California law may then require a buyback or a replacement, meaning a substantially identical new vehicle, for a new or leased car. The yardstick is a reasonable number of repair attempts, meaning the fair number of chances the law allows.
Mercedes-Benz USA, LLC appears on the Department of Consumer Affairs record of manufacturers that chose the newer lemon law rules. Its election is dated April 30, 2025. For a Mercedes-Benz sold new in 2025 or earlier, the claim sits on the elected track. Those rules, in Code of Civil Procedure sections 871.20 and following, bind only manufacturers who opt in. The track changes the filing deadline and adds a pre-suit notice, a demand needed only before a suit seeking civil penalties, the extra money a court may add for a willful violation.
Cline APC takes only lemon law and consumer warranty cases, for owners and lessees, people who lease, across San Diego County.

Which C-Class, GLC and Sprinter Campaigns Does a Mercedes-Benz Lemon Law Lawyer Track?
At Cline APC, three sets of records come up most. Certain 2023 and 2024 C 300 and GLC 300 models share fuse campaign 24V115000, where Mercedes-Benz's filing says an 80-amp fuse may fail and cut drive power. Campaign 25V255000 followed for cars repaired incorrectly under it. Wiring campaign 23V462000 reaches certain 2022 and 2023 C 300 sedans.
| Model | Model years in the record | Defect or record | Claims |
|---|---|---|---|
| C-Class | 2022 and 2023 (23V462000), 2023 and 2024 (24V115000), 2023 (25V255000) | Transmission wiring that may cut drive power, an 80-amp fuse that may fail, and a wrong fuse box that may have been fitted in that repair | C-Class claims |
| GLC | 2023 and 2024 (24V115000 and 25V255000), certain 2019 to 2023 GLC 300 (bulletin LI27.60-P-080167) | The same fuse campaigns, a shifter stuck in Park, and two recent warranty extensions | Mercedes-Benz GLC lemon law claims |
| Sprinter | 2023 (24V166000) | Main wiring that, per the filing, may chafe and cut drive power, a business test of under 10,000 pounds gross vehicle weight and five or fewer registered vehicles, and campers covered only for the chassis, chassis cab and propulsion portion | Mercedes-Benz Sprinter claims |
Say you bought a 2025 GLE 350 at Mercedes-Benz of Escondido on West Ninth Avenue. A coolant message appears on State Route 78, and the advisor writes that a warning light came on. Days later it returns on Interstate 15, and a second advisor calls it a check engine concern.
Two Write-Ups for One Mercedes-Benz Fault
Civil Code section 1795.6, subdivision (d)(1), requires the shop doing warranty work to give you a dated work order. It shows the day you brought the car in and the day you were told the repair was done. Those dates later drive the repair count and the filing deadline. Ask the advisor to copy your own description onto every ticket.
Roadside Assistance Tows That Leave a Record
The 2025 Service and Warranty Information booklet points owners to a 24-hour Roadside Assistance program for emergency repairs. A tow to a dealer leaves a dated record, and the next repair order shows what the dealer found. Note where the car quit and when you called. Keep any tow bill you paid, because reasonable towing costs actually incurred can be part of a buyback.
Should a Lemon Law Attorney Compare a Customer Care Offer With a Mercedes-Benz Buyback?
Yes. An offer through Customer Care is not a repurchase or replacement under Civil Code section 1793.2, and it may carry a release, a signed waiver of claims. Restitution, the statutory buyback, is a different measure. On the elected track, section 871.27 adjusts that figure.
Restitution repays the price paid or payable, taxes, official fees and incidental damages, such as reasonable repair, towing and rental costs. It is reduced by a mileage offset, the deduction for miles driven before the defect's first repair visit.
Say you lease a 2024 C 300 in Mira Mesa, and a drivetrain message survives two software updates. Then an offer arrives.
| Line item | Offer through Customer Care, which may include a release | Elected-track repurchase under 1793.2(d)(2)(B) and CCP 871.27 |
|---|---|---|
| Price paid or owed, transportation charge and factory options | Set by the offer | Refunded |
| Sales tax, license, registration and official fees | Set by the offer | Refunded |
| Repairs, towing and rental cars actually paid | Set by the offer | Refunded when reasonable |
| Nonmanufacturer items the buyer installed | Set by the offer | Left out |
| Equipment, GAP or service plan from an outside company | Set by the offer | Left out, though the selling dealer's version stays in |
| Negative equity from an earlier car | Set by the offer | Subtracted |
| Manufacturer rebate | Set by the offer | Never counted as paid |
| Mileage offset | Set by the offer | Subtracted |
| Release terms | Set by the offer | Only the Standardized SBA Release |
The offset formula in section 1793.2, subdivision (d)(2)(C), multiplies the price by those miles, then divides by 120,000. A $61,500 GLC first brought in at 4,200 miles would carry a $2,152.50 offset. Run the buyback calculator, or call (888) 982-6915.
