California proves an engine claim one way and a camera claim another.
When GM's dealers still cannot fix a new or leased GMC after a reasonable number of repair attempts, the law may require a buyback or a replacement. That standard means fair chances to fix the defect, weighed on the whole history. Restitution, the legal name for a buyback, refunds what you paid, minus a use charge. Replacement means a new GMC that is substantially identical to yours. A lessee, someone who leases rather than buys, has a buyer's rights under Civil Code section 1795.4.
Demonstrators sold with GM's new car warranty count. So does a business pickup under 10,000 pounds gross vehicle weight when no more than five vehicles are registered to the company in California. Used GMCs are harder. Under Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, leftover factory coverage does not make a used vehicle new unless GM issued its new car warranty with that sale. That ruling left certified pre-owned programs undecided. A certified GMC usually lands outside the new-vehicle remedy, though that point is unsettled. A selling dealer's own written warranty may support a claim under section 1795.5.
Lemon law and consumer warranty disputes are the only cases Cline APC accepts. If one GMC failure keeps coming back, call (888) 982-6915 or send the firm your repair orders.
Does It Matter to a GMC Lemon Law Lawyer Which System Keeps Failing?
It does. Owner complaints to NHTSA about 2021 to 2026 Sierra 1500 and Yukon models name the engine most often, ahead of the power train and the electrical system. Driver aids draw fewer than all three. Each system is proven with different evidence and can sit under a different warranty.
| Model | Years in GM's filings | What the campaign describes | GMC claims |
|---|---|---|---|
| Sierra 1500 | 2021 to 2024 with the 6.2L V8, 2020 to 2022 diesels | Connecting rod or crankshaft parts that may have defects that can lead to engine failure (25V274000), a transmission valve that may lock the rear wheels (24V797000), then a follow-up for possible wrong software (26V083000) | GMC Sierra 1500 lemon law claims |
| Yukon and Yukon XL | 2021 to 2024 with the 6.2L V8, 2021 diesels, 2022 ten-speeds with electronic range select | The same engine and diesel valve campaigns, plus a distinct valve condition that can lock the rear wheels (26V085000) | GMC Yukon lemon law claims |
Say your 2022 Sierra 1500 twice loses power climbing Interstate 15 north of Rancho Bernardo, and both tows go in the engine stack. The law's word for a qualifying defect is nonconformity. It means a defect that substantially impairs your GMC's use, value or safety, per section 1793.22(e)(1).
Campaign 25V274000 reaches certain 2021 to 2024 Sierra 1500, Yukon and Yukon XL models with the 6.2L V8 that GM calls the L87. GM's amended report counts 153,637 Sierra 1500s, 82,841 Yukons and 60,926 Yukon XLs built from March 1, 2021, to May 31, 2024. NHTSA's Engineering Analysis EA26005, opened August 20, 2026, studies engine failures after the recall remedy. It now reaches later L87 engines, though it is not a finding. The campaign also covers Chevrolet 6.2L trucks and SUVs and the Cadillac Escalade.
Lifter Tick and GM's Normal Characteristic Exclusion
GMC's 2021 warranty booklet excludes slight noises, vibrations and other normal characteristics. Yet it lists the Active Fuel Management valve lifter oil manifold as a covered engine part. Owners mention lifters in 115 Sierra 1500 and 137 Yukon and Yukon XL complaints filed with NHTSA through October 1, 2026. GM's bulletin 19-NA-218, dated June 2024, says a tick on the first morning start may be caused by a lifter short of oil. Its steps have a dealer leave the engine overnight, then release the vehicle when no tick follows at least 5 to 7 minutes of running. The booklet's maintenance exclusion reaches only damage from skipped service intervals or improper fluids. Federal law, 15 U.S.C. section 2302(c), generally bars a warrantor from conditioning coverage on a branded part or service.
How Does a GMC Lemon Law Lawyer Figure a Buyback When Two Defects Could Qualify?
