The recall is GM's federal duty to fix a safety defect in a way GM picks. California lemon law adds a separate duty. So a new or leased Chevrolet that dealers cannot fix may be bought back or replaced, at your choice.
A buyback, which the statute calls restitution, returns what you paid. A replacement is a substantially identical new Chevrolet. Either one follows a reasonable number of repair attempts, or fair opportunities to fix the defect. Civil Code section 1795.4 gives a lessee, the person who leases, a buyer's rights. A demonstrator sold with GM's new car warranty counts too. Business trucks also count when they weigh under 10,000 pounds gross vehicle weight. However, the owner can have no more than five vehicles registered in California.
Used Chevrolets face a harder rule. On October 31, 2024, the California Supreme Court decided Rodriguez v. FCA US, LLC, found at 17 Cal.5th 189. It held that time left on the factory warranty does not make a used car new. The exception is a sale at which GM issued its new car warranty. Because the court left certified programs aside, a certified Chevrolet usually sits outside the new-car remedy, though that point remains open. A dealer's own written warranty may support a claim under Civil Code section 1795.5.
Every file at Cline APC is a lemon law or warranty dispute. If one defect keeps returning after the recall, call (888) 982-6915 or send the firm your recall letter.
Which Chevrolet Models and Recalls Bring Owners to a Chevrolet Lemon Law Lawyer?
Recent Chevrolet campaigns reach 6.2L V8 Silverados and Tahoes, diesel transmission software, stalling Equinox fuel pumps and Bolt battery software. None of them turns a Chevrolet into a lemon by itself. Still, every recall visit leaves a dated entry in the repair record. A defect that survives the remedy keeps adding to it.
| Model | Model years in the campaign | What GM's recall filing describes | Claims |
|---|---|---|---|
| Silverado 1500 | 2021 to 2024 with the 6.2L V8, and 2020 to 2022 diesels | Connecting rod or crankshaft defects that may cause engine failure (25V274000), and a transmission control valve that may lock the rear wheels (24V797000) | Chevrolet Silverado 1500 lemon law claims |
| Tahoe | 2021 to 2024 with the 6.2L V8, 2021 diesels and certain 2021 models | The same engine and valve campaigns, plus power steering software (21V455000) | Chevrolet Tahoe lemon law claims |
| Equinox | 2021 and 2022 | The fuel pump module may not supply enough fuel, and the engine may stall (23V013000) | Chevrolet Equinox lemon law claims |
| Bolt EV and Bolt EUV | 2020 to 2022 Bolt EV and 2022 Bolt EUV | Battery fire risk near full charge (21V650000), then diagnostic software installs that may have failed (24V481000, 24V812000) | Chevrolet Bolt EV lemon law claims |
Say you bought a 2023 Silverado 1500 with the 6.2L at Kearny Mesa Chevrolet on Balboa Avenue. It passes the recall inspection in June 2025. Later that fall, the engine knocks on a climb up State Route 163. Both visits can count against one nonconformity. Subdivision (e)(1) of Civil Code section 1793.22 sets the test for that term. The defect must substantially impair the use, value or safety of the vehicle.
Passed the 6.2L Inspection but Still Knocking
GM's remedy begins with an engine inspection. An engine that fails is repaired or replaced. One that passes gets thicker oil and a fill cap marked with the new grade. GM's dealer FAQ lists warning signs such as knocking, a lit check engine light, hesitation, high RPMs, abnormal shifting and a no-start. Those words on the next order tie your complaint to the recalled defect.
Does GM or the Owner Pick the Remedy When a Chevrolet Lemon Law Attorney Steps In?
Under the federal recall statute, GM picks the remedy, and a recall refund subtracts a reasonable allowance for depreciation. California restitution, however, works the other way. The buyer chooses a refund or a replacement, and the only use charge is a mileage offset, which counts the miles before the defect's first repair visit.
| Question | Federal recall remedy, 49 U.S.C. 30120 | Song-Beverly restitution, Civil Code 1793.2 |
|---|---|---|
| Who chooses | GM picks a repair, an identical or equivalent vehicle, or a refund | You pick a refund or a substantially identical new vehicle |
| Starting figure | Price less a depreciation allowance the statute never defines | Price paid or payable, with transportation and factory options |
Take a Santee family that paid $34,800 for a new Equinox and first brought it in for stalling at 4,500 miles. Price times those miles, divided by 120,000, gives an offset of $1,305. That is arithmetic, not a forecast.
