Maserati Grecale Lemon Law Lawyer in San Diego

The Grecale showed 3,600 miles when you signed, and the salesperson called it a demonstrator. The paperwork said new. Soon after, the first warning light came on. A Maserati Grecale lemon law lawyer starts a demo case with one question.

Did the sale come with Maserati's new car warranty?

A demonstrator, dealer loaner or Maserati company car can be a new motor vehicle under Civil Code section 1793.22(e)(2) when sold with Maserati's new car warranty. A fault that keeps returning can then support a buyback, the refund Maserati owes when it takes the SUV back.

Cline APC handles only lemon law and consumer warranty claims, from an office on Ivanhoe Avenue in La Jolla and another in Poway.

If your demo Grecale keeps returning for one stubborn fault, call (888) 982-6915.

Which Grecale Warning Signs Should a Maserati Grecale Lemon Law Lawyer See First?

NHTSA holds only four owner complaints on the Grecale, all for the 2023 model year, as pulled October 2, 2026. The categories include power train, service brakes, speed control, latches and locks, and engine cooling. With so few public reports, your own dated notes and repair orders carry most of the weight.

Maserati's filings give one of these signs as the warning a driver will notice, a rearview image that does not display in reverse.

  • No rearview image when you shift into reverse
  • Oncoming drivers flash their lights at you after dark
  • A warning light the dealer cleared shortly before the sale comes back
  • A Folgore charging fault that keeps returning
  • A battery health reading falling toward 70 percent

Say oncoming drivers flash you on State Route 163 after dark. Write down the date, the road and the odometer reading.

Would a Grecale Lemon Lawyer Treat 2023, 2024 and 2025 Campaigns Alike?

No. As of October 2, 2026, NHTSA lists three campaigns on 2023 and newer Grecales. Campaigns 24V892000 and 25V098000 cover the rearview image and name certain 2023 and 2024 models. Campaign 25V722000 covers headlight caps on certain 2023 through 2025 models. The Folgore also carries its own battery term in the 2025 booklet.

Model yearNHTSA campaignsCondition in Maserati's filingsBooklet term

202424V892000, 25V098000, 25V722000The same two conditions on certain vehicles48 months or 50,000 miles, whichever occurs first
202525V722000Headlights may lack aim adjustment capsThe same basic term, plus the Folgore battery term

Say a Del Mar family bought a Grecale Modena from a demo fleet with 4,200 miles. Its model year decides which rows apply, and its VIN decides whether Maserati's filing names it. Maserati's report text on 25V098000 also describes some 2023 to 2025 Grecales, so check a 2025 VIN too. NHTSA's recall lookup shows the campaigns on any VIN.

Does a Camera Update Done Before Delivery Matter to a Grecale Lemon Law Attorney?

A camera update done in the demo fleet happened before your delivery. That puts it outside the 18-month window of the repair presumption, a rule treating Maserati as having had a reasonable number of repair attempts. It can still show the fault existed early. Ask for the demo-period repair orders, including any work under 24V892000 or 25V098000.

Say the demo-fleet update is done on the dealer's lot, and the blank rearview image returns after delivery. That update visit is not one of your attempts inside the window, and the next visit starts your own count.

Oncoming Drivers Flashing Their Lights After Dark

Campaign 25V722000 covers certain 2023 through 2025 Grecales and some GranTurismo and GranCabrio models. NHTSA's summary of Maserati's report, dated October 23, 2025, says the headlights may be missing adjustment prevention caps, which can allow improper aim. Maserati's report says improper aim may reduce forward visibility and create glare for oncoming drivers. It lists no warning an owner would notice, so a dated note each time oncoming drivers flash you matters. The remedy is an inspection and, if necessary, one or two caps.

Folgore Battery Health Under 70 Percent

Maserati's 2025 booklet prints the battery term for electric models such as the Folgore as 8 year / 100,000 miles, so read your own copy for which limit ends it. It says Maserati is committed to keeping the battery's state of health, which it ties to age and usage, between 100 and 70 percent during that term. It also says a battery under 70 percent within the term will be replaced, by a battery with at least the original's measured capacity just before the failure. If health cannot be measured, Maserati weighs factors such as age and mileage to choose the replacement. A charging fault that keeps returning is separate from battery wear, so keep every health report.

What Should a Grecale Lawyer Ask the Sales Desk Before You Sign for a Demo?

Ask whether the Grecale was ever titled or registered to anyone other than the dealer. Ask what warranty start date the card will show and whether you are the first retail owner. Request copies of any repair orders from its demo service, and write down each answer with the salesperson's name and the date.

Picture a buyer at the desk with a demo Grecale GT. Before agreeing to a price, the buyer asks to see the card, the service history and the start date.

Maserati's warranty card has a line where you and the dealer agree the delivery date and warranty start date are correct. On a demo those dates may differ, so read them before you sign. Photograph the card the day you get it, and set the contract's odometer reading beside the earliest repair order for the defect.

Do Demo Miles Shrink the Window a Maserati Grecale Lemon Law Lawyer Counts?

