California's lemon law protects a new or leased Chrysler that FCA's authorized shops cannot repair. FCA gets a reasonable number of repair attempts, and the facts of your van decide how many that is. After that, FCA owes you a buyback, which the refund formula in section 1793.2(d)(2) of the Civil Code calls restitution, or a replacement. A replacement means a substantially identical new vehicle.
The personal-use test in section 1793.22(e)(2) asks whether you bought or used the Chrysler primarily for personal, family or household purposes. Dealer-owned units and demonstrators carrying FCA's new car warranty at sale also qualify. A business van can too, if it is under 10,000 pounds gross vehicle weight and the company registers five or fewer vehicles in California. A lessee, the person holding a lease, stands in a buyer's shoes under Civil Code section 1795.4.
Used Chryslers face a narrower test, set by Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189. The California Supreme Court held there that coverage left over from the factory does not turn a used car into a new one, unless FCA's new car warranty was issued with that sale. The ruling left certified pre-owned programs undecided. Certified Chryslers usually fall outside the new-vehicle remedy, yet the question remains unsettled.

Do Pacifica Hybrid Shutdowns and 300 Airbag Recalls Give a Chrysler Lemon Law Lawyer a Case?
They can, once the dealer fails to fix the fault after a reasonable number of attempts. FCA's recall filings describe two Pacifica plug-in problems. One is a battery that may catch fire while parked, and the other is a transmission fault that may shut the engine off. For the 300, they describe curtain airbag inflators that may rupture.
| Model | Campaign and model years | What FCA's filing says | Claims |
|---|---|---|---|
| Pacifica plug-in hybrid | 26V362000, 2020 to 2022, built August 5, 2020 to May 2, 2022 | The high-voltage battery may fail internally and cause a fire, even parked with the ignition off | Chrysler Pacifica claims |
| Pacifica plug-in hybrid | 23V010000, 2017 to 2023 | An internal transmission wiring short or rotor bearing installation defect could shut the engine down | Same model claims |
| 300 | 24V198000, 2018 to 2021, built July 5, 2018 to May 19, 2021 | Side curtain air bag inflators may rupture | Chrysler 300 claims |
Say your 2022 Pacifica Hybrid loses power on Interstate 15 near Rancho Bernardo. A flatbed hauls it to Jack Powell Chrysler Dodge Jeep Ram in Escondido. A recall is FCA's report to the National Highway Traffic Safety Administration (NHTSA), not proof about your van, so the claim rests on your repair history. The fault also has to substantially impair the Chrysler's use, value or safety, which makes it a nonconformity.
Why a 300 Owner May Pick the Refund
Section 1793.2(d)(2) lets you insist on restitution, and FCA cannot force a replacement. A replacement carries the usual new-vehicle warranties. FCA also pays the tax, official fees and incidental damages, meaning reasonable tows, rentals and repair bills the defect caused. Chrysler's website says the 300 went out of production in 2023, so no substantially identical new 300 is being built. A Pacifica owner can still weigh a new van, but then pays FCA the mileage offset under section 1793.2(d)(2)(C). That charge covers the miles on the van before its first repair visit for the problem.
How Close Is FCA's Buyback Offer to the Figure a Chrysler Lemon Law Attorney Would Build?
Not always close. Restitution adds the price paid or payable, collateral charges such as tax and registration, and incidental damages. Then it subtracts the mileage offset. An FCA worksheet or goodwill offer can leave out items the statute requires. So a Chrysler lemon law lawyer checks each line against your contract before anyone signs.
Suppose you put $6,000 down on a Pacifica, made 30 payments of $780 and still owe the lender $29,500. Paid so far is $29,400, and payable is the $29,500 balance, so the price line starts at $58,900 before adjustments. Your contract and payoff letter set the real figure.
