Tesla Lemon Law Lawyers in San Diego
One fault, four channels. A mobile technician works on it in your driveway, the app replies with troubleshooting steps, and an overnight update claims a fix. Then the car still spends a week at Kearny Mesa. A Tesla lemon law lawyer counts every one of those contacts.

Under California lemon law, a new Tesla bought or used mainly for personal, family or household purposes can qualify. The test is whether Tesla fixed a defect within a reasonable number of repair attempts. That phrase means enough chances to cure the defect, judged on your car's facts.
A nonconformity is a defect that substantially impairs use, value or safety, under Civil Code section 1793.22(e). The remedy is restitution, often called a buyback, or a substantially identical new Tesla as a replacement. Because Tesla, Inc. builds, sells, warrants and services the car, every technician and software release comes from the company you would claim against.
Cline APC practices California lemon law and consumer warranty law, and nothing else. If one Tesla defect keeps returning, call (888) 982-6915 with the app open.
Which Tesla Defects Does a Tesla Lemon Law Lawyer Document, From Steering Assist to Door Locks?
Each model has its own record. Certain 2023 Model 3 and Model Y cars shared steering assist campaign 25V092000, remedied over the air. NHTSA investigated unexpected braking on 2021 and 2022 Model Y cars before closing that probe in 2026. Model X campaigns reach door locks and the hood latch, while the 2024 Cybertruck drew bed trim campaign 24V457000.
| Model | Model years | Defect or record | Claims |
|---|---|---|---|
| Model 3 | 2023, campaign 25V092000 | Steering assist loss after a stop, remedied over the air | Tesla Model 3 lemon law claims |
| Model Y | 2021 and 2022, NHTSA probe PE22-002 | Slowdowns with no vehicle ahead, probe closed without a recall | Tesla Model Y braking claims |
| Model X | 2021 to 2023, campaign 23V862000 | Cabin door locks that could unlock in a crash | Tesla Model X door claims |
| Cybertruck | 2024, campaign 24V457000 | A bed trim sail applique that could loosen | Tesla Cybertruck claims |
Say your 2022 Model Y brakes hard for no visible reason under the Interstate 805 overpasses near University City. You report it in the app twice, and both replies suggest cleaning the cameras. Neither reply puts a technician on the car. Even so, each one dates the moment Tesla heard your complaint.
The App Complaint Box and Consistent Wording
The words you type in the app become the complaint line Tesla carries onto later invoices. So describe the symptom the same way every time. Give the speed, the road, the weather and how often it happens. Matching wording helps show one nonconformity across four visits. Rather than "Autopilot acting weird," write "hard braking at 65 miles per hour on Interstate 805, no car ahead."
When the Technician Cannot Reproduce a Tesla Fault
An invoice may close with a note that the technician could not reproduce your concern. That visit still counts as a chance Tesla had to fix the car. The Fourth District, Division One, which hears San Diego appeals, decided Oregel v. American Isuzu Motors, Inc. (2001) 90 Cal.App.4th 1094. It held that a buyer is not responsible when the manufacturer's agents cannot isolate the problem.
Is There a Tesla Buyback Program, or Does a Lemon Law Attorney Rely on the Statute?
What owners search for as a Tesla buyback program is, in California, restitution under Civil Code section 1793.2(d)(2)(B). It refunds the price paid or payable, with factory options, collateral charges and incidental damages, minus any mileage offset, a deduction for the miles you drove before the first repair visit for that defect.
| Line item | Treatment under Song-Beverly |
|---|---|
| Price paid or payable, with transportation charges and factory-installed options | Refunded |
| Collateral charges, meaning sales or use tax, license, registration and other official fees | Refunded |
| Incidental damages, such as towing, rental car and repair costs you actually paid | Added |
| Items a dealer or you installed that Tesla did not make | Left out |
| Miles driven before the first delivery to Tesla for the defect | Subtracted as the mileage offset under 1793.2(d)(2)(C) |
Say you paid $54,000 for a Tesla. The formula takes the price, times the odometer miles at the first visit for the defect, over 120,000. A first mobile visit at 3,000 miles gives $1,350, while a later center visit at 9,000 miles gives $4,050. Your contract and records set the real figure, and a Tesla lemon law lawyer can check each line at (888) 982-6915. The other remedy is a replacement, a substantially identical new Tesla, and Tesla can never require you to take one.
Driveway Visit or Service Center Visit, Which One Sets the Tesla Offset?
