California lemon law gives the owner of a new or leased Jeep two remedies when FCA's dealers cannot fix it after a reasonable number of repair attempts, meaning a fair set of chances. One is a buyback, or restitution, which refunds what the Jeep cost. The other is a replacement, a substantially identical new Jeep.
The new motor vehicle definition in Civil Code section 1793.22(e)(2) reaches a Jeep bought or used primarily for personal, family or household purposes. Dealer demonstrators sold with FCA's new car warranty fit too. A company Jeep under 10,000 pounds gross vehicle weight fits if five or fewer vehicles are registered to the company in California. A rig left unregistered because it runs only off the highways does not. Lessees, the people who lease, have a buyer's rights under Civil Code section 1795.4.
FCA was the defendant in Rodriguez v. FCA US, LLC (2024) 17 Cal.5th 189. The California Supreme Court ruled that factory warranty time left on a used car does not make it new, absent FCA's new car warranty issued with that sale. The opinion did not rule on certified pre-owned programs. Even so, a certified Jeep usually stays outside the new-vehicle remedy, though that remains unsettled.
The Department of Consumer Affairs lists FCA US LLC among electing manufacturers, which puts many Jeep claims on the elected track, the newer procedures FCA chose. Lemon law and consumer warranty claims are the only work Cline APC takes, from La Jolla and Poway. Call (888) 982-6915 with your repair orders out.
Which Wrangler, Grand Cherokee and Compass Faults Does a Jeep Lemon Law Lawyer See by Model Year?
Owner complaints to NHTSA on 2021 to 2026 Wranglers, Grand Cherokees and Compasses name the electrical system most. FCA's recall filings add Grand Cherokee coil springs and suspension joints, Wrangler steering pump wiring and Compass display software. Each model's repair history supports its own claim, and a lawyer reads it model by model.
| Model | Campaigns and model years | What FCA's filing says | Claims |
|---|---|---|---|
| Wrangler | 26V363000, 2021 to 2025. 26V456000, 2026 steel wheels | Steering pump wiring may overheat and cause a fire, even parked. Wheel walls may be too thin | Jeep Wrangler claims |
| Grand Cherokee | 23V413000, 26V051000 and 26V562000, 2021 to 2023. 24V131000, 2024. 24V132000, 2021 to 2023 | Rear coil springs may detach. A knuckle and ball joint may separate | Jeep Grand Cherokee claims |
| Compass | 23V058000, 2022. 23V576000 and 24V436000, 2022 and 2023 | The cluster may be too dim, or its brightness may not adjust. Radio software may block the rearview image | Jeep Compass claims |
| 4xe plug-in hybrids | 25V741000, 2020 to 2025 Wrangler 4xe and 2022 to 2026 Grand Cherokee 4xe | The high-voltage battery may fail internally and lead to a fire | Both model claims |
A complaint is an owner's report, not a finding of a defect, and a recall is FCA's own filing. However, neither decides a claim. A Jeep lemon law lawyer builds it from your own repair history instead.
One Jeep Lemon Law Tally for Several Different Defects
The Tanner Consumer Protection Act, in Civil Code section 1793.22, sets up a presumption with three routes, each limited to the first 18 months or 18,000 miles, whichever comes first. The presumption treats FCA as having had a reasonable number of repair attempts once its conditions are met. A nonconformity is a defect that substantially impairs use, value or safety. Route one is two or more repairs of a nonconformity likely to cause death or serious bodily injury. Route two is four or more repairs of the same nonconformity. Either one calls for direct notice, a letter to FCA itself, at least once when the warranty requires it. Route three, more than 30 cumulative days out of service for repair of nonconformities, needs no letter. FCA may rebut the presumption, and section 1793.2(d)(2) still lets a claim succeed later on the full repair history.
Only the days route adds up different defects. For example, a 2023 Grand Cherokee L from Carvana Chrysler Dodge Jeep Ram of San Diego sat 9 days for a radio fault. Shifting took 14 and a steering noise 10, for 33 days inside the window, though no single problem reached 30. Each problem must still be a nonconformity for its days to count. Ask for each defect on its own line, because FCA may dispute days shared with maintenance.
Can a Jeep Lemon Law Lawyer Recover My Rental Costs When FCA Buys Back the Jeep?
