Chevrolet Silverado 1500 Lemon Law Lawyer in San Diego

Your Silverado 1500 is registered to your contracting business and pulls a trailer most weekdays. The same engine problem has now sent it back to the dealer three times. A Chevrolet Silverado 1500 lemon law lawyer expects two questions from GM in a case like that.

Was the truck bought for business, and was it towing more than it should? California law answers both, and neither ends a claim on its own.

Suppose GM's dealers still cannot fix the problem after enough chances, which the law calls a reasonable number of repair attempts, judged on the whole history. You may then choose a buyback, called restitution, or a new truck substantially identical to this one.

Cline APC handles only lemon law and warranty disputes, work pickups and other Chevrolet lemon law claims included. If your truck keeps losing days at the dealer, call (888) 982-6915 with the registrations for every business vehicle nearby.

Does a Silverado 1500 That Shudders With a Trailer Hitched Need a Lemon Law Lawyer?

It may. Owners filed 2,332 complaints with NHTSA about 2021 to 2026 Silverado 1500 trucks through September 23, 2026, with 1,026 naming the engine and 650 the power train. A defect that shows up under load is still a defect if the truck stayed inside its ratings.

Phrases like these help the advisor record it.

  • It shudders and loses power pulling the trailer up a grade.
  • The 6.2L engine knocks.
  • On the diesel, the rear end locks or it shifts roughly.
  • The wheels locked without warning on our 2026 four-wheel-drive truck.

Say you haul a mini excavator on a flatbed from a Mira Mesa yard toward State Route 56. On the third trip in a month, the Silverado shudders, loses power and throws a check engine light. The dealer's first question will be what you were pulling.

Failures That Disappear When the Trailer Comes Off

A technician who drives the empty truck around the block may write no problem found. That visit still counts as a chance GM's dealer had to fix the defect. A short video with the trailer hitched, showing the dash warning and the road, backs up your account. Note the date, the load and the road the same day, because the order may leave them out.

Which Silverado 1500 Engines and Build Dates Does a Lemon Law Attorney Match to the Recalls?

The L87 recall reaches 2021 through 2024 trucks with engines built March 1, 2021, through May 31, 2024. Diesel valve campaigns reach 2020 to 2022 diesels. A transfer case campaign reaches certain 2026 four-wheel and all-wheel-drive trucks, and NHTSA is also investigating later L87 engines.

2026Four-wheel or all-wheel drive26V289000A missing transfer case part may lock the wheels without warningInspection and a new transfer case as needed

Say your 2025 Silverado has the 6.2L, and its engine was built after the recall window. No 25V274000 letter covers it, yet its warranty visits still count.

Does a Recall Visit Prove a Defect to a Chevrolet Silverado 1500 Lemon Law Lawyer?

Not by itself. A recall visit adds a dated entry to the record but does not prove a nonconformity. That term covers only defects that substantially impair the truck's use, value or safety. Campaign 25V274000 warns that crankshaft or connecting rod defects may cause engine failure, and 24V797000 addresses a valve that can lock the rear wheels.

Take a 2021 Duramax Silverado that gets valve software in 2025 and a second load under follow-up campaign 26V083000 in 2026. Then the rear end locks on Interstate 8. That third visit joins a history GM already started.

Special Coverage That Runs Out Early at 40,000 Miles a Year

After the inspection, GM's letter adds special coverage for this engine condition for 10 years after the truck entered service or 150,000 miles, whichever comes first. A truck driven 40,000 miles a year passes 150,000 miles in under four years. That coverage is a promise of another repair at a GM dealer, not a buyback. Keep that letter with your orders.

Engines Built After May 31, 2024 and Investigation EA26005

The recall covers L87 engines produced from March 1, 2021, through May 31, 2024. On August 20, 2026, NHTSA opened Engineering Analysis EA26005 and widened it to engines built after that window. Its opening resume counts 191 L87 failure reports among those later engines. An investigation is not a finding, though it shows the question is open for trucks the recall never reached.

Aftermarket Bumpers, Accessory Wheels and Recalls GM Did Not Issue

Campaign 24V626000 came from OEM Systems, LLC, not GM, for 2024 Silverado rear bumper brackets that may not hold a trailer. GM's own 21V985000 covered certain 2019 to 2021 trucks whose 17-inch spare, used with accessory wheels, could keep the anti-lock brakes from working properly. Under section 871.27, dealer-supplied add-ons stay recoverable on GM's track. Equipment from an outside installer likely does not.

How Do You Answer the Service Writer's Towing Question for Your Lemon Law Attorney?

Tell the advisor the load, the grade and the outside temperature when the failure hit. Ask that those details go on the order word for word. Then request, in writing, a test under a comparable load, and note any refusal. Keep your own notes too.

Say an El Cajon contractor loses the truck for two weeks, and the order reads no problem found. Whether lost jobs count as damages depends on the claim and the proof. The days out of service count either way, and your own records carry the rest.

