Toyota Tundra Lemon Law Lawyer in San Diego

A recall letter says your Tundra's engine may have debris inside it, and the fix is a new engine. Maybe the truck already knocked on the Interstate 8 grade toward Alpine, or maybe it never missed a beat.

A Toyota Tundra lemon law lawyer reads the recall, the swap and every visit around them as one record.

Type your VIN into NHTSA's recall lookup, since three engine campaigns now reach 2022 through 2024 Tundras. Each recall visit counts as a repair opportunity. So a failing engine can support a buyback, meaning a refund, or a replacement, a substantially identical new Tundra.

Cline APC handles lemon law and warranty claims and nothing else, and Tundra owners meet the firm in La Jolla or Poway.

If your Tundra is waiting on a recall engine or already has one, call (888) 982-6915 with the recall letter in hand.

Does Engine Knock Before the Recall Letter Arrived Matter to a Toyota Tundra Lemon Law Lawyer?

It does. Toyota's dealer notice lists knocking, rough running, a no-start or a loss of motive power as possible symptoms. In NHTSA records pulled September 23, 2026, owners filed 1,328 complaints on 2021 through 2025 Tundras. The engine was named in 520 of them, power train in 309 and fuel or propulsion in 208.

Complaints are owner accounts, not findings. Even so, put symptoms like these on each repair order.

  • It knocks at idle or under load.
  • It runs rough.
  • It would not start in the driveway.
  • It lost drive power on a grade.
  • It ticked or knocked soon after the recall engine went in.
  • It moved in neutral with the brakes off.

Say your 2023 Tundra from Toyota of El Cajon on Arnele Avenue started knocking before any recall letter came. That early visit, the recall visit and any later visit then belong on one timeline.

Which of Three Engine Campaigns Covers My Tundra, and How Does a Lemon Law Lawyer Check?

It turns on VIN and build date. Campaign 24V381000 covers certain 2022 and 2023 Tundras, and 25V767000 expanded it to certain 2022 through 2024 trucks. Campaign 26V320000 then reached certain 2024 trucks. Complaints rose from 24 on 2021 Tundras to 430 on 2022, then ran 405 on 2023 and 338 on 2024.

A September 29, 2026 pull puts power train complaints at 104 for 2022, 85 for 2023, 85 for 2024 and 35 for 2025. Several owners told NHTSA their trucks failed the way the recalls describe after hearing the VIN fell outside the group. A lemon claim needs no recall, though, because the repair orders and the warranty carry it.

Does a Bearing Inspection Instead of a New Engine Change What a Tundra Lemon Law Attorney Counts?

Not the count. The first campaign replaced the whole engine at no charge to owners. Filed November 6, 2025, campaign 25V767000 switched to inspecting main bearing No. 1 with software and drive data, replacing the engine only if necessary. As of September 2026, campaign 26V320000 had only interim letters out.

NHTSA's records describe each later campaign as an expansion to more trucks with the same debris problem. They do not say earlier swaps failed, so a later campaign is not proof your first engine was bad. Say you have waited since spring for a remedy while your truck knocks at idle in Ramona. Your dated calls to the dealer turn that wait into evidence.

Engine Supply Released in Phases by Build Date

Toyota's March 2025 dealer notice lists seven phases covering about 98,600 Tundras. The first two were marked available and the third was set for April 2025, while later phases carried no date. Owners cite a campaign in 120 complaints, and 84 of those say the parts were not available. In 64 of the 84, the owner adds that Toyota took longer than a reasonable time.

An Axle Nut, a Neutral Roll and a Chafing Fuel Tube

Campaign 22V445000 covers certain 2022 Tundra and Tundra Hybrid trucks whose axle shaft flange nuts can loosen, which may let a shaft separate from the housing. Campaign 23V566000 covers certain 2022 and 2023 trucks whose plastic fuel tube may chafe against brake lines and leak. Later, campaign 24V125000 reached certain 2022 through 2024 Tundras that may move in neutral with the brakes off. A repeat after any of these remedies belongs in the same timeline.

What Five Papers From the Tundra Engine Swap Does a Lemon Law Lawyer Need?

Start with the repair order showing the recall code, the engine replacement and drop-off mileage. Confirm it lists the arrival and ready dates. Then keep the loaner or rental agreement, save the Proof of Correction Form, and check that earlier symptoms made the same order.

Time itself is evidence in a lemon claim. Picture a 2022 Tundra out of service 23 days for its recall engine, partly waiting on parts and partly waiting on a service bay. Without both dates printed on the order, those days are hard to prove later.

Loaner Rules Before and During the Swap

Toyota's notice lets dealers claim a loaner or other transportation at $60 a day for owners uncomfortable driving while the remedy is prepared. Once the engine arrives and the truck is dropped off, the notice says a loaner is provided during the repair. An owner whose truck cannot be driven contacts a dealer to arrange pickup. Toyota's 2025 Tundra guide also covers towing to the nearest dealer when a warranted part fails and leaves the truck inoperable.

