Civil Code section 1793.22 asks whether a warranty defect substantially impairs the vehicle's use, value or safety, and any one of the three is enough. If so, the law calls it a nonconformity. When Rivian cannot fix it after a reasonable number of attempts, meaning a fair number of chances given how serious the defect is, Rivian must replace the vehicle or make restitution, the legal word for a buyback.
Rivian says its New Vehicle Limited Warranty comes with every new passenger vehicle bought from Rivian. The Department of Consumer Affairs (DCA) lists Rivian under BBB Auto Line as a manufacturer with a state-certified arbitration program. Rivian was absent from the DCA roster of manufacturers that opted in to newer court procedures on November 2, 2026.
The firm, Cline APC, accepts only lemon law and warranty matters, from offices on Ivanhoe Avenue in La Jolla and Danielson Street in Poway.
When one defect keeps bringing your R1T or R1S back, call (888) 982-6915 with your newest service record in hand.
What Does a Rivian Lemon Law Lawyer Read First When a Truck or SUV Keeps Failing?
Every service record comes first, then the purchase or lease contract and Rivian's Warranty Guide. Rivian's support center lists the terms below for the R1, and your own model year and configuration control.
| Coverage | Term | Applies to |
|---|---|---|
| Comprehensive | 4 years or 50,000 miles | R1, model years 2025 and newer, and 2022 to 2024 except Quad Large |
| Comprehensive | 5 years or 60,000 miles | R1 Quad Large, model years 2022 to 2024 |
| Battery and drive system | 8 years or 120,000 miles | Dual Standard and Standard+ |
| Battery and drive system | 8 years or 150,000 miles | Dual Large and Dual Max, plus Tri and Quad for 2025 and newer |
| Battery and drive system | 8 years or 175,000 miles | Quad Large, model years 2022 to 2024 |
| Occupant active restraint system | 8 years or 100,000 miles | Listed as additional coverage |
| 12-volt battery | 3 years or 36,000 miles | Listed as additional coverage |
| Corrosion, perforation only | 8 years | Listed as additional coverage |
The source for every row is Rivian's warranty coverage article. Whichever limit comes first ends each term. The same page lists a one-year or 12,000-mile adjustment warranty, and it says Rivian fleet vehicles fall under a separate commercial warranty.
Say you lease an R1S in Del Mar, and one drive-system fault sends it back to Rivian four times in 14 months. Civil Code section 1795.4 gives a lessee, someone who leases rather than buys, the same rights against the manufacturer that a buyer holds.
Four Repairs, Two Repairs, or 30 Days Out of Service
Subdivision (b) of section 1793.22 creates a presumption, a rule of proof. Inside 18 months or 18,000 miles, whichever comes first, three patterns treat Rivian as having had a reasonable number of repair attempts. Four or more repairs of the same nonconformity is one. Two or more repairs of a nonconformity likely to cause death or serious bodily injury if the vehicle is driven is another. Both of those routes also need direct notice, a letter to the manufacturer itself, if the warranty materials clearly disclose that duty. The third route counts more than 30 cumulative calendar days out of service for repair of nonconformities, and it needs no notice.
Rivian can rebut the presumption. After the window closes, a vehicle can still qualify on its whole repair record under section 1793.2, subdivision (d)(2). Separately, subdivision (b) of that section expects each warranty repair within 30 days unless you consent in writing or the delay is beyond the manufacturer's control.
Counting Every Visit, Whoever Did the Work
Section 1793.2, subdivision (d)(2), counts attempts by the manufacturer or its representative in this state. Rivian's support center lists authorized service providers beside its own service locations. Keep each visit to either in the file, with the date, the mileage and the symptom written on the record. Ask for the complaint and the repair to appear in the technician's own words.
Does Rivian Owe the Buyback a Lemon Law Attorney Demands?
Rivian owes it. Once Rivian's reasonable repair chances run out, Civil Code section 1793.2, subdivision (d)(2), requires the manufacturer to promptly replace the vehicle or make restitution. The DCA says in its FAQ that the manufacturer, not the dealership, repurchases or replaces. You choose, and Rivian cannot force a replacement on you.
| Line item | Treatment in a Song-Beverly repurchase | Source |
|---|---|---|
| Price paid or payable, with transportation charges and Rivian-installed options | Refunded | Civil Code 1793.2(d)(2)(B) |
| Sales or use tax, license, registration and other official fees | Refunded | Civil Code 1793.2(d)(2)(B) |
| Towing, rental and repair costs actually incurred | Refunded as incidental damages | Civil Code 1793.2(d)(2)(B) |
| Add-ons that did not come from Rivian | Left out | Civil Code 1793.2(d)(2)(B) |
| Miles driven before the first repair visit for the defect | Subtracted as the offset | Civil Code 1793.2(d)(2)(C) |
| Section 871.27 deductions, such as rolled-in negative equity | Not applied to Rivians sold in 2025 or earlier | CCP 871.30 |

Rivians Bought Used With Factory Coverage Left
Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make a used vehicle new, unless the new car warranty was issued with that sale. The court left certified pre-owned programs unaddressed. A used Rivian therefore usually falls outside the new-vehicle remedy, though the point is unsettled.
What Does BBB Auto Line Change for a Rivian Owner?
It adds a step you can use for free. The DCA lists BBB Auto Line, at (800) 955-5100, as the state-certified program covering Rivian. According to the DCA, arbitration is free, decisions usually come within 40 days, and the manufacturer must perform an accepted decision within 30 days. You may reject the decision and still pursue other options.
A manufacturer may offer to settle once you apply, and accepting is your choice. With timely written notice of the program and a description of its operation and effect, you use it before relying on the presumption, per Civil Code section 1793.22, subdivision (c). Days spent in the program extend your deadlines. Read the DCA arbitration page before you file.
Rivian Is Not on the DCA Election List, So Which Deadline Does a Rivian Lemon Law Lawyer Use?
Four years under Commercial Code section 2725, or section 10506 for a lease. Rivian is not on the DCA roster of manufacturers that opted in to the 2025 procedures. So those procedures do not reach a Rivian sold in 2025 or earlier. The four years generally run from tender of delivery, and BBB Auto Line days extend them.
Section 871.20, subdivision (a), of the Code of Civil Procedure limits the newer chapter to electing manufacturers, and section 871.30 keeps it away from 2025 and earlier sales without an election. That removes the section 871.24 pre-suit notice, a demand required only before a suit that seeks civil penalties from an electing manufacturer.
An exception in Commercial Code section 2725 applies when two conditions meet. The warranty must explicitly reach future performance, and the breach cannot be discovered until that performance occurs. The period then starts when the breach is or should have been discovered. For a Rivian sold new in 2026 or later, section 871.29, subdivision (d), requires Rivian to name the governing procedure at sale. Under Civil Code section 1794, subdivision (d), a buyer who prevails recovers costs and reasonable attorney fees.
Rivian is also a battery-electric brand, like Tesla, and the firm reads both against the manufacturer's own warranty terms.
