Before anyone argues about repair orders, a Porsche lemon law lawyer asks one question. Does California's lemon law reach this car and this owner at all?

The answer starts with the definition of a new motor vehicle in Civil Code section 1793.22. Personal use or the small-business clause is the first gate. A lease or a demonstrator sold with Porsche's new car warranty is the second, and a California purchase is the third. Only then does the repair record decide whether Porsche had a reasonable number of repair attempts, meaning enough chances to fix the defect.

Cline APC takes only California lemon law and consumer warranty cases, working from La Jolla and Poway. If one fault has survived two trips to a Porsche Center, call (888) 982-6915 with the registration card and contract nearby.

Which Cayenne and Taycan Service Records Does a Porsche Lemon Law Attorney Need?

NHTSA's recall data for model years 2021 through 2026, pulled September 29, 2026, lists 26 campaigns touching the Taycan. It lists 8 touching the Cayenne. Neither number makes a car a lemon. Each recall trip still lands on the service record as a Porsche repair visit.

A defect that returns after the fix can become the nonconformity. Section 1793.22(e)(1) defines that as a defect that substantially impairs use, value or safety for the buyer or lessee.

ModelModel yearsDefect or recordClaims
Cayenne2021 to 20268 NHTSA campaigns, including a rear axle lock nut (21V271000) and a later alignment check (22V040000)Porsche Cayenne claims
Taycan2021 to 202626 NHTSA campaigns, six on the high-voltage battery, each tied to fire riskPorsche Taycan claims

Say your Cayenne went in for a recall repair, then twice more for the same steering vibration. The recall visit belongs in the count if the vibration is the same problem. The concern line on each repair order answers that, so a Porsche lemon law lawyer reads those lines first.

A Porsche Center That Found Nothing Still Had Its Chance

A no-problem-found visit still proves something. Porsche had the car in its shop, and the car left unrepaired. In Oregel v. American Isuzu Motors, Inc., 90 Cal.App.4th 1094, the dealer never found a persistent oil leak. The buyer only had to prove the car did not conform to the warranty. Still, in Krotin v. Porsche Cars North America, Inc., 38 Cal.App.4th 294, Porsche won 11 to 1 by leaning on the dealers' records. Its counsel told jurors that "records don't lie."

A Defect That Hurts Value More Than Use

A Porsche can still carry you to the office while a defect drags down what it is worth. Porsche's technical bulletin 166/24, filed with NHTSA, covers the carbon roof on certain 2020 to 2022 Cayennes. Coverage runs six years from delivery, whatever the mileage, for damaged paint and yellowing along the roof's edges. The bulletin adds that Porsche plans no active customer communication unless local law requires it. Whether a flaw like that impairs value to you is a fact question a Porsche lemon law lawyer builds from the price and the options sheet.

Can a Lemon Law Attorney Claim a Porsche Buyback for Your Company or Lease?

Restitution, the statute's buyback, refunds the price paid or payable plus taxes, official fees and incidental damages, meaning costs the defect forced on you, such as tows and rental cars you actually paid for. Qualifying businesses and lessees choose restitution or replacement, a substantially identical new Porsche, on the same terms as individuals.

A mileage offset, the deduction for miles driven before the first repair visit for that defect, comes off under Civil Code section 1793.2(d)(2). Porsche cannot make you take a replacement. A civil penalty is extra money the court may add for a willful violation. Compare any Porsche offer line by line before you sign.

Say your two-dentist practice in Carmel Valley owns a Cayenne, a Macan and a courier van, all registered here. That count of three keeps the practice under the clause's five-vehicle limit, which a Porsche lemon law lawyer confirms from DMV records. The firm's buyback calculator offers a rough starting number. Five California Registrations or Fewer, and Why Zero Fails

Section 1793.22(e)(2) reaches a business vehicle under 10,000 pounds gross vehicle weight, bought or used mainly for business. No more than five motor vehicles may be registered in California to that buyer. The word person covers an LLC, a corporation or a partnership. In Park City Services, Inc. v. Ford Motor Co., 144 Cal.App.4th 295, a limousine company with no California registrations lost its judgment against Ford. The court required at least one registration and no more than five. The statute does not say on which date the count is taken.

