You can keep the sedan and seek money for what the defect cost you.
Civil Code section 1794 lets a buyer who keeps the car sue for damages instead, measured through the Commercial Code. So Cline APC runs both numbers before you choose.
Lemon law and warranty law are the whole practice at Cline APC, for owners and lessees, meaning people who lease, across San Diego County.

Which C 300 Electrical Faults Can Support a Claim With a Lemon Law Lawyer?
Several, judging by Mercedes-Benz's own recall filings. For example, recall 22V678000 describes trunk moisture that may short a control module on certain 2022 C 300 sedans. The National Highway Traffic Safety Administration (NHTSA) logged 92 complaints on 2021 to 2026 C-Class model years. Electrical complaints lead with 21, as pulled September 29, 2026.
The San Diego lemon law attorneys at Cline APC read those filings beside your repair orders. Mercedes-Benz's recall reports describe these conditions.
- Rear lights that stop working (22V678000)
- A rear seat that folds down on its own (22V678000)
- A backup camera that goes dark (22V678000)
- An infotainment reset that blanks the instrument display while driving (26V281000)
- A sudden loss of drive power (23V462000, 24V115000 and 24V446000)
- A door switch that misses an open door, so the car may roll (26V481000)
Say you bought a 2022 C 300 in Carmel Valley, and the taillights, a rear seat and the camera fail together. That is the chain 22V678000 describes. Complaints prove nothing about one car, but the recall tells you which system to name at the counter.
Does Your C-Class Model Year Change Which Campaigns a Lemon Law Lawyer Checks?
Yes. NHTSA lists 19 campaigns on 2021 to 2026 C-Class model years, AMG versions included, as of September 29, 2026. The wiring and fuse campaigns center on 2022 to 2024 C 300 sedans. The belt campaign runs through 2025, and the infotainment campaign reaches only 2025 and 2026 sedans.
| Campaign | Model years | Versions | Condition | Consequence |
|---|---|---|---|---|
| 22V678000 | 2022 | C 300 | Trunk moisture may short the signal acquisition module | Rear lights, seat and camera failures, and a fire risk |
| 23V462000 | 2022 and 2023 | C 300, 2023 AMG C 43 | Transmission wiring may be the wrong length | Loss of drive power |
| 24V115000 | 2023 and 2024 | C 300, AMG C 43 | 80-amp fuses may fail | Sudden loss of drive power or safety functions |
| 24V446000 | 2022 and 2023 | C 300 | A loose pre-fuse box bolt may let a wire overheat | Fire risk and sudden loss of drive power |
| 25V253000 | 2022 to 2025 | C 300, 2023 and 2024 AMG C 43 | The driver belt cover may not seat on the tensioner | The belt anchor may come loose |
| 25V255000 | 2023 | C 300, AMG C 43 | A wrong fuse box may have been fitted under 24V115000 | The same risks as 24V115000 |
| 26V281000 | 2025 and 2026 | C 300, AMG C 43 | The infotainment unit may reset while moving | The instrument display goes blank |
| 26V481000 | 2022 and 2023 | C 300, 2023 AMG C 43 | The driver door lock switch may corrode | The parking brake or Auto-Park may not engage, so the car may roll |
Say you live in Del Mar, and your 2025 C 300's infotainment unit keeps resetting on State Route 56. Campaign 26V281000 reaches your car, but it would not reach a 2024 sedan. Enter your VIN in NHTSA's recall lookup to see which campaigns reach it.
Does Recall History Cut Resale Value, and Can a Mercedes-Benz C-Class Lemon Law Lawyer Use It?
It can. Buyers may price recall and repair history into what they pay. An appraiser uses that reaction to estimate what a car with this defect was worth at delivery. A recall alone still does not make the car a lemon.
Say you plan to sell a 2023 C 300 whose history shows three electrical recall visits. A shopper may offer less. That gap can be evidence of value lost, though section 2714 measures value at delivery.
A January 2026 extension filed with NHTSA covers the exhaust valve system of the four-cylinder M264 engine on certain 2019 to 2023 C 300 models. It extends coverage from 4 years or 50,000 miles to 15 years or 150,000 miles, whichever occurs first. Bulletin LI18.10-P-078867, from February 2025, addresses red oil pressure warnings on certain 2022 to 2024 C 300 models.
Drive Power Lost to Short Wiring and a Loose Fuse Box Bolt
Campaigns 23V462000 and 24V446000 end in the same consequence, a sudden loss of drive power. Mercedes-Benz's own number for 24V446000 is 2024070005, which may appear on your repair order instead. Fuse campaign 24V115000 also reached the GLC 300, as in Mercedes-Benz GLC lemon law claims. So orders that mention power loss before or after these recalls deserve a close read.
Door Switch Corrosion and a Loose Belt Anchor
Campaign 26V481000 was filed in July 2026, and its remedy replaces the driver's door lock. NHTSA's record, as of September 29, 2026, says owner letters were expected to be mailed September 18, 2026, in phases. Under 25V253000, dealers inspect and repair the driver belt cover. A court may treat either condition as likely to cause death or serious bodily injury. So keep each recall order even if the part never failed.
Can a Lemon Law Lawyer Recover Rentals the C-Class Warranty Booklet Excludes?
Possibly. The 2025 warranty booklet refuses to pay for loss of use, rentals, lost pay and lodging. Its California Supplement also says no payment goes to indirect or consequential damage. However, those clauses describe what the warranty pays. Civil Code section 1790.1 voids waivers of Song-Beverly rights, and section 1794, subdivision (b), points buyers to Commercial Code damages.