| Item | What the statute counts | Where a worksheet can differ |
|---|---|---|
| Price paid or payable | Down payment, payments made, loan balance, finance charges paid, destination and factory options | A dealer add-on in the wrong category |
| Collateral charges | Sales tax at the registration address rate and first-year DMV fees | Tax at the wrong rate, or a fee left out |
| Incidental damages | Reasonable tows, rentals and repair bills actually incurred | Zero, because the receipts never reached FCA |
| Mileage offset | Price times miles at the first repair visit for the defect, divided by 120,000 | Miles from a later visit with a clearer diagnosis |
| Rules FCA elected, Code of Civil Procedure 871.27 | Third-party options, service contracts and loan shortfall (GAP) coverage out, dealer-supplied products in, rebates kept out of the price, trade-in debt subtracted | Applies only under the newer procedures |
Where Each Line of a Chrysler Lemon Law Refund Comes From
On a financed California car purchase, Civil Code section 2982(a) requires a block labeled itemization of the amount financed. It lists the cash price, taxes, public fees, the down payment and any manufacturer rebate on separate rows. Under Mitchell v. Blue Bird Body Co. (2000), finance charges you became bound to pay count as paid or payable. The state tax agency's schedule effective July 1, 2026, sets Poway at 7.75% and Escondido at 8.75%, so a $50,000 van carries $3,875 or $4,375. The DMV's vehicle license fee adds 0.65%, or $325 at that price. Later renewals return only as incidental damages from a delayed buyback, under Kirzhner v. Mercedes-Benz USA, LLC (2020). Try your own numbers in the buyback calculator.
Where FCA's Worksheet Splits From a Chrysler Lemon Law Figure
On a $52,000 van, each 1,000 miles of offset moves the refund by about $433. A worksheet that starts the count at a later diagnosis therefore costs you money. Under the newer procedures, section 871.27(c) lets FCA subtract negative equity, the debt left on a trade-in beyond its value. Niedermeier v. FCA US LLC, decided March 4, 2024, involved a different trade, the defective Jeep itself. The California Supreme Court held that the trade credit did not reduce restitution. The ruling did not address negative equity from an earlier vehicle, and it came before the newer procedures.
Can a Chrysler Lemon Law Attorney Use the Warranty Notice and the Tanner Presumption for You?
Yes, in two ways. Every warranty repair order must say that a defect existing within the warranty period keeps the warranty alive until it is fixed. Early repair history can also trigger the Tanner presumption. When the history fits its terms, that presumption treats FCA as having had a reasonable number of repair attempts.
Say your 300 had an airbag lamp fault documented during coverage. Later, you paid an independent shop to chase it. That bill may belong on the incidental line, because the in-warranty orders show the defect existed in time. Coverage differs by model and model year, so a Chrysler lemon law lawyer reads the booklet that came with your car.
The Warranty Stays Open Until a Reported Defect Is Fixed
Section 1793.1(a)(2) of the Civil Code requires that statement, in 10-point boldface, on every warranty work order. The notice adds that the warranty period grows by each whole day the vehicle sat out of your hands for warranty repairs. It extends again when a repair failed and you told the manufacturer or seller within 60 days after the repair was completed.
Two Repairs, Four Repairs or 30 Days in a Chrysler's First 18 Months
Section 1793.22(b) looks only at the first 18 months or 18,000 miles, whichever comes first. Its first route is two or more repairs of a nonconformity likely to cause death or serious bodily injury if the vehicle is driven. Its second route is four or more repairs of the same nonconformity. Each needs direct notice, a report to FCA itself, at least once if the warranty clearly disclosed that duty. A third route counts time, more than 30 cumulative days out of service for repair of nonconformities, and needs no letter. FCA can rebut the presumption. Even after the window closes, the whole repair history can still carry a claim.
The California Dispute Settlement Program, or CDSP, is the program the Department of Consumer Affairs lists for Chrysler. That department, or DCA, certifies it, and FCA sponsors it. Where FCA gave timely written notice of the program, section 1793.22(c) sends you there before you can use the presumption. Days spent in the program extend the filing deadline. A separate repair-time rule, section 1793.2(b), gives FCA and its shops 30 days to finish each repair. Only your written agreement, or a delay FCA could not control, stretches that limit.
Can a Recall Visit Move the Mileage Offset a Lawyer Disputes With FCA?
It can. A recall visit is a dated trip to an FCA dealer. If the recall targeted the problem that later became the nonconformity, you can argue it opened the offset count. On a $52,000 Pacifica, the offset is $910 at 2,100 miles but $4,073 at 9,400 miles, a $3,163 difference.