Turning In a Leased Porsche While the Lemon Law Claim Is Open

Civil Code section 1795.4 lets a lessee enforce every right against Porsche that a purchaser could. Section 1793.2(d)(2)(D) counts a lessee as a buyer. A 36-month lease can run out while a claim is still open. Martinez v. Kia Motors America, Inc. (2011) 193 Cal.App.4th 187 held that a plaintiff need not possess or own the vehicle to get replacement or restitution. Turning the car in still shrinks the evidence, so photograph it and collect the final repair orders first. A lease in a company's name must also fit the small-business clause.

Bought in Arizona, Serviced on Miramar Road

In Cummins, Inc. v. Superior Court, 36 Cal.4th 478, the California Supreme Court limited Song-Beverly to vehicles purchased in California. Say a Rancho Bernardo owner bought a Macan from an Arizona dealer, then took it to Porsche San Diego at 9020 Miramar Road five times. Those repairs do not move the sale. Porsche's warranty still covers vehicles purchased and registered in the USA and Canada, so federal warranty law may help instead. A contract signed at Porsche Carlsbad on Avenida Encinas is a California sale.

How Does a San Diego Attorney Weigh Porsche Recall Counts Against the Presumption?

Inside 18 months or 18,000 miles, whichever comes first, the Civil Code 1793.22(b) presumption treats Porsche as having had a reasonable number of repair attempts. Two repairs of a nonconformity likely to cause death or serious bodily injury trigger it. So do four repairs of one nonconformity, or more than 30 cumulative days out of service for repair.

The first two routes require direct notice to Porsche itself at least once, if its warranty materials clearly disclosed that duty. Porsche's California notice names Customer Relations at One Porsche Drive in Atlanta, not a Porsche Center, for that notice. The 30-day route carries no notice condition. Porsche can rebut the presumption, and a claim outside the window can still succeed on the full repair history under section 1793.2(d)(2). The Department of Consumer Affairs (DCA) says in its FAQ that at least two repair attempts are needed.

Owner complaints to NHTSA on 2021 to 2026 Cayennes44
Certified arbitration program DCA lists for PorscheCAP-Motors, listed for no other manufacturer

Those NHTSA figures were pulled September 29, 2026. Complaints are owner reports, not findings. Say a 2023 Taycan with a battery warning visits Miramar Road four times in its first year. Then each visit for the same warning builds toward the four-repair route. NHTSA's recall lookup shows which campaigns reach your VIN.

The 30-Day Rule for a Single Porsche Repair

Civil Code section 1793.2(b) gives each warranty repair 30 days to make the car conform. Only your written agreement, or a delay caused by conditions beyond Porsche's control, extends that period. Say a Taycan sits 34 days on Miramar Road waiting on a battery module. Unless you agreed in writing or the wait came from conditions beyond Porsche's control, that visit breaks the 30-day repair rule. The presumption's 30-day route is a separate count across every visit. Only conditions beyond Porsche's control extend it, and a signed extension does not.

Independent Shop Invoices and Emergency Repairs Away From a Porsche Center

An invoice from an independent shop in Kearny Mesa can document a symptom. It does not show Porsche had a chance, because the statute counts attempts by the manufacturer or its representative. Porsche's booklet allows emergency repairs elsewhere only when the car is disabled and no Porsche Center is nearby. Even then, it asks you to return the replaced parts and the paid repair order for reimbursement consideration.

Why Does a Porsche Lemon Law Lawyer Ask When a Demo Porsche's Warranty Started?

Porsche's online warranty terms and 2026 booklet set the New Car Limited Warranty at four years or 50,000 miles, whichever comes first. It starts at first delivery to a retail purchaser. It starts earlier if the car first served as a demonstrator, lease car or company car.

Section 1793.22 still sweeps in a dealer-owned car or a demonstrator sold with the manufacturer's new car warranty. Say you bought a 911 after seven months in a dealer's demo fleet. So it reaches you with about 41 months of time coverage left. Porsche's 2026 battery electric manual also covers a Taycan's high-voltage battery for 8 years or 100,000 miles, whichever comes first.

