Cadillac Lemon Law Lawyers in San Diego

Your Cadillac has been to the service lane three times for one fault. Every repair order says the concern was addressed. A Cadillac lemon law lawyer reads that stack against California's presumption and the California notice in the General Motors LLC (GM) warranty booklet.

The presumption treats GM as having had a reasonable number of repair attempts, meaning a fair number of chances, once its conditions are met. A new or leased Cadillac can qualify for a buyback or replacement when GM's dealers cannot fix it within that number. Restitution, the statute's word for a buyback, refunds what you paid, less statutory deductions, while a replacement is a substantially identical new Cadillac.

Civil Code section 1793.22, subdivision (e)(2), covers a Cadillac bought or used primarily for personal, family or household purposes. A demonstrator or dealer-owned car counts when the sale included GM's new car warranty. A business vehicle under 10,000 pounds gross vehicle weight counts too. The business can have five or fewer vehicles registered in California. A lessee, the person who leases, holds a buyer's rights under Civil Code section 1795.4.

Used Cadillacs are a harder case. In Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, the California Supreme Court held that leftover factory coverage does not make a used car new. Only a manufacturer's new car warranty issued with that sale changes that. The court left certified pre-owned programs undecided. So a certified Cadillac usually sits outside the new-vehicle remedy, though the point remains open.

Cline APC handles only lemon law and warranty disputes. If one fault keeps sending your Escalade, Lyriq or XT6 back, call (888) 982-6915 or send the repair orders online.

Which Escalade and Lyriq Years Carry Recalls a Cadillac Lemon Law Attorney Can Use?

Recent Cadillac campaigns include 2021 to 2024 Escalades with the 6.2L gas V8. Others reach 2023 and 2024 Lyriqs that can lose drive power or brake pressure. However, a recall does not make a Cadillac a lemon by itself. A recall visit for your complaint still adds a dated repair to the history a lawyer counts.

Anti-lock brakes may release brake pressureCadillac Lyriq lemon law claims

Say your 2024 Lyriq loses drive power on Interstate 805 near the State Route 52 interchange. It happens again after the first repair. Both visits can count against one nonconformity, whether or not a campaign lists your VIN. Under Civil Code section 1793.22, subdivision (e)(1), that means a defect substantially impairing use, value or safety. Campaign 25V274000 also reaches Chevrolet and GMC trucks and SUVs.

Different Parts on Each Order, One Cadillac Defect Under the Lemon Law

Technicians often vary the fix. One order may name a battery module and the next wiring connectors. GM may argue those are two defects, each repaired once. The usual answer is that the nonconformity is the condition you experience, which never changed. Describe the symptom in the same plain words every time, and ask that your sentence appear on the order.

Where Does a Cadillac Buyback Come From When a Lemon Law Lawyer Gets Involved?

A statutory buyback comes from Civil Code section 1793.2, subdivision (d)(2), and GM cannot force a replacement on you. GM's booklet routes complaints to dealer management, then Cadillac Customer Assistance, then BBB Auto Line. An offer GM makes on its own terms is not the statute's figure. Therefore, a Cadillac lemon law lawyer compares them line by line.

ItemStatutory restitutionBBB Auto Line decision
Mileage offset, the deduction for miles driven before the defect's first repair visitPrice times those miles, divided by 120,000The Department of Consumer Affairs (DCA) says GM may deduct one
Civil penalty, extra money for a willful violationUp to twice actual damages, Civil Code 1794(c)Not required, section 1793.22(d)(7)
Attorney fees and costsA prevailing buyer recovers costs and reasonable attorney fees, Civil Code 1794(d)Not required, and DCA says they may not be covered

Picture a family weighing a GM customer-care offer on a $64,800 XT6 first brought in at 7,500 miles. Multiplying the price by those miles and dividing by 120,000 puts the offset at $4,050.

