Mazda CX-5 Lemon Law Lawyer in San Diego
Your 2021 CX-5 flashes the low engine oil level warning a few thousand miles after an oil change. The dealer adds a quart and hands back the keys. A Mazda CX-5 lemon law lawyer does not need a recall to turn that into a claim.

California asks whether Mazda fixed a warranty defect. The proof comes from Mazda's own bulletins, its warranty extensions and your repair orders.
NHTSA's recall data listed no campaign for any 2021 through 2026 CX-5 on September 30, 2026. You can check your own VIN in NHTSA's recall search. A CX-5 that keeps failing can still qualify for restitution, the statutory buyback, or for a replacement, meaning a substantially identical new vehicle.
Cline APC takes lemon law and consumer warranty cases only, and CX-5 owners meet the firm in La Jolla or Poway.

Is a CX-5 That Burns a Quart Between Oil Changes Worth a Lawyer's Look?
It can be. Owners filed 358 NHTSA complaints on 2021 through 2026 CX-5s, pulled September 30, 2026, and the engine led with 116. Of the 80 engine complaints on the 2021 model, 65 use the word oil, and only 11 of those name the turbo. Two say the dealer advised adding oil.
Each complaint is an owner's account, not a finding that a car is defective. Mazda's bulletins and program letters describe these symptoms.
- The low engine oil level warning a few thousand miles after a change
- A low dipstick with no trace of a leak
- The warning returning after the oil is topped off
- Tapping at idle in time with engine speed
- A check engine light with code P0524, P055F or P3400
- Slow warm-up, with the blue low coolant temperature light staying on
Picture a Mira Mesa owner whose 2021 CX-5 shows three low oil warnings in a year of Interstate 15 commuting. That pattern tells a Mazda CX-5 lemon law lawyer which bulletins to pull.
Why Does a Lawyer Treat the 2021 CX-5 Turbo Differently From Later Years?
Because the complaint record drops after 2021. Engine complaints fall from 80 on the 2021 model to 13, 10, 7 and 6 on the 2022 through 2025 models. The 2021 model year is also the one Mazda's valve seal bulletin names. It covers 2.5 turbos with the 10.25-inch display, built from October 6, 2020, through September 13, 2021.
Newer cars have spent less time on the road, so age explains part of that drop. NHTSA's counts do not say which engine, and each document covers only certain engines and VIN ranges.
| Model year | NHTSA engine complaints, pulled September 30, 2026 | Mazda documents cited for that year |
|---|---|---|
| 2021 | 80 | 01-003/23 and SSPD5 (2.5 turbo), 01-002/21, 01-004/21, 01-006/23, SSPD8 |
| 2022 | 13 | 01-006/23, SSPD8 |
| 2023 | 10 | 01-006/23, SSPD8 |
| 2024 | 7 | SSPD8 |
| 2025 | 6 | SSPD8 |
| 2026 | 0 | None of these |
Say your 2021 CX-5 Turbo was built in spring 2021 and bought at Mazda of Escondido on Auto Park Way. Its VIN falls inside the bulletin's range, and the oil drops a quart every 3,000 miles. A lawyer sets your orders beside the bulletin history to show the dealer was treating a known condition.
What Did Mazda Issue Instead of a CX-5 Recall, and How Does a Lawyer Use It?
Service documents. With no campaign on a 2021 through 2026 CX-5, Mazda's service bulletins and its special service programs SSPD5 and SSPD8 describe the condition in Mazda's own words. Mazda's SSPD5 dealer letter says eligibility shows in the dealer's warranty vehicle inquiry system. The federal recall search does not reach that system.
Ask the advisor to print that inquiry for your VIN. Mazda's recall lookup searches a VIN for special service programs. NHTSA's most recent CX-5 campaign, 21V875000, reached only 2018 and 2019 models, for a low-pressure fuel pump impeller that could crack. Mazda CX-90 lemon law claims start from the opposite record, with 11 campaigns in that model's first year.
From Oil Refills to Eight New Valve Seals
Bulletin 01-012/21, issued October 4, 2021, and revised November 24, 2021, said the warning usually appeared at about 3,100 to 4,700 miles. Mazda had not found the root cause yet. Dealers topped off the oil as a temporary measure. Mazda said it would add or replace oil at no charge until a full repair arrived. Versions dated October 3 and November 7, 2022, and then Mazda's bulletin 01-003/23 on January 31, 2023, named damaged exhaust-side valve seals as the cause. The fix replaces eight exhaust valve seals with a modified design.
Does SSPD5 or SSPD8 Stretch a Mazda CX-5 Lemon Law Claim?
Mazda's May 10, 2024 dealer letter announced SSPD5, a powertrain extension tied to a valve stem seal class action settlement. It covered oil consumption repairs for 7 years or 84,000 miles. Mazda letters dated August 6 and October 24, 2025 say the court clarified the coverage. It reaches all components on Mazda's Powertrain Limited Warranty Parts List for 7 years or 84,000 miles, whichever comes first. A court-appointed administrator handles reimbursement claims.
SSPD8 covers one thermostat repair on certain 2018 through 2025 CX-5s. The term is 15 years or 150,000 miles, whichever comes first, from the original warranty start date. Its owner letter describes code P0126 from a thermostat stuck open, and bulletin 01-003/25 excludes the 2.5 turbo. In December 2025, Mazda changed that repair to a dummy plug plus a software update. The Department of Consumer Affairs (DCA) lists an issue covered by an original manufacturer warranty, which does not include extended warranties, among its arbitration recommendations. So have a lawyer weigh any extension, and read a settlement release, before relying on either.