The Booklet Excludes Rentals, but a Mercedes-Benz Lemon Law Refund May Not
The 2025 booklet says the warranty does not pay for loss of use, lodging, substitute rentals or lost pay during warranty repairs. That clause describes what the warranty itself covers. Restitution is a separate duty. Section 1793.2, subdivision (d)(2)(B), lists reasonable repair, towing and rental car costs actually incurred as incidental damages. Keep each rental contract and rideshare receipt that matches a repair date.
Buying Out a Leased Mercedes-Benz Before a Claim
A lessee, the person who signs the lease, has the rights a buyer would have, under Civil Code section 1795.4. On the elected track, section 871.27 counts residual payments, amounts paid for the car's value at lease end, as damages. Residual payments count toward civil penalties only if paid or financed within 30 days after the pre-suit notice or the lawsuit, whichever comes first.
When Does Mercedes-Benz Coverage Really Start, and Why Does a Lemon Law Attorney Ask?
Under the 2025 Service and Warranty Information booklet, the New Vehicle Limited Warranty lasts 48 months or 50,000 miles, whichever occurs first. Coverage starts at delivery to the first retail buyer or first use as a dealer demonstrator. It starts no later than 18 months after production.
On the elected track, the filing deadline counts from the end of the applicable express warranty, the written warranty that covers your defect. The booklet gives specially noted California emission parts 7 years or 70,000 miles, whichever occurs first. A plug-in hybrid's high-voltage battery gets up to 6 years or 62,000 miles, whichever occurs first, or 10 years or 150,000 miles for the California plug-ins the booklet lists.
Say a slow-selling trim sat at the dealer more than 18 months after production. The booklet treats its coverage as already running, so your 48 months may end sooner than your delivery date suggests. Booklets differ by model year, and yours controls.
Warranty Months That Freeze During Repairs
Section 1795.6, subdivision (a), pauses the warranty from drop-off for warranty repair until the car comes back or you hear the work is done. So 40 days at the dealer can add 40 days of coverage. Subdivision (b) also keeps a warranty alive when a repair fails and you report that to Mercedes-Benz or the seller within 60 days. A Mercedes-Benz lemon law lawyer adds those days back before anyone calls the warranty over.
Service Members Who Bought a Mercedes-Benz Out of State
Civil Code section 1795.8 reaches a member of the Armed Forces who bought a warranted vehicle anywhere in the United States. The seller must be a manufacturer that sells vehicles in California, or its agent. The member must have been stationed or living here when buying or filing. A C-Class bought in Virginia before a transfer to San Diego can qualify.
Leftover 4-Year Coverage on a Certified Mercedes-Benz
Mercedes-Benz USA says a certified car carries the rest of the 4-year or 50,000-mile warranty, whichever comes first, then a 12-month limited warranty. In Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, the court decided that leftover factory coverage does not make a used car new. That changes only when the new car warranty was issued with that sale. Certified pre-owned programs were left undecided, so certified cars usually fall outside the new-vehicle remedy, though that is unsettled. Used-car warranty claims under Civil Code section 1795.5 may remain, and the firm checks them for Mercedes-Benz owners in La Jolla.
What Does a Mercedes-Benz Recall Visit Prove When a Lemon Law Attorney Builds the File?
It proves Mercedes-Benz had the car on a given date, but a recall alone never makes a lemon. A car listed in both 24V115000 and 25V255000 may have gone back to have the first fuse repair redone. Both visits belong in the file.
Counts from the National Highway Traffic Safety Administration (NHTSA), pulled September 29, 2026, show the volume. Complaints are untested allegations, and a multi-year campaign counts once.
| Model, 2021 to 2026 model years | Owner complaints to NHTSA | Recall campaigns |
|---|---|---|
| C-Class, AMG versions included | 92 | 19 |
| GLC, AMG versions included | 289 | 26 |
| Sprinter, not counting the eSprinter | 165 | 27 |
A recall visit can feed the presumption in Civil Code section 1793.22, subdivision (b), when it repairs the defect within the presumption's window. That presumption treats Mercedes-Benz as having had a reasonable number of repair attempts once its conditions are met. Its window closes at 18 months from delivery or 18,000 miles, whichever comes first. The word nonconformity covers any defect that substantially impairs use, value or safety. One likely to cause death or serious bodily injury needs two or more repairs, and any other needs four or more repairs of the same nonconformity. Those two routes also need direct notice, a written notice to Mercedes-Benz itself, at least once, when the booklet discloses that duty. The third route is more than 30 cumulative days out of service for repair. Mercedes-Benz can rebut the presumption, and the full repair history can still carry a claim under section 1793.2, subdivision (d)(2).
