That is the deduction Nissan may take from a buyback for miles you drove before the first repair visit for the defect. Nissan lemon law claims can reach a Pathfinder that keeps returning for the same transmission or brake complaint. A buyback, also called restitution, refunds what you paid or still owe. In a replacement, Nissan supplies a substantially identical new Pathfinder.

How Early Is Too Early for a Nissan Pathfinder Lemon Law Lawyer to Question Rear Brake Wear?
Owners filed 381 NHTSA complaints on 2022 to 2026 Pathfinders in a pull on October 2, 2026. Service brakes drew 89, ahead of electrical at 66. Of 45 summaries naming brake pads or rotors, 38 describe worn rear brakes. Separately, 28 mention the transmission and 46 fall under the power train component, and the two groups overlap.
Each summary is an owner's account, not a finding. If they match your Pathfinder, put similar words on the repair order.
- Rear pads and rotors were gone by 12,000 miles.
- The rear brakes grind at stops.
- The pedal pulsates at freeway speed.
- A brake or parking brake warning message appears.
- The transmission shudders.
- The front brakes act up after the caliper recall.
Say your rear pads were gone at 12,000 miles and Mossy Nissan Escondido on Auto Park Way replaced them at your cost. That order still shows the first time you brought the problem in.
Which Pathfinder Years Carry Seat, Airbag or Brake Campaigns a Nissan Lemon Law Attorney Checks?
NHTSA lists nine campaigns for 2022 to 2026 Pathfinders. The 2022 model year has five and the 2023 has one, shared with the Rogue. The 2024 has two, and the 2025 has the front caliper campaign. Nissan's current Pathfinder specifications list a 3.5-liter V6 with a 9-speed automatic transmission.
| Model year | Campaign | Condition in NHTSA's record | Owner letters |
|---|---|---|---|
| 2022 | 21V706000 | Secondary hood latch bracket welds | Mailed November 17, 2021 |
| 2022 | 21V742000 | Third-row headrest weld or alignment | Mailed November 17, 2021 |
| 2022 | 21V743000 | Second-row seat back frame welds | Mailed November 17, 2021 |
| 2022 | 22V111000 | Second-row seat track bolt may be missing | Mailed April 13, 2022 |
| 2023 | 23V268000 | Driver power seat may not be fully secured | Expected June 10, 2023 |
| 2024 | 24V154000 | Driver airbag inflator may absorb moisture | Mailed April 10, 2024 |
| 2024 | 24V176000 | Left front lap belt pretensioner may be missing a rivet | Mailed April 18, 2024 |
| 2025 | 25V173000 | Front brake calipers may have reduced strength and could break | Mailed May 9, 2025 |
The fifth 2022 campaign, 22V527000, covers rental vehicles. Say you bought a 2023 Pathfinder SL at Mossy Nissan Oceanside on College Boulevard. A VIN search in NHTSA's recall lookup shows whether the seat campaign reaches it.
Could Recall 25V173000 Be the First Brake Visit a Nissan Pathfinder Lemon Law Lawyer Counts?
Only if it addressed the problem you keep reporting. Campaign 25V173000 has dealers inspect and replace front brake calipers on some 2025 Pathfinders. One or both calipers may have reduced strength and could break. That visit counts as your first delivery for the defect only when the problem it addressed is the one that returns.
Say your 2025 Pathfinder's front brakes act up after the caliper repair. The recall order may then carry the controlling mileage, so keep it with the owner letter. NHTSA's summary says a broken caliper can cause a loss of front brake function, so describe what the pedal and brakes felt like.
Bulletins NTB22-050 and NTB25-012 on Upshifts and Highway Shudder
Nissan bulletin NTB22-050, dated June 16, 2022, covers a 2022 Pathfinder built before May 11, 2022. The owner notices a first-to-second gear upshift at slow speeds while the fluid warms up, and no transmission control module codes are present. Bulletin NTB25-012, dated February 25, 2025, covers lugging, shutter or judder at highway speeds. It applies to 2023 and 2024 Pathfinders built on or before September 28, 2023. Dealers reprogram the engine control module if applicable. Bulletins are not recalls, so ask that the order cite the number.
Seat and Airbag Visits Still Leave an Odometer Reading
The seat, airbag and belt campaigns in the table have nothing to do with brakes. Each visit still leaves a dated mileage on an order. Ask for the printed order every time and keep it with the recall letter. A clear timeline helps when the brake or transmission complaint returns. A seat or belt problem that returns after its remedy deserves a prompt written complaint.
Does Normal Wear on the Invoice Still Date the First Brake Visit for a Pathfinder Lemon Law Attorney?
It can, if the wear is a defect. Nissan's 2024 booklet lists worn pads and rotors as normal maintenance, but a dealer that refuses coverage cannot erase the visit. Whether early wear is a defect is a question for a lawyer. Ask that the complaint line record your words, and keep the paid invoice.
The same booklet has a separate brake products warranty among its replacement-part warranties. It covers Genuine and Value Advantage pads, rotors, drums and shoes that Nissan supplied against defects in workmanship or materials for 36 months or 36,000 miles, whichever occurs first. It excludes normal wear.
Say Mossy Nissan Poway on Poway Road checks your rear brakes at 8,100 miles and finds nothing. That order, not a later one where pads were replaced, may mark the start of the count.
