California lemon law covers a new or leased Kia that Kia's dealers cannot fix after a reasonable number of repair attempts. That means the fair number of tries the law allows Kia. How you paid then shapes the refund.

Kia America, Inc. sits on the opt-in roster the Department of Consumer Affairs (DCA) keeps for the 2025 procedures, dated May 1, 2025. That makes Kia an electing manufacturer, with Kias sold in 2025 or earlier on the elected track. The phrase means the newer deadlines and notice rules in Code of Civil Procedure sections 871.20 to 871.30. The Kia still has to qualify under Civil Code section 1793.22(e)(2). Kias bought or used primarily for personal, family or household purposes count, as do demonstrators sold with the new car warranty. A business Kia counts under 10,000 pounds gross vehicle weight if the business has no more than five vehicles registered in California.

Cline APC limits its practice to lemon law and consumer warranty claims. The firm's offices sit at 7855 Ivanhoe Avenue, Suite 400, in La Jolla and 14280 Danielson Street in Poway.

If the same Kia defect keeps returning, call (888) 982-6915 and keep the contract within reach.

Which Kia SUVs Keep Sending San Diego Owners to a Lemon Law Lawyer?

The National Highway Traffic Safety Administration (NHTSA) lists 14 recall campaigns for 2021 to 2026 Tellurides. It lists 17 for the Sorento and 11 for the Sportage, counted September 29, 2026. Still, a recall never proves by itself that your own Kia has a nonconformity, a defect that substantially impairs use, value or safety.

ModelModel years countedWhat Kia's own filings describeClaims
Telluride2021 to 2026Front power seat motors that may overheat. Campaign 26V430000 superseded 24V407000 and names an improper 24V407 repair as one possible causeKia Telluride claims
Sorento2021 to 2026On some 2021 and 2022 turbo models with the 8-speed dual-clutch, a fail-safe drive mode that may be impaired, risking a complete loss of drive power (22V760000)Kia Sorento buybacks
Sportage2021 to 2026On certain 2023 models, a brake booster that may leak vacuum and lose power brake assist (23V410000)Kia Sportage lease claims

Say your 2022 Telluride had the 24V407000 seat work in 2024. Then the seat stuck and smelled hot again the next spring, and the 26V430000 letter arrived. If the seat defect is a nonconformity, a Kia lemon law lawyer can count each visit that addressed it as an attempt at one problem.

When Does a Kia Problem Count as a Nonconformity?

Civil Code section 1793.22(e)(1) supplies that test. A rattle may not meet it, but lost drive power usually does. EV6 charging unit campaign 24V867000 superseded 24V200000 after Kia counted 88 cases alleging lost drive power following the first remedy.

Section 1793.22(b) then supplies a presumption. It treats Kia as having had a reasonable number of repair attempts once certain events occur within 18 months or 18,000 miles, whichever comes first. Two or more repairs of a nonconformity likely to cause death or serious bodily injury qualify. So do four or more repairs of the same nonconformity. Either repair route also requires direct notice, a written report to Kia itself, at least once if Kia's warranty materials clearly required it. More than 30 cumulative days out of service for repair of nonconformities also works without any notice. Still, Kia may try to rebut the presumption, and a claim may still succeed on the full record of repairs after the window closes.

Kia Repair Orders and the Lines Worth Checking at Pickup

At write-up, describe the symptom in plain words and ask the advisor to copy them onto the order. At pickup, check the drop-off date, the ready date, the mileage and any campaign number. An order that says no problem found should still show your complaint. Leave Kearny Mesa Kia with only a text saying the car is ready, and you have no dated copy of that visit.

Is a Kia Buy Back Program the Same as the Refund a Lemon Law Attorney Demands?

Many owners search for a Kia buy back program. Yet the refund comes from Kia's duty under Civil Code section 1793.2(d)(2). Once Kia cannot fix a new vehicle after a reasonable number of attempts, it must promptly replace it or make restitution. You choose which, and Kia can never force a replacement on you.