A GMC lemon law buyback is restitution, a duty Civil Code 1793.2(d)(2) places on GM. GM cannot force a replacement on you. The mileage offset is GM's deduction for miles you drove before the first repair visit for the qualifying defect. It can differ by defect, so a shift claim and an engine claim can produce different checks.
| Item | Restitution in a lawsuit under GM's 2025 election | BBB Auto Line arbitration decision |
|---|---|---|
| Price, taxes, fees, towing and rental | Returned, with tows and rentals as incidental damages, the reasonable costs the defect pushed onto you | Must follow section 1793.2(d)(2) when it orders a buyback |
| Timing | Completion within 30 days after GM receives the release signed through counsel | The Department of Consumer Affairs (DCA) says decisions usually come within 40 days of the application and must be performed within 30 days of acceptance, with few exceptions |
Take a $61,500 Sierra first brought in for a shift problem at 9,200 miles and for the engine at 21,000 miles. Price paid or payable times miles, divided by 120,000, gives $4,715 if the shift defect qualifies. If the engine qualifies, the offset is $10,762.50. Your contract and orders set the real figures, and the repair history decides which defect qualifies. Test both mileage points in the lemon law buyback calculator.
What Happens to a Rolled-In Loan Balance When GM Buys Back a GMC
Code of Civil Procedure 871.27 reshapes restitution in lawsuits under GM's 2025 election. Negative equity, an old loan balance rolled into the GMC, comes off the refund. Rebates stay out of the price paid. Service contracts and GAP policies from an outside company are left out, while selling-dealer add-ons stay in. On a leased Acadia or Yukon, lease extension and residual payments count as damages. GM must complete an agreed buyback within 30 days of receiving the release signed through your lawyer. Each late day then costs $50, unless the parties stipulate otherwise or you fail to cooperate in good faith.
Which GMC Warranty Covers the Defect, and Why Does a Lemon Law Attorney Check Both?
GMC's online warranty summary ends Bumper-to-Bumper coverage at whichever comes first, 3 years or 36,000 miles. Typical Powertrain coverage stops at whichever comes first, 5 years or 60,000 miles, though other terms exist. Your model year's booklet controls. An engine and a screen can fall under different warranties with different end dates.
GMC's 2021 booklet gave 1500 pickups with the 3.0L Duramax a Powertrain term of 5 years or 100,000 miles, whichever comes first. For 2025 Sierra EV and Hummer EV models, GMC's Electric Vehicle booklet covers the propulsion battery pack for 8 years or 100,000 miles, whichever comes first. The online summary leaves sensors, wiring and connectors out of Powertrain coverage. Say a Yukon delivered in August 2023 is driven about 15,000 miles a year. Bumper-to-Bumper coverage would end around January 2026, near 36,000 miles, and Powertrain around August 2027.
GMC's 2021 booklet keeps software GM distributes out of warranty coverage. It also excludes third-party device hardware and software, and environmental damage such as salt from sea air.
Two Visits Can Be Enough When a GMC Might Lock Its Rear Wheels
Civil Code 1793.22(b) adds a presumption, which treats GM as having had a reasonable number of repair attempts. One of three events triggers it within 18 months of delivery or 18,000 miles, whichever comes first. Route one covers a nonconformity likely to cause death or serious bodily injury if the vehicle is driven. It needs two or more repairs, and rear wheels locking at speed may fit. Route two covers one nonconformity repaired four or more times. Both routes need direct notice, at least one notice to GM itself, if its warranty clearly disclosed that duty. Route three counts more than 30 cumulative calendar days in the shop for nonconformity repairs, and it needs no notice. GM can rebut the presumption. Past the window, the full repair history can still win a claim.
GMC's 2021 booklet, in its California section, sends direct notice to General Motors LLC, P.O. Box 33170, Detroit, MI 48232-5170. Confirm the box in your own booklet. A could not duplicate order still shows you reported the problem. Reprogramming aimed at your complaint often counts as a repair attempt. BBB Auto Line is the GM-sponsored program that DCA has certified and lists for GM brands, GMC among them. If GM told you about it in writing and on time, subdivision (c) of that section requires you to try the program before asserting the presumption.
Why Does a GMC Lemon Law Attorney Start With the Engine in NHTSA Complaint Data?