Which Two Checks on a CX-5 Order Matter to a Lawyer Before a Valve Seal Repair?
The oil level check and the leak check. Bulletin 01-003/23 says it does not apply unless the technician confirms on the dipstick that the oil has dropped. It also does not apply if the engine is leaking oil. So the order should record both checks and say whether the dealer added oil or replaced the seals.
Take a 2021 CX-5 Turbo losing a quart every 3,000 miles whose early orders read only oil added. Photograph the dipstick before you add any oil, and tell the advisor how much you added and when. A leak takes the car out of that bulletin, even if it also burns oil.
Front Cover Seeps on the 2.5 With Cylinder Deactivation
Bulletin 01-006/23, dated April 26, 2023, covers oil seeping onto the engine front cover. It reaches 2018 through 2023 CX-5s with the 2.5-liter engine and cylinder deactivation. Later versions in 2024 and 2025 limit it to cars built before set dates. Oil that keeps seeping after a reseal suggests a repeat repair of one defect, and the orders should say so.
Tapping at Idle and the Oil Filter Wrapper Code
Bulletin 01-002/21 covers tapping at idle in time with engine speed on non-turbo cars. It says a lash adjuster with air bubbles in its oil passage may cause it, and it tells technicians to call Mazda's hotline if the noise returns. Bulletin 01-004/21 covers codes P0524 and P055F on cylinder deactivation engines and, for the 2021 CX-5, reaches cars built before December 14, 2020. Service alert SA-047/21 says code P3400 may come from plastic debris from the oil filter wrapper plugging a valve. It adds that warranty does not apply to a condition created by outside influence, so keep proof of who changed your oil.
Do Refill Visits and an Engine Swap Count When a Mazda CX-5 Lemon Law Lawyer Tallies Repairs?
They can. California asks whether Mazda's dealers had a reasonable number of repair attempts, meaning fair chances, at the same defect. Each refill visit from Mazda's temporary-repair period is a candidate attempt, and a replacement engine can still count. The Civil Code section 1793.22(b) presumption treats Mazda as having had a reasonable number once its conditions are met.
That presumption is a legal shortcut, and its window closes at 18 months from delivery or 18,000 miles, whichever comes first. One route counts two or more repairs of a nonconformity, the statute's word for the defect, that is likely to cause death or serious bodily injury. A second counts four or more repairs of the same nonconformity. Each of those routes needs direct notice to Mazda at least once where Mazda's warranty materials clearly disclose that duty. The third route counts more than 30 cumulative days out of service for repair of nonconformities, with no notice required. Mazda may rebut the presumption. Past the window, a claim under section 1793.2(d)(2) can still rest on the full repair history. The firm's Mazda lemon law lawyers weigh both paths.
Say a 2021 CX-5 Turbo from a Clairemont Mesa Boulevard dealer shows the low oil warning at 4,000 miles on State Route 163. Three visits later, every order reads oil added, no leaks found. Those three visits sit one short of four repairs. If the engine is later replaced and oil loss returns, the orders before and after the swap show whether one nonconformity continues.
Four Years Under Commercial Code 2725, and When the Clock Starts
The newer procedures in Code of Civil Procedure sections 871.20 and following are optional for manufacturers. Mazda was not on the state's opt-in list on September 30, 2026. So Commercial Code section 2725 gives four years, usually from tender of delivery. The exception needs a warranty that explicitly extends to future performance and a breach that cannot be discovered until then. Mazda's published powertrain warranty of 60 months or 60,000 miles, whichever comes first, may qualify, and then the clock runs from when the breach is or should have been discovered. A CX-5 delivered in April 2021 hit its default four-year date in April 2025, so the start date and any tolling decide a 2021 claim.
If Mazda gave timely written notice of BBB Auto Line, its arbitration program, with a description of its operation and effect, section 1793.22(c) requires trying it before relying on the presumption. Program days extend the deadline. Under section 871.29(d), Mazda must name the governing procedure for a CX-5 sold new in 2026 or later.
Mazda CX-5 Lemon Law Offset Math When the First Warning Came Early
Restitution returns the price paid or payable plus taxes, official fees and reasonable repair, towing and rental costs. Mazda may take a mileage offset, a deduction of the price times the miles driven before the first repair visit for that defect, divided by 120,000. For a $34,800 CX-5 first brought in for low oil at 12,000 miles, that gives $3,480. The same car first brought in at 4,200 miles carries a $1,218 offset. Run your own numbers in the buyback calculator.
Leased and Secondhand CX-5s
Civil Code section 1795.4 hands a lessee, the person leasing the car, the buyer's rights against Mazda. In Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189, leftover factory coverage did not make a used car new. The exception is a car whose manufacturer's new car warranty was issued with that sale. Certified cars usually fall outside, though that point is unsettled. Their buyers often look to the selling dealer's written warranty under section 1795.5.
Should Your First Low-Oil Repair Order Go to a Mazda CX-5 Lemon Law Lawyer?
It should, because that order dates the defect and sets the offset. A free consultation with a Mazda CX-5 lemon law lawyer at Cline APC reads your contract and service invoices against the four-year deadline. The review names gaps and strengths.
Picture a Poway owner whose 2021 CX-5 Turbo passed 60,000 miles in 2026 and still burns oil. SSPD5 coverage may still apply, while any lemon law claim turns on the dates. Nobody can promise how a CX-5 case ends.
