A Maserati Levante lemon law lawyer sorts that paperwork before counting a single repair.
A buyback is the refund Maserati owes when it takes the Levante back. California buyback rights rest on the warranty a manufacturer issues with a new car, so the factory booklet comes first.
Cline APC handles only lemon law and consumer warranty claims. Its La Jolla office meets Levante owners from across San Diego County.

Does a Maserati Levante Lemon Law Lawyer Want a Fuel Smell Reported Right Away?
Yes. Campaign 21V872000 on certain 2021 and 2022 Levantes says the fuel line sensor housing may crack and leak fuel. NHTSA says a leak may cause a stall and raise the risk of fire near an ignition source. Owners filed only two complaints on 2021 and newer Levantes as of October 2, 2026, so your reports carry the weight.
Maserati's filings and NHTSA's summaries describe the first four conditions. No campaign names the last two.
- A fuel smell while the engine runs
- An engine stall
- No rearview image when you shift into reverse
- A child seat that will not tighten on the belt
- An air suspension warning that keeps coming back
- A pulsing brake pedal the dealer calls wear
Say a Del Mar owner notices a fuel smell after a drive and emails the dealer that day. The email dates the symptom before any visit.
Which Levante Model Years Would a Lemon Law Attorney Check Against Each Campaign?
As of October 2, 2026, NHTSA lists three campaigns on 2021 and newer Levantes. Campaign 21V703000 reaches certain 2021 models, 21V872000 reaches certain 2021 and 2022 models, and 25V098000 reaches certain 2021 through 2024 models. Maserati's owner documentation portal lists no Levante after model year 2024.
| Model year | Campaign | Condition in Maserati's filing | NHTSA report and remedy |
|---|---|---|---|
| 2021 | 21V703000 | Seat belt retractors may deactivate early, so a child seat may not secure | Reported September 10, 2021, with an inspection and replacement as necessary |
| 2021 and 2022 | 21V872000 | Fuel line sensor housing may crack and leak fuel | Reported November 10, 2021, with a new housing |
| 2021 to 2024 | 25V098000 | Radio software may keep the rearview image from displaying | Reported February 17, 2025, with a software update over the air or at a dealer |
Picture a 2022 Levante GT owner checking all three rows. Only two list the 2022 model year, and the VIN decides whether Maserati's filing names the car. NHTSA's recall lookup lists the campaigns for a VIN.
Can a Levante Lawyer Count a Recall Visit When the Symptom Returns?
A completed recall visit can count as a dated repair attempt when it addressed a symptom you had. It neither proves a nonconformity nor closes a claim when the symptom returns. A fuel odor after 21V872000 or a blank camera after 25V098000 belongs on a new repair order with the date.
A nonconformity is a defect that substantially impairs the car's use, value or safety. Picture a 2022 Levante with the fuel line recall done and a fuel odor the next spring. A lawyer reads the recall summary beside both orders to see whether they describe the same failure.
Child Seat Belts That May Stop Locking
Campaign 21V703000 covers 503 potentially affected Levantes built from December 31, 2020 through July 26, 2021. Maserati's filing says the automatic locking retractors may deactivate early, so a child seat may not secure tightly. NHTSA's summary says the vehicles fail to comply with a federal occupant crash protection standard. If you carry a child seat, confirm the remedy was done and keep the order.
Camera Images Lost to Radio Software
Campaign 25V098000 reaches certain 2021 through 2024 Levantes, and NHTSA dates the report to February 17, 2025. Maserati's filing says radio software may prevent the rearview image from displaying and lists no warning before the failure. NHTSA's summary says the vehicles fail to comply with the federal rear visibility standard. A blank screen after the update needs a dated repair order.
Which Plan Should a Maserati Levante Lemon Law Lawyer Want Billed for Each Repair?
The factory warranty may still answer for a defect that began inside its term. Civil Code section 1795.6(b) keeps a warranty from expiring after a repair that did not fix the defect. You must report the failure within 60 days after the repair.
Every warranty repair order must also print the section 1793.1(a)(2) notice that repair days extend the warranty. Say a Scripps Ranch owner's 2021 Levante leaves factory coverage in 2025, and the air suspension warning returns six months later. The first appearance and each earlier order decide which plan answers.
Maserati Extended Warranty or an Outside Service Contract
Civil Code section 1791(o) defines a service contract as a written promise to perform maintenance or repair over a fixed period. Maserati describes its Extended Warranty as extending coverage up to the sixth year. Section 1794.4(b) says an outside contractor must provide the services and functional parts needed to maintain proper operation. The contract may expressly say otherwise.
Booklet Exclusions That Can Stall a Maserati Levante Lemon Law Claim
The 2023 and 2024 booklet gives the limited warranty 48 months or 50,000 miles, whichever occurs first. It starts on the earlier of first retail delivery or the date first placed into service. The 2022 booklet counts from delivery to the first retail purchaser. Shock absorbers, wiper blades and damage from flood, accident, road salt, contaminated fuel or track use are excluded outright. The booklet covers specified emission components for 8 years or 80,000 miles, whichever occurs first. They include the catalytic converter and the engine and transmission control modules.
