Mazda Lemon Law Lawyers in San Diego
A low oil message pops up between services. Later, the engine stumbles as you merge onto Interstate 15. A Mazda lemon law lawyer starts with how the dealer wrote each symptom on the repair order, because that wording becomes the proof.

A new or leased Mazda can qualify for a buyback, meaning a refund, when a warranty defect substantially impairs its use, value or safety. Mazda's dealers must also fail to fix it after a reasonable number of repair attempts, meaning a fair number of chances.
The statute calls that kind of defect a nonconformity, and Civil Code section 1793.22 defines the term. Mazda does not appear on the list of manufacturers that opted in to newer lemon law procedures in 2025, so its claims generally follow a four-year deadline from tender of delivery.
Cline APC is a lemon law and consumer warranty firm with offices in La Jolla and Poway.

What Do CX-5 Oil Loss and CX-90 Recalls Tell a Mazda Lemon Law Lawyer?
They show two kinds of record a claim can rest on. The CX-5 record runs through Mazda service documents, such as thermostat program SSPD8, oil consumption test MT-005/20 and SSPD5, a powertrain extension for certain 2.5 turbos. The 2024 CX-90, the model's first year, drew 11 recall campaigns, from steering bolts to software that could cut drive power.
| Model | Model years | What Mazda's documents describe | Claims |
|---|---|---|---|
| CX-5 | 2013 to 2021 (MT-005/20), certain 2018 to 2025 (SSPD8), 2021 with the 2.5 turbo (SSPD5) | An oil consumption test, a thermostat that can stick open, and a longer powertrain extension | Mazda CX-5 engine claims |
| CX-90 | 2024, with two campaigns also reaching 2025 | 11 recall campaigns, from steering and suspension bolts (23V429000) to plug-in hybrid drive power software (23V719000) | Mazda CX-90 recall and defect claims |
Picture a 2024 CX-90 plug-in hybrid from Mazda of Escondido that loses drive power twice in 11 months. If both orders say loss of drive power, the visits line up against one defect. If each reads only warning light on, a Mazda lemon law lawyer has a harder link to show.
A Symptom Diary Started Before the First Mazda Appointment
Start a log the day a symptom first shows up, in a phone memo or a glove box notebook. Each entry gets the date, the time and the odometer reading. Add the road, your speed and whether the engine was warm. Copy every warning message word for word. When a spouse also drives the car, notes in that driver's own words carry real weight.
Dipstick Photos and MyMazda Alerts That Back Up a Mazda Lemon Law Claim
Photograph the dipstick beside the odometer every 500 to 1,000 miles, on level ground with a warm engine. Mazda's own test in M-Tips bulletin MT-005/20 uses the dipstick too. The dealer notes the mileage, fills the warm engine to the full mark and rechecks after 1,200 miles. In a May 10, 2024 letter on program SSPD5, Mazda told dealers that low oil may appear as a code or in the MyMazda App. Screenshot each app alert as it arrives, because a Mazda lemon law lawyer can date the loss from it.
Does the Dealer or Mazda Owe the Buyback a Lemon Law Attorney Demands?
Mazda owes it, not the dealer. Once Mazda's dealers fail to conform the car to its warranty after a reasonable number of attempts, Civil Code section 1793.2, subdivision (d)(2), requires Mazda to promptly replace the car or make restitution. The Department of Consumer Affairs, or DCA, says in its FAQ that the manufacturer, not the dealership, repurchases or replaces.
For a Mazda sold in California, that means Mazda North American Operations in Irvine. Restitution is the statutory buyback, and it covers incidental damages, meaning reasonable towing, rental and repair costs you paid. Replacement means a substantially identical new vehicle, and Mazda can never force one on you. The mileage offset is a deduction Mazda may take for miles driven before the first repair visit for the defect.
| Line item | Treatment in a Song-Beverly repurchase | Source |
|---|---|---|
| Price paid or payable, with transportation charges and Mazda-installed options | Refunded | Civil Code 1793.2(d)(2)(B) |
| Sales or use tax, license, registration and other official fees | Refunded | Civil Code 1793.2(d)(2)(B) |
| Towing, rental and repair costs actually incurred | Refunded as incidental damages | Civil Code 1793.2(d)(2)(B) |
| Add-ons a dealer or you installed that did not come from Mazda | Left out | Civil Code 1793.2(d)(2)(B) |
| Miles driven before the first repair visit for the defect | Subtracted as the offset | Civil Code 1793.2(d)(2)(C) |
| Section 871.27 deductions, such as rolled-in negative equity | Not applied to Mazdas sold in 2025 or earlier | CCP 871.30 |
Say you paid $36,400 for a CX-5 and first brought it in for its engine problem at 7,500 miles. The price times those miles, divided by 120,000, gives a $2,275 offset. Your own figure turns on your contract and that first order. Try the lemon law buyback calculator, then call (888) 982-6915 before you sign anything from Mazda.
