Kia's 2025 election brings in rules that tie certain steps to having the vehicle, set out in Code of Civil Procedure section 871.24.
Under Civil Code section 1795.4(b), a lessee, the person leasing the vehicle, has the same rights against Kia as a buyer. So a leased Sportage that keeps going back for the same brake, steering, stalling or screen defect can qualify for a buyback. The defect must be a nonconformity, meaning it substantially impairs use, value or safety. A buyback, called restitution, means Kia takes the SUV back and refunds what you paid, while a replacement is a substantially identical new Sportage. Hand the Sportage in first, though, and the possession steps in section 871.24 may be out of reach.
Cline APC does lemon law and consumer warranty work and nothing else. Its La Jolla office is at 7855 Ivanhoe Avenue, Suite 400, and its Poway office at 14280 Danielson Street.
When your leased Sportage keeps going back as turn-in nears, call (888) 982-6915. Keep the lease and its maturity date nearby.
Does a Hard Brake Pedal, a Stall or a Blank Dash on a 2023 Sportage Need a Lawyer?
It may. Owners of 2021 to 2026 Sportages had filed 609 complaints with the National Highway Traffic Safety Administration (NHTSA) by September 29, 2026. Of those, 303 concern the 2023 model year. The electrical system and the engine lead the named systems, while service brakes draw 74 and forward collision avoidance 72.
Each complaint is one owner's report, so it proves nothing about your own Sportage. Still, Kia's own recall filings describe symptoms worth writing on a repair order.
- The brake pedal feels hard and takes more effort to stop the SUV
- The engine stalls or the electrical system surges
- Steering assist cuts out
- The 4.2-inch cluster shows nothing at startup, hiding the tire pressure warning
- The instrument screen reboots while driving on some SUVs with a Kia tow hitch accessory
Say your leased 2023 Sportage still needs a hard push on the pedal coming down State Route 94. That symptom belongs on the next order, in your words, even after recall work.
Which Sportage Model Years Should a Kia Sportage Lemon Law Lawyer Check Against Your VIN?
Start with 2023 models. That year draws about half the complaints and appears in 7 of the 11 campaigns NHTSA lists for 2021 to 2026 Sportages. Next come 2024 and 2025 models with the 4.2-inch screen and a Genuine Kia tow hitch accessory.
| Model years | Version | Campaign | What Kia's filing describes | Owner letters |
|---|---|---|---|---|
| 2021 | Gas | 21V137000 | Anti-lock brake unit may short, risking an engine fire | Recall began April 30, 2021 |
| 2023 | Gas | 22V651000 | Alternator nut may loosen, risking a stall or surge | September 23, 2022 |
| 2021 and 2022 | Gas, with a Kia tow hitch wiring module | 22V703000 | Tow hitch module may short, risking fire | August 11, 2023 |
| 2023 | Gas | 22V878000 | Side curtain airbags may be twisted | December 28, 2022 |
| 2023 | Gas, hybrid, plug-in hybrid with the 4.2-inch cluster | 23V298000 | Cluster may show nothing at startup | May 26, 2023 |
| 2023 | Gas | 23V410000 | Brake booster may leak vacuum and lose power assist | July 21, 2023 |
| 2023 | Gas | 23V531000 | Idle Stop and Go oil pump controller may overheat | Expected September 28, 2023 |
| 2023 and 2024 | Gas | 24V025000 | Roof molding may loosen and detach | March 15, 2024 |
| 2024 | Gas | 24V422000 | Power steering circuit board may short | July 19, 2024 |
| 2023 to 2025 | X-Line plug-in hybrid, and 2024 to 2025 X-Line gas, with 4.2-inch screen and Kia tow hitch | 25V874000 | Instrument screen may fail | February 13, 2026 |
| 2026 | Gas, hybrid, plug-in hybrid | 26V046000 | Instrument display software may fail | Expected March 26, 2026 |
Say you lease a 2024 Sportage with the 4.2-inch screen and a Kia tow hitch accessory. Then the steering, roof molding and screen rows can all match your VIN.
Can a Kia Sportage Lemon Law Lawyer Still Help After the Brake Booster Recall?
Yes. Campaign 23V410000 has dealers inspect the brake booster on certain 2023 Sportages and replace it as needed. Kia says the diaphragm may become misaligned and leak vacuum, which can cause a loss of power brake assist. If the pedal still feels hard after that visit, the recall repair order becomes one dated attempt in the claim.
Kia's report counts 98,944 potentially affected Sportages built at Kia Georgia from January 12, 2022, through February 15, 2023. It lists no warning. Instead, Kia describes a hard pedal and more effort to stop, and its chronology counts 73 incidents of hard brake pedal. Say your Sportage returns to Kearny Mesa Kia a month later with the same pedal. That visit can then count as another attempt.
When the Sportage Steering Assist Cuts Out
Campaign 24V422000 covers 2024 Sportages built at Kia Georgia from April 30 through May 23, 2024. A circuit board in the power steering pack may short, and steering assist can then drop out. Dealers then replace the electric power pack, and NHTSA lists 1,075 SUVs. Losing assist at freeway speed may count as a nonconformity likely to cause death or serious bodily injury.
Stalls, Surges and an Oil Pump Controller Parked Outdoors
Campaign 22V651000 covers 2023 Sportages whose alternator battery terminal nut may loosen, which Kia says can cause a stall or an electrical surge. Campaign 23V531000 covers 2023 Sportages with an Idle Stop and Go oil pump controller that may overheat and cause a fire. Kia told owners to park outside until the repair. So a lessee with no outdoor spot should note any cost that advice caused.
