BMW Lemon Law Lawyers in San Diego

Your glove box holds a stack of BMW service paperwork for one power loss that keeps coming back. Sorted by date, those sheets become a ledger. A BMW lemon law lawyer reads it from Order 1, the first repair order that names the defect.

BMW may owe a buyback or a replacement on a new or leased car its centers cannot fix. The test is a reasonable number of repair attempts, meaning the number of chances the law treats as fair. A buyback, which the statute calls restitution, refunds what you paid. The replacement is a substantially identical new BMW.

Civil Code section 1793.22(e)(2) covers a BMW bought or used primarily for personal, family or household purposes. It also covers a demonstrator sold with BMW's new car warranty. A business BMW under 10,000 pounds gross vehicle weight qualifies too, if the company has no more than five vehicles registered in California. Under Civil Code section 1795.4, a lessee, the person who leases, holds a buyer's rights against BMW.

Used BMWs follow Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189. Leftover factory warranty time does not turn a used BMW into a new motor vehicle unless BMW's new car warranty was issued with that sale. The court did not rule on certified pre-owned programs. Certified BMWs therefore usually sit outside the new-vehicle remedy, and the question remains open.

Cline APC handles lemon law and consumer warranty cases only, with offices in La Jolla and Poway. If one BMW defect keeps sending you back to the service drive, call (888) 982-6915.

Which Recurring BMW Problems Bring Owners to a Lemon Law Lawyer?

Power loss with a drivetrain warning, a warning light that returns after every visit and a brake assist fault can each build a BMW claim. None of them is a claim on day one. Each becomes one only when later repair orders repeat the complaint Order 1 recorded, and BMW's recall filings describe related failures on three models.

ModelModel yearsWhat the BMW campaign describesClaims

Say your 2026 530i cuts power on the State Route 52 ramp to Interstate 805 at 2,400 miles. The next visit shows no stored fault. Both orders still belong in the ledger. Under section 1793.22(e)(1), a nonconformity means a defect that substantially impairs the car's use, value or safety, and one order rarely proves it. The Department of Consumer Affairs, or DCA, says there must be at least two repair attempts to qualify.

When BMW Programming on an Order Is a Repair Attempt

BMW's 2026 booklet says the decision to repair, replace a part or perform a software update belongs to BMW. So when a technician programs or updates a control unit to address your complaint, the order records a repair attempt, even with no part changed. An update aimed at something unrelated adds nothing to your count. A could-not-verify order counts too, since it shows BMW had the car and a chance to find the fault.

How Does a BMW Lemon Law Lawyer Weigh a CDSP Decision Against a Court Buyback?

BMW's booklet points owners to CDSP, the state-certified California Dispute Settlement Program BMW sponsors, which DCA lists for BMW, MINI and Rolls-Royce. A CDSP decision is not the same as a court's Song-Beverly remedy. It binds BMW only if you accept it, and BMW's booklet says it cannot award the multiple damages or attorney fees a court can.

ItemSong-Beverly remedy in courtCDSP decision
RemedyRestitution or a substantially identical replacement, and you may insist on restitutionRepairs, repair cost reimbursement, repurchase or replacement, per BMW's booklet
Mileage offsetPrice times miles before the first repair visit for the defect, over 120,000DCA says the arbitrator may deduct one
Civil penalty for a willful violationUp to twice actual damages under Civil Code 1794(c)No multiple damages, per BMW's booklet
Costs and attorney feesReasonable costs and attorney fees under 1794(d) if you prevailNo attorney fees, per BMW's booklet
PerformanceUnder the judgment or settlementWithin a reasonable time, no more than 30 days after you accept, under 1793.22(d)(3)

Say the 530i owner holds five orders and a notice letter in September 2026. The section 1793.22(b) presumption treats BMW as having had a reasonable number of repair attempts. If BMW gave you timely written notice of CDSP, section 1793.22(c) holds that presumption back until CDSP hears the claim. Skipping CDSP does not bar a lawsuit, but the owner would then prove the attempts without the presumption. A BMW lemon law lawyer weighs that trade against the orders.