Yes. Reasonable rental costs you actually paid come back as incidental damages, the costs a defect causes you, under Civil Code section 1793.2(d)(2)(B). That holds even though FCA's 2024 Wrangler booklet lists rental costs among incidental damages its warranties exclude. A buyer who takes a replacement Jeep recovers those costs too.
Restitution is a duty the law places on FCA, and you, not FCA, choose it or a replacement. Either way, a mileage offset can apply, meaning a charge for miles driven before the first repair visit for the defect.
| Item | Restitution | Replacement Jeep |
|---|---|---|
| Price paid or payable, with transportation and factory options | Refunded | A substantially identical new Jeep with new-vehicle warranties |
| Tax, license, registration and official fees | Refunded | Paid by FCA |
| Repair, towing and rental costs actually incurred | Refunded as incidental damages | Paid as incidental damages |
| Mileage offset | Subtracted from the refund | Paid by you to FCA |
| Negative equity, rebates and outside add-ons on the elected track (CCP 871.27) | Negative equity and non-dealer add-ons come out, and rebates stay out of the price | Statute does not say how these apply |
What a 26-Day Rental Adds to a Jeep Buyback
Say your Grand Cherokee waited 26 days on a part, and a rental cost $48 a day. That adds up to $1,248. California's restitution remedy treats rental costs differently from the booklet. Keep the rental agreement and any loaner paperwork, because their dates also prove your day count. Send the firm FCA's written offer before signing, so it can check that those receipts made it in.
The Mileage Offset on a Grand Cherokee First Seen at 3,000 Miles
Section 1793.2(d)(2)(C) multiplies the price paid or payable by the miles at the first repair visit for the defect. It then divides by 120,000. A $52,000 Grand Cherokee first brought in at 3,000 miles carries a $1,300 offset. After that, added miles never grow it. That is arithmetic, not a forecast, and the buyback calculator runs it on your contract.
How Long Does the 2024 Wrangler Warranty Run, and How Does a Lawyer Count Dealer Days?
FCA's 2024 Wrangler booklet sets basic coverage at 3 years or 36,000 miles. Gas powertrain coverage lasts 5 years or 60,000 miles, and each term ends at whichever limit comes first. The defect decides which term is the applicable warranty, so a transmission complaint and a radio complaint can run on different clocks.
An express warranty is the written coverage in the booklet, and booklets differ by model and year. For instance, your 2024 Wrangler may show a transmission warning at 41,000 miles while its radio keeps resetting. The radio sits outside basic coverage, while the transmission may not.
Calendar Days and Weekends on a Jeep Lemon Law Count
The 30-day route counts calendar days, weekends and holidays included. A Jeep dropped off the Friday before Labor Day and returned Thursday was gone seven days, counting both ends. Count from drop-off for a warranty complaint to the day the dealer said it was ready. A loaner should not stop the count, although days after the ready call are hard to claim.
Waiting on a Mopar Part Past Day 30 in a Jeep Lemon Law Case
Section 1793.2(b) adds a rule for each visit. Unless you agree in writing, the dealer must fix the Jeep within 30 days, and only a delay beyond the control of FCA and its dealers extends that. Say your Wrangler is still on a lift in a South Bay shop on day 31, with no extension signed. Ask that the backorder note show the part number, order date and arrival date. Section 1793.2(a)(3) requires FCA to make enough parts available during the warranty, so its own supply delays are a hard fit for the exception.
A 4xe Waiting on Parts Without a Charge
FCA's 2024 Wrangler booklet excludes damage from leaving a 4xe more than 30 days with its lithium-ion battery at zero or near-zero charge. A plug-in Wrangler or Grand Cherokee parked at a dealer past day 30 raises a fair question about who keeps it charged, unless an open battery recall says not to charge it. Ask the advisor at drop-off and note the answer.
Do Grand Cherokee and Wrangler Recalls Count When a Lawyer Tallies Jeep Repair Days?