Restitution means the buyback refund itself, while a replacement is a substantially identical new Kia with the normal new-vehicle warranties. For a Kia sold in 2025 or earlier, section 871.27 of the Code of Civil Procedure also changes several lines of the math.

Line itemHow a compliant Kia repurchase handles itSource
Price paid or payable, with transportation and factory options, plus tax and official feesPaid backCivil Code 1793.2(d)(2)(B)

Incidental damages are the costs the defect caused you. Say you financed a Carnival at North County Kia in early 2025 with $5,500 of old debt rolled in. Before accepting a number, call (888) 982-6915 and try the buyback calculator.

Lease, Loan, or Cash and What Each Kia Refund Returns

A lessee, meaning whoever leases the Kia, has the rights a buyer would have under Civil Code section 1795.4(b). On a lease, your share tracks what you paid. Take a Niro with $2,999 due at signing and 20 payments of $419, which total $11,379 before the mileage offset. On a loan, section 871.27(g)(3) has Kia hand over your refund at the car's return. Kia must fund the lender's payoff within one business day of the return. A cash buyer who paid $38,500 for a Sorento after a $2,000 rebate off $40,500 starts from $38,500. The real figure depends on your own contract.

How Rolled-In Negative Equity Shrinks a Kia Lemon Law Buyback

Negative equity is what you still owed on a trade-in beyond the dealer's credit for it. In the Carnival example, the price was $42,000 and the $5,500 shortfall rode into the new loan. Section 871.27(c) lets Kia take that $5,500 back out of the refund. For the mileage offset, Kia multiplies the price by the odometer miles at the first shop visit for that defect, then divides by 120,000. If the first sliding-door visit came at 3,000 miles, the offset is $1,050. Contracts rarely print the words negative equity, so a Kia lemon law lawyer looks for a trade-in payoff larger than the allowance.

Which Kia Warranty Term Starts the Clock a Lemon Law Attorney Watches?

Kia's warranty page lists a New Vehicle Limited Warranty of 5 years or 60,000 miles from first service, whichever comes first. Its Powertrain Limited Warranty, for original purchasers and Certified Pre-Owned buyers, runs 10 years or 100,000 miles from first service, whichever comes first. On the elected track, the coverage fitting your defect usually starts the one-year filing clock.

Electric Kias add an EV System Warranty of 10 years or 100,000 miles, whichever comes first. It covers the motor, high-voltage battery, power control unit and on-board charger. The Warranty and Consumer Information Manual for your model year controls. Say you bought a new K5 in March 2022 and commute on Interstate 15 from Escondido. It passes 60,000 miles in April 2025, which ends the basic coverage. So for a defect only that warranty covers, a Kia lemon law lawyer would start the one-year window in April 2025, before any pause.

A Kia Lessee Counts as First Purchaser for Powertrain Coverage

Civil Code section 1795.4(a) covers warranties that limit a benefit to the original purchaser. For those, the leasing company and the lessee each count as that first purchaser. Kia ties its 10-year powertrain term to the original purchaser, so a lessee keeps that status. As a result, a transmission defect on a leased Kia can sit under powertrain coverage after the basic term ends.

Certified Pre-Owned Kias and Leftover Powertrain Years

Kia extends powertrain coverage to the buyer of a Certified Pre-Owned Kia, counted from the car's first service. Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that a used car does not become new just because some factory warranty remains. That holds unless the manufacturer's new car warranty was issued with that sale. The court did not rule on certified programs. So a certified Kia usually stays outside the remedy for new vehicles, and the question remains open. A dealer that wrote its own warranty on a used Kia may still face a claim under Civil Code section 1795.5.

Does a Kia Recall Make Your SUV a Lemon, and What Do the Totals Tell an Attorney?

No. A recall repair is one dated visit on your record, not proof of a nonconformity. Yet it counts toward the history when it addresses the problem you reported. Finishing a Kia campaign also does not close the file when the symptom comes back, as the redone Telluride seat-motor recall shows.