Say you are a physical therapist in Scripps Ranch who drives between two clinics. Across three visits on Kearny Mesa Road, you rent a car for nine days. Booklets differ by model year, and how a court squares yours with those sections is a legal question.
Filming the Fault With the Odometer in Frame
Commercial Code section 2607, subdivision (4), puts the burden on a buyer who kept the car to prove the breach. So record each failure on your phone with the date and odometer in frame. Subdivision (3)(A) also requires notice of the breach within a reasonable time after you discover it or should have. A written complaint to the dealer and Mercedes-Benz USA then adds to the repair orders.
Rentals, Rideshares and Tows as Incidental Losses
Section 2715, subdivision (1), covers reasonable expenses caused by the delay or the breach itself. That can include rentals when no loaner was offered, rideshares and tows. Receipts should match the dates on your repair orders. Subdivision (2)(a) reaches losses from needs the seller had reason to know about at signing, unless a substitute purchase or other step could reasonably have prevented them. So write down what you told the salesperson.
How Many Fix Attempts Does Mercedes-Benz Get Before a C-Class Lemon Law Attorney Seeks a Buyback?
A reasonable number of repair attempts, the tries the law counts as enough, judged on each file's facts, under Civil Code section 1793.2, subdivision (d)(2). The presumption in section 1793.22, subdivision (b), treats Mercedes-Benz as having had that number once its conditions are met. Owners who would rather keep the car can seek damages instead.
The presumption's window is 18 months or 18,000 miles, whichever comes first. Nonconformity is the statute's word for a defect that substantially impairs use, value or safety. One likely to cause death or serious bodily injury needs two or more repairs, while any other needs four or more of the same nonconformity. Both routes need direct notice, meaning a written notice you send Mercedes-Benz, at least once, when the booklet discloses that duty. The last route counts more than 30 cumulative days out of service for repair. Mercedes-Benz can rebut the presumption, and Cline APC's Mercedes-Benz lemon law lawyers can still build a claim on the whole history.
Say your 2025 C 300's screen still goes dark after the 26V281000 software update.
Keeping the Sedan and Collecting the Value Gap in a C-Class Lemon Law Claim
Commercial Code section 2607, subdivision (2), says keeping the car does not by itself impair your other remedies. Section 2714, subdivision (2), measures the gap between the car's value as accepted and its value as warranted, at the time and place of acceptance. Special circumstances, such as an AMG C 43 bought for its performance package, can support another figure. Civil Code section 1794, subdivision (b)(2), adds the cost of repairs needed to make the car conform. Then compare restitution, the statutory buyback refund, in the lemon law buyback calculator.
Why the Electing-Track Deadline May Not Reach a Damages-Only Claim
Mercedes-Benz USA elected the newer procedures, and the Department of Consumer Affairs dates that election April 30, 2025. Under section 871.30, it reaches cars sold in 2025 or earlier. For a car sold new in 2026 or later, section 871.29, subdivision (d), requires the manufacturer to name the governing procedure. Section 871.20, subdivision (b), excludes actions seeking remedies other than restitution or replacement. So a damages-only claim may fall outside that chapter's deadline and its pre-suit notice, a demand needed only before a suit seeking civil penalties, extra damages a court may award for a willful violation. Then a lawyer confirms that on your facts.
Commercial Code section 2725 then allows four years, and the contract may shorten that to one year but never lengthen it. Generally the four years run from tender of delivery. The exception applies when a warranty explicitly extends to future performance and discovery must wait for that performance. Then the claim accrues when the breach is or should have been discovered.
Double Damages and the One-Year Implied Warranty in a Mercedes-Benz C-Class Lemon Law Case
Section 1794, subdivision (c), allows that penalty, up to twice actual damages, when Mercedes-Benz acted willfully. It is available on a damages claim, but not on a claim based solely on breach of an implied warranty. That implied warranty is the unwritten promise that the car is fit for ordinary driving. Civil Code section 1791.1, subdivision (c), ties its length to the express warranty, within 60 days to one year after a new-car sale. The 2025 booklet's California Supplement limits it to one year from the original retail sale.
CDSP or Court for a Smaller Keep-the-Car Claim
Mercedes-Benz uses the California Dispute Settlement Program (CDSP). The 2025 booklet lists repairs, reimbursement and damages as remedies there, but not attorney fees or most consequential damages. Also, claims are due within six months after the warranty expires. Code of Civil Procedure section 85 sets the limited civil line at $35,000, not counting fees, interest and costs. A penalty can push a claim past it. Form ADM-254 routes Carmel Valley, La Jolla and Poway zip codes to the Central Division. Where you signed the contract can change that.
Should You Run Both Numbers With a Mercedes-Benz C-Class Lemon Law Lawyer Before Choosing?
Yes. A free consultation at Cline APC compares a damages claim with a buyback, using your contract, repair tickets and receipts. A Mercedes-Benz C-Class lemon law lawyer then shows which remedies your records support. No lawyer can promise how Mercedes-Benz will respond.
Say you lease the car and kept rental receipts plus the glove-box booklet. Bring those and any recall letters Mercedes-Benz mailed.
A buyer who prevails recovers costs and reasonable attorney fees under Civil Code section 1794, subdivision (d). The review can also cover Sprinter work vans and campers.
