A nonconformity is a defect that substantially impairs the Altima's use, value or safety. Two or more repairs of it can be enough inside 18 months or 18,000 miles, whichever comes first. That route also needs a letter to Nissan itself where its booklet required one. It leads to the presumption, a legal shortcut that treats Nissan as having had a reasonable number of repair attempts, meaning fair chances to fix the defect. Nissan lemon law claims built on it can end in a buyback, where Nissan takes the car back and refunds what you paid or owe. A replacement, the other remedy, is a substantially identical new Altima.

Can a Nissan Altima Lemon Law Lawyer Use Braking Under Overpasses and at Rail Crossings?
Yes, when your notes and orders line up. NHTSA's data, pulled October 2, 2026, holds 168 owner complaints on 2021 to 2026 Altimas. Electrical systems drew 41, forward collision avoidance 38 and service brakes 35. A hand read of the summaries that mention brakes, stopping or collision systems found 18 that describe braking or stopping without driver input.
Thirteen of them involve the 2021 model year. Complaints are unverified owner reports, so they show patterns and prove nothing about your car. Also, at least two summaries describe the Altima braking or stopping in reverse with nothing behind it. When these match your Altima, put the words on the repair order.
- The Altima slams the brakes with no car, person or object ahead.
- It slows from 55 to 30 mph under the same bridge.
- It brakes hard while backing out of the garage.
- A stopped truck ahead brings no warning.
- A Forward Driving Aids Temporarily Disabled message appears.
- The warning returns after a new front radar.
Say your 2021 Altima SR slows from 55 to 30 mph under one Interstate 8 bridge twice in a month.
Which Altima Years Use the Radar and Camera a Nissan Lemon Law Attorney Checks?
Every owner's manual from 2021 to 2026 lists Automatic Emergency Braking with Pedestrian Detection and Intelligent Forward Collision Warning. The 2021 manual says the braking system uses a front radar sensor and, for pedestrians, a camera behind the windshield. Each manual also lists Rear Automatic Braking. The table sets each year's complaints beside its recall campaigns.
| Model year | NHTSA complaints | Braking or stopping without driver input | Recall campaigns |
|---|---|---|---|
| 2021 | 70 | 13 | 21V138000, 23V628000 |
| 2022 | 20 | 3 | None |
| 2023 | 29 | 0 | None |
| 2024 | 41 | 2 | 23V882000 |
| 2025 | 7 | 0 | 26V023000, 26V526000 |
| 2026 | 1 | 0 | None |
Say your Altima brakes every time you back out of a Chula Vista garage. The 2021 manual says Rear Automatic Braking, on Altimas equipped with it, works in Reverse at speeds under about 9 mph. It also warns that weather or ultrasonic sources such as an automatic car wash may cause a false activation.
Does a Recall Cover Altima Emergency Braking, and What Else Proves It to a Lawyer?
None of the five campaigns in NHTSA's data for 2021 to 2026 Altimas addresses emergency braking. Nissan did publish bulletin NTB21-115B for false activation of the braking or forward collision warning system on 2021 and 2022 Altimas. A bulletin is a dealer repair instruction, so your repair orders still carry the claim.
Say your 2024 Altima visits Mossy Nissan National City for the steering recall, and you mention a stop at the counter. Ask that the order list both. That puts both on one dated record, so neither gets lost.
What Bulletin NTB21-115B Says About False Braking on a 2021 or 2022 Altima
Bulletin NTB21-115B was first published December 17, 2021 and amended through July 11, 2024. It applies when an owner reports false activation or unexpected braking and no related trouble codes are stored. Dealers then check the ICC/ADAS 2 control module part number and reprogram it if applicable. A bulletin guides dealers and does not prove a defect in your Altima. Ask whether the order for a 2021 or 2022 Altima cites it.
Recall Visits Still Belong on a Nissan Altima Lemon Law Timeline
A recall visit is a dated trip to the dealer. If the problem returns after the remedy, the next visit can count as another repair attempt on the same defect. Nissan prints its own recall numbers, such as R23C3 for campaign 23V628000, so match each code on your order to its NHTSA number. Letter dates are as NHTSA's record gives them.
| Campaign | Altima years | What NHTSA's record says | Owner letters |
|---|---|---|---|
| 21V138000 | 2020 and 2021 | A tie rod ball joint fastener was not tightened properly | Not stated |
| 23V628000 | 2019 to 2021 | Camera wiring damage can distort or lose the rearview image | Expected October 19, 2023 |
| 23V882000 | 2024 | Bolts joining the power steering unit to the rack may loosen, and dealers replace the steering gear | Mailed February 9, 2024 |
| 26V023000 | 2025 | Door strikers may have been improperly welded and break | Mailed March 17, 2026 |
| 26V526000 | 2025 | Passenger and knee airbag fasteners may be incorrect | Expected September 25, 2026 |
Campaign 25V437000 also reaches certain 2019 and 2020 Altimas, and the Nissan Rogue shares it.
Will Nissan Quote the Owner's Manual When an Altima Lemon Law Attorney Raises Unexpected Braking?
