Civil Code section 1793.22 asks whether a warranty defect substantially impairs your Lincoln's use, value or safety. If it does, the law calls it a nonconformity. Any one of the three is enough.
Ford gets a reasonable number of repair attempts through its Lincoln dealers, meaning enough chances given how serious the defect is. After that, it owes a replacement, a substantially identical new Lincoln, or restitution, the legal word for a buyback. Ford Motor Company, which owns the Lincoln name, is on the Department of Consumer Affairs (DCA) list of electing manufacturers. Ford's opt-in date is April 25, 2025. That means Ford opted into newer court procedures, its elected track, and many Lincoln claims run on that track's own calendar.
The firm, Cline APC, accepts only lemon law and warranty matters, from offices on Ivanhoe Avenue in La Jolla and Danielson Street in Poway.

Which Records Does a Lincoln Lemon Law Lawyer Need When a Navigator or Aviator Keeps Failing?
Every repair order comes first, then the contract and the Lincoln warranty guide. Ford's recall filings add camera, trailer brake, brake assist and plug-in hybrid campaigns. National Highway Traffic Safety Administration (NHTSA) complaint counts put the electrical system first on both SUVs.
| Model | Model years and campaigns | What Ford's filings describe | Claims |
|---|---|---|---|
| Aviator | 2020 to 2023 (23V598000), 2022 plug-in hybrid (22V187000), 2020 to 2025 (25V407000) | Camera image that may vanish in reverse, charge port part that may cut drive power, trim that may detach | Lincoln Aviator camera claims |
| Navigator | 2022 to 2027 (26V104000), 2025 (25V488000 and 25V823000), 2022 to 2024 (25V314000) | Trailer module that may lose communication, booster that may cut brake assist, brake lines that may leak | Lincoln Navigator claims |
Say you lease a 2023 Aviator in Carmel Valley, and one electrical fault keeps it at the dealer nine days in March and twelve in May. Civil Code section 1795.4 gives a lessee, someone who leases rather than buys, the same rights against Ford that a buyer holds.
Shop Days as Proof That a Lincoln Lost Its Use
Subdivision (b) of section 1793.22 creates a presumption, a rule of proof. When one of three patterns shows up inside 18 months or 18,000 miles, whichever comes first, it treats Ford as having had a reasonable number of repair attempts. For a nonconformity likely to cause death or serious bodily injury if the vehicle is driven, two or more repairs are enough. Four or more repairs of the same nonconformity are enough, danger or not. Each of those two routes also needs direct notice, a letter to Ford itself. It must go at least once if the warranty guide or owner's manual clearly disclosed that duty.
No letter is needed on the third route. It applies once repairs of nonconformities have kept the Lincoln out of service for a cumulative total of more than 30 calendar days. Nothing but conditions beyond Ford's control extends that count. The Carmel Valley Aviator stands at 21 days, so ten more would cross it. Ford may try to rebut the presumption. After the window closes, a Lincoln can still qualify on its whole repair record under section 1793.2, subdivision (d)(2). Separately, section 1793.2, subdivision (b), expects each warranty repair within 30 days. That one-visit limit stretches only with your written consent or for a delay Ford could not control.
When a Luxury Lincoln Loses Value but Still Drives
Value is measured to the buyer or lessee, so visible flaws can count. Campaign 25V407000 covers 2020 to 2025 Aviators whose rear door window bars and C-pillar trim may detach from the vehicle while driving. On 2025 Navigators, 25V831000 addresses a rear lightbar that may crack and let in moisture, leaving reverse lights dark or flickering. The firm also handles Cadillac SUV claims.
How Does a Voluntary Lincoln Offer Compare With the Refund a Lemon Law Attorney Can Demand?