A Settlement Offer After You Apply to BBB Auto Line
DCA lists BBB Auto Line as the state-certified arbitration program for Mazda. According to DCA, a manufacturer may offer to settle once you apply. Accepting is your choice. An offer that skips registration fees deserves a second look. Mazda's willful violation can also add a civil penalty, an extra sum of up to twice actual damages, under Civil Code section 1794, subdivision (c). Under subdivision (d), a buyer who prevails recovers costs and reasonable attorney fees.
Rolled-In Loan Balances and Outside Service Contracts on a Mazda
Code of Civil Procedure section 871.27 trims restitution, but only for manufacturers that opted in to the newer procedures. It offsets negative equity rolled in from a trade and leaves out service contracts sold by outside companies. Section 871.30 keeps those rules away from Mazdas sold in 2025 or earlier, because the DCA roster shows no Mazda election. How the older rules treat that balance is a question for a lawyer holding the paperwork.
Leased, Demonstrator and Certified Cars in a Mazda Lemon Law Case
Civil Code section 1795.4 gives a lessee, who leases instead of buying, a buyer's rights. A demonstrator sold with Mazda's new car warranty also counts as new. Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189 held that leftover factory coverage does not make a used car new, unless the new car warranty was issued with that sale. The court left certified pre-owned programs unaddressed. So a certified Mazda usually falls outside the new-vehicle remedy, though the point is unsettled.
How Long Does Mazda's Warranty Keep a Lemon Law Claim Open for a Lawyer?
Mazda's published warranty summary lists 36 months or 36,000 miles of New-Vehicle Limited Warranty coverage on Mazda-supplied parts. The Powertrain Limited Warranty covers Mazda-supplied powertrain components for 60 months or 60,000 miles. Whichever limit comes first ends each term. An engine defect first reported inside the right window keeps its later visits in the file.
Both warranties transfer to a later owner during the term, and Mazda lists towing to the nearest Mazda dealer when a warranted failure leaves the car undrivable. Booklets differ by model and year, so your own warranty information booklet controls.
Civil Code section 1793.22, subdivision (b), adds a presumption, a legal shortcut. Once its conditions are met within 18 months of delivery or 18,000 miles, whichever comes first, the law treats Mazda as having had a reasonable number of repair attempts. One route counts two or more repairs of a nonconformity likely to cause death or serious bodily injury. Another counts four or more repairs of the same nonconformity. Each of those routes needs direct notice to Mazda itself at least once, if Mazda's warranty materials clearly disclose that duty. The third route counts more than 30 cumulative days out of service for repair of nonconformities, with no notice needed.
Mazda can rebut the presumption. After the window closes, a claim can still succeed on the full repair history under section 1793.2, subdivision (d)(2). Picture a powertrain defect that appears at 25,000 miles and survives three repairs by 45,000. The DCA FAQ puts the floor at two repair attempts. The firm weighs Honda claims against that brand's own booklet.
Maintenance Receipts Mazda Can Ask to See
Mazda's warranty summary says coverage is based on following recommended factory maintenance. It also points owners to MyMazda service history records. On an engine claim, Mazda may ask for oil change receipts, and a gap invites an argument about neglect. Keep every receipt, including those from an independent shop. Each one should name the oil grade, the date and the mileage.
Accessory Devices That Hand Mazda an Easy Excuse
Mazda's service alert SA-032/23 tells technicians facing an electrical concern to ask first whether aftermarket devices were installed. Its examples include a GPS tracking device, a phone charger in the 12-volt socket and a dash cam. Each one hands Mazda another explanation. Remove such devices before a visit, or disclose them at the counter. Leave stored codes alone too, because clearing them erases evidence.
Do a Bulletin, a Program and a Recall Carry Equal Weight With a Mazda Attorney?
No. A technical service bulletin names a known condition and an approved fix. A special service program, such as SSPD8, extends coverage without a safety recall. A recall is a safety campaign filed with NHTSA. Recall work counts as a repair visit for the defect it addresses, but it does not close a claim when the symptom returns.