Demo Miles and the 18,000-Mile Half of the Presumption

The presumption's window runs 18 months from delivery to the buyer or 18,000 odometer miles, whichever comes first. The months run from your own delivery date. Read literally, the miles half counts the odometer, demo miles included. A 911 delivered with 3,400 demo miles leaves 14,600 miles of window at signing. Ask the selling Porsche Center in writing when coverage began on your VIN.

Porsche Approved Certified Cars and the New-Car Line

Under Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, leftover factory coverage alone does not make a used car a new motor vehicle. The exception is a car whose new car warranty from the manufacturer was issued with that sale. Certified pre-owned programs were not decided there. So certified Porsches usually sit outside the new-vehicle remedy, though courts have not settled the point. Porsche's online warranty terms put its Approved Certified Pre-Owned Limited Warranty at 2 years with unlimited miles after the new car warranty expires.

In What Order Does a Porsche Lemon Law Lawyer Handle CAP-Motors and the Four-Year Deadline?

Porsche was not on the DCA list of carmakers electing newer court procedures in a September 2026 check. So the section 871.24 pre-suit notice, a written demand due to an electing manufacturer at least 30 days before a suit seeking civil penalties, does not apply. Commercial Code section 2725 gives four years instead, generally from tender of delivery, the handover.

The clock can start later when the warranty explicitly extends to future performance and discovery of the breach must await that performance. The period then runs from when the breach is or should have been discovered. Section 871.29(d) also says Porsche must name the governing procedure when it sells a car new in 2026 or later.

Say a Cayenne was delivered on June 10, 2023, and its air suspension began faulting in 2025. Counting from delivery, the default date is June 10, 2027. Whether Porsche's four-year warranty moves that date is a question about your booklet.

DCA lists CAP-Motors as Porsche's certified arbitration program. Timely written notice of CAP-Motors from Porsche, under section 1793.22(c), means you use it before relying on the presumption. Program days extend the limitation period. The booklet says a decision binds Porsche but not you. Porsche's California notice says it complies within a reasonable time, and no later than 30 days after receiving your acceptance.

What CAP-Motors Turns Away, From Commercial Use to Airbag Claims

Porsche's booklet says CAP-Motors will not arbitrate claims for a vehicle involved in an accident. Claims that an airbag failed to deploy, or deployed when it should not have, are out too. So is a vehicle used for commercial purposes, unless the state's lemon law covers one, and California's small-business clause covers some. The California notice gives six months after the warranty expires to file with CAP-Motors. CAP-Motors does not award multiple damages or attorney fees.

Binding AAA Arbitration Added to Recent Porsche Warranty Booklets

Porsche's 2025 and 2026 booklets add a separate binding arbitration provision that the 2024 booklet lacks. Either side may elect it, even after a claim is filed in court. A single arbitrator then decides under the American Arbitration Association's Consumer Arbitration Rules. The opt-out is a letter to Customer Relations within 30 days after the car first visits a Porsche Center. Your own booklet may differ, and whether the clause binds a California lemon claim is a legal question. The firm reviews it with Porsche owners in La Jolla and across the county.

Will Your Porsche Clear Every Eligibility Gate a Porsche Lemon Law Lawyer Checks?

A strong repair record does not help a car outside the statute. Six registered vehicles at a company, a purchase in another state or a certified pre-owned sale can each block the buyback remedy. A Porsche lemon law lawyer can spot those problems from a handful of documents in one conversation.

Cline APC offers that review as a free consultation, by phone or at the Ivanhoe Avenue office. Bring the contract or lease, the registration card and the warranty booklet for your model year. Business owners should also bring the DMV printout of company registrations.

A lawyer checks ownership, the warranty start date and the point of sale, then tells you whether CAP-Motors comes first. If a buyer prevails, section 1794(d) awards costs and reasonable attorney fees. Nobody can promise how a claim ends.

With the documents in one folder, message the firm online or call (888) 982-6915 and say whose name is on the title.
