Porsche Cayenne Lemon Law Lawyer in San Diego
Say the appraiser at a Porsche Center just offered $61,000 for the Cayenne you bought for $98,000. The warning that sent it back four times glows as the appraiser drives. Before you sign, a Porsche Cayenne lemon law lawyer puts a second number beside that offer.

It is what California's buyback statute would return.
A trade offer prices a used SUV with a known defect. Restitution under the buyback rule in Civil Code section 1793.2 prices what you paid instead. It is the refund a manufacturer owes for a car it could not fix.
Cline APC works only in California lemon law and consumer warranty matters. If a Porsche Center is waiting on your answer, call (888) 982-6915 before you sign.
Which Cayenne Warnings Should a Porsche Lawyer See Before the Trade Appraisal?
Owners filed 44 NHTSA complaints on 2021 through 2026 Cayennes as of September 29, 2026, led by forward collision avoidance at 13 and the electrical system at 12. Porsche's recall filings describe the risk of axle misalignment, a detached steering column, a cracked control arm, a fuel leak and a missing backup image.
Complaint counts are categories, not diagnoses. Describe your own symptom the same way at every visit, in lines like these.
- Driver assistance cameras drop out on the freeway.
- The SUV pulls to one side at freeway speed after axle work.
- No backup picture appears in reverse.
- A fuel smell comes from the engine bay.
- Rear hazard or parking lights stay dark after shutdown.
Say your 2024 Cayenne S loses its driver assistance cameras on State Route 56 from 6,000 miles on. Orders that repeat those words can tie the visits to one nonconformity. That is a defect that substantially impairs the SUV's use, value or safety to you.
Why Does a Porsche Cayenne Lemon Law Attorney Look Hard at the 2021 Model Year?
The 2021 model year drew 21 of the 44 complaints, against 3 for 2022 and 5 each for 2023 and 2024. The 2021 cars also carry the axle, steering column, seat heating and camera campaigns, and the 2024 cars add three more.
| Model year | Owner complaints | Campaigns | Condition in Porsche's filing |
|---|---|---|---|
| 2021 | 21 | 21V271000, 21V318000, 21V493000, 22V040000, 25V896000 | Axle lock nut, seat back heater, steering column screw, alignment check, rearview camera |
| 2022 | 3 | 22V040000, 25V896000 | Alignment check, rearview camera |
| 2023 | 5 | 25V896000 | Rearview camera |
| 2024 | 5 | 23V527000, 24V533000, 25V634000, 25V896000 | Rear lighting, control arm, fuel pump fasteners, rearview camera |
| 2025 | 6 | 25V634000, 25V896000 | Fuel pump fasteners, rearview camera |
| 2026 | 4 | 25V634000 | Fuel pump fasteners |
Say NHTSA's recall lookup shows an open camera campaign on your 2021 Cayenne the week you plan to trade. Finishing it adds a dated Porsche repair order to your file.
Does Rear Axle Work Done Twice Help a Porsche Cayenne Lemon Law Lawyer?
Campaign 21V271000 covered certain 2021 Cayennes whose rear trailing arm lock nut could break from stress corrosion and misalign the axle. Campaign 22V040000 then covered certain 2021 and 2022 Cayennes, and its filing says the alignment may not have been inspected after 21V271000 repairs. That is a recall fix that needed another visit.
Porsche's bulletin 71/24, filed with NHTSA, adds two years beyond the new car warranty for the air ionizer on assigned 2021 to 2023 Cayennes, whatever the mileage. Porsche plans no active notice to owners unless the law requires it.
Say your 2021 Cayenne had the axle campaign, then returned twice for the same pull. A lawyer reads the three orders together.
Can a Steering Recall Count as One of Two Porsche Cayenne Lemon Law Repairs?
Civil Code section 1793.22(b) creates a presumption that treats Porsche as having had a reasonable number of repair attempts, in other words a fair number of chances to repair the defect. It covers events within 18 months or 18,000 miles, whichever comes first. One route is two repairs of a nonconformity likely to cause death or serious bodily injury. Another is four repairs of the same nonconformity, and the third is more than 30 cumulative days out of service for repair. Only the first two routes require direct notice at least once, a written report to Porsche Cars North America itself, and only if Porsche's warranty materials clearly disclosed that duty. Porsche may rebut the presumption, and a claim outside the window can rest on the whole repair record. If Porsche gave timely written notice of its certified program, CAP-Motors, section 1793.22(c) sends you there first.
Campaign 21V493000 addressed certain 2021 Cayennes whose steering column screw connection could fail and detach the column. Campaign 24V533000 addressed certain 2024 Cayennes whose upper front control arm may have been installed with cracks, risking a sudden loss of steering control. A recall repair is still an attempt on a Porsche repair order. If the same steering fault returns afterward, that visit can be the first of the two repairs.
Cayenne Campaigns You Might Never Notice From the Driver's Seat
Campaign 25V634000 covers certain 2024 to 2026 Cayennes whose high-pressure fuel pump fasteners may not be tightened properly, risking a fuel leak. Under 25V896000, certain 2019 through 2025 Cayennes may show no rearview image in reverse. Campaign 23V527000 covers certain 2024 models whose rear hazard and parking lights may stay dark if switched on within 10 seconds after a control unit shuts off.
Why Does a Lawyer Want the Cayenne Inspected Before You Trade It?
A traded Cayenne leaves your control, and so does the chance to inspect it. CAP-Motors, the certified arbitration program Porsche uses, can have an impartial technical expert inspect the vehicle, Porsche's California notice says. Section 1793.22(d)(6) requires certified programs to provide that inspection without charge to you when the arbitrator asks.