Dealer Management, Customer Assistance, Then BBB Auto Line

BBB Auto Line is the third step in that sequence. BBB Auto Line for General Motors, Cadillac included, is certified and listed by DCA, and GM sponsors it. Any restitution it orders must follow section 1793.2(d)(2), under section 1793.22(d)(5). DCA says a repurchase excludes dealer add-ons. If GM gave you timely written notice, subdivision (c) has you use the program before relying on the presumption. DCA says decisions usually come within 40 days of your application. Accept the decision and GM is bound, with a reasonable time to perform that cannot exceed 30 days after you accept. However, if you reject it, a lawsuit stays open with the presumption intact. Program days also extend your filing deadline.

Price, Fees and Deductions in a Cadillac Lemon Law Buyback

Restitution under section 1793.2, subdivision (d)(2)(B), returns the price paid or payable, with transportation charges and GM factory options. It adds sales or use tax, license and registration fees. Incidental damages, meaning reasonable towing, rental and repair costs you paid, come back too. Items a dealer or you added that did not come from GM stay out. On GM's elected track, the newer procedures GM chose in 2025 for Cadillacs sold through 2025, section 871.27 keeps selling-dealer add-ons in and drops outside-company products. It also subtracts negative equity, an old car's unpaid balance rolled into the loan, and keeps factory rebates out of the price. The buyback calculator takes your own numbers.

How Long Does Cadillac Coverage Last, and Why Does a Lemon Law Attorney Check Each Term?

GM's 2025 Cadillac booklet sets bumper-to-bumper coverage at 4 years or 50,000 miles and powertrain at 6 years or 70,000 miles. Each term ends at whichever limit comes first. Longer terms cover seatbelts, airbags and rust-through. Booklets vary by model year, so a Cadillac lemon law lawyer matches each failed part to the term in yours.

Say you commute on State Route 56 and Interstate 5 and pass 50,000 miles before year four. An engine sensor fault then sits outside both terms, since the booklet excludes sensors, wiring and connectors from engine coverage. A failed crankshaft would likely still fall under powertrain. That term covers internally lubricated engine parts, the transmission case and torque converter, and the transfer case. The booklet also says the warranty may be extended one day for each day beyond the first 24 hours that a car sits at a dealer for warranty service. The filing deadline on GM's track counts from the day the warranty ends, so an extension can move that date too.

Matching Cadillac Repair Orders to the Three Presumption Routes

Civil Code section 1793.22, subdivision (b), treats GM as having had a reasonable number of repair attempts if one of three events happens within 18 months from delivery or 18,000 odometer miles, whichever comes first. The first route is two or more repairs of the same nonconformity likely to cause death or serious bodily injury if the vehicle is driven. The next route is four or more repairs of the same nonconformity. Both need direct notice, meaning you told GM itself at least once, if GM clearly and conspicuously disclosed that duty.

The third route counts more than 30 cumulative calendar days out of service for repair of nonconformities. It needs no notice. Days spent on different defects add together, and only conditions beyond GM's control stretch the total. GM's bulletin PIP5984 put the 2022 to 2024 L87 engine assembly on part restriction while GM engineering gathered failure data. A wait that traces to GM's own restriction may be hard to call a condition beyond its control. GM can rebut the presumption, and after the window a claim can still stand on the full repair history. A separate rule, section 1793.2, subdivision (b), requires each repair within 30 days. Extensions come only from your written agreement or a delay beyond GM's control.

The Detroit Notice Box in the Booklet's California Section

Page 13 of the 2025 Cadillac Limited Warranty and Owner Assistance Information booklet holds a section headed Warranty Information for California Only. It lists the three routes, then a line in capital letters directs notice to General Motors LLC, P.O. Box 33170, Detroit, MI 48232-5170. Page 25 lists the Cadillac Customer Assistance Center at P.O. Box 33169, one number away. DCA's roster of electing manufacturers and GM's California warranty notice list P.O. Box 33173 for repurchase notices. Confirm each box in your own booklet and GM's notice before mailing. Send a certified letter with a return receipt giving your name, VIN, year, model, mileage, the defect and each visit.

Do GM's Own Recall Words on Propulsion, Brakes and Engines Help a Cadillac Lemon Law Lawyer?

As evidence of danger, yes, though a recall alone neither creates a Cadillac claim nor ends one. NHTSA's consequence summaries come from GM's recall reports. They describe lost drive power, released brake pressure and engine failure as conditions that can increase crash risk. That wording can help show why a symptom is dangerous.