Partly. Inside 18 months or 18,000 miles, whichever comes first, a presumption in Civil Code section 1793.22(b) treats Maserati as having had a reasonable number of repair attempts once its conditions are met. The months start at your delivery. The miles come from the odometer, which already includes demo miles.

A reasonable number of repair attempts means enough fair chances to fix the defect. A nonconformity is a defect that substantially impairs the SUV's use, value or safety. Three routes trigger the presumption. The first is two or more repairs of a nonconformity likely to cause death or serious bodily injury. A second route is four or more repairs of the same nonconformity. Each of those routes needs direct notice, a written complaint sent to Maserati rather than only the dealer, at least once if the booklet clearly disclosed that duty. The third route is more than 30 cumulative days out of service for repair of nonconformities, and no notice applies to it. Maserati can rebut the presumption, yet a claim can still succeed on the full repair history after the window.

Say a Grecale had 5,200 demo miles and an owner who commutes on Interstate 5 from Oceanside to downtown. Only 12,800 miles remain before the mileage side closes. Cline APC's Maserati lemon law lawyers count both sides from your delivery papers.

Showroom Demo Versus Trade-In, Where the Supreme Court Drew the Line

A demonstrator is a vehicle a dealer assigns to show the qualities and characteristics common to its model and type. Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 was decided October 31, 2024. It held that leftover factory coverage on a used car does not make it a new motor vehicle. The exception is a car sold with the manufacturer's new car warranty issued at that sale. A Grecale that a consumer bought or leased and then traded in usually falls outside the new-vehicle remedy, and so does a used Maserati Levante. Under Civil Code section 1795.4, a lessee, the person who leases, has a buyer's rights.

Earlier Warranty Start, Earlier Maserati Grecale Lemon Law Deadline

The 2023 to 2025 booklets start the 48 months or 50,000 miles, whichever occurs first, on the earlier of retail delivery or the date the car was first placed into service. Say a demo entered service March 1, 2024, and you bought it September 1, 2024. The 48 months end around March 1, 2028, before repair days extend the warranty under section 1795.6.

Maserati North America Inc. opted into the newer lawsuit procedures on April 30, 2025. Code of Civil Procedure section 871.30 reaches Grecales sold in 2025 or earlier. For those, section 871.21 requires suit within one year after the applicable express warranty, the written coverage for the defect, ends, and never more than six years after original delivery. Shop days pause both clocks. So do up to 60 days after a pre-suit notice, a written demand to Maserati. Where original delivery on a demo is unclear, a lawyer plans around the earlier date. If you bought the Grecale new in 2026 or later, section 871.29(d) requires Maserati to name the governing procedure at the sale.

Maserati's booklets name BBB AUTO LINE, a program the Department of Consumer Affairs (DCA) certifies. They allow filing until six months after the warranty ends. Where Maserati gave timely written notice of the program, section 1793.22(c) makes you use it before you rely on the presumption. For a Grecale sold in 2025 or earlier, section 871.24 requires a pre-suit notice only before a suit seeking civil penalties. Civil penalties are the extra money section 1794(c) allows for a willful violation. Maserati needs the notice in hand at least 30 days before filing. A compliant offer within 30 days after Maserati receives it, completed within 60 days of that receipt, keeps civil penalties out. Missing either date leaves them available.

The Demo-Mile Fight Inside a Maserati Grecale Lemon Law Refund

A mileage offset is the deduction Maserati may take for miles driven before the first repair visit for the defect. Section 1793.2(d)(2)(C) multiplies the price paid or payable by those miles over 120,000. The statute calls the offset use by the buyer, yet its numerator counts miles traveled by the vehicle. On a demo those differ. Take an $84,000 demo with 3,600 miles at purchase, first returned for the defect at 9,600. Counting the 6,000 miles you drove gives $4,200, and counting all 9,600 gives $6,720, a $2,520 gap. A lawyer argues for the lower figure, and Maserati may argue for the higher. A replacement, a substantially identical new Grecale, carries the same use charge. Test the same math on your numbers in the buyback calculator.

For a Grecale sold in 2025 or earlier, section 871.27 keeps rebates out of the price paid and drops add-ons from outside companies. It also offsets negative equity, the unpaid balance carried over from an earlier car. If Maserati does not complete an agreed buyback within 30 days of receiving the release signed through your counsel, it owes $50 a day. The parties can stipulate otherwise, and the penalty does not apply when the buyer fails to cooperate in good faith. Separately, the civil penalty section 1794(c) allows cannot exceed twice actual damages. Costs and reasonable attorney fees go to a buyer who prevails, under section 1794(d).

Can a Maserati Grecale Lemon Law Lawyer Check Your Demo Paperwork?

A free consultation at Cline APC reads the sales contract, the warranty card and the first repair order together. It confirms whether the sale carried Maserati's new car warranty, counts the demo miles and dates every deadline that applies to your Grecale.

Say a Folgore owner arrives with a demo disclosure, the repair orders and a battery health report. The lawyer lines them up by date and shows which deadline comes first.

Cline APC offers the consultation by phone or at its Ivanhoe Avenue office. No lawyer can promise a result.

Call (888) 982-6915 or send the odometer reading from your purchase day, so a Maserati Grecale lemon law lawyer can start from that number.