What CDSP Can and Cannot Award in a BMW Lemon Law Claim

A numbered item in BMW's booklet narrows its capital-letter arbitration notice. You must use CDSP before asserting rights under section 1793.22 or Title I of the Magnuson-Moss Warranty Act, not before other remedies. DCA says a written submission must include all relevant documents, and that there is no cost to the consumer to file. Per the booklet, a decision ordinarily comes within 40 days, with extensions in set cases. If you reject it, you can still sue and assert the presumption, and the findings come into evidence. Section 1793.22(c) adds the days your claim spends in the program to the filing deadline.

Adding Up Restitution Line by Line From a BMW Contract

Say the 530i contract shows $64,000, with destination and BMW-installed options. Restitution returns that price, plus sales tax, license and registration. It adds incidental damages, the reasonable repair, towing and rental costs you actually paid, such as a $180 rental. However, dealer-applied paint protection film stays out. The mileage offset is the charge for miles on the car when you first brought it in for the defect. Here it is $64,000 times 2,400, over 120,000, or $1,280. Reported during an oil service at 1,200 miles, it would be $640. Those figures are arithmetic only, and the buyback calculator runs your own. BMW cannot force a replacement on you if you want the refund.

When Did Your BMW Warranty Start, and Why Does a Lemon Law Attorney Ask?

BMW's 2026 booklet sets the New Vehicle Limited Warranty at 48 months or 50,000 miles, whichever comes first. Coverage starts on the date of first retail sale, or on the date the car was first placed in service if that came earlier. Warranty repairs do not extend it. Booklets differ by model year, so check yours.

That start date can sit months before your purchase. Say you buy a 2026 X3 demonstrator in Carlsbad with 3,800 miles, and its coverage began six months before the sale. Only 42 of the 48 months then remain for you.

Aftersales Mobility Cars, Demonstrators and BMW's Warranty Start Date

BMW's booklet counts a sales demonstrator, an Aftersales Mobility Program car or a company vehicle as placed in service. So compare Order 1 with the warranty start date, not with the day you signed. A demonstrator sold with BMW's new car warranty still counts as new. The presumption's months run from delivery to you, but its mileage limit reads the odometer, demo miles included.

Ultimate Care Maintenance Versus Warranty Repairs

BMW's 2026 booklet says Ultimate Care covers scheduled maintenance for the first 36 months or 36,000 miles, whichever comes first. An oil service is not a warranty repair by itself. Still, if the order records the defect you reported at that visit, the visit can join the ledger. So ask the advisor to write the complaint as its own line.

How the BMW Lemon Law Presumption Reads an 18-Month Ledger

The presumption sits in Civil Code section 1793.22, subdivision (b). It treats BMW as having had a reasonable number of repair attempts once its conditions are met within 18 months of delivery or 18,000 miles, whichever comes first. Two repairs of a nonconformity likely to cause death or serious bodily injury qualify, and so do four repairs of one nonconformity. Each of those two routes also requires direct notice at least once, meaning a letter to BMW itself, because BMW's booklet discloses that duty. The third route needs more than 30 cumulative days out of service for repair of nonconformities, with no notice. BMW can rebut the presumption, and a BMW claim can still succeed on the whole repair record under section 1793.2(d) after the window.

On the 530i ledger, Order 4 sits 26 days waiting for a module, and Orders 1 to 3 add 6 more, for 32 cumulative days. BMW's booklet calls backorder delays outside its control and not unreasonable, so whether those 26 days count turns on why the part was late. For this route, the statute extends the limit only when conditions beyond BMW's control prevent the repair, and a signed extension does not. Separately, section 1793.2(b) requires each repair within 30 days unless you agree in writing or a delay beyond BMW's control intervenes.