Through October 1, 2026, owners filed 2,183 NHTSA complaints about 2021 to 2026 Sierra 1500 pickups. Of those, 1,031 named the engine. Complaints are what owners report, not findings. A completed recall is one more repair visit, never proof of a nonconformity by itself.
| GMC by the numbers | Figure | Source |
|---|---|---|
| 2021 to 2026 Sierra 1500 complaints | 2,183 total, engine 1,031, power train 443, electrical 292, forward collision avoidance 66 | NHTSA, duplicates removed, pulled October 1, 2026 |
| 2021 to 2026 Yukon and Yukon XL complaints | 1,693 total, engine 1,068, power train 285, electrical 211, forward collision avoidance 72 | Same pull |
Say your 2023 Canyon brakes hard for nothing twice on State Route 52 near Santee, after the 24V133000 software update. You took it in both times, and GM got your written notice after the first. Those two visits may meet route one, depending on timing and on each order's wording.
EV Drive Units and Battery Packs on the Sierra EV and Hummer EV
Campaign 24V320000 covers certain 2024 Sierra EV and Hummer EV SUV models, among other GM vehicles, 10 in all. Rear drive unit motor wires may lack enough insulation and cut drive power, so dealers replace the unit. Campaign 26V494000 covers certain 2026 Sierra EV and 2022 Hummer EV Pickup models, among other GM vehicles, 11 in all. A loose battery module part may damage the pack and raise fire risk, so dealers replace the battery. While a drive unit or pack is on order, Civil Code 1793.2(b) separately expects each repair finished within 30 days. Only your written agreement or conditions beyond GM's control can extend that period.
Phantom Braking and Dark Cameras the Dealer Cannot Recreate
Campaign 24V133000 covers certain 2023 Canyons whose front camera module may falsely detect an obstacle and trigger emergency braking. Dealers update the software, and letters went out April 5, 2024. Campaign 22V709000 covers certain 2020 and 2021 Acadias with Surround Vision, whose camera connectors may have been crimped improperly. GM may point to manual passages on when driver aids may not work. Save a dated dashcam clip and log the road, speed and weather that day.
When Does an Engine Claim or a Camera Claim Run Out for a GMC Lemon Law Attorney?
General Motors LLC elected newer court procedures on April 23, 2025, per DCA's register. GM's recall filings name General Motors LLC as GMC's manufacturer, so section 871.30 reaches GMC vehicles sold in 2025 and earlier. On that track, suit must be filed within one year after the applicable express warranty ends. An engine and a camera can carry different deadlines.
The elected track is a separate set of deadlines and demand-letter rules. The applicable express warranty means the written GM coverage that reached that defect at delivery. Code of Civil Procedure section 871.21 requires suit within one year after that warranty ends, and never more than six years after delivery. Repair days and program time under section 1793.22 pause both limits. A pre-suit notice under section 871.24 also pauses them for up to 60 days. That written demand to GM is required only before a suit seeking civil penalties, extra money for a willful violation.
Take that August 2023 Yukon. Before any pause, a camera claim would face a deadline near January 2027. An engine claim would face one near August 2028.
For a GMC first sold new in 2026 or later, section 871.29(d) obligates GM to state at the sale which procedure governs. Where the notice names the older rules, Commercial Code section 2725 sets four years, normally from tender of delivery. A warranty that explicitly extends to future performance, with discovery awaiting that performance, starts the period when the breach is or should have been discovered.
Two Letters GM Expects From a GMC Lemon Law Lawyer
Direct notice is a condition of two presumption routes, and a GMC lemon law lawyer tracks both notices. Section 871.24's pre-suit notice is a demand letter, required only before a lawsuit that seeks civil penalties. Civil Code 1794(c) limits them to twice actual damages. The rule applies to GMCs sold in 2025 or earlier on GM's elected track. The notice must reach GM at least 30 days before filing. It lists your name, the correct VIN, a brief repair history and a demand that GM repurchase or replace the GMC. Email it to the address GM posts for these notices, or mail it certified or registered, return receipt requested, to the booklet address. GM's California warranty notice, updated June 26, 2025, lists a different box, P.O. Box 33173 in Detroit, for repurchase requests. Confirm which box applies to your sale before mailing.
Hold on to the GMC for 30 days from GM's receipt, or the full 60 once GM makes an offer. GM's offer is due by day 30 and completion by day 60, both counted from receipt. Meeting both dates keeps penalties out of the case, and missing either leaves them available under subdivision (e)(1). If day 30 passes without an offer, you may sell the GMC and still pursue penalties. You must first tell the buyer in writing why you sought a buyback and about any pending lawsuit. A buyer who prevails also recovers costs and reasonable attorney fees under section 1794(d).