When the Complaint Changes Names in a Nissan Pathfinder Lemon Law File
Grinding from the rear at stops can become a pulsating pedal. A brake warning can become a parking brake fault. Seven summaries mention the parking brake, and six of those also discuss pads, rotors or wear. If the orders describe one defect, the earliest can set the offset. Compare the technician notes and parts replaced on each. Thirteen summaries use the phrases wear and tear or normal wear.
No Problem Found Visits and a First Stop at Another Store
The statute counts the first delivery for correction whether or not the dealer fixed anything. A call to Nissan Consumer Affairs is not a delivery. Any authorized Nissan facility counts. Say you bought in Oceanside and first reported the brakes at Mossy Nissan Chula Vista on Auto Park Place after moving. That order sets the mileage, so request printed copies from every dealer.
Which Presumption Route Does a Nissan Pathfinder Lemon Law Lawyer Match to Your Repair History?
Within 18 months or 18,000 miles, whichever comes first, three patterns lead California to treat Nissan as having had a reasonable number of repair attempts. They are two or more repairs of a nonconformity likely to cause death or serious bodily injury, four or more of the same nonconformity, or more than 30 cumulative days out of service.
That is the Civil Code 1793.22(b) presumption, a legal shortcut. A reasonable number of repair attempts means fair chances to fix the defect, and a nonconformity is a defect that substantially impairs the Pathfinder's use, value or safety. The first two routes also need direct notice, a letter from you to Nissan itself, at least once, if its booklet or manual disclosed that duty clearly and conspicuously. The 30-day route counts days out of service for repair of nonconformities and needs no notice. Nissan can rebut the presumption. After the window closes, a claim can still succeed on the full history under section 1793.2(d)(2). Say rear brake wear is first reported at 12,000 miles and a transmission shudder at 20,000. That is two defects with two first-visit dates.
Working the Offset on a $44,850 Pathfinder Contract
Section 1793.2(d)(2)(C) multiplies the price paid or payable by the miles driven before the first repair visit for the defect. It then divides by 120,000. The price counts transportation and factory options. Take a $43,455 price plus $1,395 transportation. A first brake order at 9,600 miles gives $3,588. A first order at 4,200 miles gives $1,569.75, which saves $2,018.25. If Nissan picked a 20,000-mile transmission visit instead, the same contract would give $7,475. The offset follows a replacement too. Try your figures in the buyback calculator. The firm runs the same arithmetic for Nissan Altima lemon law claims.
A lessee, the person leasing the Pathfinder, holds a buyer's rights under Civil Code 1795.4. A used Pathfinder carrying leftover factory coverage is outside the new motor vehicle definition under Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, unless Nissan's new car warranty was issued with that sale. Certified programs were not decided, so a certified Pathfinder usually falls outside. A selling dealer's own written warranty can still trigger section 1795.5.
What Section 871.27 Takes Out Before the Pathfinder Check Is Cut
For a Pathfinder sold in 2025 or earlier, Code of Civil Procedure 871.27 subtracts negative equity, such as $2,700 from a trade-in. A factory rebate never counts toward the price paid, so a $1,000 rebate is left out. It also leaves out GAP or service contracts from a third company, while selling-dealer add-ons stay recoverable. Collateral charges, such as $3,900 tax and $620 registration, add back. So do incidental damages, such as a $410 rental you paid, for a total of $4,930.
June 2027 and Other Filing Dates for a Nissan Pathfinder Lemon Law Suit
The Department of Consumer Affairs, or DCA, lists Nissan North America as an electing manufacturer. That means it opted in to the newer procedures, on April 28, 2025. The election covers a Pathfinder sold in 2025 or earlier. Section 871.21 requires a Pathfinder suit within one year after the applicable express warranty ends, and never more than six years after delivery. The applicable express warranty is whichever written coverage applies to your defect. Days in the shop for repairs pause both limits, and so do up to 60 days after a pre-suit notice, a written demand that Nissan repurchase or replace the vehicle. For a defect under basic coverage, the 2023 booklet sets 36 months or 36,000 miles, whichever comes first. With the odometer under 36,000 miles, a June 2023 delivery points to a default date of June 2027 before any pause. Your own booklet may differ.
That notice is required only before a suit that seeks civil penalties, meaning extra money for a willful violation. Nissan must receive it at least 30 days before the suit is filed. After Nissan receives the notice, it has 30 days to offer and 60 days to complete. If it meets both dates, civil penalties are out of the case, and missing either date leaves them available. When a Pathfinder is sold new in 2026 or later, Nissan must name the governing procedure under section 871.29(d). If Nissan gave timely written notice of BBB Auto Line, section 1793.22(c) has you use it before relying on the presumption.
Why Circle the Earliest Repair Order Before Meeting a Nissan Pathfinder Lemon Law Lawyer?
Cline APC reviews the contract, the window sticker and every repair order in date order. A Nissan Pathfinder lemon law lawyer does that in a free consultation. The review looks at which order likely sets the offset and which deadline governs.
Say you are missing one early order. Ask the dealer for a copy before the review. Section 1794(d) shifts costs and reasonable attorney fees to Nissan when a buyer prevails. Nobody can promise a result.
