Under California lemon law, a new or leased Ford that the dealers cannot fix can qualify for a buyback or a replacement, meaning a substantially identical new Ford. The test is a reasonable number of repair attempts, the fair number of chances Ford gets.

Ford Motor Company appears on the Department of Consumer Affairs (DCA) list of manufacturers that elected the newer procedures. That election, called the elected track, puts many Ford claims on fixed dates, but the vehicle still has to qualify. Civil Code section 1793.22, subdivision (e)(2), covers a Ford bought mainly for personal, family or household use. Demonstrators sold with Ford's new car warranty count too. So does a business truck under 10,000 pounds gross vehicle weight when the business registers no more than five vehicles in California. The chassis, chassis cab and propulsion portion of a motor home qualify as well.

For used Fords, Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make the car new. The exception is a car whose new car warranty was issued with that sale. The court did not rule on certified pre-owned programs, so a certified Ford usually falls outside the new-vehicle remedy, though the point is unsettled. A lessee, the person who leases, has a buyer's rights against Ford under Civil Code section 1795.4.

Cline APC handles only lemon law and consumer warranty claims, from offices in La Jolla and Poway. If your F-150, Explorer, Mach-E or Bronco keeps going back for one failure, call (888) 982-6915.

Which Ford Recalls Can Support a Claim With a Ford Lemon Law Lawyer?

Ford has filed safety recalls for F-150 transmissions that can drop into neutral and for Explorer park-system damage. Mach-E battery contactors and Bronco fuel pumps drew campaigns too. A recall alone does not make a Ford a lemon, but each recall visit adds a dated repair to your history.

ModelModel yearsWhat the Ford campaign describesClaims
F-1502021Transmission could shift into neutral after a false low fluid pressure code (22V188000), then trucks repaired incorrectly under it (25V169000)Ford F-150 lemon law claims
Explorer2020 to 2022, then 2024, with the 2.3-liter engine and 10R60 transmissionA control module reset while moving could damage the park system (23V069000 and 26V371000)Ford Explorer lemon law claims
Mustang Mach-E2021 and 2022High-voltage battery contactors could overheat (22V412000), then vehicles repaired incorrectly under it (25V130000)Mustang Mach-E lemon law claims
Bronco2021 to 2023The low-pressure fuel pump could lose pressure and stall the engine (25V455000)Ford Bronco lemon law claims

Say your 2023 Explorer's rear camera goes black four times in its first year, and one visit was recall work. A Ford lemon law lawyer can count all four against one nonconformity. Section 1793.22, subdivision (e)(1), defines that word as a defect that substantially impairs use, value or safety.

Other campaigns include 24V635000, for Nano EcoBoost intake valves that may break in some 2021 and 2022 F-150, Bronco, Edge and Explorer models. Campaign 25V025000 covers rear shocks on some 2021 through 2024 Broncos that could corrode and lose the external reservoir.

Reopened Recalls That Strengthen a Ford Lemon Law Claim

A reopened recall means Ford filed a new campaign for vehicles repaired incorrectly under an earlier one. Campaign 25V169000 followed 22V188000 on the F-150. On the Mach-E, 25V130000 followed 22V412000. On the Explorer, 25V166000 reached vehicles repaired incorrectly under two axle bolt campaigns. When one vehicle lands in both campaigns, the second visit is another dated attempt at the same defect.

What Should a Lawyer Check in Ford's Day-30 Buyback Offer?

Restitution, the legal word for a buyback, is a statutory duty. On Ford's elected track, Ford has 30 days after receiving your pre-suit notice, the written demand sent before suing for civil penalties, to offer restitution or a replacement. It must cover the amounts in Civil Code sections 1793.2 and 871.27, plus fees and costs if a lawyer represents you.

Say you paid $58,000 for an F-150 and first brought it in for the shifting problem at 7,200 miles. The mileage offset, Ford's deduction for miles driven before that first visit, works out to $3,480. Run figures in the lemon law buyback calculator, and send the firm Ford's offer before you sign it.

