front seat belt anchors that may detach on certain 2024 through 2026 Santa Fes.

ICCU Failures That Leave an Ioniq 5 on the Shoulder

Hyundai's report on campaign 24V868000 says the Integrated Charging Control Unit, or ICCU, can stop charging the 12-volt battery. Warnings may then build over about 20 to 40 minutes before drive power fades. Whether a power loss is likely to cause death or serious bodily injury is a question of fact. So for a stranded Hyundai, the days in the shop are often the stronger route.

How Does a Lawyer Compare a Hyundai Buyback With a BBB AUTO LINE Award?

The buyback California enforces is the repurchase or replacement in Civil Code section 1793.2(d)(2), and you choose between them. BBB AUTO LINE, the state-certified arbitration program Hyundai sponsors, can award a similar refund. But Hyundai's handbook says its awards leave out attorney fees and civil penalties, the added award a court can make for a willful violation.

Restitution is the statute's word for a buyback. It returns the price plus incidental damages, meaning costs the defect caused you. Hyundai may then subtract a mileage offset for miles logged before you first brought the defect in for repair. The written demand called a pre-suit notice is needed only before a suit that seeks civil penalties.

ItemSong-Beverly repurchase on Hyundai's elected trackBBB AUTO LINE repurchase award
Price, tax, registration and official feesReturnedReturned

Civil penaltiesUp to twice actual damages for a willful violation under 1794(c)Not included, per the handbook
TimingPenalties stay out with an offer by day 30 and completion by day 60 after the pre-suit notice arrivesDecision should come within 40 days of a completed claim form, per the handbook

Take a $43,500 Santa Fe that first went in for the defect at 6,400 miles. Multiply the price by 6,400 and divide by 120,000, and the offset is $2,320. Still, your contract sets the real figure. Try the buyback calculator, and share Hyundai's written offer with the firm before you sign.

Every Item a Hyundai Repurchase Must Return

On the elected track, Code of Civil Procedure section 871.27 adjusts the refund. Outside sellers' service contracts and GAP coverage stay out, while the selling dealer's products stay in. Negative equity from a trade-in comes off, and Hyundai's own rebate never counts as price.

Under subdivision (g)(2), Hyundai must complete an agreed buyback or replacement within 30 days after it receives the release you signed through counsel. A $50 daily penalty follows, unless the parties agree otherwise or you did not cooperate in good faith.

Opting Out of Hyundai's Handbook Arbitration Clause

Hyundai's handbooks for the 2022, 2025 and 2026 model years print a section called Binding Arbitration for California Vehicles Only, and your own handbook may differ. The 2026 version lets either side choose arbitration under American Arbitration Association rules, even after a suit is filed. Whether a court will enforce it against a Song-Beverly claim is contested. The handbook lets you reject the clause by emailing the opt-out address printed there within 30 days of the purchase or lease.

BBB AUTO LINE, which DCA certifies for Hyundai and Genesis, is a separate program. If Hyundai told you about the program in writing and in time, section 1793.22(c) requires you to try it before relying on the presumption. Hyundai is bound only by a decision you accept, and program days extend the filing deadline.

Why Does a Hyundai Lemon Law Lawyer Ask Who Owned the Car First?

Because Hyundai's powertrain coverage turns on it. The 2026 handbook gives the original owner 10 years or 100,000 miles on the powertrain, whichever comes first. A second owner gets 5 years or 60,000 miles, whichever comes first. The New Vehicle Limited Warranty runs 5 years or 60,000 miles, whichever comes first.

Ownership also decides whether the lemon law reaches the car. The state Supreme Court decided Rodriguez v. FCA US, LLC in 2024 (17 Cal.5th 189). Under it, leftover factory coverage does not make a used Hyundai a new motor vehicle, unless Hyundai's new car warranty was issued with that sale. The court did not consider certified pre-owned programs, so the new-vehicle remedy usually does not reach a certified Hyundai, though the question stays open.

Say you bought a 2023 Santa Fe from Hyundai of El Cajon. Its air conditioning blows warm along State Route 52, and three visits fix nothing. That defect threatens no crash, so a Hyundai lemon law lawyer counts it under use.

The Hyundai Lemon Law Presumption Graded by Severity

Civil Code section 1793.22(b)'s presumption treats Hyundai as having had a reasonable number of repair attempts when its conditions occur within 18 months or 18,000 miles, whichever comes first. Two repairs qualify for a nonconformity likely to cause death or serious bodily injury. Anything else qualifies after four repairs of the same nonconformity. Either of those two routes needs direct notice, a letter or email to Hyundai itself, at least once where the handbook disclosed that requirement. More than 30 cumulative days out of service for repair of nonconformities qualifies too, with no notice needed. Say your Santa Fe sat at Dalton Hyundai in National City for 19 days in March and 14 in July of its first year for the same transmission fault. Those 33 cumulative days pass the 30-day route.

