A new Maserati can qualify for a buyback, the refund Maserati owes when it takes the car back. That takes a nonconformity that survives a reasonable number of repair attempts. A demonstrator sold with Maserati's new car warranty can qualify too.
In the statute's words, a nonconformity substantially impairs a car's use, value or safety. A reasonable number of repair attempts means enough fair chances to fix it. Civil Code section 1793.2, subdivision (b), gives each warranty repair 30 days, counted from the day you deliver the car. Only your written agreement, or a delay beyond the control of Maserati and its dealers, stretches that limit.
Cline APC handles only lemon law and consumer warranty claims, with offices in La Jolla and Poway. If a part has held your Maserati for weeks, call (888) 982-6915.
Why Does a Maserati Lemon Law Lawyer Rely on Your Grecale or Levante Repair Orders?
Because the public record is thin. NHTSA data pulled October 2, 2026, shows four owner complaints on the Grecale and two on 2021 and newer Levantes. So a Maserati claim rests on its own repair orders and parts notes. Campaign 25V098000 covers radio software that may keep the rearview camera image from displaying on certain models of both SUVs.
| Model | Model years | NHTSA campaigns and complaints | Claims |
|---|---|---|---|
| Grecale | 2023 and newer | 24V892000 park assist software and 25V098000 radio software (certain 2023 and 2024), 25V722000 headlight caps (certain 2023 to 2025), 4 complaints | Maserati Grecale claims |
| Levante | 2021 to 2024 | 21V703000 seat belt retractors (certain 2021), 21V872000 fuel line sensor housing (certain 2021 and 2022), 25V098000 radio software (certain 2021 to 2024), 2 complaints | Maserati Levante claims |
Picture a 2023 Levante owned by a family off Poway Road. The dealer orders a part at diagnosis and learns it is backordered with no date. Six weeks later, the Levante goes home. A lawyer checks the drop-off and ready dates on that order against the 30-day limit.
Four Complaints on a Grecale Say Little About Yours
All four Grecale complaints concern the 2023 model year, counted once per complaint number. Their components include the power train, service brakes, speed control, latches and locks, and engine cooling. Still, those are owner reports to a federal agency, not findings that any Grecale is defective. A Maserati file leans on dated repair orders, parts notes and dealer letters instead.
A Levante No Longer Built New and the Replacement Question
After a reasonable number of failed repair attempts, Maserati must promptly replace the car or promptly make restitution, the statute's word for a buyback. You may elect restitution, and nobody can force a replacement on you. A replacement is a substantially identical new vehicle with full new-car warranties. Maserati's owner documentation portal lists no Levante after 2024 as of October 2, 2026. Its report on campaign 25V098000 says Levante production stopped March 18, 2024. So an identical new Levante may be hard to supply.
Which Lines Does a Maserati Lemon Law Attorney Add to a Buyback Besides the Price?
Restitution starts with the price paid or payable, destination and factory options included. Civil Code section 1793.2(d)(2)(B) then adds tax, government fees and incidental damages, the costs the defect caused. For a Maserati sold in 2025 or earlier, Code of Civil Procedure section 871.27 adjusts add-ons, rebates and negative equity under the newer procedures Maserati chose.
| Line item | Treatment | Source |
|---|---|---|
| Price paid or payable, with destination and factory options | Refunded | Civil Code 1793.2(d)(2)(B) |
| Tax, license, registration and other official fees | Refunded | Civil Code 1793.2(d)(2)(B) |
| Reasonable towing, rental and repair costs actually paid | Refunded | Civil Code 1793.2(d)(2)(B) |
| Service contracts, GAP and add-ons from an outside company | Left out | CCP 871.27(b)(1) |
| The same products from the selling dealer | Recoverable | CCP 871.27(b)(2) |
| Negative equity from a prior car | Offset | CCP 871.27(c) |
| Manufacturer rebate | Kept out of the price | CCP 871.27(d) |
| Miles before the first repair visit for the defect | Mileage offset | Civil Code 1793.2(d)(2)(C) |
Say a $98,000 Maserati first went in for the defect at 4,800 miles. The mileage offset deducts for miles driven before the first repair visit for the defect. Here it is $98,000 times 4,800 over 120,000, or $3,920. Test your figures in the buyback calculator, and call (888) 982-6915 before answering any Maserati offer.
