Can an SUV titled to a business qualify? Civil Code section 1793.22 says it can in two cases. The Navigator was bought or used primarily for personal, family or household purposes. Or it has a gross vehicle weight under 10,000 pounds, and the business buyer has five or fewer vehicles registered in California. Repeat towing or brake failures then count like any other nonconformity, a warranty defect that substantially impairs the SUV's use, value or safety.
The firm's Lincoln lemon law lawyers work from offices on Ivanhoe Avenue in La Jolla and Danielson Street in Poway. Cline APC limits its caseload to lemon law and warranty claims. If the company's Navigator keeps returning for one defect, call (888) 982-6915 and have the company's vehicle count ready.
Which Trailer Brake Signs on a Navigator Should a Lemon Law Lawyer Hear About?
Ford's 26V104000 filing describes a trailer module that may lose communication at start-up. That can cost trailer stop lamps and turn signals and, for a trailer with electronic brakes, trailer brake function. Complaint data from the National Highway Traffic Safety Administration (NHTSA), pulled October 2, 2026, lists 89 complaints on 2021 to 2026 Navigators. Electrical leads at 22.
Complaints are owner reports, not findings. So write the symptom on each repair order in plain words, such as these.
- The trailer does not slow when I brake.
- The trailer's stop lamps or turn signals quit while I tow.
- A Trailer Brake Module Fault message appears on the cluster.
- The brake pedal feels different and travels farther.
- The red brake warning light comes on after the fluid level drops.
- A 2024 3.5L engine suddenly leaks oil.
- The backup image and driver alerts drop out together.
Say a Kearny Mesa event company hauls staging on State Route 52, and the trailer brakes quit twice after recall work. Each visit can count as an attempt at the same nonconformity, so that history is what a lawyer reviews.
Does Your Navigator's Build Year Fall Inside a Campaign Range, and Why Does a Lemon Law Lawyer Ask?
NHTSA's October 2, 2026 pull lists 28 recall campaigns on 2021 to 2026 Navigators. The trailer module campaign reaches 2022 to 2027. The brake line campaign reaches 2022 to 2024, the booster campaigns 2025, and the cup plug oil leak 2024 models with the 3.5L engine. So your VIN decides which filings apply.
| Campaign | Navigator years | What Ford's filing describes |
|---|---|---|
| 22V193000, then 25V132000 | 2022 | Software error, towed trailer may not brake. Second campaign covers incorrect repairs |
| 23V598000 | 2018 to 2021 | Rearview camera may show no image in reverse |
| 24V851000 and 25V198000 | 2024 | Misaligned cup plug in the 3.5L engine may cause a rapid oil leak |
| 25V314000 | 2022 to 2024 | Front brake lines may touch the air cleaner pipe and leak |
| 25V488000, then 25V823000 | 2025 | Brake booster module may lose power assist. Second campaign replaces the booster |
| 26V104000 | 2022 to 2027 | Trailer module may lose communication |
| 26V165000 | 2022 to 2025 | Image processing module may reset, dropping camera and driver aids |
Say a fleet manager runs every company Navigator VIN through NHTSA's recall lookup. A 2022 SUV and a 2025 SUV then show different campaigns.
When a Navigator Trailer Brake Recall Covers Repairs Done Incorrectly, What Does a Lemon Law Attorney Count?
Ford opened 25V132000 for Navigators repaired incorrectly under 22V193000, the trailer brake software campaign. So a second visit for the same trailer brake failure can count as another attempt. Campaign 26V104000 later added a trailer module software fix, installed by a dealer or over the air.
Say the trailer brakes fail again weeks after the 22V193000 visit. A repair aimed at the nonconformity can count with or without a recall number on the order. The order's words matter more than the campaign label, so ask that your complaint appear there.
Why a Change in Brake Pedal Feel Matters in a Lincoln Navigator Lemon Law Case
For 25V314000, Ford's filing says a brake line leak may lengthen pedal travel, and a rapid fluid loss can extend stopping distance, raising crash risk. For 25V488000, Ford's report covers 7,104 Navigators and lists a change in pedal feel and increased pedal travel among the warnings. Ford says the lost booster assist can extend stopping distance. Campaign 25V823000 later added a new booster for five Navigators. A record like that can help show a defect likely to cause death or serious bodily injury.
Cup Plug Oil Leaks and Camera Resets
Campaigns 24V851000 and 25V198000 cover 2024 Navigators with the 3.5L engine. Ford's filings say a misaligned cup plug may cause a rapid oil leak. They say the oil loss can cause lost motive power and, near hot parts, raise fire risk. Campaign 23V598000 reached 2018 to 2021 models with camera failures shared with the Aviator, which the firm follows on Lincoln Aviator claims. Campaign 26V165000 reaches 2022 to 2025 Navigators whose image processing module may reset.
Which Records Should a Business Keep for a Lincoln Navigator Lemon Law Lawyer After Each Dealer Visit?
Keep every repair order with its in and out dates. Also keep the rental invoice for each visit, a fleet log of towing complaints by date and VIN, and booking or cancellation records. The business must prove its downtime cost, and the orders also count shop days.
Say a Mission Valley car service owns three Navigators. One spends 23 days at the dealer over two visits, and the company rents an SUV to keep bookings.