The presumption is rebuttable, and it is not the only path. The New Vehicle Limited Warranty outlasts the window, so later visits still count under section 1793.2(d)(2). Oregel v. American Isuzu Motors (2001) 90 Cal.App.4th 1094 would not make a buyer find the cause of a defect the dealer never located.

Where Hyundai Wants Its Lemon Law Letters Sent

The 2026 handbook sends direct notice to Hyundai Customer Care, P.O. Box 20850, Fountain Valley, CA 92728. The pre-suit notice goes by certified or registered mail, return receipt requested, to P.O. Box 8010 in Fountain Valley. It can also go to the email address Hyundai posts for California written notices.

Civil Code section 1795.6 also requires each work order to show the drop-off date and when you were told the car was ready. Those dates are how the 30-day route gets proved.

What Do Hyundai's Own Recall Filings Prove to a Lemon Law Attorney?

A recall shows that Hyundai found a defect across a group of vehicles. It does not prove your Hyundai has a nonconformity, and a recall repair alone does not create a claim. If recall work meant for your defect fails to cure the symptom, that visit can count as an attempt.

Complaints are unverified owner reports. Picture a leased 2024 Tucson in Mira Mesa whose center screen freezes and takes the backup camera with it. No campaign has to name that fault for a Hyundai lemon law lawyer to count your visits. Before each appointment, check NHTSA's recall lookup for open campaigns on your VIN.

Tow Hitch Wiring Faults Count Against Use

Campaign 25V893000 covers certain 2022 through 2024 Tucsons with an optional Mobis tow hitch wiring kit. Hyundai says water in the kit's control module may disable trailer lights or short the circuit, a fire risk. It advises parking outside, away from structures, until the repair. The listed remedy removes that wiring and caps the socket. If you bought the Tucson to pull a small trailer, that fix may take away a use.

Can a Hyundai Lemon Law Attorney File in Year Seven of a 10-Year Warranty?

Usually not. Hyundai Motor America opted into the AB 1755 procedures on April 28, 2025, putting many of its cars on an elected track with separate deadlines. Section 871.21 then requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. Repair stays and a pre-suit notice can pause both limits.

The applicable warranty is the coverage that fits your defect. Under Code of Civil Procedure section 871.21, subdivision (c) stops both clocks while the car is out of service for repair of a nonconformity. Serving a pre-suit notice also stops them, for no more than 60 days.

Section 871.30 carries Hyundai's election to vehicles sold through the end of 2025. When Hyundai sells a vehicle new from 2026 on, it must name the procedure that governs, under section 871.29(d). If older rules apply, Commercial Code section 2725's four years run from tender of delivery. For a warranty explicitly extending to future performance, where discovery must await that performance, the period runs from when the breach is or should have been discovered. Kia lemon law claims and Honda lemon law claims each get their own DCA check.

Say you took delivery of a new Santa Fe on June 14, 2025, and its engine fails years later. One year past the powertrain term could reach 2036 on a low-mileage car. Yet the six-year limit falls on June 14, 2031, before any pause, so a Hyundai lemon law lawyer dates the claim from delivery.

Selling a Hyundai While a Lemon Law Demand Is Pending

Section 871.24 calls for the pre-suit notice only when a suit will seek civil penalties. It goes to Hyundai 30 days or more ahead of filing. Include your name, the VIN, a short repair history and your demand for a buyback or replacement. Hold the car when you send it, then at least 30 days past Hyundai's receipt, or 60 if Hyundai makes an offer.

From receipt, Hyundai has 30 days to offer a remedy, plus reasonable attorney fees and costs when you have counsel, and 60 days to complete it. Meeting both dates keeps civil penalties out, while missing either leaves them available. Without an offer by day 30, you may sell the car. But subdivision (i) keeps a penalty claim alive only if you first told the buyer about your demand and any pending suit in writing. Cline APC also handles Hyundai lemon law claims for Poway owners.

Can a Hyundai Lemon Law Lawyer Sort My Repair Orders by Severity?

Yes. Bring every repair order, including visits that found no problem. Add the contract, recall letters, tow and rental receipts and any Hyundai Customer Care case number. A free consultation at (888) 982-6915 lets Cline APC grade each complaint and name the deadline track governing your Hyundai.

Say you clipped an Interstate 805 tow receipt to each Ioniq 5 charging repair order. Then a Hyundai lemon law lawyer can match every tow to a visit and a date.

Cline APC meets Hyundai owners at its La Jolla office and in Poway, and nothing goes to Hyundai until you decide. Nobody can promise the outcome. Civil Code section 1794(d) moves reasonable attorney fees and costs onto Hyundai only for a buyer who prevails.
