Kia opted into the newer lemon law chapter, called the elected track, for vehicles sold in 2025 or earlier. So for those Sorentos, Code of Civil Procedure section 871.27, subdivision (c) lets Kia pull that rolled-in balance back out of a buyback.
A buyback, or restitution, is the refund Kia owes when it takes a defective vehicle back. A Sorento that keeps returning for the same hesitation can qualify for one, or for a replacement, meaning a substantially identical new Sorento. The defect must be a nonconformity, meaning it substantially impairs the Sorento's use, value or safety. The test is whether Kia fixed it within a reasonable number of repair attempts, a number no statute fixes.
Lemon law and consumer warranty cases are all Cline APC handles, from offices in La Jolla and Poway.

Is a Sorento That Hesitates or Loses Drive Power Worth a Call to a Lemon Law Lawyer?
It can be. Owners of 2021 to 2026 Sorentos had filed 603 complaints with the National Highway Traffic Safety Administration (NHTSA) by September 29, 2026. The engine appears in 174, while the power train appears in 161 and the electrical system in 145. Those are owner reports, not findings, but they show where complaints cluster.
Kia's own recall filings also describe warnings worth putting on a repair order in your words.
- A chime, a stop safely immediately message and a warning light, then lost drive power
- An engine knocking noise
- A blower that quits, a burning or melting smell, or smoke from the vents
- Low beams and taillights that shut off
- Steering assist that drops out
- Signs of a fuel leak on a 2022 plug-in hybrid
Say your 2023 Sorento from Kearny Mesa Kia hesitates and shudders on the climb up State Route 52. No campaign names that symptom, yet each visit where you report it still goes on the record.
Which Sorento Years and Powertrains Does a Kia Sorento Lemon Law Lawyer Check First?
The 2022 model year alone accounts for 223 of the 603 complaints. NHTSA also lists 17 recall campaigns across 2021 to 2026 Sorentos. They split by year and by gas, hybrid and plug-in hybrid versions. So a Kia Sorento lemon law lawyer matches each campaign to the years and powertrain it names.
| Model years | Version | Campaign | What Kia's filing describes | Remedy |
|---|---|---|---|---|
| 2021 | Gas, 2.5-liter turbo | 21V519000 | Fuel may leak where the high-pressure pump meets the fuel rail | Pipe tightened or replaced |
| 2021 and 2022 | Hybrid, and 2022 plug-in hybrid | 22V447000, replacing 22V127000 for 2022 | Front seat belt pretensioners may explode on deployment | Pretensioners capped |
| 2022 | Gas, turbo | 22V202000 | Turbocharger oil supply pipe may crack and leak (26 SUVs) | Pipe replaced |
| 2021 and 2022 | Gas, 2.5-liter turbo with 8-speed dual-clutch | 22V760000 | Fail-safe drive mode may be impaired after an oil pump fault | Transmission checked, replaced as needed, new software |
| 2022 | Plug-in hybrid | 23V027000 | Fuel tank may leak | Tank replaced as needed |
| 2024 | Gas | 24V287000 | Power steering wiring may be assembled wrong (95 SUVs) | Wiring repaired or replaced |
| 2024 and 2025 | Gas, plus 2025 hybrid and plug-in hybrid | 25V006000 | Software may cut the low beams and taillights | Software update |
| 2025 | Gas, 2.5-liter turbo (one SUV) | 25V548000 | Connecting rod bolts may be improperly tightened | Sub engine replaced |
| 2021 to 2023 | LX trim | 25V649000 | Blower motor wiring may overheat | Wiring and resistor replaced |
Other campaigns cover a tow hitch module, rear camera clips, spare tires, visor labels and 2025 to 2026 display software. For example, say you own a 2022 plug-in hybrid. The pretensioner and fuel tank rows can match your VIN, but the transmission row cannot, because 22V760000 names the gas turbo.
What Did Kia Change in the Sorento Engine and Transmission Recalls a Lawyer Reviews?
Campaign 22V760000 has dealers inspect the transmission on certain 2021 and 2022 Sorentos, replace it as needed and update its software. Campaign 25V548000 also replaces the sub engine on one 2025 Sorento whose connecting rod bolts may have been improperly tightened. So if the same symptom returns after either visit, the repair count keeps going.
Kia's report for 22V760000 covers 65,612 turbo dual-clutch Sorentos built at Kia Georgia from October 26, 2020, through August 25, 2022. It warns of chimes, a stop safely immediately message and the malfunction light. The SUV may then drive normally for 20 to 30 seconds before it loses all drive power. Picture a 2022 Sorento that loses power merging onto Interstate 805 from State Route 52 after the recall visit. That event belongs on a new repair order.
Is a Sorento Engine Still Inside Kia's 10-Year Coverage?
On Kia's warranty page, the original purchaser gets a Powertrain Limited Warranty of 10 years or 100,000 miles, whichever comes first. It runs from the date of first service. For example, it covers the engine, transmission, axles and differentials. The New Vehicle Limited Warranty, at 5 years or 60,000 miles, whichever comes first, covers most other components. Still, the manual for your model year controls. On Kia's elected track, the coverage that fits the defect sets the one-year filing clock.
