Civil Code section 1793.22 asks whether a warranty defect substantially impairs the car's use, value or safety, and any one of the three is enough. If so, the law calls it a nonconformity. When Lexus's dealers cannot fix it after a reasonable number of attempts, meaning a fair number of chances given how serious the defect is, the manufacturer must replace the car or make restitution, the legal word for a buyback.

Lexus describes itself as a division of Toyota Motor Sales, U.S.A., Inc. Neither Toyota nor Lexus appeared on the Department of Consumer Affairs (DCA) roster of manufacturers that opted in to newer court procedures on November 2, 2026. That shapes the deadline that applies to your car.

The firm, Cline APC, accepts only lemon law and warranty matters, from offices on Ivanhoe Avenue in La Jolla and Danielson Street in Poway.

What Does a Lexus Lemon Law Lawyer Read First When a Car Keeps Failing?

Every repair order comes first, then the sales or lease contract and the warranty booklet that came with the car. Lexus's warranty page lists the terms below for the model year it shows, and your booklet for your own model year controls.

CoverageTermSource
Basic warranty48 months or 50,000 milesLexus warranty page
Powertrain warranty72 months or 70,000 milesSame page
Hybrid warranty8 years or 100,000 milesSame page

The page also lists a corrosion perforation warranty and a parts warranty. Whichever limit comes first ends each term. Our blog covers Lexus models to avoid before you buy.

Say you lease a hybrid Lexus in Carlsbad, and one electrical fault sends it back to the dealer four times in 14 months. Civil Code section 1795.4 gives a lessee, someone who leases rather than buys, the same rights against the manufacturer that a buyer holds.

Four Repairs, Two Repairs, or 30 Days Out of Service

Subdivision (b) of section 1793.22 creates a presumption, a rule of proof. Inside 18 months or 18,000 miles, whichever comes first, three patterns treat Lexus as having had a reasonable number of repair attempts. Four or more repairs of the same nonconformity is one. Two or more repairs of a nonconformity likely to cause death or serious bodily injury if the car is driven is another. Both of those routes also need direct notice, a letter to the manufacturer itself, if the warranty materials clearly disclose that duty. The third route counts more than 30 cumulative calendar days out of service for repair of nonconformities, and it needs no notice.

Lexus can rebut the presumption. After the window closes, a car can still qualify on its whole repair record under section 1793.2, subdivision (d)(2). Separately, subdivision (b) of that section expects each warranty repair within 30 days unless you consent in writing or the delay is beyond the manufacturer's control.

Counting Every Dealer Visit

Section 1793.2, subdivision (d)(2), counts attempts by the manufacturer or its representative in this state, not one store. So a visit to a Lexus dealer in another county belongs in the file beside visits at your usual dealer. Ask each time whether a bulletin, program or campaign matches your VIN, and have the answer written on the order.

Does the Dealer or Lexus Owe the Buyback a Lemon Law Attorney Demands?

The manufacturer owes it, not the dealer. Once Lexus's reasonable repair chances run out, Civil Code section 1793.2, subdivision (d)(2), requires the manufacturer to promptly replace the car or make restitution. The DCA says in its FAQ that the manufacturer, not the dealership, repurchases or replaces. You choose, and Lexus cannot force a replacement on you.

Certified and Used Lexus Cars With Factory Coverage Left

Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make a used car new, unless the new car warranty was issued with that sale. The court left certified pre-owned programs unaddressed. A used Lexus, L/Certified included, therefore usually falls outside the new-vehicle remedy, though the point is unsettled and a claim against the selling dealer may survive.

What Does the Certified Arbitration List Say About Lexus?

The DCA keeps a list of state-certified arbitration programs, and it names Toyota under the California Dispute Settlement Program, or CDSP, but does not name Lexus. The DCA says that when a manufacturer has no state-certified program, you can take your case to court or try mediation through the New Motor Vehicle Board at (916) 445-1888. Read the DCA arbitration page before you decide.

The list matters for one reason. Under Civil Code section 1793.22, subdivision (c), a qualified third-party program must be used before relying on the presumption only if you get timely written notice of it, with a description of its operation and effect. Check your warranty booklet and owner letters for that notice, and keep it in the file. Days spent in any qualified program extend your deadlines.

Lexus Is Not on the DCA Election List, So Which Deadline Does a Lexus Lemon Law Lawyer Use?

Four years under Commercial Code section 2725, or section 10506 for a lease. Lexus is not on the DCA roster of manufacturers that opted in to the 2025 procedures. So those procedures do not reach a Lexus sold in 2025 or earlier. The four years generally run from tender of delivery.

Section 871.20, subdivision (a), of the Code of Civil Procedure limits the newer chapter to electing manufacturers, and section 871.30 keeps it away from 2025 and earlier sales without an election. That removes the section 871.24 pre-suit notice, a demand required only before a suit that seeks civil penalties from an electing manufacturer.

An exception in Commercial Code section 2725 applies when two conditions meet. The warranty must explicitly reach future performance, and the breach cannot be discovered until that performance occurs. The period then starts when the breach is or should have been discovered. For a Lexus sold new in 2026 or later, section 871.29, subdivision (d), requires the manufacturer to name the governing procedure at sale. Under Civil Code section 1794, subdivision (d), a buyer who prevails recovers costs and reasonable attorney fees.

The same roster question arises for Toyota claims, since Toyota was also absent on November 2, 2026.
