A Nissan lemon law lawyer reads those papers in the order you collected them, because each proves a different part of the claim. Say Nissan's dealers cannot fix a new or leased Nissan after a reasonable number of repair attempts, meaning a fair set of chances. The car can then qualify for restitution or a replacement. Restitution is the statute's word for a buyback, in which Nissan takes the car back and refunds what you paid or still owe. A replacement is a new Nissan that is substantially identical to yours.
The California Department of Consumer Affairs, or DCA, keeps a roster of manufacturers that elected the newer procedures. Nissan North America is on it, with an opt-in date of April 28, 2025. That election puts Nissans sold in 2025 or earlier on the elected track. The elected track means the newer deadlines and procedures in Code of Civil Procedure sections 871.20 to 871.30. Civil Code section 1793.22(e)(2) still decides which vehicles qualify, including demonstrators sold with Nissan's new car warranty.
Used Nissans differ. In Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, the California Supreme Court held that leftover factory coverage does not make a used car a new motor vehicle. Its one exception is a sale at which the manufacturer's new car warranty was issued. Certified pre-owned programs were left undecided, so a certified Nissan usually falls outside the new-vehicle remedy, though the point is unsettled.

Which Rogue, Pathfinder and Altima Campaigns Should a Nissan Lemon Law Lawyer Check First?
Cline APC starts with three groups of Nissan recalls. They are the Rogue's VC-Turbo engine campaigns, front caliper campaign 25V173000 on certain 2025 Pathfinders and steering campaign 23V882000 on certain 2024 Altimas. A recall does not make a Nissan a lemon. When the defect returns after the remedy, the next visit can count as another repair attempt.
| Model | Campaigns and model years | What the filing with NHTSA describes | Claims |
|---|---|---|---|
| Rogue | 25V437000, certain 2021 to 2024 with VC-Turbo engines. 26V080000, certain 2023 to 2025 with the 1.5-liter engine | Bearings may have manufacturing defects, or heat may break down the oil and seize them. Either can lead to engine failure | Nissan Rogue lemon law claims |
| Pathfinder | 25V173000, certain 2025 | One or both front brake calipers may have reduced strength and could break | Nissan Pathfinder claims |
| Altima | 23V882000, certain 2024 | Bolts joining the electronic power steering unit to the rack may loosen | Nissan Altima lemon law claims |
Say your 2023 Rogue knocks on cold starts, the dealer performs the 26V080000 remedy, and the knock returns. NHTSA's record says that remedy may include an oil pan check and an engine replacement. A Nissan lemon law lawyer can count both visits toward one engine defect.
NHTSA's recall data for these models lists no campaign on continuously variable transmission, or CVT, performance. Dealer announcements dated June 1, 2022 and May 23, 2023 raised CVT coverage to 84 months or 84,000 miles, whichever occurs first. For these three models, they cover only 2014 to 2018 Rogues, 2015 to 2018 Pathfinders and 2017 and 2018 Altimas.
Matching Nissan Recall Codes Like R25E2 to NHTSA Numbers
Nissan labels recalls with its own codes, and a repair order may print one instead of the NHTSA number. NHTSA's record for 26V080000 lists Nissan's numbers R25E2 and R25E3. The record for 26V081000, a throttle body campaign on certain 2024 and 2025 Rogues, lists R25E2, R25E3 and R25A9. So one code can point to two campaigns. Also keep each owner letter with its order.
A Kearny Mesa Mechanic's Invoice Gives Nissan No Chance to Repair
Nissan's booklet says you must take the vehicle to an authorized Nissan dealer to obtain warranty service. Its exclusions also list damage from repairs by anyone else. Say a Kearny Mesa mechanic replaced a sensor on your Altima to save a trip. That invoice adds nothing to the repair count, and Nissan may cite it against coverage. Use a Nissan service department instead.
What Line Items Would a Nissan Buyback Return When a Lemon Law Attorney Totals Them?
Restitution under Civil Code section 1793.2(d)(2)(B) returns the price paid or payable, with transportation and factory options. Tax, registration and incidental damages, meaning reasonable repair, towing and rental costs you paid, come back too, less the mileage offset, the deduction for miles driven before the first repair visit for the defect.
