Mazda CX-90 Lemon Law Lawyer in San Diego

You bought a 2024 CX-90 in its first year on sale. NHTSA lists 11 recall campaigns for that model year, and the steering still grabs on the way down Interstate 15. A Mazda CX-90 lemon law lawyer reads that stack of letters differently than a service advisor does.

Each recall visit goes on your record like any other warranty repair, and a symptom that returns afterward can support a buyback claim, meaning a refund of the price. Check your own VIN in Mazda's recall lookup, because the plug-in hybrid and the mild hybrid carry different campaigns.

Only lemon law and consumer warranty cases come through Cline APC. CX-90 owners meet the firm in La Jolla or Poway.

If your CX-90 went back for a recall and the same problem keeps showing up, call (888) 982-6915. Stack the recall letters and repair orders in date order first.

Does Sticky Steering or Power Loss in a CX-90 Call for a Mazda CX-90 Lemon Law Lawyer?

It can. Owners filed 491 NHTSA complaints on 2024 through 2026 CX-90s, pulled September 30, 2026. Steering leads with 197, and 191 of those are on the 2024 model. Also, a keyword count finds 100 steering complaints using a form of the word stick. These are owner accounts, not findings that any car is defective.

These symptoms come from Mazda's own recall filings and bulletins, not from owner complaints.

  • A sudden increase in steering effort while driving
  • An engine and electric motor shutting down with little or no warning on a plug-in hybrid
  • An engine that does not restart after the idling stop feature shuts it off
  • Brakes that apply suddenly after the system falsely detects an object
  • A bark, hoot or chirp on the 1-2 shift when pulling away from a stop
  • Radar cruise control slowing the SUV to match a car in the next lane

Picture a Carmel Valley owner whose 2024 CX-90 steering turns heavy on the State Route 56 curves. The worm gear recall repair was done three months earlier. The recall work is on file, but the new symptom feels like the old one. A lawyer reads that as the same nonconformity, the warranty defect itself, possibly returning. Then the next repair order decides how strong the link is.

Is the 2025 CX-90 Covered by the 2024 Recalls, and What Does a Lawyer Check?

Mostly not. NHTSA lists 11 campaigns for the 2024 CX-90. However, only two reach the 2025 model, and none reach 2026, as of September 30, 2026. The plug-in hybrid and the mild hybrid carry different campaigns, so the table shows which powertrain Mazda's documents name.

25V568000September 2, 20252024, 2025Mild hybridFuel gauge may misread

Say you own a 2025 mild hybrid and find only the fuel gauge and dash electrical rows on your VIN. So those two campaigns are the only ones that name 2025 CX-90s. Mazda's bulletins also name the powertrain they apply to, so check which one yours matches.

What Does NHTSA's Recall Query Mean for a CX-90 Lawyer Reviewing a Claim?

NHTSA's defects office opened Recall Query RQ26-002 on January 26, 2026. It aims to assess whether the remedy for steering recall 24V022 is adequate. Its opening summary cites 26 complaints and several field reports of brief increases in steering effort on 2024 CX-90s with the remedy. NHTSA's file lists no closing date as of September 30, 2026.

Therefore, a symptom that survives a remedy is the pattern the query describes. Each visit for it after the recall can count as another attempt at the same defect. Ask the dealer to reference 24V022000 on every post-recall steering order. Then the link between visits is printed rather than argued.

Bolts and a Worm Gear in the First Steering Campaigns

Mazda's report for 23V429000 covers 18 cars built March 4 to 11, 2023. So most owners will not find it on their VIN. For 24V022000, Mazda's report says excessive friction in the worm gear may raise the force needed to turn the wheel. It lists no warning. The remedy replaces the spring engaging the worm gear and reapplies grease. Mazda's report says the improved steering gear assembly entered production on December 11, 2023.

Four Campaigns Filed on October 31, 2024

Mazda filed all four of 24V814000, 24V815000, 24V816000 and 24V817000 on one day. Its reports count 5, 16, 7 and 11 field reports in the United States and its territories as of late October 2024. For the plug-in hybrid shutdown in 23V719000, Mazda's report says the engine and motor may stop with little to no warning. Each completed campaign can mark a separate repair visit, so keep every letter.

Brake and Shift Bulletins Mazda Issued Without a Recall

Service alert SA-077/23, dated November 15, 2023, told dealers how to answer customer concerns about unintended Smart Brake Support braking. Later, recall 24V349000 was filed on May 16, 2024. Mazda's SSPD1 reprograms side radar software on 8,041 vehicles, while SSPD6 reprograms the vehicle control module on 28,404. Bulletin 05-001/24 covers a bark, hoot or chirp on the 1-2 shift. Bulletin 05-004/24 covers shift shock when the fluid is 86 degrees Fahrenheit or colder. Both name the inline-six. A surge near 60 miles per hour in EV mode on plug-in hybrids falls under 05-003/24.

