After it, the question is whether Toyota got a reasonable number of repair attempts, in plain terms a fair number of chances to fix a defect its warranty still covers.
That shortcut sits in Civil Code section 1793.22, the repair presumption statute. Past its window, your repair orders carry the proof, since each records a chance Toyota had to fix the vehicle.
Cline APC takes on lemon law and consumer warranty claims and nothing else, from La Jolla and Poway.

Can a Failed Toyota Recall Fix Start a Claim With a Toyota Lemon Law Lawyer?
It can. A recall visit lands on your repair record like any warranty visit. When the symptom returns after the remedy, the next visit counts as a fresh try at the same defect. NHTSA lists Toyota campaigns for RAV4 airbag sensors, Tundra engines, Tacoma axles and driveshafts, and Camry lug nuts and inverters.
| Model | Model years and campaign | What Toyota's campaign describes | Claims |
|---|---|---|---|
| Camry | 2023 (23V432000), then 2025 and 2026 Hybrid (25V869000) | Lug nuts that may be loose, then a possibly loose inverter bolt that can cost motive power | Toyota Camry claims |
| RAV4 | 2020 and 2021, gas and hybrid (23V865000) | A sensor short that may stop the passenger airbag from deploying | Toyota RAV4 claims |
| Tacoma | 2022 and 2023 (24V152000), then 2025 (25V656000) | An axle shaft that may separate, then a front CV joint that may break | Toyota Tacoma claims |
| Tundra | 2022 and 2023 (24V381000), expanded through 2024 (25V767000, 26V320000) | Manufacturing debris that may ruin main bearings and stall the engine | Toyota Tundra claims |
No recall turns a Toyota into a lemon on its own, since a campaign reaches a whole group. The statute asks about a nonconformity in yours, which section 1793.22, subdivision (e)(1), describes as a defect that substantially impairs a vehicle's use, value or safety.
Say your Tacoma had the 24V152000 axle inspection in 2024, and the same clunk returns a year later, so each visit counts.
Toyota's continuously variable transmission, or CVT, has one campaign across 2019 through 2025 Corollas, Corolla Crosses and C-HRs. Campaign 18V901000, filed December 19, 2018, covered certain 2019 Corolla hatchbacks whose torque converter impeller blades may detach and stall the car.
A Replacement Tundra Engine That Fails Again
Toyota's remedy under campaign 24V381000 is a new engine assembly. The two later campaigns expanded the group and moved to an inspection of main bearing No. 1, replacing the engine only if necessary. When a recall engine later knocks or stalls the same way, that failure counts against the same defect again. The first visit, the swap and the new failure then share one timeline.
Reading a Toyota Interim Letter Against Your Own Symptoms
An interim letter warns of a risk before a fix exists, and a remedy letter says the repair is ready. Check your VIN with Toyota's recall lookup, then compare the letter with your symptoms. Matching symptoms support your earlier complaint visits. If you never had symptoms, the recall shows Toyota's view of the defect but may not prove a nonconformity in your vehicle.
How Does a Lemon Law Attorney Compare a Toyota Goodwill Offer With a Song-Beverly Buy Back?
A goodwill check or service plan from Toyota or a dealer is not restitution, the statutory buyback. Restitution refunds what you paid or still owe, including factory options, taxes and official fees. Under Civil Code section 1790.1, a buyer cannot waive Song-Beverly rights except where the Act expressly allows it.
It also refunds incidental damages, meaning towing, rentals and repairs the defect made you pay for. Then it subtracts a mileage offset, a deduction tied to miles you drove before the first repair visit for that defect. Replacement means a substantially identical new vehicle, and the choice is yours.
| Line item | Song-Beverly restitution |
|---|---|
| Price paid or payable, with transportation, factory options, finance charges and any loan balance still owed | Refunded |
| Sales or use tax, license, registration and other official fees | Refunded as collateral charges |
| Towing, rental and repair costs actually incurred | Refunded as incidental damages |
| Items installed by a dealer or by you that did not come from Toyota | Left out |
| Miles driven before the first repair visit for the defect | Subtracted as the offset, which Toyota must prove |
Take a Highlander Hybrid that has visited Toyota of El Cajon on Arnele Avenue four times in 30 months for a transmission clunk. An offer arrives before the fifth visit. If the SUV cost $39,600 and first went in at 8,500 miles, the offset is $2,805. The formula is price times miles, divided by 120,000. Before you sign anything, call (888) 982-6915.