Blank Instrument Screens From Startup to the Tow Hitch
Campaign 23V298000 updates the cluster software on 2023 Sportage, Hybrid and Plug-in Hybrid models with the 4.2-inch cluster, which may show nothing at startup. Under 25V874000, a tow hitch control module on certain X-Line models may make the cluster reboot while driving, so dealers replace that module. Finally, campaign 26V046000 covers 2026 models, with software sent over the air or installed by a dealer.
How Does a Lawyer Prove a Sportage Screen Failure That Clears on Restart?
Record it. Once you are safely stopped, photograph or video the blank screen. Also note the date, the mileage and anything connected, such as a trailer or a phone. Then ask that the repair order describe the failure in your words, even when the technician finds nothing.
Say the screen on that 2024 Sportage goes blank on State Route 52 while you tow a small camping trailer home from Santee. Kia's filing for 25V874000 ties a reboot like that to the tow hitch module. A wireless update may never produce a repair order, so save the update notice and its install date.
Does Leasing Change the Repair Count a Kia Sportage Lemon Law Lawyer Uses?
No, because sections 1795.4(b) and 1793.2(d)(2)(D) give a lessee a buyer's rights. Section 1793.22(b) then sets up a presumption for events within 18 months or 18,000 miles, whichever comes first. Once they occur, it treats Kia as having had a reasonable number of repair attempts, the tries the law allows.
The first route is two or more repairs of a nonconformity likely to cause death or serious bodily injury. The second is four or more repairs of the same nonconformity. Both of those routes also require that Kia itself got a direct notice from you, at least once, if Kia's materials clearly required it. The third is more than 30 cumulative days out of service for repair of nonconformities, with no notice needed. However, Kia can rebut the presumption. Even after the window, a claim can rest on the full repair history, which the Kia lemon law lawyers at Cline APC review line by line. For example, a 36-month lease that began in October 2023 left the window before turn-in, yet early brake visits inside it can still count.
Keeping the Kia Sportage in Hand for the Lemon Law Notice
Kia America, Inc. opted into the newer procedures on May 1, 2025, for Sportages sold in 2025 or earlier. Under section 871.24(a), a pre-suit notice is a written demand for repurchase or replacement. It is required only before a suit seeking civil penalties, extra sums beyond a refund. It must reach Kia at least 30 days ahead. Subdivision (c) requires the Sportage in your possession when the notice goes out. Then subdivision (g) has you keep it 30 days after Kia receives the notice, or 60 if Kia makes an offer. An offer within 30 days, completed within 60, removes civil penalties, and missing either keeps them available. A suit that skips the notice seeks only restitution or replacement, and subdivision (h) still requires possession at filing. Kia takes the notice through its CA Lemon Law Notice form, or by certified or registered mail, return receipt requested.
Extend the Lease or Buy the Residual Before a Kia Sportage Lemon Law Demand?
Both moves keep the Sportage in your hands. Under section 871.27(e)(1), payments under an existing agreement to extend the lease count as damages. Subdivision (e)(2) counts money you pay toward the residual value, the lease's buyout price, and Kia pays the rest of a financed residual straight to the lienholder. Extension payments count toward civil penalties only if paid, or the extension activated, within 30 days after delivering the notice or filing suit, whichever is earlier. The residual counts only if paid or financed in that window.
A Lease Maturing January 31, 2027, Laid Against Kia's Clock
Picture a lease that matures on January 31, 2027, with Kia receiving your notice on December 2, 2026. Kia's 30-day answer then falls around January 1. If Kia makes an offer, you hold the Sportage until about January 31, right on maturity. So an extension or buyout decided in early December protects both windows. After an agreed buyback, Kia has 30 days from receipt of the release signed through your counsel to complete it. Miss that, and Kia owes $50 a day, unless the parties agreed otherwise or your failure to cooperate in good faith caused the delay.
Filing Limits and BBB AUTO LINE for Sportage Lessees
For covered Sportages, section 871.21 requires suit within one year after the applicable express warranty ends. That is Kia's written coverage for the defect, and suit can never come more than six years after delivery. Shop days for a nonconformity pause both limits, as do up to 60 days after a pre-suit notice. Still, the end of a lease does not start that clock. Kia's state-certified arbitration program is BBB AUTO LINE. If Kia disclosed it in writing and on time, you go there first, before the presumption becomes available, as section 1793.22(c) requires. The Department of Consumer Affairs says decisions usually come in about 40 days.
Is It Too Late to Call a Sportage Lemon Law Attorney Before Turn-In Day?
Not while you still have the Sportage. A free consultation at Cline APC reads the lease, the repair orders and the recall record together. You then learn whether to send a notice now, and whether an extension or buyout makes sense before the inspection.
Say the leasing company already booked your turn-in inspection. Then bring that notice, the latest lease statement, any buyout quote and every photo or video of the defect.
Cline APC also handles Kia Telluride claims and Sorento trade-in claims, and the buyback calculator shows the refund formula. Under Civil Code section 1794(d), a lessee who prevails recovers costs and reasonable attorney fees, if a lawyer represents you. Every result turns on the facts in your file.
Call (888) 982-6915 or send the lease details so a Kia Sportage lemon law lawyer can check the maturity date.