Should a BMW Recall Visit Go in the Ledger You Show a Lemon Law Attorney?

Yes. A BMW recall visit is a dated repair visit, so it belongs in the ledger. A recall alone does not show that your own car has a nonconformity, because it covers a group of vehicles. If the symptom you reported returns after the recall work, though, the completed campaign does not close your claim.

NHTSA's public data files, pulled September 29, 2026, give these counts for BMW-brand cars and SUVs, motorcycles excluded. Each complaint is an owner's report rather than a finding. A campaign reaching several model years appears once in the combined row.

Say your 2025 530i falls under campaign 25V202000. Its NHTSA record says the starter-generator to battery connection may come loose and can stall the engine. NHTSA's record says interim letters went out May 28, 2025, with second letters once the remedy is available. If the power loss returns after the campaign work, both visits go in the ledger. NHTSA's recall lookup lists the campaigns on any VIN.

Brake Assist Campaign 24V104000 and the Two-Visit Route

Campaign 24V104000, reported to NHTSA on February 12, 2024, covers certain 2023 to 2025 BMW, MINI and Rolls-Royce vehicles. Its summary says the integrated brake system may malfunction and cause a loss of power brake assist. It may also keep the antilock brakes and Dynamic Stability Control from working properly. A fault like that may be likely to cause death or serious bodily injury, which reaches the presumption with two repairs plus direct notice. Whether your fault qualifies is a question of fact, and a BMW lemon law lawyer tests it against each order.

When Does a BMW Lemon Law Lawyer Say Your Filing Window Closes?

BMW of North America was not on the DCA list of electing manufacturers, makers that opted into newer court procedures, when checked September 29, 2026. So a BMW claim generally runs on the four-year limit in Commercial Code section 2725, counted by default from delivery, and no section 871.27 deductions apply.

It also needs no section 871.24 pre-suit notice, the demand an electing manufacturer must receive before a suit seeking civil penalties. The DCA list of manufacturers that elected the new procedures does not name BMW. Under Commercial Code section 2725, the clock starts at tender of delivery, the day the car is handed over. The exception needs two conditions. The warranty must explicitly extend to future performance, and discovery of the breach must await that performance. Then the clock starts when the breach is or should have been discovered. For a 530i delivered in October 2025, the default date falls in October 2029, and program days can extend it.

BMW's Booklet Sets a CDSP Deadline Tied to Warranty Expiration

BMW's booklet says claims must be filed with CDSP within six months after the warranty expires. For the October 2025 530i, that points to about April 2030 if the miles do not end coverage first. A high-mileage driver can reach 50,000 miles well before month 48. That pulls the warranty end and the CDSP deadline earlier, but not the four-year date.

Why Electing-Track Deductions Stay Out of a BMW Buyback

SB 26, signed April 2, 2025, made the procedures AB 1755 added apply only to manufacturers that elect them. Section 871.27 lets an electing manufacturer subtract third-party service contracts and negative equity, the loan balance rolled over from an older car. BMW has not elected that chapter, so a BMW buyback is built under section 1793.2. For a car sold new in 2026 or later, section 871.29(d) says the manufacturer must tell you at the sale which procedure governs. So check that notice. Mercedes-Benz USA, LLC opted in on April 30, 2025, which puts many Mercedes-Benz lemon law claims on another calendar. No Audi entity is listed, so Audi claims on the same four-year track follow section 2725.

BMW Customer Relations and the Written Notice Letter

BMW's 2026 booklet sends notice to BMW of North America, LLC, Customer Relations and Services Department, P.O. Box 1227, Westwood, New Jersey. Check your own model year's booklet first. Name the car by year and VIN, and describe the defect in your orders' words. List each order by date and mileage, then ask BMW to repair it. Certified mail with a return receipt proves delivery. Direct notice is a condition of the presumption's two-repair and four-repair routes only, never of the claim itself.