Three Things to Read in Any Toyota Release
A release is a signed promise to give up claims. Check the claims it names, whether it reaches future failures of the defect, and whether it mentions replacement or restitution. Because Toyota did not opt in to the newer lemon law procedures, the standardized release in Code of Civil Procedure section 871.25 does not govern. In Rheinhart v. Nissan North America, Inc. (2023) 92 Cal.App.5th 1016, a leasing customer took $3,548.40 and signed a release. The Court of Appeal held it void under the circumstances. Nothing showed the manufacturer explained replacement or restitution before he signed, and the ruling turned on its own facts.
Who Has to Prove the Toyota Offset Mileage
CACI No. 3241, the jury instruction on restitution, puts that burden on the manufacturer. If an earlier visit described the same symptom in other words, the offset may use that lower mileage. The buyback calculator runs your numbers. Section 1794, subdivision (c), also permits a civil penalty when a violation was willful, an extra sum of up to two times actual damages. If you prevail, subdivision (d) awards your costs and reasonable attorney fees. The firm explains its fee arrangement before you decide.
Why Does a Lemon Law Lawyer Read a Toyota Warranty Past Month 18?
Because coverage outlasts the presumption window. Toyota's owner warranty summary lists basic coverage at 36 months or 36,000 miles and powertrain coverage at 60 months or 60,000 miles, whichever comes first. Hybrid-related parts such as the inverter get 8 years or 100,000 miles. A reasonableness claim follows the applicable warranty, meaning the coverage for your defect.
Powertrain covers the engine, transmission, drive systems, seatbelts and airbags. For 2020 and later hybrids, the hybrid battery gets 10 years from first use or 150,000 miles, whichever comes first. Booklets differ by model and year, so your own Warranty and Maintenance Guide controls.
Section 1793.22(b) supplies the presumption, a legal shortcut. Its conditions must be met within 18 months of delivery or before 18,000 miles, whichever comes first. The law then treats Toyota as having had a reasonable number of repair attempts. One route needs a nonconformity likely to cause death or serious bodily injury, repaired two or more times. A second needs four or more repairs of one nonconformity. Both need direct notice, meaning a complaint sent straight to Toyota, at least once when the warranty or owner's manual clearly disclosed that duty. The third route needs no notice, only time out of service for repair of nonconformities topping 30 cumulative days. Toyota can rebut the presumption, and after the window closes a claim can still succeed on the whole repair history under section 1793.2(d)(2).
A Highlander Hybrid inverter that fails at 71,000 miles in year five is still inside the hybrid-related term. A Toyota lemon law lawyer can count every failed visit for it, depending on the repair notes.
Repair Days Added Back to a Toyota Warranty
Civil Code section 1795.6, subdivision (a)(1), pauses the warranty from the day you deliver the vehicle for warranty repair. The pause ends when you get it back or learn it is ready. Subdivision (d)(1) requires a work order showing both dates. Say your 4Runner spends 19 days at Dalton Toyota National City across three visits during basic coverage. Its 36-month basic term then runs 19 days longer, depending on the dates on each order.
The 60-Day Notice After a Toyota Repair Fails
Subdivision (b)(2) keeps a warranty alive when a warranty repair did not fix the defect. The condition is notice to the manufacturer or seller within 60 days after the work was finished. Picture a Corolla Cross whose air conditioning is repaired at 35,200 miles and blows warm again near El Cajon at 36,400. A dated email to the dealer and a letter to Toyota inside those 60 days can keep coverage for that defect.
Does a Toyota Visit That Found Nothing Count for a Lemon Law Lawyer?
Yes. CACI No. 3202, the jury instruction on repair opportunities, counts each time you hand the vehicle to Toyota or an authorized dealer for repair, whether or not anyone did work. At least two opportunities are required. After that, reasonableness is a fact question decided on all the circumstances.
| Toyota model | Complaint model years | NHTSA owner complaints | Recall campaigns, 2021 to 2026 models |
|---|---|---|---|
| Camry and Camry Hybrid | 2021 to 2025 | 501 | 9 |
| RAV4, Hybrid and Prime | 2021 to 2026 | 1,236 | 13 |
| Tacoma and Tacoma Hybrid | 2021 to 2025 | 439 | 12 |
| Tundra and Tundra Hybrid | 2021 to 2025 | 1,328 | 26 |
Complaint counts date from September 2026, and campaign counts, label and equipment recalls included, from September 29, 2026.