When a Mazda Advisor Says the CX-90 Works as Designed, What Should a Lawyer See?

The complaint written on the order. A visit where the advisor calls the behavior normal can still show you reported a defect on a date. Ask that the order record your words, the campaign numbers and whether SSPD1 and SSPD6 are complete. Also ask for the drop-off and ready dates.

Say a Del Mar owner reports sudden braking on Interstate 5 in early 2024 and is told the system is working as designed. The later recall describes a similar event, which can help support the earlier complaint. Still, a lawyer has to tie it to that car.

Next, log each event the day it happens. Note the road, speed, EV mode, battery percentage and every display message. Photograph the cluster before restarting when it is safe. Mazda's service alert SA-041/23 says neutral is available only with the engine running, or the plug-in hybrid in Ready-On. Tell any tow company before it arrives.

Has Your 2024 CX-90 Aged Out of the Presumption a Mazda CX-90 Lemon Law Lawyer Uses?

Maybe. The Civil Code section 1793.22(b) presumption treats Mazda as having had a reasonable number of repair attempts, meaning fair chances. Its conditions must be met within 18 months of delivery or 18,000 miles, whichever comes first. For example, a July 2023 delivery aged out in January 2025. Even so, the right to a buyback can remain.

The presumption has three routes. One route needs two or more repairs of a nonconformity likely to cause death or serious bodily injury. A second needs four or more repairs of the same nonconformity. Each of those needs direct notice to Mazda at least once, meaning you told Mazda itself, where Mazda's warranty materials clearly disclose that duty. The third route counts more than 30 cumulative days out of service for repair, with no notice needed. However, Mazda can rebut the presumption. After the window, a claim can still succeed on the full history under section 1793.2(d)(2). According to the Department of Consumer Affairs (DCA) FAQ, the floor is two attempts. The firm's Mazda lemon law lawyers weigh each route.

Picture a 2024 CX-90 plug-in hybrid delivered at Mazda of Escondido in summer 2023. Its steering, drive power and camera recall visits fall inside the first year, but later steering visits land after the window closes.

Two Power Losses and a Letter to Mazda

Say a Chula Vista owner's plug-in hybrid lost power twice, with both orders written at Westcott Mazda on National City Boulevard. Still, two such repairs can fit the two-repair route. That needs the loss of power to be a nonconformity likely to cause death or serious bodily injury. A lawyer confirms that from the orders, the dates and Mazda's warranty booklet. Send Mazda a written notice with the VIN and visit dates, and keep proof of receipt.

When a Mid-2023 Mazda CX-90 Lemon Law Claim Runs Out of Time

As of September 30, 2026, Mazda is not on the DCA list of manufacturers that opted in to the newer procedures in Code of Civil Procedure section 871.20 and following. So Commercial Code section 2725 gives four years, generally from tender of delivery. A 2024 CX-90 delivered in mid-2023 reaches its default four-year date in mid-2027. An exception applies when the warranty explicitly covers future performance and the breach cannot be found until that performance occurs. The clock then runs from when the breach is or should have been discovered. For a CX-90 sold new in 2026 or later, section 871.29(d) requires Mazda to name the governing procedure at sale. Section 1793.22(c) requires trying BBB Auto Line, Mazda's state-certified arbitration program, before relying on the presumption if Mazda gave timely written notice of it with a description of its operation and effect. Then program days extend the deadline.

Refund or Another Early-Production CX-90?

Restitution, the statutory buyback, returns the price paid or payable, with taxes, official fees and reasonable towing, rental and repair costs. Mazda may deduct a mileage offset equal to the price times the miles driven before the first repair visit for the defect, divided by 120,000. For a $56,400 CX-90 first in for steering at 4,000 miles, the offset is $1,880. A replacement must be substantially identical. Because that can mean another early-production SUV for a 2024 model, ask which campaigns it has had. Section 1795.4 gives a lessee, the person leasing the SUV, a buyer's rights. The buyback calculator runs your own figures.

Should a Mazda CX-90 Lemon Law Lawyer Sort What the Recalls Did Not Fix?

Yes. A free consultation with a Mazda CX-90 lemon law lawyer at Cline APC sorts your recall letters against your repair orders. The review shows which symptoms came back after a remedy. It also covers your delivery date, first-visit mileage, total days in the shop and any BBB Auto Line notice.

Pull the contract, the recall letters, every repair order and any SSPD1 or SSPD6 notice into one folder. Then add dashcam clips and your own notes on steering, braking or power loss. Nobody can promise how a CX-90 case ends, so weak points get discussed along with strong ones.

Cline APC's lemon law attorneys in San Diego see CX-90 owners at the La Jolla and Poway offices. The CX-5 engine claims come from a different record, with no recall at all.