Once Ford's reasonable repair chances run out, Civil Code section 1793.2 requires a prompt remedy. Ford must either replace the Lincoln or make restitution. You choose, and Ford cannot force a replacement on you. A voluntary offer carries only the terms of its own letter, so compare each line.
| Line item | Restitution under Civil Code 1793.2(d)(2)(B) and CCP 871.27 |
|---|---|
| Price paid or payable, with transportation and factory options, plus tax and official fees | Refunded |
| Reasonable repair, towing and rental costs you actually paid | Refunded as incidental damages, the expenses the defect caused |
| Add-ons and service contracts from the selling dealer | Recoverable on Ford's elected track, 871.27(b)(2) |
| The same products from an outside company | Not recoverable on that track, 871.27(b)(1) |
| Negative equity, an old loan balance rolled into the Lincoln loan | Offset on that track, 871.27(c) |
| Manufacturer rebate | Left out of the price paid on that track, 871.27(d) |
| Miles driven before the first repair visit for the defect | Price times those miles over 120,000, 1793.2(d)(2)(C) |
Say you paid $96,000 for a new Navigator in Rancho Bernardo, and the lightbar first went in at 4,500 miles. The mileage offset is the deduction for the miles driven before that first repair visit for the defect. Here it runs $0.80 a mile, or $3,600. Try your own figures in the lemon law buyback calculator.
Factory Options, Dealer Add-Ons, and the Lincoln Refund Line by Line
Factory packages belong in the refund, while non-manufacturer items a dealer or buyer added stay out. On Ford's elected track, Code of Civil Procedure section 871.27 then treats dealer-supplied equipment, surface-protection products and service contracts as recoverable. Its subdivision (e) counts lease extension and residual payments as damages. A civil penalty is an added sum a court may award for certain violations. Those payments count toward it only if paid or financed no later than 30 days after the earlier of the pre-suit notice or the lawsuit. That notice, a written repurchase or replacement demand, is needed only before a suit that seeks civil penalties.
Keeping the Lincoln and Claiming Diminished Value
Under Civil Code section 1794, subdivision (b)(2), a buyer who kept the goods turns to Commercial Code sections 2714 and 2715. Section 2714 measures the gap between the Lincoln's value when accepted and its value as warranted. Lawyers call that gap diminished value. Code of Civil Procedure section 871.20, subdivision (b), keeps the elected-track chapter away from those claims. A keep-the-car claim may therefore follow a different deadline.
Does Limited or Powertrain Coverage Set the Deadline a Lincoln Lemon Law Lawyer Works Toward?
Either one can, depending on which part failed. Lincoln's website lists limited coverage of 4 years or 50,000 miles for the 2027 Navigator. Powertrain coverage runs 6 years or 70,000 miles. Your own model year's warranty guide controls. For a Lincoln that Ford's election covers, the filing clock runs from the end of the coverage for your defect.
Code of Civil Procedure section 871.21 sets that clock for Lincolns sold in 2025 or earlier. It requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. The applicable express warranty means Ford's written coverage that applies to the specific defect. Subdivision (c) pauses both limits during repair days, and for up to 60 days once a pre-suit notice goes out. Days in BBB Auto Line, Ford's state-certified arbitration program, extend them too under section 1793.22, subdivision (c).
One Lincoln, Two Filing Dates, Depending on Which Part Failed
Say the camera fault on your Aviator falls under the limited warranty, which ended June 14, 2026. By default, the camera claim's window would close June 14, 2027, before any paused days. A Lincoln lemon law lawyer checks whether a transmission defect on the same Aviator sits under powertrain coverage with a later end date. Mileage can end coverage first, since 20,000 miles a year passes 50,000 miles in two and a half years.
Lincolns Bought Used With Factory Coverage Left
Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 came from the California Supreme Court on October 31, 2024. The court held that leftover factory coverage does not make a used car new, unless the manufacturer's new car warranty was issued with that sale. The justices did not decide how certified pre-owned programs fit. Certified Lincolns usually land outside the new-vehicle remedy, and the question stays unsettled. A claim against the selling dealer may survive.
Can Ford's Lincoln Recall Summaries Prove the Safety Risk a Lemon Law Attorney Needs?
Not alone. NHTSA's October 2, 2026 pull lists 28 recall campaigns on 2021 to 2026 Navigators and 44 on Aviators. A recall visit still sits on your repair history. Ford's summaries can help show a nonconformity likely to cause death or serious bodily injury if the vehicle is driven.
| Model | NHTSA complaints, 2021 to 2026 models, pulled October 2, 2026 | Selected components named | Recall campaigns, same years |
|---|---|---|---|
| Navigator | 89 | Electrical 22, engine 12, power train 11, service brakes 10, forward collision avoidance 9 | 28 |
| Aviator | 159 | Electrical 42, engine 26, back-over prevention 19, forward collision avoidance 15 | 44 |
Each complaint is counted once across its model names, and complaints are owner reports. A recall repair aimed at your defect that fails to cure the symptom can count as one more attempt. Say your 2025 Navigator's brake pedal feel changes twice in the same week on State Route 56. Campaign 25V488000 covers 2025 Navigators with a brake booster that may lose power assist, and Ford's filing says that can extend stopping distance. Two repair orders inside the window may fit the two-repair route, with any required direct notice, if the failure is likely to cause death or serious bodily injury.