On Nissan's elected track, section 871.27 also subtracts negative equity, an old car's unpaid balance rolled into the new loan. It keeps factory rebates out of the price and drops outside add-ons. The price times the miles, divided by 120,000, gives the offset. Say a 2024 Rogue SV signed at Mossy Nissan Kearny Mesa in March 2024 carries $3,800 of negative equity and a $1,000 Nissan rebate. On the elected track, the $3,800 comes out of the refund, and the $1,000 never counts as price paid.
| Line item | Treatment |
|---|---|
| Price paid or payable with transportation and factory options, plus tax, registration and other official fees | Refunded |
| Reasonable repair, towing and rental costs actually paid | Refunded as incidental damages |
| Items that a dealer or you installed and Nissan did not make | Left out, except selling-dealer additions on the elected track |
| GAP, service contracts and add-ons from an outside company | Left out on the elected track |
| Negative equity and Nissan rebates | Equity subtracted and rebates kept out of the price, on the elected track |
| Miles before the first repair visit for the defect | Subtracted as the mileage offset |
Payoff Letters and the Balance Still Owed on a Nissan Loan
A loan's remaining balance counts as price payable beside what you already paid, so a current payoff letter matters. Section 871.26 lists finance information and an estimated payoff amount among a plaintiff's first documents in an elected-track suit. You may choose restitution over a replacement, and Nissan cannot force a replacement on you. Try your figures in the buyback calculator.
The Standardized Release and the Rheinhart Warning for Nissan Owners
Section 871.25 makes the Standardized SBA Release the only release Nissan may require for a remedy under the chapter. Once Nissan receives that release signed through your counsel, section 871.27(g)(2) gives it 30 days to complete the agreed remedy. A $50 daily penalty follows if it does not, unless the parties stipulate otherwise. The penalty does not apply when the buyer fails to comply in good faith and delays the remedy.
Rheinhart v. Nissan North America, Inc. (2023) 92 Cal.App.5th 1016 began in San Diego Superior Court. A lessee, meaning someone leasing a Nissan, signed a release in a $3,548.40 settlement. On that summary judgment record, the Court of Appeal held the release void as against public policy.
Which Nissan Warranty Term Covers Your Defect, and How Does a Lemon Law Lawyer Read It?
Nissan's 2025 Warranty Information Booklet sets basic coverage at 36 months or 36,000 miles, whichever comes first. Powertrain coverage runs 60 months or 60,000 miles, whichever comes first. It covers engine parts, the transmission and its electronic controls, drivetrain parts and the restraint system. Coverage starts at delivery to the first retail buyer or first use, whichever is earlier.
The term covering your defect is the applicable express warranty, the written coverage whose end starts the elected-track filing clock. Booklets differ by model and year, so a Nissan lemon law lawyer reads the edition that came with your car.
The 2025 booklet says an owner incurs no charge when an over-the-air update harms a covered part or keeps it from working as intended during the new vehicle limited warranty. Its exclusions add that embedded software and updates are not covered, and the software is licensed rather than sold.
Normal maintenance, such as worn brake pads and rotors, falls outside coverage. Every booklet from 2021 through 2026 asks owners to keep maintenance records and to consent to Nissan accessing data stored in vehicle systems. It warns that failing to consent is likely to result in denial of warranty coverage.
How Does a Nissan Lemon Law Attorney Build the Repair Count From Recall Codes and Orders?
A recall does not create a claim by itself. A recall repair is still a dated repair visit, and finishing it does not close the claim if the defect returns. So each Nissan code on an order gets matched to its NHTSA campaign.
Say your Pathfinder brake complaint began at the Chula Vista store and moved to Kearny Mesa after a job change. Both stores' orders go into one timeline.
| Model | NHTSA owner complaints, 2021 to 2026 models, pulled October 2, 2026 | Recall campaigns, 2021 to 2026 models, pulled October 2, 2026 |
|---|---|---|
| Rogue | 1,711 | 21 |
| Pathfinder | 381 | 9 |
| Altima | 168 | 5 |
Complaints are owner reports, not findings, and say nothing about your own car. A campaign spanning several model years counts once, and NHTSA lists no 2021 Pathfinder.
Presumption Routes Open Within 18 Months or 18,000 Miles
The count feeds the presumption in Civil Code section 1793.22(b), a legal shortcut. It treats Nissan as having had a reasonable number of repair attempts once its conditions are met. The window closes at 18 months or 18,000 miles, whichever comes first. Nonconformity is the statute's word for a defect that substantially impairs a car's use, value or safety. The first route counts two or more repairs of a nonconformity likely to cause death or serious bodily injury. Another route counts four or more repairs of the same nonconformity. Either needs direct notice, a letter to Nissan itself, at least once when its warranty or manual disclosed that duty clearly and conspicuously. The third counts more than 30 cumulative days out of service for repair of nonconformities, with no notice. Nissan can rebut the presumption, but a claim can still succeed on the full repair history under section 1793.2(d)(2).