The offset stops at the first delivery to Tesla or its authorized repair facility for the problem that became the nonconformity. On a Tesla, that first contact may be a driveway visit. Tesla says mobile technicians who cannot fix an issue can often pre-diagnose it for a center visit. Tesla may still argue the center visit was the first repair, so keep the mobile invoice and its odometer reading.
Rental Cars and Tows While a Tesla Sits
Towing, rental car and reasonable repair costs count as incidental damages when you actually paid them. If Tesla gave you a loaner, there is no rental cost to claim for those days. Without one, keep the rental agreement for your Sorrento Valley commute and the card receipt. A tow from Interstate 15 to the Miramar service center belongs in the same folder. The firm's buyback calculator then gives a rough first figure.
How Long Does Tesla's Warranty Last, and Which Booklet Version Does a Tesla Lemon Law Lawyer Read?
Tesla's New Vehicle Limited Warranty, effective September 1, 2026, gives the Basic Vehicle Limited Warranty 4 years or 50,000 miles, whichever comes first. Battery and Drive Unit coverage runs 8 years, capped at 100,000, 120,000 or 150,000 miles by model. The booklet ties covered repairs to notice within the warranty period.
An express warranty is the written promise in that booklet. Your own booklet version, fixed by your delivery date, controls, because booklets differ by model and year. Civil Code section 1795.6(c) also counts Tesla's own repair facility as the manufacturer for tolling, the pause in the warranty clock during repairs.
Say your Model 3 reaches 49,200 miles with a defect that keeps getting worse. An app report that week can date when Tesla learned of it, before basic coverage hits its mileage limit. The firm reads battery booklets the same way in Hyundai EV claims.
Tesla's Pre-Owned Warranty Year and the Used-Car Rules
Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make a used car new unless the manufacturer's new car warranty was issued with that sale. It did not rule on certified pre-owned programs. That leaves a used Tesla sold with Tesla's added coverage usually outside the new-vehicle remedy, and courts have not settled the point. Tesla's Pre-Owned Vehicle Limited Warranty, effective May 7, 2026, adds 1 year or 10,000 miles after the original basic coverage ends, or from delivery if it already expired. Civil Code section 1795.5 places manufacturer duties, with listed exceptions, on a used-goods seller that issues its own express warranty.
Skipped Updates and Tesla's Warranty Exclusion
Tesla's booklet says coverage may be excluded for issues caused by not installing a software update after notice that one is available. The same list names failing to follow recall advisories. A declined update can hand Tesla an argument against your claim, even when the defect started earlier. Install updates when prompted. Then note in the app thread if one made the symptom worse.
Does an Over-the-Air Update Count as a Repair Attempt for a Tesla Lemon Law Attorney?
Song-Beverly never mentions over-the-air software, so the question stays the one it asks of any repair. Did Tesla have a reasonable number of attempts? An update aimed at the component you reported belongs in the repair history, and one aimed at something unrelated adds nothing. Recall 23V838000 shows how a fleetwide remedy can arrive with no invoice at all.
| Tesla recall data point | Figure |
|---|---|
| Vehicles in recall 23V838000, an Autosteer remedy sent over the air | 2,031,220 |
| Campaigns reaching 2021 to 2026 Model 3 cars | 31, with 20 remedied over the air |
| Campaigns reaching 2021 to 2026 Model Y cars | 41 |
| Campaigns reaching 2021 to 2026 Model X cars | 31 |
| Campaigns reaching 2024 to 2026 Cybertrucks | 11, each one reaching 2024 trucks |
NHTSA's recall data, checked September 29, 2026, supplies those counts. Say your 2023 Model 3 loses steering assist as you pull away from a light on Mira Mesa Boulevard. Campaign 25V092000 covered certain 2023 cars running software older than version 2023.38.4, and its remedy was an over-the-air update. If the assist still drops out afterward, a Tesla lemon law lawyer can present that update as one more failed attempt.
A recall, standing alone, does not prove your car has a nonconformity. Nor does a completed recall update end a claim when the problem continues. The firm reads software fixes the same way in Volkswagen ID.4 claims.
Mobile Visits, Completion Texts, and the Warranty Clock
Tesla says its mobile technicians can complete most repairs wherever you park, and a text confirms the work is done. Civil Code section 1793.2(c) already allowed repairs at the buyer's residence in some situations. Section 1795.6(a)(1) pauses the warranty during repairs, and for residence repairs the pause ends when you are told the work is complete. Subdivision (b) keeps the warranty alive after a failed repair if you report the failure within 60 days of its completion. Save each completion text.