Brake, Stall, and Park Pawl Campaigns Ford Filed on Lincoln SUVs
Campaign 25V314000 covers 2022 to 2024 Navigators whose front brake lines may touch the air cleaner outlet pipe and leak. Under 25V455000, a low-pressure fuel pump may fail and stall 2021 to 2023 Aviators and 2021 and 2022 Navigators. That campaign also covers Fords, which the firm handles as Ford lemon law claims. Campaign 26V402000 covers a park pawl that may engage while moving, on 2018 to 2021 Navigators and 2020 and 2021 Aviators. Ford's filing says park system damage may affect Park's hold on the SUV if the parking brake is not applied.
Waiting on a Lincoln Remedy That Has Not Shipped Yet
Ford mailed interim letters on 26V402000 on July 10, 2026, and its filing anticipates the remedy in April 2027. Campaign 26V451000 covers Aviator second-row seats that may unlatch, tip or slide, with the remedy anticipated in January 2027. An interim letter by itself is not a repair attempt, because no dealer has worked on the SUV. If the defect appears while you wait, get a repair order that records it.
What Clock Does a Lincoln Lemon Law Attorney Watch Once the Demand Letter Reaches Ford?
For Lincolns sold in 2025 or earlier that Ford's election covers, the section 871.24 demand is required only before a suit that seeks civil penalties. Ford must get it 30 days or more before filing. Its offer is due by day 30 and completion by day 60, counted from receipt.
Meeting both dates keeps civil penalties out, and missing either leaves them available. An offer must add reasonable attorney fees and costs if a lawyer represents you. The letter gives your name, the Lincoln's accurate VIN and a brief repair history, and demands repurchase or replacement. Send it by email to the address Ford displays for these demands. Mail also works if it goes certified or registered with a return receipt, to the address in Lincoln's owner's manual or warranty booklet. You must have the Lincoln when the letter goes out. Keep it at least 30 days after Ford gets the letter, and 60 if Ford makes an offer.
Silence From Ford Past Day 30
Subdivision (g)(1) of section 871.24 covers a notice that draws no offer within 30 days of Ford's receipt. You may then sell the Lincoln and still seek remedies, civil penalties included. Say a Poway contractor needs a working SUV and cannot wait out a lawsuit. Selling opens up on day 31. Subdivision (i) bars penalties after that sale unless you first gave the buyer written notice. The notice must state the basis for your repurchase request and any pending action.
Willfulness, Not the Second Penalty, in Most Lincoln Cases
Under Civil Code section 1794, subdivision (c), a willful failure to comply can add a civil penalty of up to twice actual damages. Subdivision (e) holds a second penalty, which (e)(2) removes when the manufacturer keeps a qualified dispute program that substantially complies with section 1793.22. BBB Auto Line is the program DCA certifies and lists for Ford, Lincoln included, and Ford sponsors it. A Lincoln lemon law lawyer therefore generally centers the penalty debate on willfulness. With timely written notice of BBB Auto Line, you try it before relying on the presumption, per section 1793.22, subdivision (c). Subdivision (d) of section 1794 awards costs and reasonable attorney fees to a buyer who prevails.
Which Rules Cover a Lincoln Bought New in 2026?
The DCA roster lists Ford Motor Company with no separate Lincoln entry, and Lincoln's own California notice calls Lincoln a division of Ford Motor Company. So the firm reads Ford's election, tied to 2025 and earlier sales by section 871.30, as reaching those Lincolns. If your Lincoln was sold new in 2026 or later, section 871.29, subdivision (d), requires Ford to name the governing procedure at the sale. If that notice picks the older Civil Code procedures, the Commercial Code's four-year limit in section 2725 generally starts at tender of delivery. The start can move when the warranty explicitly extends to future performance and discovery of the breach must await that performance. The period then begins when the breach is or should have been discovered.