They can. A recall is FCA's own report of a safety-related defect or a missed federal standard. Its repair order dates can count toward your tally when the recalled condition is a nonconformity in your Jeep. Finishing a recall leaves the claim alive if the symptom returns.
| NHTSA measure | Wrangler | Grand Cherokee | Compass |
|---|---|---|---|
| Complaints on 2021 to 2026 models, as of September 23, 2026 | 2,717 | 1,955 | 429 |
| Complaints on 2024 to 2026 models, pulled September 29, 2026 | 1,028 | 460 | 83 |
| Recall campaigns on 2021 to 2026 models, same pull | 32 | 44 | 5 |
| Recall campaigns reaching 2024 to 2026 models, same pull | 17 | 20 | 1 |
| Windshield and crack in one description, 2021 to 2026, same pull | 18 | 6 | 0 |
Say your 2022 Grand Cherokee L went in under the first coil spring campaign and back under the second. Each visit then becomes a dated entry. Days inside the 18-month or 18,000-mile window feed the 30-day route, and later days still bear on the filing deadline.
Knuckle and Ball Joint Campaigns and Do-Not-Drive Days
Coil spring campaign 26V051000 replaces 23V413000, and 26V562000 replaces both, so Jeeps repaired under an earlier one need the new remedy. Campaign 24V131000 covers certain 2024 Grand Cherokees whose steering knuckle may separate from the ball joint. Under 24V132000, the upper ball joint and knuckle may separate on certain 2021 to 2023 L and 2022 to 2023 two-row models. Get any do-not-drive instruction in writing, since days parked at home are harder to count than days on a lift. NHTSA's recall lookup shows open campaigns on your VIN.
How Long Does FCA's Election Give a Jeep Lemon Law Attorney to File Suit?
FCA elected the newer procedures on April 25, 2025. For a covered Jeep, section 871.21 requires suit within one year after the applicable express warranty ends, and never more than six years after delivery. Both limits pause for repair days and up to 60 days after a pre-suit notice, a demand needed only before a suit seeking civil penalties.
Section 871.30 ties that election to Jeeps sold in 2025 or earlier. A Jeep sold new in 2026 or later is different, because section 871.29(d) says FCA must name its procedure at the sale. If the older rules govern, Commercial Code section 2725 gives four years from tender of delivery. If a warranty explicitly extends to future performance and discovery must await it, the clock starts when the breach is or should have been discovered.
Say a 2024 Wrangler delivered in May 2024 stays under 36,000 miles. Basic coverage ends in May 2027, so the default window runs to May 2028 before tolling, meaning paused time. Forty repair days push it back 40 days under section 871.21, subdivision (c)(2). A Jeep lemon law lawyer confirms the real date from your booklet and repair orders.
Two Statutes That Pause the Jeep Clock for Shop Time
Section 871.21(c)(2) pauses the filing deadline while the Jeep is out of service for repair of a nonconformity. Civil Code section 1795.6 pauses the warranty itself, from delivery for repair until you hear it is ready. It also keeps the warranty from lapsing after a failed repair you report within 60 days. The two rules work together, because the deadline runs from the warranty's end. Section 1795.6(d) entitles you to a work order showing the in date and the ready date. Section 871.26 then governs elected-track suits filed on or after January 1, 2025, with a lawyer. It makes FCA produce its full warranty history on your VIN.
Should a Jeep Lemon Law Claim Start With FCA's Pre-Suit Letter?
Section 871.24 requires the notice only before a suit that seeks civil penalties, extra money a court can add for a willful violation. FCA has to receive it 30 or more days before the complaint is filed. The letter lists your name, the accurate VIN and a brief repair history, and it demands repurchase or replacement. Email it to the notice address FCA posts, or mail it certified or registered, return receipt requested, to the booklet address. You must have the Jeep when it goes out and keep it at least 30 days after FCA receives it, or 60 if FCA makes an offer. An offer within 30 days of FCA's receipt and completion within 60 keep civil penalties out, and missing either leaves them available. Skipping the letter still allows a suit for repurchase or replacement, without penalties.
FCA maintains a qualified arbitration program, so the separate section 1794(e) penalty generally drops away. A Jeep penalty claim then turns on willfulness under section 1794(c), capped at twice actual damages. The Department of Consumer Affairs certifies CDSP Auto Line as FCA's arbitration program for Jeep. With timely written notice of it, section 1793.22(c) puts that program before the presumption, and program days extend the deadline. A prevailing buyer recovers costs and reasonable attorney fees under section 1794(d). Cline APC walks through its attorney fee arrangement before you sign anything.