Complaints are owner reports, not findings. Say your 2023 all-wheel-drive Lyriq's brakes let go twice in stacked traffic on State Route 163 through Balboa Park. Two repairs and one letter to GM may fit the two-repair route. Write down the speed, the road and the pedal feel.

Campaign 24V459000 is a closer call. It reaches certain 2023 to 2025 XT5 and 2024 and 2025 XT6 models. Their instrument panel may not light up when the hazards, high beams or turn signals are on. NHTSA's consequence statement says a driver could fail to turn them off, and lights left on can confuse other drivers. Defects with no recall can still qualify, and a dashcam clip, a dated video and a technician's written confirmation help prove them.

How Long After the Warranty Ends Can a Cadillac Lemon Law Lawyer Still File?

For a Cadillac that GM's 2025 election covers, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. That warranty is the written GM coverage given at delivery. Repair days pause both limits, as do up to 60 days after a pre-suit notice, a written demand to GM.

That notice is required only before a suit seeking civil penalties. GM's opt-in date, April 23, 2025, appears on the Department of Consumer Affairs list of manufacturers that elected the newer procedures. Section 871.30 of the Code of Civil Procedure carries that choice over Cadillacs sold in 2025 and earlier years. A Cadillac sold new in 2026 or later falls under section 871.29, subdivision (d), which requires GM to name the governing procedure at the sale. Where GM names the older rules, Commercial Code section 2725 sets four years, running by default from tender of delivery. A warranty that explicitly extends to future performance, with discovery awaiting it, starts the period when the breach is or should have been discovered.

Section 871.22, subdivision (a), adds that the warranty must cover the specific defect. Say you took delivery of an XT5 in March 2023. Its bumper-to-bumper coverage runs out by time in March 2027. A claim tied to that coverage would have a default filing date in March 2028, before any pauses. Your own date depends on the booklet and the repair orders.

When a Six-Year Powertrain Term Meets the Six-Year Filing Limit

A six-year powertrain term that ends by time puts the one-year date in year seven, so the six-year limit comes first. A term that ends at 70,000 miles in year four leaves the one-year rule in control. Shop days that stretch the warranty can move the one-year date, and the six-year limit moves only through the pauses in subdivision (c) of section 871.21.

GM's 30-Day Answer to a Cadillac Lemon Law Demand

The notice in section 871.24 must reach GM at least 30 days before a suit seeking penalties. It gives your name, the accurate VIN, a brief repair history and a demand to repurchase or replace. Email works if you use the address GM displays online for these notices. Certified or registered mail, return receipt requested, to the address in the owner's manual or warranty booklet also works. You must have the Cadillac when you send it. Keep it 30 days after GM receives the notice, or 60 if GM makes an offer. From receipt, GM has until day 30 to offer and day 60 to complete. Meeting both dates keeps civil penalties out of the case, while missing either leaves them available under subdivision (e)(1).

With a lawyer, GM's offer must add reasonable attorney fees and costs. A prelitigation dispute over fees alone goes to neutral, binding arbitration. Under section 871.25, the only release GM may require is the Standardized SBA Release. Under section 871.27, subdivision (g)(2), GM then has 30 days from receipt of the release signed through counsel to complete the agreed buyback. Each late day costs $50 unless the parties stipulate otherwise. The penalty falls away if the buyer fails to cooperate in good faith and delays the buyback.

Can a Cadillac Lemon Law Lawyer Test Your Repair Orders Against the Three Routes and GM's Deadline?

Yes. Bring the purchase or lease contract, every repair order in date order, any letter you mailed to GM and the warranty booklet. Cline APC offers a free consultation at (888) 982-6915 that tests each route against those papers and dates your filing deadline.

Staple the certified mail green card to the repair order it followed. Cline APC meets Cadillac owners at its La Jolla office, its Poway office or by phone. A Cadillac lemon law lawyer there names any gap in your records plainly. Nobody can promise how GM will respond.

When the folder is ready, send the firm your repair history online to book the review.