Incidental damages are the expenses the defect caused. Civil Code section 1793.2, subdivision (d)(2), lists reasonable repair, towing and rental car costs actually incurred. Section 1794, subdivision (b)(2), sends a buyer who kept the goods to Commercial Code sections 2714 and 2715. Section 2715 treats as consequential a loss from needs the seller had reason to know of at contracting. A lost booking might fit, but a court may examine that proof closely.
Are Two Brake Repairs Enough for a Lincoln Navigator Lemon Law Lawyer to Pursue a Buyback?
They can be. Two repairs inside 18 months or 18,000 miles, whichever comes first, can meet the Civil Code 1793.22(b) presumption. It treats Ford as having had a reasonable number of repair attempts, meaning enough chances given how serious the defect is. The failure must be likely to cause death or serious bodily injury, with direct notice where required.
The presumption has two other routes. Four repairs of the same nonconformity meet it, with the same direct notice, meaning a letter to Ford itself. More than 30 cumulative days out of service for repair meet it with no notice. However, Ford can rebut the presumption, and a claim can still succeed on the full repair history under section 1793.2, subdivision (d)(2), after the window closes. A trailer brake or booster failure can fit the two-repair route if it repeats. Once the attempts run out, restitution, the legal word for a buyback, refunds the price and certain costs.
Say a La Jolla brokerage LLC owns a 2024 Navigator L and two sedans. The Navigator's transmission goes back twice for the same harsh shift. NHTSA's October 2, 2026 pull lists no harsh-shift campaign on 2022 to 2026 Navigators. Of the 89 complaints, 11 name the power train. So the repair orders carry that claim.
The 10,000-Pound and Five-Registration Test for a Company Navigator
Section 1793.22, subdivision (e)(2), has a personal branch and a business branch. The personal branch needs no personal title. The business branch needs a gross vehicle weight under 10,000 pounds and not more than five motor vehicles registered in California to the business. NHTSA's VIN decoder places the Navigator and Navigator L patterns checked, 2021 to 2025, in gross vehicle weight rating Class 2F, 7,001 to 8,000 pounds. Confirm the rating on the door label. The statute does not say when the count is measured, so keep dated records.
What Ford Learns About the Fleet Once a Lincoln Navigator Lemon Law Suit Is Filed
In an elected-track suit filed on or after January 1, 2025, with counsel, section 871.26 applies. Subdivision (g) has the owner make disclosures within 60 days after Ford answers. For an SUV used mainly for business, that includes whether more than five vehicles are registered to the business. An elected track is the set of newer court procedures a manufacturer opted into. The Department of Consumer Affairs (DCA) dates Ford Motor Company's opt-in April 25, 2025. Section 871.30 ties it to sales in 2025 or earlier.
For a Navigator that election covers, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. Both limits pause while the SUV is out for repair and for up to 60 days after a pre-suit notice. That notice is a written demand required only before a suit that seeks civil penalties, meaning extra money a court may award for certain violations. It must reach Ford 30 days or more before filing, in the company's exact legal name, while the company holds the SUV.
Lincoln's website lists limited coverage of 4 years or 50,000 miles and powertrain coverage of 6 years or 70,000 miles for the 2027 Navigator. However, your model year's guide controls. Under section 871.29(d), Ford must name the governing procedure when a Navigator is sold new in 2026 or later. If it names the older procedure, Commercial Code section 2725 generally allows four years from tender of delivery.
Company Leases and Residual Buyouts in a Lincoln Navigator Lemon Law Case
A lessee, the person who leases, holds a buyer's rights under Civil Code sections 1793.2, subdivision (d)(2)(D), and 1795.4. Section 1791 defines a lease as one by an individual for over four months, primarily for personal, family or household purposes. A corporate lease for business driving does not match those words on its face, while a lease signed in the owner's own name may. On Ford's elected track, section 871.27, subdivision (e), counts residual buyout money as damages. It counts toward civil penalties only if paid or financed no later than 30 days after the earlier of the pre-suit notice or the lawsuit.
Used Navigators Bought for the Business
The holding in Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 is narrow. Leftover factory coverage on a used car does not make it new, unless the manufacturer's new car warranty was issued with that sale. However, the court did not decide how certified pre-owned programs fit. Certified Navigators therefore usually fall outside the remedy, and the question stays unsettled.
Offset Math on a High-Mileage Work Navigator
Ford may deduct a mileage offset for the miles driven before the first repair visit for the defect. It equals the price times those miles over 120,000. On a $98,000 Navigator first repaired at 9,000 miles, it is $7,350. Run your own figures in the lemon law buyback calculator. A company that prevails as the buyer recovers costs and reasonable attorney fees under section 1794, subdivision (d).
Should a Lincoln Navigator Lemon Law Lawyer Check the Fleet Count Before Your Company Replaces the SUV?
A free consultation at Cline APC starts with the weight rating and the registration count, then moves to the repair record and the deadline. Before the company trades in the failing SUV, a Lincoln Navigator lemon law lawyer can run that check, since a trade-in can weaken its position.
Say a Poway contractor is about to trade in the company Navigator. Gather the registration cards for every company vehicle, the Navigator's contract, all repair orders and rental invoices. The firm then reviews whether the SUV fits the statute and which deadline applies. No one can promise how a claim ends.
Send the firm a short online message, or call (888) 982-6915 for a Navigator fleet review.