Who Picks the Remedy Under Federal Recall Law
Section 30120, subdivision (a), lets the manufacturer repair the vehicle, swap it or refund the price less depreciation. If a repair is not done adequately within a reasonable time, subdivision (c) requires a replacement or refund. Sixty days without an adequate repair after you present the vehicle is prima facie evidence of unreasonable delay, which GM must then rebut. A visit before the remedy date in GM's notice does not count as a presentation. Subdivision (d) requires a reimbursement plan, and GM's June 2025 letter enclosed a reimbursement form.
Chevrolet Lemon Law Restitution Adds What a Recall Refund Leaves Out
Restitution under subdivision (d)(2)(B) of Civil Code section 1793.2 also returns sales or use tax, license, registration and other official fees. Non-GM items a dealer or you installed are left out, except selling-dealer add-ons on GM's track. Incidental damages also cover reasonable towing, rental and repair bills you actually paid, meaning the costs a defect caused you. Any replacement must carry the usual new-vehicle warranties, with GM paying its tax and fees. A Chevrolet lemon law lawyer checks each line of GM's figure, and the buyback calculator gives you a rough one first.
Does GM's 10-Year Engine Letter Change What a Chevrolet Lemon Law Lawyer Can Pursue?
Only as a repair promise, which may not move a filing date. GM's 6.2L letter covers the recalled condition, once inspected, for 10 years or 150,000 miles from in-service, whichever comes first. Chevrolet's online warranty summary lists Bumper-to-Bumper terms of 3 years or 36,000 miles and typical Powertrain terms of 60,000 miles or 5 years, whichever comes first.
Say a Poway plumber takes delivery of a Silverado in June 2023 and drives 36,000 miles a year. Powertrain coverage would end by miles in early 2025, and a one-year filing window would run from there. The firm checks Chevrolet claims from Poway owners against both coverages.
The Special Coverage Letter Is a Repair Promise, Not a Buyback
GM's letter covers an engine failure from the recalled condition within 10 years of the in-service date or 150,000 miles. The work happens at a GM dealer, and GM says it will repair or replace the engine at no charge. However, other conditions fall outside it, as do engine failures outside the powertrain warranty. GM's dealer FAQ adds courtesy transportation while an affected vehicle is inside the associated warranty period.
The Presumption Window Counts Chevrolet Recall Visits Too
Under Civil Code section 1793.22, subdivision (b), the presumption is a burden-shifting shortcut. That rule treats GM as having had a reasonable number of repair attempts given any of three events. The window is 18 months from delivery or 18,000 miles, whichever occurs first. One route takes two or more repairs of a nonconformity, such as a loss of power in traffic, likely to cause death or serious bodily injury. Another is four or more repair visits for one and the same nonconformity. Each of those routes also requires direct notice, meaning at least one letter went to GM itself, if the warranty disclosed that duty. The last is repairs that keep the vehicle in the shop beyond 30 cumulative days, and it needs no notice. GM can try to rebut the presumption.
Even after the window closes, the full repair history can still carry a claim under section 1793.2, subdivision (d)(2). A recall visit counts when it addresses the defect you keep reporting. The Department of Consumer Affairs (DCA) certifies and lists BBB Auto Line as the arbitration program for GM brands, which GM sponsors. If GM gave timely written notice of the program, subdivision (c) of section 1793.22 puts it ahead of the presumption. Program days extend your filing deadline as well.
How Many Chevrolets Did the 6.2L Recall Reach, and What Can a Lawyer Do if the Fix Failed?
Recall 25V274000 covers 597,571 GM vehicles, and GM's July 21, 2026 report placed 508,188 in its remedied column. NHTSA then opened Engineering Analysis EA26005 on August 20, 2026, citing 499 post-remedy engine failure complaints. Still, an investigation is not a finding. What a lawyer can use is your own repair history after the recall visit.
| Chevrolet 6.2L recall figure | Number | Source |
|---|---|---|
| Vehicles in 25V274000, filed April 24, 2025 | 597,571 | NHTSA recall filing |
| Vehicles GM reported as remedied | 508,188 | GM report dated July 21, 2026 |
| Post-remedy engine failure complaints in EA26005 | 499, with 473 after the oil change and 26 after a new engine | NHTSA resume |
| Failure reports on L87 engines built after the recall window | 191 | Same resume |
Recall 25V274000 also reaches GMC trucks under the same 6.2L campaign and the Escalade in Cadillac lemon law claims. Now picture a 2022 Equinox that stalls on Interstate 805 near State Route 52 shortly after its 23V013000 fuel pump recall. That stall is evidence a Chevrolet lemon law lawyer can use. Enter the VIN in NHTSA's recall lookup and pair each campaign with an order.