In NHTSA's data, complaints are owner accounts rather than findings, and each complaint number counts once.
| Mazda by the numbers, NHTSA data pulled September 30, 2026 | Figure |
|---|---|
| Recall campaigns on the 2024 CX-90 | 11 |
| Recall campaigns reaching the 2025 CX-90 | 2 |
| Recall campaigns on 2021 to 2026 CX-5s | 0 |
| Owner complaints on 2021 to 2026 CX-5s | 358 |
| Owner complaints on 2024 to 2026 CX-90s | 491 |
Suppose the center screen and rear camera on your 2025 CX-70 go dark at startup. At Hello Mazda of San Diego, the advisor types camera inoperative. Ask that the order add the dates from your log. Mazda's recall 24V814000 covers certain 2024 and 2025 CX-90s and 2025 CX-70s whose dash electrical supply unit may leave the 360-degree view monitor, among other functions, not working properly at startup.
Wording the Mazda Concern So the Technician Can Test It
Technicians work from conditions. A car that feels strange gives them nothing to test. A transmission that slips between second and third on a cold start gives them a road test. Say what you felt, heard or saw, and where. Most orders split each job into the concern, the cause and the correction, so read all three before driving off.
Asking the Technician Which Bulletin Matched Your VIN
At every visit, ask whether a bulletin, program or campaign matches your VIN, and have the answer written on the order. Mazda's recall lookup searches a VIN for safety recalls and special service programs. Section 1793.2, subdivision (d)(2), counts attempts by Mazda or its representative in this state, not one store. So a visit to Team Mazda of El Cajon belongs in the file beside visits at your usual dealer.
Mazda Is Not on the DCA Election List, So Which Deadline Does a Mazda Lemon Law Lawyer Use?
Four years under Commercial Code section 2725, or section 10506 for a lease. Mazda is not on the DCA roster of manufacturers that opted in to the 2025 procedures. So those procedures do not reach a Mazda sold in 2025 or earlier. The four years generally run from tender of delivery, and BBB Auto Line days extend them.
Manufacturers may opt in to newer procedures in Code of Civil Procedure sections 871.20 and following, a choice called an election. Mazda was absent from the DCA roster of manufacturers that opted in on September 30, 2026. Section 871.20, subdivision (a), limits the chapter to electing manufacturers. Section 871.30 keeps it away from 2025 and earlier sales without an election. That removes the section 871.24 pre-suit notice, a demand required only before a suit that seeks civil penalties from an electing manufacturer.
An exception in Commercial Code section 2725 applies when two conditions meet. The warranty must explicitly reach future performance, and the breach cannot be discovered until that performance occurs. The period then starts when the breach is or should have been discovered. Under Civil Code section 1793.22, subdivision (c), program days extend any deadline. With timely written notice of BBB Auto Line and a description of its operation and effect, you use it before relying on the presumption, and you can still sue afterward. For a Mazda sold new in 2026 or later, section 871.29, subdivision (d), requires Mazda to name the governing procedure at sale.
Imagine a Chula Vista CX-5 delivered in March 2024 that has visited Westcott Mazda four times for one engine noise. Its default four-year date is March 2028, before program days or tolling. The same roster question arises for Toyota claims, since Toyota was also absent on September 30, 2026.
Writing to Mazda North American Operations in Irvine
Direct notice matters only for the two-repair and four-repair presumption routes. It applies only when Mazda's warranty materials clearly and conspicuously disclose it. Mazda's owner letters come from Mazda North American Operations on Spectrum in Irvine, but the address in your booklet controls. List the VIN, each visit date and the symptom, and keep proof of receipt. After any call to Mazda's Customer Experience Center, confirm the case number in writing.
Which Courthouse Hears a Claim From Each Mazda Store
The court's Form ADM-254 sorts zip codes into divisions. Local Rule 1.2.2(E) sends South County and East County civil cases downtown to the Central Division. A claim tied to Westcott Mazda in National City would usually be filed there. Mazda of Escondido and AutoNation Mazda Carlsbad sit in North County, whose civil cases go to Vista. Under Code of Civil Procedure section 85, a case worth $35,000 or less is limited civil.
Can a Mazda Lemon Law Lawyer Take the First Look at Your Symptom Log?
Yes, and that log is often where a strong Mazda file begins. A free consultation with a Mazda lemon law lawyer at Cline APC opens with your four-year date. Next come the repair count, the days out of service and whether a BBB Auto Line notice shapes the next step. The review names the gaps along with the strengths.
Before the call, sort your sales or lease agreement, service invoices, Mazda program letters and log by date.