How Does a Maserati Levante Lemon Law Lawyer Count Warranty Visits Against Contract Visits?
The presumption in Civil Code section 1793.22(b) looks at repairs by Maserati or its agents. It treats Maserati as having had a reasonable number of repair attempts once the statute's conditions are met. Visits billed to Maserati's warranty or a recall fit plainly, while visits billed to an outside contract may be argued differently.
A reasonable number of repair attempts is the law's phrase for enough fair chances to fix a defect. The presumption reaches repairs within 18 months from delivery or 18,000 miles, whichever comes first, and it has three routes. A nonconformity likely to cause death or serious bodily injury that Maserati or its agents repaired at least twice is the first route. Four or more repairs of the same nonconformity make the second. Those two routes call for direct notice, a written complaint to Maserati rather than only the dealer. That notice is needed at least once, and only when the booklet clearly disclosed the duty. A third route, more than 30 cumulative days out of service for repair of nonconformities, carries no notice rule. Maserati can rebut the presumption, and the full repair history can still carry a claim after the window closes.
Say a Levante GT was delivered new in Rancho Bernardo on March 14, 2022. A defect first appeared in 2024 and still returns. The 18 months ended September 14, 2023, so the claim rests on the full repair history under section 1793.2(d)(2). Cline APC's Maserati lemon law lawyers sort every visit by pay type before counting.
Why a Certified Levante Usually Falls Outside the New-Car Remedy
Maserati says its certified program accepts only models still under the 4 year, 50,000 mile new vehicle warranty. It adds up to 2 years on listed components. Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage on a used car does not make it new. Only a sale that came with a newly issued manufacturer's new car warranty changes that result. That ruling did not reach certified programs. Certified Levantes are usually outside the new-vehicle remedy, and the question has never been settled either way.
Other routes remain. Civil Code section 1795.5 gives a used-car seller who makes an express warranty a manufacturer's obligations, with exceptions. The implied warranty then runs as long as that express warranty, but not under 30 days or over three months after the sale. The Magnuson-Moss Warranty Act, section 2310(d), may also let a prevailing consumer recover costs and attorney fees.
Which Warranty Starts the One-Year Clock on a Maserati Levante Lemon Law Case?
On April 30, 2025, Maserati North America Inc. elected the newer lawsuit procedures. Code of Civil Procedure section 871.30 reaches Levantes sold in 2025 or earlier. For those, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after original delivery. That warranty is the written coverage for the defect. Repair time pauses both clocks, as do up to 60 days after a pre-suit notice, a written demand to Maserati. Section 871.29(d) means Maserati must name the governing procedure when it sells a Levante new in 2026 or later.
Say a Levante was delivered August 5, 2023. Its 48 month factory term would end around August 2027 absent mileage or repair days, so a lawyer plans around that date first. An extended plan or certified coverage may support a later date, but that argument carries risk.
The booklet points California owners to BBB AUTO LINE, which accepts filings until six months after the warranty ends. If Maserati gave timely written notice of the program, you must use it before asserting the presumption, under section 1793.22(c). For a Levante sold in 2025 or earlier, section 871.24 requires a pre-suit notice only before a suit seeking civil penalties, the extra money section 1794(c) allows for a willful violation. At least 30 days before filing, the notice must reach Maserati. Send it by email to the address Maserati posts or by certified or registered mail, return receipt requested, to the General Counsel address in the booklet.
Service Contracts and Everything Else a Maserati Levante Lemon Law Buyback Returns
Restitution, the statute's word for a buyback, repays the price paid or payable under Civil Code section 1793.2(d)(2)(B). That includes destination charges, factory options, tax, official fees and incidental damages, the costs the defect caused, such as towing and rental. The mileage offset is the deduction for miles driven before the first repair visit for the defect. A $92,000 Levante first returned at 7,500 miles carries a $5,750 offset. Run your own numbers through the buyback calculator.
For a Levante sold in 2025 or earlier, section 871.27 keeps an outside company's service contract out of the refund unless the selling dealer sold it. Maserati's filing for 25V098000 puts the end of Levante production at March 18, 2024, so a replacement, a substantially identical new vehicle, may be hard to find. A Maserati Grecale swap would be a negotiated choice, never one you must accept. The civil penalty section 1794(c) allows cannot exceed twice actual damages. Under section 1794(d), a prevailing buyer recovers costs and reasonable attorney fees.

A free consultation at Cline APC checks which coverage paid for each visit and whether Maserati's 2025 election governs your deadline. The lawyer then says whether BBB AUTO LINE, a pre-suit notice or a claim against a contract company fits first.