The California Rights Statement on Every Tesla Invoice
Civil Code section 1793.1(a)(2) requires a 10-point boldface statement of your California warranty rights on every warranty invoice. Section 1795.6(d)(1) adds two dates, the day you returned the car and the day you learned it was ready. Tesla also has you approve a cost estimate before each appointment, so file each estimate with its invoice. A Collision Center visit fixes body damage and adds nothing to the repair count.
Which Forum Hears a Tesla Claim, and Which Papers Does a Lemon Law Attorney Read First?
Tesla is not on the Department of Consumer Affairs electing list as of a September 2026 check. So the section 871.21 filing window and the section 871.24 pre-suit notice, a written demand sent before suing, do not govern its cars. Commercial Code section 2725 gives four years instead, generally from tender of delivery.
An electing manufacturer is a carmaker that opted into Code of Civil Procedure sections 871.20 and following, and the department's list of electing manufacturers omits Tesla. Under Commercial Code section 2725, a claim can accrue later when the warranty explicitly extends to future performance and discovery must wait for that performance. It then runs from when the breach is or should have been discovered. If Tesla sold your car new in 2026 or later, section 871.29(d) says Tesla must name the governing procedure at the sale.
Say you ordered a Model 3 online in 2024, and it spent 34 days at Kearny Mesa in its first year. The presumption in Civil Code section 1793.22, subdivision (b), may then help. It treats Tesla as having had a reasonable number of repair attempts once its conditions are met within 18 months or 18,000 miles, whichever comes first. More than 30 cumulative days out of service for repair of nonconformities qualifies. So do two or more repairs of a nonconformity likely to cause death or serious bodily injury, or four or more repairs of the same nonconformity. Those two routes need direct notice to Tesla itself at least once, if Tesla clearly disclosed that duty. Tesla can rebut the presumption, and a car can still qualify on its full history under section 1793.2(d)(2) after the window closes.
Does CDSP Auto Line Come Before the Tesla Presumption?
The Department of Consumer Affairs lists CDSP Auto Line, which it certifies, as the certified arbitration program for Tesla, which Tesla sponsors. A decision binds Tesla only if you accept it. Under section 1793.22(c), timely written notice of the program means you use it before relying on the presumption. Program time extends the deadline to sue, and subdivision (d) sets the program standards. An accepted decision must be performed within a reasonable time, never more than 30 days after you accept it. The department calls the program free, with decisions usually within about 40 days.
Section 1794(c) allows a civil penalty, an added award of up to twice actual damages, for a willful violation. Under subdivision (d), a buyer who prevails recovers costs and reasonable attorney fees, based on actual time spent. The firm covers its attorney fee arrangement when you first meet, including with Tesla owners in La Jolla.
Did You Mail Tesla's Fremont Opt-Out Letter in Time?
Tesla's current booklet reproduces the Agreement to Arbitrate from its order terms. It sends disputes not resolved within 60 days of written notice to one arbitrator under American Arbitration Association consumer rules. Any hearing is held where you live, and small claims court stays open. The clause allowed an opt-out within 30 days after signing, by letter to a post office box in Fremont. Your own Vehicle Order Agreement may differ, so a lawyer reads the version you accepted.
What Tesla's Written Repurchase Request Should Include
Tesla's booklet asks California owners who want a repurchase or replacement to send written notice first. It goes by email to the address printed in the booklet, or by certified or registered mail with a return receipt. The mailing address is Tesla, Inc., care of CT Corporation, Suite 700, 330 N Brand Boulevard, Glendale, California 91203. Give your name, contact details and VIN, then summarize every repair visit and state your demand. This request comes from Tesla's own warranty, not from section 871.24.
Should You Share the Tesla App's Service History With a Tesla Lemon Law Lawyer Before Booking Again?
Yes, before the next appointment. Screenshot the full service request history, and save every invoice and estimate. Find the Vehicle Order Agreement and any opt-out letter you mailed. Add the purchase or lease contract and any tow or rental receipts.
Cline APC reviews the folder during a free consultation at (888) 982-6915. The call covers which channels Tesla used, how many attempts the records support and which forum comes first. Those answers depend on your documents, and no lawyer can promise a result.
Say you bring printed invoices, app screenshots and a 2024 lease. From that mix, a Tesla lemon law lawyer can line up each contact by date and tell you what is missing.
When the folder is ready, send your repair file through the firm's online form with your VIN.