The formula takes the price paid or payable and multiplies it by the miles at the first delivery for that problem. Dividing by 120,000 gives the offset. Say recall software went onto your Pacifica Hybrid at 2,100 miles, and the first shutdown came at 9,400. Under section 1793.22(d)(5), a certified arbitration program that orders restitution follows the same formula, offset included.
| NHTSA figure for Chrysler-brand models, pulled September 30, 2026 | 2024 | 2025 | 2026 |
|---|---|---|---|
| Owner complaints | 70 | 29 | 11 |
| Recall campaigns reaching that model year | 11 | 10 | 5 |
Across those years, NHTSA shows 110 complaints and 15 distinct campaigns. FCA filed 10, and three other companies filed 5. Each complaint is one owner's account, not a finding. NHTSA's recall lookup lists the campaigns open on your VIN.
Getting Paid Back for a Repair That Later Became a Recall
FCA's Part 573 reports on the 300 airbag and Pacifica shutdown recalls describe a reimbursement policy. It covers owners who paid for a repair that later became a recall. The Pacifica battery letters send owners to FCA's reimbursement website or to a mailed claim with receipts for FCA Customer Assistance in Auburn Hills, Michigan. Money FCA pays back should not be claimed again in a buyback, so log each charge, the date paid and any refund. A charge the program does not repay may still count as incidental damages.
What Letter Must FCA Receive Before a Chrysler Lemon Law Lawyer Seeks Civil Penalties?
The pre-suit notice is a written demand that must reach FCA at least 30 days before a suit that seeks civil penalties, meaning extra money for a willful violation. DCA dates FCA US LLC's election into the newer procedures to April 25, 2025, and section 871.30 ties it to vehicles sold new in 2025 or earlier.
The elected track means the rules FCA chose to follow, found in sections 871.20 through 871.28 of the Code of Civil Procedure. The DCA list of electing manufacturers names FCA US LLC, which NHTSA lists as Chrysler's manufacturer. If FCA sold your Chrysler new in 2026 or later, section 871.29(d) obliges it to name the governing procedure at that sale. If FCA names the older rules, Commercial Code section 2725 generally gives four years from tender of delivery. An exception applies when the warranty explicitly extends to future performance and discovery of the breach must await that performance. Then the four years run from when the breach is or should have been discovered.
The One-Year Clock Pauses for Repairs and for the Notice
Section 871.21 requires suit on the elected track within one year after the applicable express warranty ends, and never more than six years after delivery. That warranty is the written booklet coverage for your defect. Section 871.21(c) pauses both limits for every day the Chrysler is out of service because of a nonconformity repair. A pre-suit notice adds a pause of up to 60 days. Say a Mira Mesa lessee's Voyager sat 22 days for an electrical fault. Those days push the date back, and drop-off and pickup dates prove them.
FCA's Offer, Release and Payoff on a Chrysler Buyback
Under section 871.24, the notice gives your name, the accurate VIN and a short repair history, then demands repurchase or replacement. Send it by email to the address FCA displays on its website for these notices. Mail also works, sent certified or registered with a return receipt to the address in the owner's manual or warranty booklet. The Chrysler must still be in your possession when the notice goes out. Keep it 30 days after FCA's receipt, or 60 if FCA offers. Small errors will not cost you penalties.
FCA keeps civil penalties out by offering within 30 days of receipt and completing within 60 days of receipt. Missing either date leaves penalties available. If a lawyer represents you, FCA's offer must include reasonable attorney fees and costs. If FCA does not offer by day 30, you may sell the Chrysler and still seek civil penalties, which can reach twice actual damages under section 1794(c). First give the next owner written notice, before the sale, of the basis for your demand and of any pending case. Section 871.27(g)(2) gives FCA 30 days from receipt of a release signed through your lawyer to complete the agreed buyback or replacement. Past that, FCA owes $50 a day, unless the parties agreed otherwise or you failed to cooperate in good faith. If you prevail in court, section 1794(d) has the court award your costs and reasonable attorney fees.