Kia model, 2021 to 2026 model yearsNHTSA recall campaignsNHTSA owner complaints
Telluride141,227
Sorento17603
Sportage11609

NHTSA's data gave those counts on September 29, 2026, and they move daily. Complaints are owner reports, not findings. Picture a Sorento owner in Santee who runs the VIN through NHTSA's recall lookup the night before a consultation. Two campaigns come back with no matching order.

The Telluride Seat-Motor Campaign That Needed a Second Fix

Kia filed campaign 24V407000 on June 5, 2024, for certain 2020 to 2024 Tellurides whose front power seat motor may overheat. On July 2, 2026, Kia filed 26V430000 to supersede it, naming an improper 24V407 repair as one possible cause. Its remedy is an electronic fuse assembly. If the seat actually failed, a visit under each campaign can count as a dated attempt at one defect.

What Happens in Kia's 30-Day Answer Window After a Kia Lemon Law Lawyer Sends Notice?

Section 871.24 of the Code of Civil Procedure calls for a pre-suit notice. That is a written demand required only if you plan to sue for civil penalties, extra sums beyond the refund. For a Kia sold in 2025 or earlier, Kia needs it 30 or more days before the suit begins. Kia's form says it replies within 30 days.

From receipt, Kia has 30 days to offer restitution or replacement, plus reasonable fees and costs if you have a lawyer. Completion must come within 60 days of receipt. If Kia meets both dates, the case loses its civil penalties. If Kia misses either, they remain available. Keep the Kia at least 30 days after Kia receives the notice, or the full 60 if Kia makes an offer. Say your K4 lease ends 45 days after receipt, and Kia offers on day 25. The hold then runs past turn-in, so a short extension may bridge it.

Separately, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. That warranty means the written coverage Kia gave for the defect. Subdivision (c) stops both clocks for each day the Kia spends in the shop for repair of a nonconformity. It also stops them for up to 60 days after a pre-suit notice.

Online Form or Certified Letter for a Kia Lemon Law Notice

Kia takes the notice through a form labeled CA Lemon Law Notice, linked in the footer of its owner website. Mail also works if it goes certified or registered with a return receipt, addressed to Kia America, Inc., Dept. CC-AB1755, P.O. Box 52410, Irvine, CA 92619-2410. The notice names you, gives the accurate VIN, sums up the repair history and demands repurchase or replacement. You must possess the Kia when it goes out.

Kias Sold New in 2026 and the Delivery-Day Disclosure

Kia's May 1, 2025, election reaches Kias sold in 2025 and earlier under section 871.30. Kias sold new in 2026 or later get a different notice. At the sale, Kia must tell you which procedure governs the car, because section 871.29(d) requires it. If it names the newer chapter, the one-year and six-year limits apply. If it names the older Civil Code procedures, Commercial Code section 2725 sets four years from tender of delivery. The exception is a warranty that explicitly extends to future performance, when discovery must await that performance. In that case, the four years run from when the breach is or should have been discovered.

The BBB AUTO LINE Step Kia's Paperwork Can Require

BBB AUTO LINE is the state-certified arbitration program DCA lists for Kia. Where Kia disclosed the program to you in writing on time, section 1793.22(c) makes a filing there come before any reliance on the presumption. DCA says decisions usually come within 40 days after the program gets your application. A decision you accept binds Kia, which must perform within a reasonable time that cannot exceed 30 days from your acceptance. Reject it, and the lawsuit and the presumption stay open, while program days extend your deadline.

Can a San Diego Kia Lemon Law Lawyer Read Your Lease or Loan Before Kia Answers?

Yes. Bring the lease, the retail installment contract or the cash buyer's order, with every repair order and recall letter. Reach Cline APC at (888) 982-6915 and book a free consultation. A lawyer sets those papers side by side and names the deadline track for your Kia.

Say you pulled the loan statement, the payoff letter and two tow receipts from the glove box. A Kia lemon law lawyer ties each one to a visit or to the offset math.

The firm meets Kia owners at its La Jolla and Poway offices. No lawyer can promise the outcome of a claim. Under Civil Code section 1794(d), a buyer who prevails recovers costs and reasonable attorney fees, if a lawyer represents you.

When you have the papers in hand, message the firm about your Kia.