Software Recall Fixes Leave Only a Date Behind
Campaign 24V797000 loaded new transmission software on 2020 to 2022 diesel Silverado 1500 trucks and 2021 diesel Tahoes. GM paired it with special coverage for transmissions the software flags. Campaign 21V455000 updated power steering software on certain 2021 Tahoes at the dealer or over the air. Ask GM or the dealer to confirm an over-the-air date in writing. Bolt campaigns 24V481000 and 24V812000 show why, since installs may have failed.
When Does GM's 2025 Election Set the Filing Deadline for a Chevrolet Lemon Law Attorney?
GM elected on April 23, 2025, opting in to separate deadlines, demand letters and case rules for Chevrolets sold in 2025 or earlier. There, the deadline to sue is one year after the end of the applicable express warranty, which is the defect's written coverage. Repair days pause that deadline and the outer limit of six years after delivery.
A pre-suit notice, a written demand required only for a suit seeking civil penalties, adds a pause of up to 60 days. Civil penalties are extra money a court may add for a willful violation. GM's date is shown in the Department of Consumer Affairs register of manufacturers that opted in. Chevrolet is a General Motors brand. GM's date also sits inside the 30-day election window of section 871.30, which reached vehicles sold in 2025 and earlier. Section 871.21 sets both limits and adds the arbitration-time pause in Civil Code section 1793.22.
Say you bought a new Tahoe at Cumming Chevrolet on the National City Mile of Cars in March 2026. Section 871.29, subdivision (d), covers a vehicle sold new in 2026 or later. GM must tell the buyer at that sale which procedure governs. A Chevrolet lemon law lawyer reads that notice in the deal jacket before trusting any date. If it names the older rules, Commercial Code section 2725 gives four years, by default from tender of delivery. When the warranty explicitly covers the vehicle's future performance and discovery has to await it, the four years begin on the date the breach is or should have been discovered.
The Pre-Suit Letter That Keeps Chevrolet Lemon Law Penalties Alive
Section 871.24 calls for that notice only before a lawsuit that asks for civil penalties. The rule reaches Chevrolets sold in 2025 or earlier under GM's election. In that case, the letter must arrive at least 30 days before you file. It lists your name, the VIN, a brief repair history and a demand to repurchase or replace. Counting from GM's receipt, its offer is due by day 30, and the buyback or replacement must be complete by day 60. If GM hits both dates, civil penalties drop out of the case. If it misses either one, they stay available under subdivision (e)(1). When a lawyer represents you, that offer must also include reasonable attorney fees and costs.
If GM Offers, Stalls or Stays Silent on a Chevrolet Lemon Law Demand
Under section 871.27, service contracts and GAP from an outside company come out of the offer. The same products from the selling dealer stay in. GM may subtract negative equity, a trade-in's unpaid balance rolled into the loan. Section 871.25 limits GM to the Standardized SBA Release. Subdivision (g)(2) of section 871.27 then sets a 30-day clock to finish the agreed buyback or replacement. It runs from GM's receipt of the release signed through counsel. Missing that date costs GM $50 a day unless the parties stipulate otherwise. The penalty does not apply if the buyer fails to cooperate in good faith.
For elected-track cases with counsel, filed January 1, 2025, or later, section 871.26 sets disclosures within 60 days of GM's answer. They include the warranty history and related service bulletins. The parties schedule mediation by day 90, to occur by day 150. Civil Code section 1794, subdivision (c), permits a civil penalty as large as twice the actual damages for a willful violation. That penalty is unavailable in class actions and implied-warranty-only claims. Under subdivision (d), costs and reasonable attorney fees go to a buyer who prevails. Cline APC walks through its fee arrangement at the first meeting.
Should You Ask a Chevrolet Lemon Law Lawyer Whether Your Recall Turned Into a Claim?
Yes, once the same defect returns after the recall visit. Bring the recall letter, the recall repair order, every later order and the purchase or lease contract. Cline APC offers a free consultation at (888) 982-6915, and that review lines up the visits by date and mileage against GM's election.
Say a Tahoe owner keeps the June 2025 recall letter, the passed-inspection order and a second engine order in one folder. A Chevrolet lemon law lawyer then reads it for the presumption routes and the days out of service.
Cline APC meets owners from across San Diego County in La Jolla and Poway. When a file supports a claim, the next step is usually a written demand or a BBB Auto Line filing, and you choose. Nobody can promise how a case ends.
When the papers sit together, send Cline APC a message online to set up that first review.