Complaint Wording That Holds a Nissan Repair Count Together
Your complaint line should carry your own words, such as a shudder between 20 and 30 mph under light throttle. Use the same words at each visit, because mismatched wording lets Nissan argue the orders describe different defects. Separately, Civil Code section 1793.2(b) gives each repair 30 days after delivery of the car for it. Only your written agreement or conditions beyond Nissan's control extend that limit.
Why Does a Nissan Lemon Law Lawyer Send the Direct Notice Before the 871.24 Demand?
Direct notice keeps the two-repair and four-repair routes open where Nissan disclosed that duty. The section 871.24 pre-suit notice, a written demand that Nissan repurchase or replace the vehicle, usually comes later. It must reach Nissan at least 30 days before a suit seeking civil penalties, extra money for a willful violation. Only that kind of suit requires it.
Say you lease a 2024 Rogue from Mossy Nissan Poway and hold three stalling orders. A direct notice now keeps the repeat-repair routes open inside the 18-month window. Civil Code section 1794(c) allows a civil penalty of up to twice actual damages, and the pre-suit notice rule reaches a Nissan sold in 2025 or earlier.
For a Nissan sold in 2025 or earlier, Code of Civil Procedure section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. Subdivision (c) pauses both limits during repair days and up to 60 days after a pre-suit notice. Section 871.29(d) requires Nissan to name the governing procedure for any Nissan sold new in 2026 or later. Where the older Civil Code procedures govern, Commercial Code section 2725 gives four years, generally from tender of delivery, or later if the warranty expressly covers future performance.
What the 871.24 Demand Says and Where Nissan Takes It
Section 871.24 asks for your name, the accurate VIN, a brief repair history and a demand to repurchase or replace. Nissan's California lemon law notice, checked October 2, 2026, accepts email or return-receipt certified or registered mail to its Consumer Requests box in Franklin, Tennessee. You must also have the car when you send it. Keep it 30 days after Nissan receives the demand, or 60 if Nissan offers.
Nissan has 30 days after receipt to offer and 60 to complete. Meeting both keeps civil penalties out, and missing either leaves them available. With counsel, the offer adds reasonable attorney fees and costs. Under section 1794(d), a buyer who prevails recovers costs and reasonable attorney fees from Nissan.
Why Contacting Nissan or the Dealer First Matters Before BBB Auto Line
DCA lists BBB Auto Line as the state-certified arbitration program for Nissan owners. If Nissan gave you timely written notice describing how it works, section 1793.22(c) has you use it before relying on the presumption. DCA reports that decisions usually arrive within 40 days of the program receiving your application. Nissan's booklet adds 7 days when the owner has not first contacted the proper person at the dealership or at Nissan.
An accepted decision binds Nissan, which under subdivision (d) must perform within a reasonable time, not over 30 days after you accept it. However, rejecting it keeps the lawsuit and the presumption. Program days also extend filing deadlines.
Nissan's California Arbitration Agreement and the Tennessee Venue Clause
The 2021 through 2024 booklets carry no Nissan arbitration agreement. The 2025 and 2026 editions add an Agreement to Arbitrate for California Vehicles Only. It sends disputes to one arbitrator at New Era ADR or the American Arbitration Association and allows small claims court. You can opt out within 30 days of first delivery by letter with your name, VIN and a plain opt-out sentence.
The 2026 booklet adds a Notice to Consumer that Nissan elected the section 871.20 procedures. It also names Williamson County, Tennessee courts for disputes not required to be arbitrated and says Code of Civil Procedure section 1283.05 will not apply. Civil Code section 1790.1 voids waivers of Song-Beverly rights except where the Act permits them. Your own booklet may differ.
Which Papers Should You Bring to a Nissan Lemon Law Lawyer, and in What Order?
Bring them in the order Cline APC reads them. The contract and delivery packet come first, then the booklet for your model year, then every repair order by date. Any letter already sent to Nissan or BBB Auto Line goes last, since its date may have started a clock.
In a free consultation, a Nissan lemon law lawyer checks which repair pattern your orders match and which deadline governs. The review also asks whether the arbitration agreement reaches your car. Still, nobody can promise how a claim ends.