Sorento Campaigns That Touch the Lights, the Steering and the Blower
Campaign 25V649000 covers 2021 to 2023 Sorento LX models built at Kia Georgia. Kia's report says the blower resistor connection can overheat on fan speed 3. Its listed warnings are a dead blower, a burning smell or smoke from the vents. Depending on the facts, lost steering assist or dark headlights may count as a nonconformity likely to cause death or serious bodily injury.
Campaigns Only Sorento Hybrid and Plug-In Owners Get
Campaign 22V447000 caps seat belt pretensioners on 2021 and 2022 hybrids and 2022 plug-in hybrids. It expanded and replaced 22V127000, which covered only 2022 models, so SUVs fixed under 22V127000 need the cap too. On the 2022 plug-in hybrid, 23V027000 covers a fuel tank that may leak. For the 2025 plug-in hybrid, 24V920000 adds a cover because the steering rack may damage the fuel line in a crash.
Does a No Problem Found Visit Still Count for a Sorento Lemon Law Attorney?
It can. When you report the symptom and the dealer finds nothing, the order still records a chance Kia had to fix it. So the order should carry your description every time. It should also name any campaign already done when a symptom returns, and show the days the Sorento sat at the dealer.
Say the dealer updates software at 4,000 miles, replaces a sensor at 7,800 miles and finds nothing at 11,000. By the fourth visit, you have spent 26 days without the SUV. So the question is no longer whether the Sorento has a problem, but whether Kia has had enough chances.
How Many Repair Visits Before a Kia Sorento Lemon Law Lawyer Can Seek a Buyback?
No statute sets one number. Instead, Kia owes a buyback or replacement once it cannot fix the defect in a reasonable number of attempts. Civil Code section 1793.22(b) adds a presumption. It treats Kia as having had them when certain repair events occur within 18 months or 18,000 miles, whichever comes first.
The first route needs two or more repairs of a nonconformity likely to cause death or serious bodily injury. The second route needs four or more repairs of the same nonconformity. For both of those routes, Kia must have received direct notice, your own written report to Kia, at least once where its materials clearly required it. The third route is more than 30 cumulative days out of service for repair of nonconformities, and it needs no notice. Kia can rebut the presumption.
Even so, Cline APC's Kia lemon law lawyers can still build a claim on the full repair history after the window. Say the fourth hesitation visit lands at about 14,000 miles and inside 18 months, with 26 days already out of service. That reaches the four-repair route if the notice condition is met, while the days route still needs more than 30.
The $6,200 Rolled-In Balance in a Kia Sorento Lemon Law Refund
Negative equity is what you owed on the old SUV beyond its trade-in allowance. For example, take a $38,000 price, $3,600 in taxes and fees and the $6,200 rolled in, for $47,800 before interest. On Kia's elected track, section 871.27(c) removes the $6,200, leaving $41,600. First repair visit for the defect at 6,000 miles? The mileage offset, Kia's deduction for miles before that visit, is $38,000 times 6,000, divided by 120,000, or $1,900. Add a $400 rental, and restitution comes to $40,100. Subdivision (d) keeps a Kia rebate out of the price, and it cannot shrink the negative equity offset. The lender's payoff is due from Kia within one business day of the return. Still, your own contract sets the real figures.
Filing Clocks and the 30-Day Offer on Kia's Electing Track
Kia's May 1, 2025, election, applied by section 871.30, reaches Sorentos sold in 2025 and earlier. For those Sorentos, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. In other words, the applicable warranty is Kia's written coverage for the defect. Days out of service for repair of a nonconformity pause both limits.
A pre-suit notice also pauses them, for up to 60 days. That notice is a written demand required only before a suit seeking civil penalties, which are extra sums beyond a refund. Kia needs it in hand at least 30 days before you file, while you still possess the Sorento. Kia takes it through its CA Lemon Law Notice form, or by certified or registered mail, return receipt requested, to its Irvine post office box. An offer within 30 days of receipt, completed within 60, removes civil penalties, and missing either keeps them available.
Timely written notice from Kia about BBB AUTO LINE, its state-certified program, means you file there before relying on the presumption, under section 1793.22(c). For a Sorento sold new in 2026 or later, section 871.29(d) requires Kia to name the governing procedure at the sale. If it names the older Civil Code procedures, the section 871.27(c) offset does not apply.
Checking a Kia Sorento Lemon Law Offer Line by Line
First, the negative equity line in Kia's offer should match the gap between your trade-in allowance and payoff. Then check that the rebate did not inflate that offset. Under section 871.27(b), service contracts the selling dealer supplied stay recoverable. Once Kia receives the release signed through your counsel, it has 30 days to complete an agreed buyback. Past that date, Kia owes a $50 daily penalty, unless the parties stipulate otherwise or your own lack of good-faith cooperation caused the delay. Run your own numbers in the buyback calculator first.
Should a Kia Sorento Lemon Law Lawyer Check the Trade-In Numbers Before You Sign?
Yes, before you accept any Kia offer. The buyer's order, the retail installment contract and the old lender's payoff letter tell the negative equity story. A free consultation at Cline APC sets them beside your repair orders and shows what a buyback could return.
Say Kia's offer letter arrived last week and your latest loan statement sits beside it. A Kia Sorento lemon law lawyer compares the two, line by line, before you answer.
Cline APC also handles Kia Telluride claims and leased Sportage claims. If you prevail, Civil Code section 1794(d) lets you recover costs and reasonable attorney fees when a lawyer represents you. No one can promise a result.