Where the Tow Truck Bill Fits in a Maserati Lemon Law Refund
Say your Grecale will not start in a Poway garage. Civil Code section 1793.2(c) applies when the nature of the defect keeps you from reasonably delivering the car. Written notice to Maserati or its nearest repair facility then counts as returning it. Maserati bears reasonable transport costs. The booklet excludes loss of use, but restitution still returns reasonable towing, rental and repair costs you paid.
The $50-a-Day Rule After Maserati Receives Your Counsel's Signed Release
For a Maserati sold in 2025 or earlier, section 871.27(g)(2) gives Maserati 30 days from receipt of the release signed through your counsel to complete the agreed buyback or replacement. After that, $50 a day accrues unless the parties stipulate otherwise or the buyer's failure to cooperate in good faith caused the delay. A buyer who prevails recovers costs and reasonable attorney fees under Civil Code section 1794(d).
What Fine Print in Maserati's 48-Month Warranty Does a San Diego Lemon Lawyer Flag?
Maserati's booklets cover parts and labor for defects in materials or workmanship for 48 months or 50,000 miles, whichever comes first. Narrower terms sit inside that coverage, and repair or replacement is Maserati's choice at the dealer's location. A denial under those terms raises a coverage question, and it does not end a lemon claim by itself.
A booklet is Maserati's express warranty, its written promise, and terms vary by model and year. The 2025 Grecale booklet adds a lithium-ion battery term for electric models, printed as 8 year / 100,000 miles. Picture a Rancho Santa Fe weekend driver told that a mileage condition ends coverage for a dead 12-volt battery. A Maserati lemon law lawyer would want that denial in writing.
The 6,000-Mile Battery Condition for Weekend Drivers
The 2022 to 2025 Levante and Grecale booklets cover the 12-volt battery for 4 years or 25,000 miles, whichever occurs first. That coverage holds only if the car is driven at least 6,000 miles per calendar year. So a weekend Maserati can fall short. Wheel alignment, balancing and adjustments are covered only for the first 3 months. A later pull may be logged as an adjustment.
Warranty Service at Any Authorized Maserati Dealer
Under General Warranty Information, Maserati's booklets say any authorized Maserati dealer in the U.S.A. or Canada performs warranty service, not only the selling dealer. Visits at a second store count on your repair history, and their shop days add up too. Civil Code section 1793.2(a)(1)(A) requires enough California repair facilities reasonably close to where a manufacturer sells, or authorized independent shops.
How Does a Lawyer Read Recall Work, Backorders and Adjustment Programs on a Maserati?
Recall campaigns draw on the same parts counters as warranty repairs. A recall visit is also a dated visit on your record, and it may count as a repair attempt. California's adjustment-program law, Civil Code sections 1795.90 and following, treats the importer as a manufacturer for cars built abroad.
Section 1795.92 requires mailed notice to eligible owners within 90 days of adopting a program. Maserati's booklets say Maserati North America sometimes offers special adjustment programs. An owner who paid before learning of one can claim reimbursement in writing within two years of paying. Maserati must answer within 21 business days of the claim. Yet a recall alone does not prove a nonconformity, nor does a finished recall close the file when the symptom returns. NHTSA's recall lookup shows the campaigns on your VIN.
Say a new Grecale Modena in Carmel Valley shows a drivetrain warning at eight months. On day 12 after drop-off, the advisor says a control module is on order from the factory. Day 30 passes with the Grecale still on the lift and no signed extension. That visit alone may have broken the 30-day rule in section 1793.2(b). What it is worth depends on the repair history.
| Maserati by the numbers, pulled October 2, 2026 | Figure |
|---|---|
| NHTSA owner complaints | Grecale 4, 2021 and newer Levante 2 |
| NHTSA recall campaigns | Grecale 3, 2021 and newer Levante 3 |
| Maserati entities NHTSA lists | Maserati S.p.A., Modena, Italy, and importer Maserati North America, Inc., Auburn Hills, Michigan |
Does a Part Shipped From Italy Excuse the Wait?
Section 1793.2(b) grants extra time for conditions beyond the control of Maserati and its representatives. Section 1793.2(a)(3) also makes Maserati supply its shops with enough parts and service literature during the warranty. So a backorder inside Maserati's own import chain fits the exception poorly, though each wait is a factual question.
A Maserati lemon law lawyer also tracks the presumption in Civil Code section 1793.22(b). Within 18 months from delivery or 18,000 miles, whichever comes first, it treats Maserati as having had a reasonable number of repair attempts in three cases. One is two or more repairs of a nonconformity likely to cause death or serious bodily injury. Another is four or more repairs of the same nonconformity. Both need direct notice, a written complaint to Maserati itself, at least once if the booklet clearly disclosed that duty. The third is more than 30 cumulative days out of service for repair of nonconformities, a separate count from the per-repair limit. Only conditions beyond Maserati's control extend that count. A signed extension does not. However, Maserati can rebut the presumption, and a claim can still succeed on the full history after the window.