Scale Tickets and Door Labels a Chevrolet Silverado 1500 Lemon Law Lawyer Wants

Chevrolet's 2025 Trailering Guide defines gross vehicle weight rating, or GVWR, as the most the truck itself should weigh with passengers, cargo and equipment. It sits on the certification label on the driver door or frame. The guide's 13,300-pound highest towing rating is not GVWR, and neither is a combination rating as high as 19,100 pounds on some configurations. A certified scale ticket well inside those ratings answers most overloading arguments.

Oil Grade Receipts After the L87 Inspection

A truck that passed the inspection runs on a higher viscosity oil, and the new fill cap names the grade. Many work trucks get oil changes at fleet shops or quick-lube stores. Ask each shop to print the grade on the receipt, and keep every one. If the engine fails later, those receipts answer any claim that the wrong oil caused it.

Why Does a High-Mileage Silverado 1500 Outrun the 18-Month Shortcut a Lemon Law Attorney Uses?

The presumption, a burden-shifting shortcut, only reaches events in the first 18 months after delivery or the truck's first 18,000 miles, whichever comes first. A truck driven 30,000 miles a year reaches 18,000 in about seven months. After that, claims proceed under section 1793.2, subdivision (d), and proving a reasonable number of attempts falls to you.

Inside the window, Civil Code section 1793.22 treats GM as having had a reasonable number of repair attempts under three sets of facts. Two or more repairs suffice when a nonconformity creates a failure likely to cause death or serious bodily injury. Rear wheels locking at speed may fit that route. Any other nonconformity takes four or more. Both need one direct notice, a letter addressed to GM rather than the dealer, if the warranty discloses that duty. Shop stays that add up to more than 30 cumulative days for repair also count, with no notice. GM can rebut the presumption. Apart from it, section 1793.2, subdivision (b), expects each repair within 30 days, absent your written consent or a delay GM cannot control.

Under 10,000 Pounds GVWR and No More Than Five Registered Vehicles

Subdivision (e)(2) of section 1793.22 reaches a truck whose main purpose, at purchase or in use, is personal, family or household driving. A business truck qualifies only with a gross vehicle weight under 10,000 pounds and a buyer with five or fewer vehicles registered in California. Say a Santee pool service runs two trucks and one van. Both tests are likely met. That count belongs to whoever bought the truck, and Vehicle Code section 415 defines a motor vehicle as self-propelled, which bears on trailers.

Fleets Past Five and the Federal Warranty Act

The federal Magnuson-Moss Warranty Act, at 15 U.S.C. section 2310(d), lets a consumer harmed by a breach of a written warranty sue the warrantor. The Federal Trade Commission rule at 16 C.F.R. section 700.1 treats automobiles used for both personal and commercial purposes as consumer products. A consumer who finally prevails may recover costs and fees unless the court finds that inappropriate. A fleet buyer's eligibility is a legal question.

One-Year Windows, Six-Year Limits and an Offset at 14,000 Miles

GM opted in to the newer procedures, a distinct set of deadlines and letter rules, on April 23, 2025. The election covers Silverados sold in 2025 or earlier. On that track, section 871.21 sets the filing deadline one year past the end of the applicable express warranty, the written coverage for that defect. Six years after delivery is the outer limit. Repair time pauses both, and a pre-suit demand letter to GM pauses them up to 60 days.

Say an Escondido electrician takes delivery in April 2024 and drives 40,000 miles a year. Chevrolet's listed Bumper-to-Bumper term, 36,000 miles or 3 years, whichever comes first, would end in early 2025. The window for a non-powertrain defect would then close in early 2026 before pauses. Section 871.29 requires GM to name the governing procedure for any Silverado sold new in 2026 or later. Where it names the older rules, section 2725 of the Commercial Code sets a four-year period, usually from tender of delivery. A warranty explicitly promising future performance, with discovery awaiting it, instead starts the period once the breach is or should have been discovered.

Under section 871.24, that letter is a prerequisite only for a suit seeking civil penalties, which can reach twice actual damages for a willful violation. It must arrive 30 or more days before filing. From receipt, GM has 30 days to offer and 60 to finish, and meeting both dates removes those penalties, while missing either keeps them in play. The mileage offset, the charge for miles logged before the defect's first repair visit, runs about $6,872 on a $58,900 truck first brought in at 14,000 miles. The buyback calculator runs your numbers.

Is It Time to Call a Chevrolet Silverado 1500 Lemon Law Lawyer About Your Work Truck?

If the same failure has come back, yes. Bring the registrations for every business vehicle, the purchase contract, dealer and installer invoices, repair orders, scale tickets and door-label photos. Cline APC reviews them during a free consultation by phone at (888) 982-6915, checking the weight and fleet tests, the visits and the deadline under GM's election.

Say a landscaper runs four trucks and three trailers and wonders whether the trailers count. The firm sorts that out before any agreement.

A Chevrolet Silverado 1500 lemon law lawyer is candid about weak spots, and no firm can promise how GM responds. The firm also reviews Chevrolet lemon law claims from Poway, GMC Sierra 1500 claims and Chevrolet Tahoe lemon law claims.