Deductions and Add-Ons to Check Before Signing Ford's Offer

Section 871.27 applies only to vehicles Ford's 2025 election covers. A $6,000 balance from an old truck rolled into the new contract comes back out as negative equity, and a rebate cannot shrink that offset. A civil penalty is extra money a court can add for certain violations. Lease buyout payments still count as damages, but they count toward a penalty only if paid within 30 days after the notice or the suit, whichever comes first.

Is a Different Mach-E Trim a Substantially Identical Replacement?

A replacement has to be substantially identical to the Ford you return, with a full set of new-vehicle warranties. Ford also pays the tax, government fees and incidental costs that come with it. You can never be required to take a replacement instead of your money back. A Mach-E demand answered with another trim may not satisfy day 30, especially if you asked for restitution.

How Long Is Ford's Warranty, and When Does the 18-Month Rule Help My Lawyer?

Ford's express warranty, the written coverage in its booklet, splits into parts, and booklets differ by model and model year. For 2026 cars and light trucks other than electric vehicles, Ford's 2026 Model Year Ford Warranty Guide lists Bumper to Bumper coverage for 3 years or 36,000 miles, whichever comes first. Early repair trouble can shift the burden onto Ford.

Powertrain coverage in that guide runs 5 years or 60,000 miles, whichever comes first. The 2024 Mach-E guide lists those two terms and 8 years or 100,000 for electric vehicle parts.

Say your Explorer sat at the dealer for 19 days in March and 14 more in June. More than 30 cumulative days out of service for repair inside 18 months can shift the burden onto Ford by itself. A Ford lemon law lawyer proves the total from repair orders.

The Burden Shifts to Ford Inside the First 18 Months

Civil Code section 1793.22, subdivision (b), creates a presumption. That legal shortcut treats Ford as having had a reasonable number of repair attempts once its conditions are met inside 18 months or 18,000 miles, whichever comes first. Ford can try to rebut it, and a Ford can still qualify on its full repair history after that window. Two attempts on a defect likely to cause death or serious bodily injury qualify, such as a truck dropping into neutral. Four attempts on one nonconformity qualify too, and both routes need direct notice, a written notice to Ford itself, if the booklet disclosed that duty. Ford's 2026 warranty guides, which cover 2026 models, say Ford requires written notice of defects first, to the extent state law allows. Whether that wording meets the statute's disclosure test is a separate question.

More than 30 cumulative days out of service qualifies with no notice at all. Only visits to an authorized Ford dealer count.

Timely Notice of BBB Auto Line Changes a Ford Owner's First Step

The Department of Consumer Affairs lists BBB Auto Line as Ford's state-certified arbitration program. Under section 1793.22, subdivision (c), an owner with timely written notice of the program uses it before relying on the presumption. DCA describes the program as free, with decisions typically within roughly 40 days. The decision binds Ford only if you accept it, and Ford then performs within a reasonable time, at most 30 days. Subdivision (d)(5) requires any buyback or replacement the program orders to follow section 1793.2. Subdivision (d)(7) does not require the program to award the section 1794(c) civil penalty or attorney fees. Reject the decision, and the lawsuit and the presumption both stay open. Subdivision (c) also extends your filing deadline by the days the program takes.

Does Every Ford Recall Visit Count When a Lawyer Tallies Repair Attempts?

Every Ford recall visit lands on your repair record with a date and a mileage. A recall is not a lemon claim by itself, because it covers a group of vehicles rather than proving your defect. If the recall fails to cure the problem you reported, your claim stands and that visit counts toward it.

NHTSA's public data, pulled October 2, 2026, gives the count for Ford-brand vehicles. Complaints are owner reports, not findings, and a campaign spanning model years counts once in the recall total.