The California Registration Note in Toyota's Dealer Notice

The notice says California requires emission-related safety recalls to be completed before registration renewal. It adds that Toyota reports incomplete recalls to the DMV, which may ask for proof at renewal. After the work, the dealer hands over a Vehicle Emissions Recall Proof of Correction Form. Keep it with the repair order, because it also proves the date the recall repair was finished.

Does a Recall Engine Swap Count as a Repair Visit for a Toyota Tundra Lemon Law Lawyer?

Yes. CACI No. 3202, the official jury instruction, counts every trip to Toyota or its dealer for repair, even when no work was done, so the swap is one. The real question is whether Toyota cured a nonconformity within a reasonable number of tries, meaning enough chances under the circumstances.

Section 1793.22(e)(1) defines a nonconformity as a defect substantially impairing the truck's use, value or safety. Subdivision (b) adds a presumption until 18 months have passed since delivery or the odometer reads 18,000, whichever comes first. In three situations it treats Toyota as having had a reasonable number of repair attempts. Only two repairs are needed for an engine fault likely to cause death or serious bodily injury. Toyota's recall summary says lost drive power increases crash risk.

Four repairs of the same nonconformity also count. Both repair routes need one direct notice, a written complaint to Toyota itself, where the booklet clearly disclosed it. Downtime for repair that tops 30 cumulative days also qualifies, without any notice. Toyota may try to rebut the presumption, and the general rule still applies after the window.

Picture a Tundra towed in from the shoulder of State Route 52 before the recall letter, then swapped under the campaign. Cline APC's Toyota lemon law lawyers count both visits.

A Second Engine Failure in a Toyota Tundra Lemon Law Claim

In 2026 NHTSA complaints, at least three owners reported that the recall engine later failed. A matching symptom is another attempt at the same defect. Say your 2022 Tundra got its recall engine in 2025 and knocks again on State Route 78. The 2025 Tundra guide puts the engine, including the turbocharger housing and internal parts, under a 60-month or 60,000-mile powertrain term from the in-service date, whichever occurs first. Check your own year's guide. Section 1795.6, subdivision (b)(2), keeps coverage alive for that defect if you tell Toyota or the seller within 60 days after the repair that it failed. A precautionary swap on a quiet truck, however, raises a fact question.

Work Trucks, Towing and a Toyota Tundra Lemon Law Misuse Defense

A business Tundra can qualify under section 1793.22, subdivision (e)(2), when it is under 10,000 pounds gross vehicle weight. The business also needs five or fewer vehicles registered in California. Leases carry the same rights under section 1795.4. The guide excludes misuse such as racing and overloading, and it adds service for towing. Under section 1794.3 and CACI No. 3220, Toyota must prove misuse caused the defect, and its recall summaries blame manufacturing debris.

CDSP Days That Can Stretch a Tundra Deadline

Toyota was not among the manufacturers that opted in to newer lemon law procedures on the Department of Consumer Affairs roster checked September 23, 2026. That rules out a section 871.24 pre-suit notice. Only a buyer seeking civil penalties, extra sums for a willful violation, from a manufacturer that opted in must send one. Commercial Code section 2725 then supplies four years, normally running from tender of delivery. If a warranty explicitly covers future performance and the breach cannot be found until then, the start moves to when it is or should have been discovered.

A Tundra delivered in November 2022 points to a default line in November 2026. Toyota must name the governing procedure at sale for trucks sold new in 2026 or later. With timely written notice of CDSP Auto Line, Toyota's sponsored program, section 1793.22(c) requires it before the presumption. Days spent there also extend limitations. Toyota is bound by a CDSP decision only once you accept it, and the findings can come into evidence.

Knocking at 11,250 Miles and the Toyota Tundra Lemon Law Offset

A buyback covers payments made and the balance owed, with transportation, factory options, tax, registration, towing and rental. Accessories a dealer added from other makers stay out. A $57,600 Tundra first in for knocking at 11,250 miles would carry a $5,400 offset, charged for the miles driven before that first knock visit. For a truck that never had symptoms, which visit counts first is its own question, and the buyback calculator gives a ballpark. Under Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, leftover factory coverage from an earlier sale does not make a used Tundra new, even with a recall engine. Certified trucks are usually outside the new-vehicle remedy too, though the point is unsettled.

Before or After the Swap, Can a Toyota Tundra Lemon Law Lawyer Read My Recall File?

Yes, at either stage. Bring the recall letters, loaner agreements and the Proof of Correction Form. Add every repair order from before and after the swap, plus a list of knock and stall dates. A Toyota Tundra lemon law lawyer then lines up the recall visit with the rest of the truck's history.

The review checks the 18-month window, the four-year date and the powertrain term. For a willful violation, section 1794, subdivision (c), lets a court add a civil penalty of up to double actual damages. Under subdivision (d), an owner who prevails recovers costs and reasonable attorney fees.

Cline APC offers a free consultation that stays confidential, in La Jolla or Poway, and no one can predict how a Tundra claim will end. Toyota lemon law claims from Poway go to the Danielson Street office, and the firm also sees Toyota Tacoma lemon law claims.

When the recall file is together, send your Tundra details or call (888) 982-6915 to set a time.