It can. The 2021 and 2024 Altima manuals say that in some road and traffic conditions the system may unexpectedly apply partial braking. They tell the driver to press the accelerator pedal to override it when acceleration is necessary. So the dispute often turns on how often the car stops and how dangerous each stop is.
Your records must show both. The manuals also say the system may react to overhead objects such as a low bridge. They list road surface objects too, such as railroad track, grates and steel plates. It may react to patterns, shadows or lights that resemble a vehicle or pedestrian. A car that brakes once a year near a rail crossing differs from one that stops under the same bridge every week.
Notes, Dashcam Clips and Dashboard Photos From Each Stop
Start the log after the first stop, not the third. Write the date, time, road, speed, weather, dashboard message and following traffic within the hour. Next, keep a dashcam running and photograph any message before restarting the car. Hand the advisor your clips and ask that the order note the owner supplied video. Switching the system off is not a repair.
After the Dealer Replaces the Front Radar
One 2021 owner told NHTSA the warning returned within two months of a new front radar. A radar replacement is a real repair attempt and does not reset the count. Ask that the order name the part, list any calibration and record the mileage. Return with the earlier order number, because a new warning message still belongs to the same system.
Do Two Stops at Freeway Speed Meet the Safety Route for a Nissan Altima Lemon Law Lawyer?
California treats Nissan as having had a reasonable number of repair attempts after one of three patterns within 18 months or 18,000 miles, whichever comes first. Two or more repairs of a nonconformity likely to cause death or serious bodily injury count, as do four or more of the same nonconformity and more than 30 cumulative days out of service.
That is the Civil Code 1793.22(b) presumption. The two-repair and four-repair routes also need direct notice to Nissan at least once, if its booklet or manual disclosed that duty clearly and conspicuously. However, the 30-day route needs no notice. Nissan can also rebut the presumption. After the window closes, a claim can still succeed on the full repair history under section 1793.2(d)(2).
Say your 2022 Altima stops itself twice near the Carlsbad exits on Interstate 5. Use the same words on both orders, such as braked hard with no object ahead. A stop at freeway speed puts safety at issue.
When a Back-Ordered Radar Pushes the Altima Past 30 Days
The 30-day route counts days out of service for repair of nonconformities. Only conditions beyond Nissan's control extend it. Say Mossy Nissan Chula Vista keeps your Altima 18 days for a radar and 14 more after the stops return. That is 32 cumulative days, though Nissan may argue the parts delay was beyond its control. Separately, section 1793.2(b) gives each repair 30 days after you deliver the car for it. Only your written agreement or such a delay extends that limit.
When the Filing Window Closes on a 2023 Nissan Altima Lemon Law Claim
The Department of Consumer Affairs, or DCA, lists Nissan North America as an electing manufacturer, one that opted in to the newer procedures, on April 28, 2025. For an Altima sold in 2025 or earlier, Code of Civil Procedure 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. The applicable express warranty is the written coverage for your defect. Pauses apply to both limits, among them repair days, days in arbitration and up to 60 days after a pre-suit notice, a written demand that Nissan repurchase or replace the car. The 2023 booklet sets basic coverage for a 2023 Altima at 36 months or 36,000 miles, whichever comes first. With the odometer under 36,000 miles, an August 2023 delivery points to a default date of August 2027 before any pause. Your own booklet may differ.
That notice is required only before a suit seeking civil penalties, which are extra money for willful violations. Nissan must receive it at least 30 days before filing. Nissan has until day 30 after receipt to offer and day 60 to complete. Civil penalties stay out of the case when Nissan meets both dates, and missing either leaves them available. For an Altima sold new in 2026 or later, section 871.29(d) requires Nissan to name the governing procedure. BBB Auto Line is the state-certified program for Nissan. Under section 1793.22(c), you use it before relying on the presumption if Nissan gave timely written notice of it.
Dividing by 120,000 After the Altima's First Braking Complaint
Restitution, the statute's word for a buyback, returns the price paid or owed under section 1793.2(d)(2)(B), with options, transportation, tax and registration. It also adds incidental damages, such as towing or rental costs you paid. Miles driven before the first repair visit for the defect set the mileage offset, a deduction from the refund. A $29,500 contract first written up for braking at 3,900 miles gives $958.75, as arithmetic only. But an earlier oil change does not set it. Try your figures in the buyback calculator.
Civil Code 1795.4 gives a lessee, the person leasing the car, a buyer's rights against Nissan. Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make a used Altima a new motor vehicle, unless Nissan's new car warranty was issued with that sale. The court left certified pre-owned programs undecided, so those Altimas usually fall outside.
What Does a Nissan Altima Lemon Law Lawyer Do With Your Stop Log and Dashcam Clips?
Cline APC reads your repair orders, stop log and clips in a free consultation with a Nissan Altima lemon law lawyer. The review checks whether your stops fit the two-repair route, which deadline applies and what the next order should say.
Also bring the contract, the booklet for your model year and every repair order.
When a buyer prevails, section 1794(d) shifts costs and reasonable attorney fees to Nissan. Still, nobody can promise a result.