Picture a 2023 Sienna whose sliding door stops halfway at a Rancho Bernardo school pickup. It goes in four times in 26 months, and two visits end with no part changed, yet all four count. CACI No. 3202 rests partly on Oregel v. American Isuzu Motors, Inc. (2001) 90 Cal.App.4th 1094, where six oil leak visits counted though parts were replaced once. The court said a consumer is not answerable for whether the manufacturer's agents find the problem.
A Convoy Street Shop Repair and the Opportunity Count
CACI No. 3202 counts only Toyota and the shops it authorizes. A fix at an independent shop on Convoy Street gives Toyota no chance to repair the defect. It can also let Toyota blame someone else's work for the next failure. If an independent shop finds the defect first, keep its invoice. Then take the vehicle to an authorized Toyota dealer, so the complaint lands on Toyota's own paper.
Two Opportunities Minimum, and Reasonableness After That
In Silvio v. Ford Motor Co. (2003) 109 Cal.App.4th 1205, the court stressed that the statute's word attempts is plural. So CACI No. 3202 requires at least two opportunities, unless the vehicle was destroyed after the first attempt or the manufacturer refused to attempt the repair. Robertson v. Fleetwood Travel Trailers (2006) 144 Cal.App.4th 785, 799, treats reasonableness as a fact question. Two failed visits for a brake defect can weigh differently than two for a sticky console latch.
Why Does a Toyota CDSP Brochure Change What a Lemon Law Attorney Files First?
Because of section 1793.22, subdivision (c). Toyota's 2025 Warranty and Maintenance Guide tells California owners that a brochure for the California Dispute Settlement Program, or CDSP, sits in the glove box. An owner with timely written notice of that program must use it before relying on the presumption.
The Department of Consumer Affairs, or DCA, certifies the program Toyota sponsors and lists it as CDSP Auto Line, the program it also lists for Honda owners. DCA says arbitration charges consumers nothing, needs no attorney and usually brings a decision in about 40 days. The findings can come into evidence later, and program days extend any limitations period. Only a decision you accept binds Toyota, which must then perform within 30 days of acceptance. If you reject it, you can still sue and assert the presumption.
Toyota was absent from the DCA roster of manufacturers that opted in when checked on September 23, 2026. So the newer procedures in Code of Civil Procedure sections 871.20 and following, including the section 871.24 pre-suit notice, do not govern its claims. That notice is a written demand required only before a suit seeking civil penalties from a manufacturer that opted in. Instead, the four-year period of Commercial Code section 2725 governs, generally measured from tender of delivery. If a warranty explicitly extends to future performance and discovery must await that performance, the four years run from when the breach is or should have been discovered. A Sequoia delivered in August 2023 has a default line in August 2027 unless that exception or tolling moves it. Toyotas sold new in 2026 or later must come with a section 871.29(d) notice naming the governing procedure.
Case Numbers From the Toyota Brand Engagement Center
Toyota's booklet sets three steps for an unresolved problem. First talk with a dealership manager. Next, call the Toyota Brand Engagement Center with your VIN, mileage and dealer name. Finally, use CDSP. Ask for a case number on every call. Say you call about a Crown whose screen keeps freezing on Interstate 805. Log the number, the date and the representative's first name, then email the dealer that day.
Toyota's CDSP Condition for a Federal Warranty Claim
Toyota's 2025 booklet requires CDSP before a suit under the federal Magnuson-Moss Warranty Act. Song-Beverly rights, which the federal act did not create, need no program first, apart from the presumption rule in subdivision (c). Under 15 U.S.C. section 2310(d), a consumer who finally prevails on the federal claim may be awarded costs and attorney fees unless the court finds a fee award inappropriate. So a Toyota lemon law lawyer weighs any federal count before you skip CDSP.
Letters to the Warrantor in Plano
The booklet names the warrantor as Toyota Motor Sales, U.S.A., Inc., at P.O. Box 259001 in Plano, Texas. Where your owner materials require direct notice for the presumption, send it to the address they specify. List your VIN, each repair date and the defect. Keep a copy with the certified mail return receipt, because it shows when Toyota received it. Dealer visits alone do not replace that letter when the requirement applies.
After Month 18, What Should You Bring to a Toyota Lemon Law Lawyer?
Bring every repair order in date order, the sales or lease contract, the Warranty and Maintenance Guide, any CDSP brochure and any Toyota case number. A Toyota lemon law lawyer at Cline APC then counts your repair opportunities against the warranty dates.
That review dates your four-year period and shows whether CDSP should come first.
The free consultation is confidential, and any next step is yours. Nobody can promise how a case ends. Toyota owners in Poway can meet at the Danielson Street office.