The Department of Consumer Affairs (DCA) certifies CAP-Motors and lists it for Porsche. Before any trade, photograph the warning screens and record the fault on video. Say the camera fault shows up mostly on the drive home to Carmel Valley on State Route 56. A dated phone video with the warning on screen is harder to dismiss than an order marked could not duplicate.
A Written Appraisal as Proof of Lost Value
The nonconformity test covers value as well as use and safety. A dealer's written bid that notes the fault is a document about value. An appraiser who sees a flashing warning simply bids lower. In a trade, the depreciation stays with you as well. Ask the dealer for the offer in writing, even if you never plan to accept it.
Five Weeks on Avenida Encinas Waiting for a Camera Module
Civil Code section 1793.2(b) gives Porsche 30 days to complete each warranty repair. Only your written agreement, or delay beyond Porsche's control, extends that limit. Say a Cayenne sits five weeks at Porsche Carlsbad on Avenida Encinas waiting on a camera module. Unless you agreed in writing or the delay was beyond Porsche's control, that visit broke the 30-day rule. Section 1795.6 also pauses the warranty period while the SUV sits for warranty work. If a repair fails and you report it within 60 days after completion, the warranty cannot lapse in the meantime.
Should a Porsche Cayenne Lemon Law Lawyer Count Repairs Before You Trade?
Yes, because a trade made before Porsche has had a reasonable number of attempts can cost the remedy. That holds whether the claim rests on the presumption's two-repair, four-repair or 30-day route, or on the full history. So the repair count and a written repurchase request come before any signature.
Cline APC's Porsche lemon law lawyers begin with that sequence. Say you trade at Porsche Carlsbad after two visits, before asking Porsche for a buyback. You may have given Porsche too little chance to comply, and the California Supreme Court left that situation undecided.
Niedermeier and the Question the Court Left Open
Niedermeier v. FCA US LLC (2024) 15 Cal.5th 792, decided March 4, 2024, held that a trade-in credit does not reduce restitution. That holds at least when the manufacturer's own failure to comply forced the trade. The owner had asked for a buyback three times and made 14 repair presentations by her third request, and the jury found the violation willful. The court left open a trade made before the manufacturer's chance to pay. It said a buyer who trades before allowing a reasonable number of repair opportunities cannot obtain restitution, or a replacement, meaning a substantially identical new vehicle. A private sale follows the same logic.
A written repurchase request to Porsche Cars North America Customer Relations at One Porsche Drive in Atlanta builds that kind of record. Porsche's booklet says notice to a Porsche Center does not count.
Restitution Versus a $61,000 Trade Offer on a $98,000 Cayenne
Section 1793.2(d)(2)(B) starts from the price paid or payable, with transportation charges and manufacturer-installed options. Collateral charges such as sales tax and registration come back, plus incidental damages, meaning towing, rental and repair bills you actually paid. The mileage offset in (d)(2)(C) then subtracts use before your first repair visit for the defect. Take 98,000 times 6,000 miles, divided by 120,000, and the offset is $4,900. Restitution starts near $93,100 before taxes and incidentals, more than $30,000 higher than the trade offer. A lender's payoff normally comes out in either path, but a trade rolls any shortfall forward as negative equity. These figures are hypothetical, and the firm works each line with Porsche owners in La Jolla. The buyback calculator gives a first pass.
Choosing a New Cayenne Through the Statute Instead of a Trade
Section 1793.2(d)(2)(A) lets you take a replacement Cayenne carrying every new-vehicle warranty. Porsche also pays the sales or use tax, registration fees and incidental damages that come with it. You choose between replacement and restitution. California's tax agency says in Publication 34 a trade-in allowance cannot be excluded from the amount taxed. The same publication treats a lemon law replacement as part of the original sale. Tax then runs only on any difference in value, and a cheaper replacement should bring a refund of the difference, tax included.
Did the Four Years Already Run on a 2022 Porsche Cayenne Lemon Law Claim?
A September 2026 check of the DCA roster of manufacturers electing newer court procedures found no Porsche entity. So no pre-suit notice stands in the way. That is a written demand owed to an electing manufacturer ahead of a suit for civil penalties, meaning extra money for willful violations. Commercial Code section 2725 allows four years, counted generally from tender of delivery, the handover. An exception applies if the warranty explicitly extends to future performance and discovery of the breach must await that performance. In that case the four years run from the date the breach is or should have been discovered.
Say a Cayenne left Porsche Carlsbad in August 2022. Counting from delivery, the default date was August 2026. The exception, or CAP-Motors days under section 1793.22(c), may still matter. Porsche's California notice says CAP-Motors can award repurchase or replacement, but not multiple damages or attorney fees, and takes claims until six months after the warranty expires.
Can a Porsche Cayenne Lemon Law Lawyer Set Your Trade Sheet Beside a Restitution Figure?
A free consultation at Cline APC puts the dealer's written offer next to a restitution worksheet. It draws on your contract, loan statement and every repair order, recall visits included. You see what each path leaves you before the dealer gets an answer.
Owners of an electric Porsche get the same review from a Porsche Taycan lemon law lawyer. Costs and reasonable attorney fees go to a buyer who prevails in court under section 1794(d), though nobody can promise how a claim ends.
A Porsche Cayenne lemon law lawyer can meet you on Ivanhoe Avenue in La Jolla or talk it through by phone. Send the firm a short message or call (888) 982-6915, and hold the trade offer until a lawyer has set it beside the restitution figure.