The Parts Timeline a Maserati Repair Order Needs
Civil Code section 1795.6(d) requires a work order showing the date you delivered the car for repair and the date you were told it was ready. A line reading waiting on parts proves little a year later. Ask for the part number, the order date and any arrival estimate Maserati gave the dealer, then the arrival, installation and ready dates.
What Did April 30, 2025, Change for Owners Who Call a Maserati Lemon Law Lawyer?
Maserati North America Inc. opted in to newer lawsuit procedures on April 30, 2025. For a Maserati sold new in 2025 or earlier, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. Repair days pause both limits. So do up to 60 days after a demand letter.
The date appears on the Department of Consumer Affairs (DCA) list of manufacturers that opted in, which makes Maserati an electing manufacturer. Section 871.30 carried that choice to Maseratis sold new in 2025 and every earlier year. The applicable express warranty is the written coverage for the defect. Maserati must name the governing procedure at the sale of a car sold new in 2026 or later, under section 871.29(d). If Maserati names the older Civil Code procedures, Commercial Code section 2725 allows four years, generally from tender of delivery. The four years instead run from when the breach is or should have been discovered, when a warranty explicitly extends to future performance and discovery must await that performance.
Take a Grecale delivered new on June 3, 2024. With no mileage cutoff or shop days, its 48-month warranty would end June 3, 2028. Section 871.21 would then set a default deadline one year later. Each warranty repair pauses the warranty under Civil Code section 1795.6, which pushes both of those dates out.
The Maserati Lemon Law Demand Sent to the General Counsel
For a Maserati sold in 2025 or earlier, a pre-suit notice is the written demand section 871.24 requires only before a suit seeking civil penalties. A civil penalty is an added amount, up to twice actual damages, that section 1794(c) allows for a willful violation. The notice gives your name, the accurate VIN and a brief repair history, then demands repurchase or replacement. It must reach Maserati at least 30 days before filing. Send it by email to the address Maserati posts, or by certified or registered mail, return receipt requested. Paper goes to the Office of the General Counsel at Maserati North America, 800 Chrysler Drive, Auburn Hills, MI 48326.
Keep the car when the notice goes out. Keep it at least 30 days after Maserati receives the notice, or 60 days if Maserati makes an offer. A compliant offer within 30 days of receipt, completed within 60 days of receipt, keeps civil penalties out. Missing either date leaves them available under section 871.24(e)(1).
BBB AUTO LINE Within Six Months of the Warranty's End
DCA lists BBB Auto Line as Maserati's certified program, which Maserati sponsors. After timely written notice of the program, section 1793.22(c) requires you to try it before relying on the presumption. The booklet allows six months after the warranty ends to file, so coverage ending in March 2027 leaves until September 2027. DCA says arbitration decisions usually arrive within 40 days after the program gets an application. Program days extend the filing deadline under section 1793.22(c). Under section 1793.22(d)(3), a qualified program sets a reasonable time for Maserati to perform an accepted decision, not over 30 days after you accept.
Which Auburn Hills Address Your Maserati Booklet Prints
The two repair routes need direct notice only if the booklet or owner's manual disclosed that duty clearly and conspicuously. The notice then goes to the address printed there. Maserati's 2025 Grecale booklet names the Customer Care Department at 800 Chrysler Drive, Auburn Hills, MI 48326. The 2024 Grecale and the 2023 and 2024 Levante booklets print 1 Chrysler Drive, so your own booklet controls. The booklets' own lemon law notice describes the earlier of 12 months or 12,000 miles and says it varies by state. California's window is longer.
Waiting on a Part? Why Does Every Shop Day Matter to a Maserati Lemon Law Lawyer?
Every day of waiting adds to the record. A Maserati lemon law lawyer counts the shop days, checks the 30-day limit on each visit and confirms whether Maserati's election covers your car. Cline APC offers a free consultation by phone or at its La Jolla and Poway offices at (888) 982-6915.
Picture an owner laying out the booklet, repair orders and parts notes before the call. No lawyer can promise a result, but the review shows whether BBB AUTO LINE, a pre-suit notice or another step fits first.
When the stack is ready, describe the delay in a message to the firm and say which Maserati is waiting.