Model yearOwner complaints to NHTSARecall campaigns
20241,18099
202555599
202613754
2024 to 20261,872176

Say your 2021 F-150 received the 22V188000 software update and then dropped into neutral again on State Route 52. The recall visit and the new failure both belong in the file, and NHTSA's recall lookup lists every campaign on a VIN. Ford's technical service bulletins (TSBs) matter the same way. TSB 22-2428 covers harsh or delayed shifts on some 2017 through 2023 F-150 trucks built on or before August 15, 2022.

Ford Turns Over Its Warranty History Once a Lemon Law Suit Is Answered

In an elected-track case filed on or after January 1, 2025, section 871.26, subdivision (h), gives Ford 60 days after its answer to produce 17 categories of records. They include your vehicle's entire warranty transaction history and a list of required field actions. Ford must also produce published service bulletins tied to your defect. Repeat campaigns then show, in Ford's own records, several chances at one defect.

What Happens on Day Zero, Day 30 and Day 60 After a Lawyer Writes to Ford?

Ford Motor Company elected the AB 1755 procedures on April 25, 2025. For a Ford that election covers, the day Ford receives your pre-suit notice is day zero. Ford then has 30 days to offer a remedy and 60 days to complete it, and meeting both dates keeps civil penalties out of the case.

The suit itself must follow within one year after the applicable warranty ends. Say the coverage for your Bronco's defect ran out on May 10, 2026. That window would close on May 10, 2027, before any tolling, meaning paused time, is added. A Ford lemon law lawyer confirms both dates.

Ford's Filing Deadline Counts From the End of the Applicable Warranty

Code of Civil Procedure section 871.21 adds an outer limit of six years after first delivery. Subdivision (c) pauses both limits for days the Ford sits out of service for repair. It also pauses them for up to 60 days after a pre-suit notice and adds tolling under section 1793.22. Ford's date falls in the section 871.30 window for vehicles sold in 2025 and earlier. For a Ford sold new in 2026 or later, section 871.29, subdivision (d), requires Ford to name the governing procedure at the sale. Under the older rules, Commercial Code section 2725 allows four years, generally from tender of delivery, or later for a warranty that covers future performance.

The 150-Day Schedule After Ford Files Its Answer

Section 871.26 covers actions filed on or after January 1, 2025, though not owners without a lawyer. Both sides exchange documents within 60 days of Ford's answer, and you disclose modifications such as a Bronco lift kit. Each side takes one two-hour deposition within 120 days. Mediation is scheduled by day 90 and held by day 150. San Diego Superior Court's Local Rule 1.2.2(E) sends East County and South County civil cases downtown, while North County cases file in Vista.

Inside the 60 Days After Ford Receives a Lemon Law Demand

The notice in section 871.24 is required only before a suit that seeks civil penalties, and it must reach Ford at least 30 days before filing. It gives your name, the full VIN, a short account of each repair visit and a demand to repurchase or replace. It goes by email or by return-receipt certified or registered mail, and Ford's DCA listing and 2026 guides print both addresses. You keep the Ford for 30 days after receipt, or 60 if Ford makes an offer. After a buyback is agreed, the Standardized SBA Release in section 871.25 is the only release Ford may require. Section 871.27, subdivision (g)(2), gives Ford 30 days from receipt of the release signed through your counsel to complete the buyback. After that, a $50 daily penalty applies unless the parties agree otherwise or your own delay caused the miss.

A willful violation can add a penalty of up to twice actual damages under Civil Code section 1794, subdivision (c). At $40,000 in damages, that cap is $80,000. Subdivision (d) awards costs and attorney fees to a buyer who prevails, and only then. Cline APC explains its own attorney fee arrangement at the first meeting. Lincoln's own California notice calls Lincoln a division of Ford Motor Company. So the firm reads Ford's election, tied to 2025 and earlier sales, as reaching Lincoln claims.

Should I Call a Ford Lemon Law Lawyer Before Ford's 30 Days Start?