Two Fuse Box Recall Visits on the Same Car
Say your 2023 C 300 got new main fuse boxes under 24V115000. Then a 25V255000 notice says the dealer may have installed a box not designed for the car. Among C-Class cars, only 2023 C 300 and AMG C 43 models appear in the second campaign, so a 2024 C 300 has the first visit alone. NHTSA's recall lookup shows which campaigns touch your VIN.
Back-Ordered Parts Under the Booklet and Under the Statute
The 2025 booklet says delays from back-ordered parts and other circumstances outside its control will not be considered unreasonable. Section 1793.2, subdivision (b), requires each warranty repair within 30 days, extended only by your written agreement or a delay beyond the manufacturer's control. The presumption's 30-day route counts cumulative days, and only conditions beyond the manufacturer's control extend it. A part Mercedes-Benz failed to stock may pass neither test.
In What Order Does a Mercedes-Benz Lemon Law Lawyer Send Letters to Sandy Springs?
Usually a direct notice letter goes first, then any arbitration claim, then the section 871.24 demand. For a Mercedes-Benz sold in 2025 or earlier, suit is due within one year after the applicable express warranty ends. It can never come more than six years after delivery. Repair days, and up to 60 days after the demand, pause both limits.
The 2025 booklet's Important Notice for California Retail Buyers and Lessees asks for direct notice in writing. It goes to the Customer Care Center in Sandy Springs, Georgia, not a dealer.
Mercedes-Benz USA uses the California Dispute Settlement Program (CDSP), and the Department of Consumer Affairs lists CDSP as its state-certified arbitration program. Section 1793.22, subdivision (c), says an owner told of CDSP in writing, on time, must try it before relying on the presumption. Days between filing there and the decision extend any filing deadline. Subdivision (d) sets the standards, including performance within a reasonable time, not to exceed 30 days after you accept a decision. The 2025 booklet requires filing within six months after the warranty expires.
Say you bought a new 2025 GLE 350 in Escondido on February 3, 2025, and stay under 50,000 miles. If your booklet reads like the 2025 edition, basic coverage ends February 3, 2029. The default filing date is then February 3, 2030, before paused days are added. For a vehicle sold new in 2026 or later, section 871.29, subdivision (d), says the manufacturer must name the governing procedure at the sale. When no election covers the sale year, Commercial Code section 2725 gives four years, generally from tender of delivery.
Why the Retention Mailbox Needs Care Before You Email It
The demand in Code of Civil Procedure section 871.24 is required only before a suit that seeks civil penalties. It gives your name, the accurate VIN, a short repair history and a demand to repurchase or replace. It must arrive at least 30 days before filing. Mercedes-Benz USA's online California Consumer Notice uses one email address for lemon law concerns and for these demands. A casual email can therefore read as the formal demand. An offer within 30 days after Mercedes-Benz receives the demand, completed within 60 days of receipt, keeps civil penalties out of the case, and missing either date leaves them available. Talk to a Mercedes-Benz lemon law lawyer before you write.
Leaving the Mercedes-Benz Arbitration Agreement Within a Month of Delivery
The 2025 booklet prints an Individual Arbitration Agreement and Class Action Waiver that sends disputes to private arbitration. Owners may opt out within 30 days after initial delivery with a letter to the Customer Care Center giving their name, VIN and intent. Your own booklet may differ, and how the clause applies to a California claim is a legal question.
Should a Mercedes-Benz Lemon Law Lawyer Read the Customer Care File Before You Call Again?
Yes, before the next call. A Mercedes-Benz lemon law lawyer can say whether a letter to Sandy Springs should come first. The review also checks whether CDSP suits your file and how much time remains under section 871.21. Cline APC offers a free consultation by phone or at its La Jolla and Poway offices.
No lawyer can promise how Mercedes-Benz will answer a demand. If you prevail, Civil Code section 1794, subdivision (d), awards costs and reasonable attorney fees.
